Sandusky, alleging broad conspiracy, insists he's innocent of child sex-abuse charges

Jerry Sandusky, former Penn State assistant football coach who was convicted of 45 counts of child sexual abuse, professes his innocence from his jail cell. NBC's Brian Williams reports.

Updated at 8:27 p.m. ET: Former Penn State assistant football coach Jerry Sandusky insisted Monday that "I did not do these alleged disgusting acts" and blamed a systematic conspiracy among police, Penn State administrators and the media for his conviction on 45 counts of child sexual abuse.

"They can take away my life, they can make me out as a monster, they can treat me as a monster, but they can't take away my heart," Sandusky, 68, who is to be sentenced Tuesday, said in a three-minute statement recorded from his jail cell in Bellefonte, Pa., and aired on the Penn State student radio station.

Sandusky said his accusers were part of a "well-orchestrated effort of the media, investigators, the system, Penn State, psychologists (and) civil attorneys" to falsely put him in prison.

"My wife has been my only sex partner, and that was after marriage. Our love continues," he said.

"Over and over, I asked why? Why didn't we have a fair opportunity to prepare for trial?" Sandusky said. "Why have so many people suffered as a result of false allegations?"

He said his accusers chose to join his Second Mile program for troubled boys "because of issues" and said that "some of those may remain."

Sandusky said he hoped his experience would help others, saying: "Some vulnerable children who could be abused might not be because of all the publicity. That would be nice, but I'm not sure about it."

Karl Rominger, an attorney for Sandusky, told NBC News that  he hadn't known of Sandusky's plans to issue the statement beforehand. After hearing it, he said it sounded like his client.

Earlier, Sandusky's lead attorney, Joe Amendola, said his client was prepared for the worst when he is sentenced on 45 counts of child sexual abuse Tuesday.

"He's going to say that he’s innocent," Amendola told NBCPhiladelphia. com.

Sandusky, who had become a hometown hero as a Penn State coach and as a champion for underprivileged boys, was convicted in June of abusing 10 boys over  15 years, including some attacks inside Penn State's athletic facilities.

Before the judge decides how much time Sandusky will spend in prison, some of his victims may speak out, as may Sandusky.

"Jerry will not be having anyone speak on his behalf," Amendola told NBC News on Monday before participating in a closed-door meeting with prosecutors and Judge John Cleland to discuss sentencing logistics. 

Attorney Ben Andreozzi, who represents Victim 4, told the Patriot News that nothing surprises him from Sandusky.

"I keep hoping he will do the right thing and take responsibility for his actions but it appears that day will never come," Andreozzi said.

Sentencing is expected to begin with a hearing to determine whether Sandusky qualifies as a sexually violent predator under Pennsylvania's version of Megan's Law, after which Sandusky will be sentenced.

Sandusky will likely spend the rest of his life in prison, given his age and the serious nature of his convictions. Several of the counts carry mandatory minimum sentences of five or 10 years.

Amendola said Sandusky is prepared to hear the worst.

"It's going to be tantamount to a life sentence for Jerry," Amendola told NBCPhiladelphia.com.

Amendola told NBC News that he has letters defending Sandusky, including one from his wife, Dottie Sandusky, who stands by her husband and will attend the sentencing.

Sandusky admits to no wrongdoing, Amendola said, but he does admit making a mistake.

“What Jerry has always said, his mistake was using bad judgment and doing some of the things that led up to the accusations — getting showers with kids," Amendola told NBCPhiladelphia.com. "He said he should have realized, obviously, that wasn't the thing to do. But he's always maintained and still maintains his innocence."

Sandusky has spent the last three months in a cell with a bed, a sink and a toilet.

"It’s a Spartan life. He’s isolated," Amendola said. "Not because he's bad, not because they think he's a bad person, but for his own protection.”

Sandusky has been busy writing a detailed document that he is convinced will be the key to his appeal.

'He was set up'
"I believe that he was set up; I really do," Amendola said, according to NBCPhiladelphia.com. "I believe this started out as an investigation into Jerry Sandusky, but as soon as the power people realized that this could also implicate Penn State, I think this took on a life of its own."

Analysis: What to expect at Sandusky's sentencing

Amendola said there were inconsistencies in the testimony from accusers that jurors simply ignored.

