Analysis: What to expect at Jerry Sandusky's sentencing

In an exclusive interview with Rock Center’s Kate Snow, Travis Weaver speaks out about the alleged abuse he says he suffered at the hands of former Penn State Assistant Coach Jerry Sandusky. Weaver alleges he was abused by Sandusky more than 100 times in the Sandusky home, Penn State locker room and on trips with the Sandusky family. 

ANALYSIS

Jerry Sandusky's criminal trial did not draw the attention of the nation because there was some uncertainty about the outcome.  And though there is little reason to doubt he will be ordered to spend the rest of his life in prison when he is sentenced on Tuesday, our continuing interest in this case has little to do with the issues the court has to decide.

Based on the jury's finding of guilt on 45 of the 48 counts, the former Penn State defensive coordinator and founder of the Second Mile charity for underprivileged kids could be sentenced to a maximum of over 400 years. But the judge is not required to sentence him to anything near that. Six of the offenses carry mandatory minimums of 10 years. This does not, however, mean that Sandusky must receive a minimum of 60 years in jail.  The judge will have to determine whether Sandusky serves his sentence for these individual offenses concurrently -- meaning simultaneously -- or consecutively.

None of the other offenses has such a low-end boundary, so the 68-year-old Sandusky could theoretically be sentenced to as little as 10 years. 


Those unfamiliar with the criminal justice system often find it bizarre that a defendant could serve time for two or more crimes at once.  After all, a prisoner serving two 30-year sentences at the same time is being punished the same as a person serving the same sentence for a single crime.  Practical realities, however, require this common occurrence.  If defendants were not routinely able to serve sentences simultaneously, a very substantial number of prisoners would be serving life sentences for offenses far from the worst in our criminal codes.

Sentencing guidelines in many states like Pennsylvania instruct the judge on the appropriate sentence for each individual count. For instance, the judge is required to give Sandusky an indeterminant sentence of 10 to 20 years on the involuntary deviate sexual intercourse counts.  But judges in Pennsylvania, as is common throughout the country, have almost absolute discretion to determine whether the sentences for those counts will be served consecutively. So the judge's determination of which sentences should be served consecutively will thus be the single greatest factor determining the actual number of years Sandusky receives.

A young man known as "Victim 1" and who testified against former Penn State coach Jerry Sandusky is suing the university claiming it cared more for its reputation than it did about child safety. NBC's Lester Holt reports.

That means that Judge John Cleland has the discretion to give Sandusky a sentence that would permit him to be released after 10 years, just as he has the discretion to give him a sentence that could require him (in theory) to spend over 400 years in prison.  Given the number and seriousness of the counts, the lower end of this range seems improbable -- for any judge.

For some judges, the upper end of this range would be an attractive option.  But anything greater than 25 years would mean a life sentence as a practical matter. In other words, Sandusky's life would not be changed, practically speaking, by adding another 375 years to a 25-year sentence.  A judge could see a multi-century sentence as a way to send a strong message to would-be child molesters without changing either a defendant's punishment of the state's cost of incarceration.  More cynically, a judge presiding over a case with this type of profile could see a multi-century sentence as a way to grab headlines and increase his reputation as someone who dealt severely with America's best-known serial pedophile.

But Cleland is not a grandstander.  We saw that time and again throughout the course of the criminal proceedings.  He thoughtfully considered defense motions.  Despite community pressure, he rejected a prosecution request that Sandusky not be permitted to sit on his back porch while out on bond.  His tone and demeanor were measured throughout one of the most closely watched criminal cases in the history of the country.  His sentence may approach the century mark, but a maximum sentence seems unlikely. 

The young man known as "Victim 2" in the Jerry Sandusky sex abuse case spoke out for the first time through his attorneys about how the former Penn State coach abused him and stalked him with phone messages. NBC's Ron Allen reports.

Nothing about Cleland -- or the seriousness of the facts of this case -- suggests, however, that Sandusky will receive a sentence of less than 25 years.  And that means a life sentence.  So the only real question is how he will serve out that sentence.  The Department of Corrections makes this determination and thus has a much larger role than Cleland in determining what the rest of Jerry Sandusky's life will be like.

'Shameful': Sandusky victim sues Penn State

A battery of tests will be conducted to determine Sandusky's mental state, physical condition, his risk to others and the risk that others pose to him.  He will then be classified for a level of security – minimum, medium, close or maximum.  No one factor is determinative, though the serious nature of the offenses will certainly be a factor.  The availability of housing meeting his security level will determine his specific placement and in making that determination, there is no official policy to prefer a facility close to the inmate's family.  He could be placed anywhere in Pennsylvania.

