9/11 mastermind, alleged accomplices return to Guantanamo court

Updated at 5:20 p.m. ET: The self-professed mastermind of the Sept. 11, 2001, attacks on the United States, which resulted in the deaths of 2,976 people, appeared before a military judge at Guantanamo Bay Naval Base in Cuba on Monday after months of delays due to scheduling conflicts, religious observances, an Internet outage and a tropical storm.

Khalid Sheikh Mohammed shocked some observers by appearing with a long, full beard that had been dyed bright reddish-orange. He appeared before Judge Army Col. James Pohl for the start of a week of pretrial hearings, along with co-defendants Ali Abdul Aziz Ali, a Pakistani; Mustafa Al Hawsawi, a Saudi; and Walid Bin Attash and Ramzi Binalshibh, two men from Yemen.

Unlike their last appearance in court in May, which was disrupted several times by the defendants, the five men sat quietly at the defense table, under the watchful eyes of military guards and several family members of the 9/11 victims, The Associated Press reported. All seemed to be cooperating with their attorneys. Mohammed read legal papers. Two others responded politely to the judge when they were asked questions, according to the AP.

All the defendants wore white robes and turbans, and spoke openly with one another throughout the course of the day.


The men, being prosecuted in a special military tribunal for war-time offenses, are charged with conspiring with al-Qaida, attacking civilians and civilian targets, murder in violation of the laws of war, destruction of property, hijacking and terrorism. All five could face the death penalty if convicted.

The families of people killed in the Sept. 11 attacks were invited to military installations in New Jersey, Massachusetts, Maryland and New York City to watch the pretrial hearings on closed-circuit television, NBCNewYork.com reported.

Getting the terror suspects to this point has been a years-long process mired in political and legal arguments over the defendants' rights, the use of evidence that may have been derived through torture, and the proper venue for the proceedings. The actual trial is expected to be at least a year away.

The pretrial hearings this week will cover a series of motions filed by the various defense teams, dealing primarily with secrecy issues and the detainees' rights.

The most controversial issue, which was not taken up by the end of the first day, is a challenge to the government's gag order on any information gained during interrogation of the detainees. The ACLU and more than one dozen news organizations filed a motion to oppose to government's gag order. The government maintains the order is necessary to protect classified intelligence-gathering techniques.

Defendants may skip hearings
On Monday, prosecutors and lawyers spent hours arguing the most preliminary of issues, including whether the defendants have to be in court at all, with one attorney saying the hearings may dredge up bad memories of their harsh treatment in CIA detention.

Defense attorney Capt. Michael Schwartz argued that the detainees should not be forced to come to court because the process of forcibly removing them from their cells is traumatic and reminiscent of harsh interrogation techniques.

Schwartz said that if the court was considering forced cell extraction it had to talk about torture.

"No we don't," the judge said quickly.

"I think we do," Schwartz said.

"I'm telling you I don't think that's relevant in this issue. That's the end of that, move on to something else," Pohl retorted.

But Schwartz persisted, saying he needs to address the issue of torture.

"No you don't," the judge said more forcefully this time, adding that the defense does not have the opportunity to make an argument that he sees as irrelevant.

After a prolonged and heated back-and-forth, the detainees were granted the right to waive their attendence at the hearings at least until jurors are assembled for the actual trial, but they must sign a waiver each day they choose not to attend.

Toward the end of the day, the judge asked each of the five detainees a series of questions to ensure they understand their new rights to waive attendance at their sessions.

Binalshibh answered each of his questions in imperfect English, veering into a perplexing discussion about escaping from Guantanamo and alleging unfair treatment from his guards.

When asked whether he understands that the trial could ultimately continue even if he is not present, Binalshibh looked perplexed, saying, "that is a very wide word, can you be concrete?"

"I'm not implying that I think you are going to escape," the judge said, adding that if that were to happen, the trial could continue without him being there.

"Escaping from custody?" Binalshibh asked.

"I'm not saying you're going to," the judge said, asking again whether he understands that the trial could continue without him. Binalshibh seemed to smile as he said, "Yes I do."

Guantamo guards make things 'difficult'
He raised concerns about the fact that guards would be sent to bring him to the hearings, though, saying, "dealing with the guard is very difficult. They didn't report everything so correctly. Problems with guards can misreporting all things."

"Some guard when you have problem with them they can make it very difficult for us," he said.

Despite President Obama's vow to shut down Guantanamo Bay, the nation's most expensive prison is undergoing some costly new updates that would allow the facility to remain open for years. NBC's Michael Isikoff reports.

When the judge recommended reporting any problems to his attorney, Binalshibh said, "Where can I call him? There is no time to contact him. Very difficult communication for us."

Mohammed answered his questions through his interpreter. He looked down and answered simply "yes" to every question, until at the end when asked whether he understands he doesn't have to attend the sessions.

"Yes, but I don't think there is any justice in this court," he said through his interpreter.