"If Jerry Sandusky did all the things these young people said he did, he didn’t have time to do anything else — he didn’t have time to be a parent, he didn't have time to be an assistant coach at Penn State — my God, he was busy doing all these sexual activities with all these kids!"

Sandusky is more than ready to be sentenced, Amendola said, because for them, the sentencing finally triggers the appeals process. The basis of their appeal will be that Sandusky was denied due process.

Looking back, Amendola said he does have regrets — Sandusky should have testified, and his lawyers should have asked for an out-of-county jury. But the biggest regret was the interview with Bob Costas of NBC's "Rock Center."

When Sandusky walks into court Tuesday, he’ll look different from  the last time, when he was handcuffed after his guilty verdict and led away in his starched white shirt and brown sports coat.

"You’re going to see a guy who's lost some weight," Amendola said. "They may have him dressed in prison garb ... the bright orange. And he’s lost weight. But he's feisty!"

"He really believes that he's going to be vindicated," Amendola said. "He really anticipates he's going to get another shot at this.

Innocent of what?

Those boys told the Court what happened, and Sandusky refused to testify in his own defense when he saw that his adopted son was standing by to validate everything all of the other boys said, so I wouldn't say he's "innocent" of the charges upon which he was convicted.

If Sandusky was "innocent" why didn't he take the stand and testify to his "innocence" under oath?

Now Sandusky wants to "proclaim" his innocence when he's NOT under oath, and when he cannot be cross-examined by his accusers.

@oldhamletman No one at Penn State believes that Sandusky is innocent. I don't know where you got this idea, but you should look around before you make assumptions like this one. The PSU community hates this guy just as much as, if not more than the outside world does. Your attacks on the school and the community are really quite irrelevant to the subject of this article, which is the fact that Sandusky and Amendola (NOT PSU) maintain Sandusky's innocence. In fact, if you had read the article, you would see that Sandusky partly blames Penn State for the alleged "conspiracy" against him.

Furthermore, your inclusion of "students and players" as members of the guilty party is preposterous. The students and players were in grade school when these crimes occurred.

More and more today you hear of people being detained by officers for hours and hours on end, to the point of exhaustion, and many FALSE confusions are obtained. Many do so just to end the madness - and hope that the courts figure it out down the road. Poor use of the justice system.

Taking the 5th does not speak to one's innocent, or guilt. Jury's are instructed in this manner.

              His delusion of innocence allows others to maintain their delusion that he could never do anything wrong. At this point, his only goal can be to try to keep at least a few people he cares about believing he is innocent. If they desert him, then he truly IS all alone.                     I have been to Penn State among many other schools and taught at a State University with a major football program..... I've also followed the whole story with great interest because of my background.

                    I understand that there are plenty of students and faculty and alumni that believe Sandusky is guilty... but the vast majority of students and alumni who have been quoted or commented on the internet, yourselves included, arrogantly take the position that they have no contribution to what happened, and nothing could be further from the truth....

                    from your assumption that I nor anyone else knows anything about campus life....

                    to the never ending denials of students that they are partially responsible for the cultural entitlement that results in these never ending tales of illegal behavior and looking the other way with respect to athletics...

                        Child molesters do not fare well in prison. It will not be a "sex" thing (like any rape ... it's NEVER about sex) it's a power and control thing. For some of the prisoners it's a REVENGE thing (since they can't take revenge on those who hurt them when they were young). But Sandusky will likely find that he hates showering after he enters general population ...

                        The inmates in prison despise crimes against women and children. The new arrivals must show their "papers" - meaning the papers containing their conviction(s) to prison.

                        Anything with crimes against women and children, the new arrivals might as well ask for Administrative Segregation. (security housing unit). They won't stand a chance in general population.

                        And I've never heard they didn't like people that committed crimes against women, that's a new one.

                        New inmates don't have to ask to be separated as he will evaluated and they will determine where he will be housed long before he arrives. Since he is high profile and the nature of his crimes you can bet he will not be in the general population and may spend most of his time alone in his cell for 23 hours a day with an hour of to spend in an outdoors cage.

                        Obviously you have never worked in corrections. Inmates know who are coming ,why and where they will be housed. Particularly in a high profile case.