The Department of Corrections will further have to determine whether measures are needed to protect Sandusky from other prisoners.  If inmates express concern for their safety, the department takes that into consideration. But  Sandusky has expressed a desire to be in the general population, at least at his present facility.  If there is a safety concern, he could be given an individual cell, but otherwise remain in the general population. Or he could be placed in what is known as a special needs facility.  In such facilities, there is greater supervision of the inmates due to their risk of victimization because of factors like age, or mental impairment.  He could also be placed in administrative segregation for his protection, which would amount to solitary confinement for 23 hours a day. The department does not, however, have a presumption that child sex offenders will be at risk for victimization merely because of their crimes.

The Department of Corrections, over the next month, not at Tuesday's sentencing hearing, will determine what the rest of Jerry Sandusky's life is like.  Just as the result of his trial was fairly certain, so is the practical result of his sentencing.  Practically, the few issues that remain relate only to the level of his custody and will not be affected by his sentence.

Agreed but sadly, no matter what sentence they could pass down, it could never come close to a match. The best that we can hope for is that he can no longer hurt anyone else ever again.

Just to clear things up for you and not to defend this pedo in any way, but the only time 'alleged' is used in this article is in reference to the video with Travis Weaver. Travis Weaver is not one of the 10 people Sandusky was convicted of molesting. While there is a great likely hood that he was molested by Sandusky, since Travis has only made allegations at this point, the abuse is considered 'alleged'.

    Personally I've always been of the opinion that the families/parents of the victims of Rape should have a good hour ALONE with the convict after being found guilty. In this case, the young men he assaulted should have that same right.

    It would cut down on the # of repeated rapes by scum that stay in prison for 4-5yrs then get out to repeat their crimes. It would cut down on prison overpopulation. And it would save the taxpayers a fortune.

    Sadly, it's not allowed. In that case then, put him in with the general population. There's a special place in hell for rapists, and he should start the moment he's sentenced.

    I called the radio stations here in denver about this story! some of my family went to penn state, and I have been to football games there years ago--What is sad--is more people knew about this! Its a small university and more people knew! Thats the sad part. And has penn state changed? I haven't seen it!

    RC, don't know much about children do you? They can be easily manipulated by someone who knows how. These pedophiles are addicted to their sickness & STUDY how to do their thing, preying on children, more efficiently. They know exactly what to do, what to say, how to do it, & what NOT to do in order to train these kids that what is happening is okay & right.

    Sure, the kid will often realize that what is happening ISN'T right, usually sometime around puberty or a bit later. But by then alot of often permanent damage has already been done to the person's mind & self-esteem.

    Heck, this is fairly easy with ADULTS. Look at the numerous examples of cults, where ONE single person has convinced hundreds of people to quit jobs, leave families, loan out their daughters, & even commit suicide .... all while being 100% convinced that the evil person talking to them is their true saviour.

    The human mind is NOT that difficult to control in many types of personalities and/or ages. And the "controllers" are true professionals at what they do.

    And before any of you sick SOB's start saying I sound like I know too much about how to meld people's minds, know that the reason I do is because during my 13+ years in service, I was a POW for a little over 3 months in Bosnia. While I actually was treated fairly well, along with the half-dozen other soldiers with me in the same prediciment, we WERE psychologically "tested" to near breaking. In a bizarre way, I owe something to my captors. While subjected to only minimum physical mistreatment, they showed me a great deal about just how powerful, and how weak, a human mind can be. And Ive used that to become a MUCH stronger person than I even was before ..... after figuring out how to make the wife-scaring nightmares end anyway.

    So don't dare try to make this kid out to be at fault, as you seem to be doing. He is a victim, 100%.

Several industries and career paths specialize in just that. They're advertising, public relations, and politics. How often do politicians, advertisers, or PR reps spin stuff to either motivate, or "convince" people of things? And sometimes it's far more subtle then other times... "Marketing research" also tells companies how they can influence people's minds "more effectively", in order to motivate them into buying stuff they might not otherwise have bought... People found out generations ago that tobaco advertisers were targeting their kids, though not for sex, but rather to get them addicted to their product so they'd be life long customers, regardless of the health effects of smoking, etc...

