Odessa Clay is accused of tattooing her 11-year-old daughter.
A North Carolina woman is in trouble with the law for tattooing her 11-year-old daughter, according to a published report.
Odessa Clay, 30, of Grantsboro in Pamlico County has been charged with one count of tattooing a person under age 18, WCTI-TV reported.
In North Carolina, it’s illegal to tattoo a minor.
Clay was arrested and charged in late September after police in Havelock, where she used to live, found out she gave her daughter a small, heart-shaped tattoo near her right shoulder, according to WCTI. Clay, who herself is heavily tattooed, said she used her own tools.
"She asked me to do it," Clay told WCTI.

Clay said she numbed her daughter's arm for the procedure and her daughter was never in pain.
Clay said she did not know that tattooing a minor is illegal. She told WCRI that she believes a former in-law reported the tattoo.
She is due in court next month.

It's Okay for the government to tattoo a SS# on your forehead at birth but don't go putting any identifying marks on your kids that help id them in the event they are taken or harmed. Bring on the chip implants.

"I don't like that, so I support agents hired to protect life and property to kick in whatever door they need to even if there's no clear and present danger." I have some news - parents aren't a STATE APPOINTED agent when dealing with their own children. It's NONE of the State's business if a parent and child get "I'm with stupid" tattoos. We're collapsing under a burden of debt and a suspect monetary system, but we continue to CRIMINALIZE activities where no crime has been committed. We simply can't afford to make criminals out of everybody to make the Puritans happy. We have so many more things to worry about.

Should the point be made that as tattoos have been around for thousands of years; it is just recently that they have gained an overwhelming popularity that will die as all fads do. You do not see any great-grand parents, grandma’s and grandpa’s and mothers and fathers that were tattooed by their parents when they were children. No, the choice of getting and having a tattoo were made as adults.
You can pierce the ears of a baby (or even clip off some skin from the penis) but you if you tattoo an 11 year old who has expressed the desire for one - you go to jail. Brilliant.
I also don't think babies ears should be pierced. My mom and dad would not let me have my ears pierced until I was old enough to take care of my ears. As for circumcision, that is a whole other platform.
Good points! I don't agree with piercing either at such a young age. Soon tatoos will be acceptable too... Just waiting for middle class white women to get on the bandwagon to decide "it ok and cute". Then there won't be any further discussion or arrests...
Agreed. You get into a very different area where you have religion and health issues being brought up. Circumcision is usually discussed with one's religious representative or doctor to find out the pros and cons of having something done. Some parents choose to have their kids circumcised due to a possible health reason at the time it is being considered.
the "health benefits" of infant circumcision are almost non existant, even the AAP admits that in there reccomendation on RIC. it no different from a tattoo, its just a tribal mark, nothing more. If its ok to cut babies then it must be fine to tattoo them
This is none of our business and it shouldn't be against the law. This is a family issue. Not a state issue, not a federal issue, not a local issue. It is a family issue. And I consider myself left-leaning on the political scale.
Yeah, I wouldn't do it and I probably agree that folks should wait [voluntarily] til they're 18 or, even better, 40 - you know when skin starts sagging and you can see what it'll really look like. But it's not my business what people want to do with their skin. Or their kids' skin.

So she did not know it was illegal? So someone reported her? She should know better. My 10 year old wanted to drive my car, as a MOTHER I said no. Children SHOULD NOT make decisions for PARENTS. Ignorance is no excuse. Another example of someone who does not have enough common sense to reproduce.

I think the mother showed a complete lack of sense and does need some supervision or counseling. An 11 year old is way too young, even with parental consent. Her body will be growing more and stretching, so it is also not wise from a aesthetic point. I could see allowing a minor who is 16 or 17 with parental consent, but even then, it would make me uncomfortable. Why can't kids wait to be an adult to do more things? Kids younger and younger are getting cell phones, dying their hair, dressing sexy, using Facebook and other "older" activities. Why not leave some things to look forward to? I have an almost 11 year old boy and the thought of tattooing or piercing him in any way is abhorrent.
As for the comment about circumcision, I agree that it is hypocritical to allow someone to cut someone else's genitals when they are too young to give consent. We are horrified with female circ, but somehow think it is ok to take a part of our sons' genitals off, for no reason. Most of the world finds that barbaric. The original practice of circ for boys was to curtail their sex drive (you can thank one of the Kelloggs, of the cereal company fame, for that).