                        Many of the inmates will put a "hit" on an inmate to see who will get the recognition for his/her murder.

                        Sandusky has about a 25 % chance of making it a year in prison;provided that he is kept id ad-segregation.Other than that he's done. Inmates have a way of getting to the ones that are undesirable.

                        Oh yeah...no, I haven't been in prison, but I have an uncle and a couple of nephews who work at two. Maybe their info is biased, but the local cops my dad is friends with all seem to agree. And these guys have been around law for a few decades.

                            dee~ yes, many inmates go into protective custody (PC). But, as a fellow officer for two states......I will tell you this, not all of them pc up and there is a process before that happens. A majority of sex offenders, and murders of women/children are "taken care of by other inmates". Most often, it's done by inmates who are doing life w/out and have nothing to lose.

                            I worked at one of the Max. prisons and there are inmates in there who have murdered, or what they call victimized pedophiles, rapists, etc. Even behind bars, in 23 hr. lock down, the no-good pieces of crap still have to show papers why they are in there and still taunted if found out they pc'd up. Just and fyi :)

                              Josh: I have often thought the same. Paterno's percieved reputation could have ridden out the storm. One press conference (years ago) saying one of my coaches committed a crime, he was fired, it was the right thing to do...and PSU paying the victim some cash and it would have gone away. Why Paterno had others hush it up is very strange to me. I too, wonder what he knew, and whether he participated.

                              I thought I might remind some of you of a certain fact that has remained buried but is very significant to this case and that is the dead and missing DA Ray Gricar who was murdered. I believe that Sandusky is GUILTY and so is Dottie BUT who else knew and was willing to see Ray Gricar murdered? His disk drive was removed from the computer. A drive with evidence on it about this case. So much has not been told and I fear will go to the grave with many.

                                      The Penn State football program and players had nothing to do with this. Want to blame someone? Blame McQueary. He was the eye witness who did nothing. I wonder how much the first incident affected the later one. In the first incident, it was reported and investigated and no charges were filed. That would certainly make university officials wonder if charges would be filed in the later case and might make it more difficult to step forward and report it. Not justifying their actions, just sayin'.

                                      Yes, McQueary should have stepped in immediately, and very few will ever understand how he could not. However, Sandusky is now in prison because McQueary at least reported to the administrators what he saw the next day. If it weren't for McQueary, Jerry would still be bringing those little boys to the Penn State showers.

                                      Sandusky had already been investigated before McQueary saw him in the shower and everybody at P S knew about it. Then McQueary tells Paterno about the shower incident and nothing happens for a decade. Paterno and his underlings put a lid on it for the glory of the football program and the greater glory of Paterno. This whole story is so disgusting it would make any sane person sick, yet Penn Staters want to defend the sainted Paterno and and the glorious football program. The football program, which was much, much bigger and more important than the school itself, was the reason this child sexual abuse continued for so long. Footballl continues to be played at Penn St and people continue to go to games and the football program is still the only thing that matters at Penn St. No Excuse for this.

                                      In the course of my work I've had to interview and communicate with many of these offenders. One way or another, they say it's not their fault; frequently blaming the victim if they don't claim nothing happened at all. They don't "come clean." I won't say it is impossible, but it is highly improbable. When I was still in my undergrad, I sat in on a interview where the offender claimed repeatedly that it was the victim's fault. He stated that she came onto him, that she wanted it, and he was just appeasing her. The victim was well under two years of age in that case. It left me shocked at that time, but since then I've seen that type of thinking all too often with these offenders. Typically, they see themselves as the victims.

                                      As hard as it is for us to hear it, it is much harder for the children who have to live it. I won't pretend there haven't been times that I came home and cried in the shower, but if we don't open our ears and eyes and act to protect them, where do these children turn? Your SIL and DIL have seen some horrors, being in those lines of work. I commend them for their efforts; it isn't easy. You do not become inured to this, it does not get easier, but you tell yourself if you can save even one child, it will be worth it.