    I sat in a courtroom last month in my home state Oregon and watched the judge release a pedophile, who molested two of his children, free on probabtion. (one girl and one boy that anybody knows of anyway!!!)The reason, first offense, it was only his kids not others children. This pig also addmitted his crimes and that he was addicted to porn since middle school. When asked by the judge what type of porn he stated hetro porn of females between 20 and 25 years old. Did the idiot judge buy this??? I doubt it, but did he care??? Don't think so as he is close to retiring. This SOB was sent to live with his parents and a brother who is a registered sex offender. Guess it runs in his family. Hope the cycle is broken with his children and they get the help they need to heal somewhere because the judge certainly DID NOT give them help!!!

He had served his lengthy prison term and was about to be free'd and asked if he could be castrated, he warned them he would do it again. They wouldn't do it.         Bill, I agree on what to expect, what I would like to see if the judge whip out a 45 and end the sentencing right there. Won't happen, but one could always dream. Short of instant death, the next acceptable sentence would have to include a barrel, a rope and the entirety of general pop for the next 500 years.

        Jack, I have learned not to waste my saturday or sunday on my favored teams this year. I rebuilt the adopted sons Zetec and listed to both of them piss away but yet another game.

When Paterno is found to not be involved in sandusky's doing will you and the others hwo have been so quick to judge be willing to say you were wrong ? Sandusky it appears now was involved in a child porn ring in 3 states. many others were dooped by this guy and serveral others. They used thier positions to blind others of prominence and everyone else for that matter,of their wrong doings. Anyone who actually believes Paterno had anything to do with what Sandusky was doing is blinded by media hype. I believe Paterno will be cleared of these alegations. and they remain alegations. He was never charged and never able to clear his own nome yet so many have him tried and convicted including his own university.

          Fact Paterno fired Sandusky and one of the reasons he wouldn't resign as head coach was because the Board of Trustee's wanted him out and Sandusky back as head coach.

            Final Justice,

            What can one even say in the reflected light of of one of the most abominable and despicable cases of child abuse and molestation in modern times. The fact that Sandusky did this for so many years to so many young boys within the framework of his university's sports program and his private foundation, Second Mile, that supposedly was intended to help troubled kids is even more egregious. What's equally disturbing is that Paterno and a number of the highest school officials knew about his conduct and did nothing in order to protect the Penn State name and it's holier than thou 'reputation', and although Paterno is gone, the rest of those people need to pay for their complicency in it.

            In the final analysis, there is almost no single or totally thorough and sufficient sentence that can or will ever do justice to the many innocent boys who were abused by this absolute monster. They were robbed of their innocence, their childhood and their humanity, and in ways that will haunt them more than likely for the rest of their natural lives. How can any judge or court sentence, no matter the type or length, ever put all of these young lives and their families totally back together?

            As long as this animal Sandusky never ever sees the light of even one free day again, that will be sufficient to satisfy the letter of the law as it is interpreted for the purposes of sentencing. Beyond that, the real lesson in all of this in the future is for people who discover or know child abusers or sexual predators to come forward clearly and forcefully to bring these monsters to the attention of the law and to rid them from our society, permanently.

            What proof do you have that Paterno or anyone else knew exactly what Sandusky was doing. This is a man who fooled trained professionals into letting him foster kids, adopt kids, take kids from The Second Mile alone. So how was an elderly football coach & a few administrators who don't deal w/ children and had no training in such matters supposed to know?

            It is stated in the actual eyewitness accounts and investigational correspondence of this case that the assistant coach, McQuery, as well as the Second Mile foundation manager knew as early as 1996 that Sandusky had been seen in compromising and sexual situations with several young boys that he had culled from the foundation's youth program. A few of them had come forward at the time but were dismised because they were classified as 'troubled youth' and their assertions were not taken seriously, especially against a man who had such stature in the community. The President of Penn State, his VP and his administrative assistant knew since 2000 that Sandusky was using his position in the sports program to isolate, impress and ultimately abuse these boys for his own deviant pleasure...and they stood silent and did nothing. They are and should be held accountable for the atrocities perpetuated for so many years upon these innocent boys. No one needs 'training' to know sexual deviancy or abuse when it is arises, or even if they think it is present...one only needs common sense and the urgency to do what is right for the children. Paterno and the Penn State brass were worried only about the school's century old sports legacy and their university's reputation, as well as their cushy jobs. Their 'head in the sand' cover-up and their behaviour was an absolute disgrace... period.

            Excellent point! A serious search would reveal hundreds of priests who would each make Sandusky look liked an angel! Since few of these perverts are put away for such a lengthy period, Sandusky needs to be sentenced to labor-intensive incarceration until his 80th birthday and then released.