The court was in session for about five total hours, with several breaks throughout the day. It then adjourned until 9 a.m. ET. Tuesday.

Pohl was also expected to hear requests from news organizations on limiting closed courtrooms for secret sessions and be asked to decide whether the U.S. Constitution governs tribunals held at the U.S. base in Cuba.

The testy exchanges occurred during a hearing that was otherwise calm and orderly, in stark contrast to the chaotic 13-hour arraignment hearing in May, when defendants made defiant outbursts and refused to answer the judge's questions or listen through earphones to an Arabic-English translation of the proceedings. In those proceedings, one of the men was briefly restrained and two of them stood up to pray at one point.

Subsequent hearings had been pushed back for various reasons.

A hearing in July was postponed to allow the defendants to observe the holy month of Ramadan. Hearings in August were delayed when an Internet outage left the lawyers unable to access their electronic legal documents. That hearing was later canceled altogether as Tropical Storm Isaac approached. The storm caused no damage to the base.

A hearing scheduled for late September was also delayed because the work space for the defense lawyers was shut down due to a rat infestation and mold, which lawyers claimed were making them sick, Reuters reported.

Pohl ruled on Oct. 5 there would be no further postponements to the hearings.

An earlier attempt to try the five men at Guantanamo ended when the Obama administration tried to move the trials to New York City, where two of the hijacked planes slammed into the World Trade Center.

That was abandoned under pressure from Congress and from New Yorkers, and the charges were re-filed in Guantanamo.

There are several points here to consider:

1) Gitmo was supposed to have closed, Obama said, as his priority first day in office. It is still open.

2) The trial is NOT "set to begin", it is a year away from beginning (DOJ statement released yesterday).

3) Many detainees ahve been released and returned to their native countries, only to become a part of another terror attack against the US.

4) Why are we trying these terrorists as if they are a criminal who just robbed a 7-11?

BTW waiting for the news of another amazing Seal raid on someone supposedly tied to killing the Americans in Libya... Clearly Obama screwed Libya up, whether it is how HIS administration (he runs the State Dept) handled the secutity requests, or more importantly how he continues to try and cover up his own response to the news of the murders by misleading America. He will pull some stunt before the debate to look good...

You can leave Obama out of it there are many things he said he was going to do and has not done.

I am curious how many Iraqis or Afghanis were involved in 9-11. We attacked Afghanistan on the accusation that Bin Laden was responsible. We saw Husseins and his sons killed but according to the Bin Laden SEAL team he was not armed nor did he have any armor on which begs the question why did they kill him, would justice have not been served and given more closure to have him face justice from the country that he so hated, to be at our mercy so to speak. It was known where he was for many months, but instead of locking him up and throwing away the key we just shoot him in the head and then they bury him at sea so they said.

I am beginning to believe that the more afraid a people are the more willing they are to give up their rights. As Ben Franklin said " a society who is willing to give up their freedoms for a little security will lose both".

@Creek Dog well that is what we were and are being told but i doubt we will ever see the trial since its to be held on a military base under tight security and no publicity.

Nonsense! If I waterboard you 87 times, I can get you to admit that you planned and executed the 9/11/2001 "terrorist" attacks too.

Al qaeda had no way of knowing that we would be running military amd national "Security" drills on the morning of 9/11 which would leave us only 4 interceptors to guard the entire East coast of America. A dereliction of duty which should have resulted in the firing and criminal probes of all the brass which allowed such a weak defensive position to exist, drills or no drills.

Al qaeda's choice to "hijack" only fly-by-wire aircraft is equally dubious, for they would be the most likely aircraft to be impossible to successfully commandeer here in the USA. All the FAA would need is a "backdoor" into the flight computers of any "hijacked" aircraft, and the ability to use them as a flying bomb of terror would be ended. To not have that simple capability in the 21st century would also be a dereliction of duty and criminal negligence by the FAA and NORAD.

If any of you of the right side of politics paid attention, you would be aware that the republican hawks fought the closing of Gitmo. They didn't want them on American soil, and stopped Obama from closing Gitmo due to "security" issues. How about the last six years of Bush's term; he didn't close nor say he would close the facility.

They were terrified the prisoners would escape. The funny part being that the only reasons these prisoners have never been tried in the past 11 years is simply because George Bush gave the order to torture them in order to get them to give confessions. I think they've finally found a military judge that has ruled those tortures cannot be used in court as a defense nor a matter of public record but the confessions can be. Makes sense. Any and every secret session is an open admittance that the things being discussed are the illegalities of the Bush administration that have prevented these trials from going forward and thus the Gitmo bases from being closed. The bases were kept open by the american publics demand they stay open in lieu of trials and executions of the detainees.

The CIA used enhanced interrogation techniques to obtain highly valuable information from KSM and the other terrorists residing in Gitmo. The techniques were well controlled and never put their lives at risk. These guys have been drained of information. Time to execute them.