                                      niece1964... I think you ought to broaden your perspective a bit. It is the courts which find the individual guilty or innocent, not the police. The police enforce the statutes which were created by your elected representatives. Sandusky was found guilty by the court, so you should have no concern with the police until you commit a crime, at which time the police will take you to court, where your guilt or innocence is determined and you will be confined or released. This is where your statement " being kind and doing good by others" is found to be the case, not by the police, but by the court. Thus you can be religious, and according to your faith, " you are being kind and doing good by others ", but to our secular court system you might be guilty of a crime, and incarcerated... and maybe that fact accounts for the number of Christians in prison, that their personal faith was blind to broader societal expectations of behavior.

                                              every one is entitled to a defense. I sure as hell couldn't do that for a living, but it is a right we all have as Americans. Hope he gets paid well, at the least.

                                              Cat Trax: you are incorrect. McQueary went directly to Joe Paterno who didn't want to 'ruin anyone's weekend' by reporting it to his superiors.

                                              In my opinion all involved are guilty at that school, and should be jailed. Too bad Paterno died, he should have served time in jail as well.

                                              I say here for all to see that I sincerely hope that Sandusky never breathes air as a free man. I must say that my cousin's suggested punishment has merit. He suggests that Sandusky be taken to an old falling down shack in the woods, that his private parts, all of them, be nailed to the floor, gasoline spread around him, Give him an old rusty knife, and then drop a lighted match as jailers go out the door saying............ Free yourself. Nuff said?

                                                He's so delusional and sick, he doesn't actually believe he hurt those boys. He thinks they enjoyed it and is wondering why everyone is so bent out of shape! I hope that before he dies, he finally realizes how evil he is at the core...and i hope that he learns it at the hands of his bunkmate BIG BUBBA. But they'll probably put him in some swanky solo room so he can be alone with his memories of raping children, reliving the abuse and satisfying himself.

                                                Here is the problem with this type of offender - they truly believe they did nothing wrong. All they did was love the child and now they are being persecuted.Whether they can't face the truth and block it out or they truly don't understand what they did - they don't believe it was wrong and they would do the same thing again if given the opportunity. The lawyer says he doesn't know how Sandusky could have had the time to do all of these things - there are years here. Every minute he was alone with a child was a threat to the child and an opportunity for inappropriate behavior. It only takes a minute to steal a child's innocense - and once it has been stolen, it is gone forever and a piece of that child has died.

                                                Agreed. The lawyer saying he doesn't know how Sandusky could have had the time to do all of these things is about the lamest excuse ever. It was 10 boys over the course of 15 years.

                                                Also, the wife. I cannot imagine it wouldn't seem odd for my husband to regularly go into one of our children's rooms for long periods of time with the door closed without me occasionally wanting to know what they were doing. No one does that, it's weird.

                                                I know a guy who got 3 life sentences for his sexual contacts with 1 minor, Sandusky should get more because he has more victims. He is a very deceived man to think he hasn't done any harm to these children, now young men. He deserves the maximum sentence the judge can give him. For Sandusky to maintain his stance of innocence is truly disgusting.

If the government can still make the case despite a vigorous defense, then you can be reasonably assured that the government "got it right.""

                                                  Of course, that doesn't always work so well in practice, particularly when defendants are poor, represented by public defenders, who often see them as numbers, rather than people. Yes, this is still better than just about any other legal system on earth, many of which don't provide even the basic protections against government overreaching.

                                                        You know, it's one thing to be a good, zealous defense attorney. It's another thing entirely to go out in public and make all kinds of declarations about how you believe your client was "set up" and "the powers" made all this happen and it's all a big lie. That's not what good defense attorneys do, and in fact has nothing to do with being an attorney. 'Nuff said.

                                                        It's also just a bad thing to do in a sentencing hearing. He's already been found guilty. Give an equivocal apology, sure. Not admit to anything? Fine. But attacking the victims and alleging crazy conspiracies is probably going to make the judge more likely to give him the maximum sentence.

                                                        Amendola is the worst lawyer ever. Sure, there wasn't much to defend, but Amendola with those creepy interviews, statements, and conspiracy theories has done a terrible job. Fortunately, probably not so bad to get an ineffective assistance of counsel reversal.

                                                        Be sure to give the Judge a transcript and save extra copies for any parole hearings, too Sandusky. Parole boards are very sympathetic to people put in jail because everyone has been lying about them.
