Updated at 5:44 p.m. ET: LOS ANGELES -- A California man who was behind an anti-Muslim film that sparked violent protests in the Middle East denied on Wednesday he violated his probation stemming from a 2010 bank fraud conviction.
U.S. District Judge Christina Snyder ruled that Mark Basseley Youssef will remain in custody and scheduled an evidentiary hearing for Nov. 9.
Youssef, 55, has been in a federal detention center since Sept. 28 after he was arrested for eight probation violations and deemed a flight risk by another judge. Prosecutors said Youssef lied to his probation officers about his real name and used aliases.
Youssef answered "deny" eight times when the judge asked him to respond to the allegations, which include lying to the probation officer about his role in the making of the controversial 13-minute "Innocence of Muslims" movie clip.
Youssef fled his home in the Los Angeles suburb of Cerritos and went into hiding when violence erupted in Egypt on Sept. 11 over the trailer of "Innocence of Muslims" that was posted on YouTube. The trailer depicts Mohammad as a religious fraud, womanizer and pedophile.
The unrest spread, killing dozens, and enraged Muslims have demanded severe punishment for Youssef, with a Pakistani cabinet minister offering $100,000 to anyone who kills him. The violence coincided with a separate attack on U.S. diplomatic facilities in Benghazi that killed four Americans, including the U.S. ambassador to Libya.

Youssef's attorney, Steven Seiden, asked the court during Wednesday's brief hearing that his client be taken out of protective custody at the federal prison and released into the general population. Snyder ordered the prosecutor to meet with personnel at the federal Bureau of Prisons to determine whether that can be done, Southern California Public Radio reported.
"My client was not the cause of the violence in the Middle East," Seiden said after Wednesday's hearing. "Clearly, it was pre-planned and it was just an excuse and a trigger point to have more violence."
A judge will decide whether or not Nakoula Basseley Nakoula, the producer behind the 'Innocence of Muslims' film, violated the terms of his 2010 conviction on bank fraud charges. NBC's Savannah Guthrie reports.
Youssef, a Christian originally from Egypt, was convicted of bank fraud in 2010 and sentenced to 21 months in prison. After he was freed, he was barred from using computers or the Internet for five years without approval from his probation officer. He also wasn't supposed to use any name other than his true legal name without the prior written approval of his probation officer.
"It will be interesting to see what the judge does and what the reaction is around the world,'' Stan Goldman, a Loyola Law School professor, told Reuters.
Goldman said attorneys for Youssef could argue the terms of his 2011 release from prison did not apply directly to his recent activities, in which people associated with the film have said he misrepresented himself.
"It's not exactly like an armed robber on probation, getting caught with an automatic weapon in his possession. It's a little more technical,'' Goldman said.
At least three names have been associated with Youssef since the film trailer surfaced -- Sam Bacile, Nakoula Basseley Nakoula and Youssef.
Court documents show Youssef legally changed his name from Nakoula in 2002, but he never told federal authorities while he was being prosecuted for check fraud. Orange County Superior Court documents show he wanted the change because he believed Nakoula sounded like a girl's name.
Youssef sought a passport in his new name but still had a California driver's license as Nakoula, authorities said.
Authorities said Youssef used more than a dozen aliases and opened about 60 bank accounts and had more than 600 credit and debit cards to conduct the check fraud scheme.
Bacile was the name attached to the YouTube account that posted the video.
The probation issues were the latest of Youssef's legal woes. Cindy Lee Garcia, an actress who says she was duped into appearing in the anti-Islam film, has sued him, identifying him as the film's producer. Garcia also named YouTube and its parent company Google as defendants.
Google has refused to remove the film from YouTube, despite pressure from the White House and others, though the company has blocked the trailer in Egypt, Libya and other Muslim countries.

Why is this man in prison? His civil rights are being violated. He broke no law with regard to the film he made. Why does the media continue to perpetuate the lie that the violence was the result of the film, and not the fact it was a planned orchestrated event.
While I agree with the sentiment, he did in fact violate the conditions of his parole. 1-Using a computer and 2-using fictious names (even though one is/was his real name)

READ THE ARTICLE. He's in prison because one of his probation requirements was to stay off the internet.

His imprisonment has nothing to do with the film.

Additionally burdening the comments section here is that people are going off without reading other news sources on this man, which provided additional information about his felony convictions and prison time and pseudonym usage and so on. But, again, that would require people to read more... we can't have that!

The dumb ass is locked up because he attracted attention to himself as a result of the film and was found to be in violation of his parole/probation as he used fake names and used the internet, or so it seems. when placed on parole/probation you are given a list of rules, if you violate the rules and get caught back to prison you go; no 1st amendment issues involved.

1. He should have served a very very long time in prison after being caught for his original crimes.Not 21 months but maybe 21 years for his crimes.And then there should have been serious considerations as to revoking his "rights" to stay in the US.

If the man had shot several people and been released ten years later on parole, would you be so blasé about the idea of him violating his probation? He committed a crime and was sent to federal prison. One of the requirements for atoning for that crime is to do as you are told under the terms of your probation. This man violated those terms by going onto the internet and using pseudonyms ("Sam Bacile") while making his POS "film." He basically asked to be put back in prison.

Can I just say that even if the tragedy that occurred was planned... as it, indeed, seems to have been... by NO means did this man have to foster additional hatred for Americans by insulting a sacred religious figure belonging to the second-biggest religion on the planet?
His "movie" (created through lies and deceptive practices to the cast and crew, which premiered in Holllywood to a grand audience of ten people) provided a much-desired excuse to incite violence, and the rioting and deaths that sprang up elsewhere would not have occurred on such a worldwide scale (i.e. Australia) if not for his input. He lit the match for that particular candle.

It is quite evident when reading the many comments on these articles. The comments are for the most part not of any moderate Republicans, that is for sure. An extreme invasion has infiltrated the party and those moderates within the party have no power to diffuse it. They are being steamrolled and pushed out by the likes of Ryan, Cantor, Prince, McCarthy, etc. I am currently reading, "The New New Deal" by Michael Grunwald, and I have to say it is a very enlightening look at President Obama's Recovery Act legislation, or better known as the stimulus. If you want to get a good look at just what the Republicans did(and continue to do today on a daily basis in regards to governing) to try and defeat that bill at every turn and demonize it on a daily basis, either buy it or get it at your local library. What the Recovery Act is designed to do was to stop the short term bleeding, but to also build for the future. It is taking me a bit of time to read it as it is quite complex, and I am not well versed in economics or the politics as well as I'd like to be, so I am reading it word for word, can't skim over even one line! Anyway, I do highly recommend it. Peace.

That struck me too. Then I thought, maybe their strategy is to downplay his movie as the cause of the attack. If they put him in protective custody it reinforces the premise of the movie that any Muslim is sure to kill him. If they put him in the GP it sends a message that something else triggered the attack.

The attorney is trying to make his client look good in the eyes of the court by pulling him out of protective custody, but he'll only end up putting him in greater physical danger... either in the population (Double Muslims, anyone?--Richard Pryor joke) or out on the street. No one expected a armed group to attack the embassy, they should have taken extra precautions because of the 9/11 anniversary and figured out that the terrorists would hit something American.