            Sorry, many will not agree with me, but our nation has the highest percentage of our citizens incarcerated, by far, than any other world nation. A primary factor here is that so many, as reflected in these posts, demand excessive and outrageous sentences, and never seem to remember that their taxes pay for this ridiculous system. We need a higher educational level, and we need schools that are centered around learning, rather than sports!

            America's fixation on athletics, (versus academics), is nothing more than the result of a capitalist plot to mesmerize the masses. Obviously, it is working remarkably well. We have to import brain power from countries which emphasize a math and science curriculum, and utilize their educational facilities year round, as opposed to our wasteful nine month school year, and emphasis on basket weaving.             Unfortunately, this matter is, I believe, a bit deeper than protecting athletics over academia. This was an effort to protect an organization, which occurs far more often than in the area of athletics. We have seen this phenomenon in the Catholic Church and other organized institutions. They cover up to protect the larger whole, in a misguided effort to protect the good that the organization has bestowed; rather than separate the acts of the few from the organization itself. In the early 60's, a teacher repeatedly molested numerous of his seven-year old students over a prolonged period of time. When the district discovered this, he was merely transferred to another district, to protect the reputation of the district where the offenses occurred. A not uncommon response then, previously or now. When something unpleasant occurs or is suspected in an organization, the ranks close. We see this in politics frequently; albeit not with subject matter so egregious as molestation, yet the psychological mechanism is the same. When an individual so strongly associates themselves with a group, they put the interests of that group in primary position, even to the point of sublimating their own sense of right and wrong, to a degree. That is the most disturbing facet of this tragedy; how an individual can avert their attention or engage in denial, at such a high human cost, in order to further the group.

            I do agree that something is tragically awry that we have to import technological talent; however, we are not in full agreement as to the cause of that malady. I will leave it at that, as my response would be off topic.

              My guess is the judge will impose a mixture of concurrent and consecutive, but either way, the end result is Sandusky will not live long enough to breathe free air again. My second guess is his days are numbered, period - unless he is put into protective segregation, someone will get to him in prison. If he gets a short sentence (highly unlikely), someone will take him out upon release, and an "investigation" would be half-hearted at best.

              If Sandusky has truly stated he wants to be a part of the regular population, it is because he has a death wish. To that end, he is a coward. Nah, he should be put in a cell 23 hours per day...along with a constant video feed of all the news reports outlining his crimes, showing him walking out of the courtroom in handcuffs, and comments from viewers telling him what a worthless piece of scum he is.

Then, the author ends the piece by admitting there was INTERNATIONAL interest in the Sandusky story.

              As a correspondent for Newsweek/TheDailyBeast.com who covered every inch of the trail I can tell you it has been and still is one of the most read topics I write about. Everyone has an opinion about what should happen to Jerry Sandusky

              While this author has an expertise in the law - I believe the draw of this story is rooted in other subjects of interest to the general population: the desire to keep kids safe, the worry that law enforcement doesn't do enough when powerful people are suspect, the very base question of HOW COULD ANOTHER HUMAN BEING DO WHAT I WOULD NEVER DO?

              BTW - I'm not sure if this author was actually there for the late night verdict and saw the communities reaction to it. (you can read about that here:

              I was there to see the thousands of childhood sexual abuse victims and members of the community and the determination on their faces (and, yes, their cheers at the verdict and their signs asking for the maximum punishment) Given that, I don't think there is anyway Judge Cleland is going to go with a sentence of just 25 years. I'm looking for a triple digit sentence since Sandusky faces more than 400 possible years in prison. The community will not accept less.

                As a victim of sexual abuse at age 13, where the perpetrator has never been punished. I hope the judge sends him away for the maximum in a regular prison, no honor farm, with the general population. I live every day with the memory of the abuse I took. There are days when I wished I could have done the same to his kids, but that wouldn't be right or fair. His children shouln't have to suffer for the sins of their father. That's the only thing that has kept me from seeking revenge. Incidentally, I am 65 years old and have never been married. The memory buried deep in my heart has never given me the peace to have a normal, loving, lasting relationship with anyone.

                You do not live with a man as long as Dottie lived with Jerry and not know what type of person he is. She knew, and she either refused to face it or turned a blind eye. She deserves all the heartache she will have over the rest of her life and she does not deserve is pension from the Univ.                 It's my opinion that Mrs. Sandusky was accustomed to a very nice lifestyle afforded by the Penn State football program, including the money and the status. It's also my opinion that she knew what was going on and valued what she had more than what was right.