80% of the males in the world do not get cut. They do just fine in other developed countries. While there may be a small advantage to be circ-ed in Africa, those studies were not thorough enough to account for the differences between those who had been circ-ed and if that was the real reason the stats show a slight benefit. Their are religious and cultural difference between those who were circ-ed there and those who weren't. The part removed in circumcision is not insignificant and unless you have lived with it both ways, you don't know what was taken from you. I know that people thought it was needed years ago and that it was the accepted way to be. We know better now. The AAP is irresponsible and kowtowing to religious groups and its own doctors who make literally billions a year cutting off parts of healthy penis'.

For those who think it is a quick snip and no big deal, I challenge you to watch a video of the procedure. Go to Youtube and you will find many examples. Make sure the audio is on. Then come back and tell me you want that for your helpless infant.
Agreed. If a parent is jailed for ordering a tattoo, jailing should extend to cutting off part of the body. Why is it that only the penis is the only body part that is not covered by child mutilation laws? Is it less worthy of legal protection ?
it is ironic that people are outraged at a girl getting a tattoo, but cutting healthy body parts of a boy, thats fine, no issue there. Seems very backward and hypocritical to me

Good way to brand yourself as an individual with the butterfly tramp stamp on the small of your back, star on your shoulder or a dolphin on your ankle. Then you get the real hardcore guys who are addicted to it and get tattoos on their face. Brilliant, good career move that on. Why do people want to look like they have been to prison?
I understand the nanny state argument and agree we don't want one.
To some extent we already are on that path with the Republican Christians involvement in politics and their campaign to make there religious laws into state laws.

We are talking an 11 year old child here. In this case it was just a small heart shaped tattoo (something that's not offencive to anyone).
What about the crazier parents among us and the tattoos they might put on throe kids.
Maybe it's not a bad idea to have kids wait till these decisions are made. Just like we do for smoking and drinking.

Regardless of whether or not tattooing an 11 year old is a good idea, one has to ask if this sort of thing is really worth the state's time and effort. Look, the general intent of most laws prohibitting the tattooing of minors is to prohibit tattoo parlors from tattooing kids against their parents wishes. It's to prohibit the unscrupulous from taking advantage of minors who we view as unable to manage their own lives and therefore are dependent on their parents to make life decisions for them.
If mom agrees, and provides the tattooing herself, it seems like a real waste of time and energy for the state to prosecute her, give her jail time, and then dump the girl in foster care for a couple of weeks or months till mom is out again. Who's the victim here? The girl doesn't mind the tattoo, mom's rights to make decisions for her child were not violated, so I cannot figure out who's suffering. Is the state going to start going after every parent that lets their 16 year old try a glass of wine at dinner, too?
The Government ABSOLUTELY has the right to say whether a kid can get a tattoo or not. Apparently no one here is versed in Thomas Hobbes' Leviathan theory. The government is designed to prevent stupid people from doing stupid stuff.

In other words, according to Hobbes, the key roll of government is making sure people don't do things to each other that makes life nasty, brutish, and short. That means things like making sure people don't assault or kill one another, don't engage in theft and fraud, etc. It is not, as you erroneously assert, to prevent stupid people from being stupid.
But even if we accept, for the sake of argument, that government is meant to prevent stupid people from doing stupid stuff, what's the limiting principle, if any? Is there a line that the government should not cross, a stupid decision that the goverment should ignore and let people make? Should parents be cited for not feeding their children properly and not making sure they get enough exercise? Should they be charged for taking their 8 year old to an R rated movie? Years ago, one my employee's daughter got a tattoo at the age of 16. Here in Alabama, it is illegal to have tattoo done if you are under the age of 18. What astonished us is that there were no health department restrictions whatsoever on tattoo parlors in the state. Our local politician, who was in the House of Representatives in Montgomery at the time, got a law passed requiring tattoo parlors to have periodic inspections of their equipment & sterilization procedures. That's a good idea. Do you think it's wise to have someone permanently dye your skin with a dirty needle? Is it wise to get a tattoo to begin with? Not in my world...