The US does not use EIT's on common criminals. They are just tried and either jailed or released. These terrorist only have one fate waiting, and it's not Disney world.

    Torturing of prisoners did not begin and end with waterboarding. If the United States government actually felt and feel that they are exempt from the laws of war and that they were fully justified in using torture at any level, then stop the showcasing and move forward and let the court openly make their testimonies in front of the rest of the world instead of all this damn secrecy. If they felt justified to the point they gave orders stemming from a directive from the President of the United States to torture prisoners then it should be public knowledge. We do have the right to know if our military, Homeland Security or any other organisation are permitting criminal acts of war. I have seven sons and two daughters that could be effected by this criminal act in future conflicts. What the tortures show the rest of the world is that it is okay if they torture prisoners and that the United States will do torture their sons and daughters. Regardless of what terrorists are doing to prisoners is no excuse for government militaries or agencies using those criminal acts as a justification for their own actions which one day could be the very reason other countries pick up this practice and use the United States as their own justifications for tortures.

    It costs $800,000 per year to house an inmate at gitmo. To house 171 inmates for the last four years would amount to $546.4 million, or somewhat less than the amount spent on Solyndra (but not all the rest of the failed green energy companies) during the same time period.

    With regard to Romney's trust - there's a huge difference in a citizen in a free country investing their own money in whatsoever legal endeavour they choose - assuming the personal risk with their OWN money, and being prepared to live with the consequences...

    And a President, who swore to protect my right to my property... taking MY money and investing it with NO fear of negative consequences or loss, for political paybacks (other than losing the election when people find out).

    The first would be called a bad investment. The second would be called stealing.

    Please refer this reader to a list of the 4000 companies you claim Obama has given stimulus money to; otherwise, I'm going to claim that 3999 have since gone bankrupt taking over 90 Billion in green energy taxpayer dollars with them.

    Obama claims 4.5 million new jobs created as a result of his 900 Billion stimulus program. Do the math, that's $200,000 spent for each job created.

    A prison is a prison and a criminal is a criminal. There are prisons in just about ever city they are called jails but any place where they take away your freedom is a prison. If you dont want they people free maybe they should do what they did with Osama Bin Laden just murder them. I see what the SEALs did to Bin Laden as murder since he was not armed nor did he have on any armor to prevent being seized. I am taking that info from the SEAL who wrote the book about his murder (capture) call it what you will. I do not call it justice unless its ordered by a court.

      The problem with GITMO is that the prisoners housed there would be allowed certain rights if imprisoned on U.S. soil. This is why nobody wants them, and why Obama can't shut it down.. Us republicans knew this 4 years ago, which was why we let Obama make that promise, knowing that the only way he could follow through with it was to put the burden of dealing with these criminals on whichever state they were forced upon. So far no state has expressed any desire to deal with this issue, it brings way too much legal trouble, not to mention the ACLU will be able to sue the heck out of everyone involved.

      The problem is, nobody wants to deal with war criminals and other people who have committed major crimes against the U.S. on foreign soil. They should just be shot, but so much attention has been directed at these people by groups like the ACLU, the liberals would freak out if these prisoners were just lined up and shot. Now the government is forced to have a trial, but there aren't that many laws about this sort of thing. It is entirely possible they won't have the grounds to execute and will end up letting these murderers go. Bin Laden wasn't the only one involved, and wasn't even really the mastermind, yet now that he is dead, it seems like the liberals have lost their desire for bringing those responsible to justice and make them pay for their actions. Over 80% of the population of the U.S. was crying for the government to find and kill these men, and now that only about 50% of the civilian population is interested in terrorists being dealt with, the thought of dealing with these prisoners is not popular any more.

      More people know the stories behind each member of dancing with the stars than the criminals behind the murdering of thousands of their own people only a short decade ago. And sadly, most of them care more about whether we should be treating them better than what they did to get there.

      My point was more over these are not your average criminals - in my book they committed war crimes and as such need to be treated in that fashion. They've all been denied their right to a speedy trial, and they need to go on trial in civilian courts, not military courts. They're criminals, not POW's.                                           They need to keep this prison opened.If it for murdering suspect like this and they are a prisoner of war,then they don't need no Holiday Inn to live in.This is a prisoners of war prison and it don't need fixed up to be suitable.If you were prisoners of war in their country you would have it less comfortable then what they are staying in,so don't waste tax payers money on fixing this prison up for scum bags killers,murderers like them.But do keep the prison open for scum bags like these.They don't need a Holiday Inn,their not worthy of a nice place.I hope they hang their butts,or shoot them in front of a firing squad,kill them all they are scum bags murderers.

                                                Why was this trial postponed because of ....Ramadan? Really?? The article states the "holy" month of Ramadan. "Holy" to who? Sickening..

                                                This crap should have been executed several years ago.slowly. They are not soldiers in a declared war.They are sneaks.

                                                I tend to doubt that they ever will ever be executed, especially if muslim NObama is reelected.
