Court rules Fort Hood shooting suspect Nidal Hasan must shave beard

U.S. Army Major Nidal Hasan, charged with killing 13 people and wounding 31 in a November 2009 shooting spree at Fort Hood, will have to shave his beard, a military court has ruled.

A U.S. military court ruled on Thursday that Fort Hood shooting suspect Major Nidal Hasan must shave his beard before appearing for court martial on murder charges connected to the November, 2009 massacre.

"In front of a military panel, it is undeniable that failure to comply with Army grooming regulations would cast him in a negative light," a majority of judges on the U.S. Army Court of Criminal Appeals ruled. "The military judge has the authority to prescribe the proper uniform for trial."

Hasan, 42, argued that he has a beard because of his Muslim beliefs and requiring him to shave it would amount to religious discrimination.


Hasan faces the death penalty or life in prison without parole if convicted in the Nov. 5, 2009, attack that killed 13 people and wounded more than two dozen others at the Army post about 130 miles southwest of Dallas.

His trial has been on hold for months while the issue of his beard was adjudicated.

Hasan's attorneys also want the appeals court to overturn six contempt-of-court rulings Col. Gregory Gross issued against Hasan for having a beard at pretrial hearings this past summer, when he first showed up in court with facial hair.

Army grooming standards prohibit beards but allow for religious exceptions. Gross denied Hasan's request for such an exception. He found that Hasan's claims of religious sincerity did not outweigh prosecutor's arguments that Hasan grew the beard just before his August trial date so witnesses wouldn't be able to identify him in court.

At an Oct. 11 hearing, defense attorney Capt. Kristin McGrory said military judges have no authority to order forcible shaving. She said military regulations authorize it for inmates only for safety and health reasons.

McGrory also disputed Gross' assertion that the beard would be a disruption during Hasan's trial.

"The fact that he's wearing a beard does not materially interfere with the course of the trial," she told the panel of judges.

Shaving his beard is now legal (DUH) but shaving out his tongue wouldnt be, so you do have a point. I still say killing him is too easy, but this is a case that warrants the death penalty if there ever was one.

Probably the three most prominent American Muslims, Mr. Muhammad Ali, Dr. Mehmet Oz and the late Mr. Malcolm X are/were all clean shaven.

There was no FBI sting involved to raise an argument of entrapment and it shouldnt take 3 years to determine his mental status. Justice is taking way too long in this case.

      I am still wondering, is he still getting on military salary (which he shouldn't be anymore) and if so, he should still follow grooming standards no matter what, but better in the military system than in the civilian sector as this would still not have been decided. Time for the victims to get their day in court and for that can't speak for themselves.                         Phillip, religion and cult is the same thing. All of them are fantastic stories that prey on human vulnerability, to say theirs is a cult and yours is some sort of true religion when it has the same silly magic stories is ludicrous. As far as his beard goes, when he was arrested he was clean-shaven, so I don't want to hear about what his religion now requires of him.                           The real problem here is that his crimes are no longer labeled 'acts of terrorism' but rather, 'workplace violence.' Interesting how this administration is referring to terrorism as anything BUT terrorism. Look at Benghazi, those 'protestors' who attacked the compound weren't commiting terrorism, they were protesting.

                          Removing the terrorism label is attempting to reduce the severity and scope of Hasan's crimes. Shouting 'Allu Akhbar' while blasting away at unarmed soldiers isn't 'terrorism' nope, it is 'workplace violence.' Why bother to try him, he should be given probation and counseling to help with 'anger management.'

                          I am still confused as to why the Obama administration continues drone attacks and the war in Afghanistan, we are no longer fighting terrorists, we are doing...what, exactly?

                          This SoB is still in the military and subject to military rules and regulations. His beard is obviously not in conformance with those regulations. There is nothing that guarantees any religious exception to allow him to grow a beard. The court has correctly ruled that he must appear properly dressed and groomed for his court appearances. The added factor that the beard was grown in an attempt to confuse I witness identifications only adds to the justification for forcing him to shave. I almost hope that this bastard refuses to shave on his own so that the MPs can have the pleasure of holding him down and forcibly shaving him while he whines and cries like a baby about it. I just wish they would hurry up and get the trial over with so that the military can move forward with executing him. There is no way he is not going to found guilty and the only suitable punishment for what he has done is death.

                            Even when off duty or on leave, if you have to appear in an official capacity, you are required to conform to the uniform and grooming standards. He can stay bearded in his cell, but the moment he enters that courtroom he is appearing in an official capacity. Since his request for a religious exemption was denied, he MUST be clean shaven in that courtroom.

                                At an Oct. 11 hearing, defense attorney Capt. Kristin McGrory said military judges have no authority to order forcible shaving. She said military regulations authorize it for inmates only for safety and health reasons.

                                Nice try Captain. Any vet knows that civilian judical authority and military judicial authority under the Uniform Code of Military Justice (UCMJ) are to two different things. When you sign your enlistment papers you sign your life over to the rules set in the UCMJ. Just because one becomes a military prisoner, it doesn't mean that person is no longer in the military. And when you are in the military, you dress the way they say you dress.....period.

                                    I can see the legitimacy of the claim that forcing him to cut his beard is religious discrimination. There was a case recently where Amish individuals were prosecuted for cutting another Amish person's beard. In that, the US government does recognize the religious expression of a person's beard. This country is founded on religious freedom and the devout often decry the government suppressing religious expression and this is what that is.

                                    Don't think me overly sympathetic, it is just that I like to try to be philosophically consistent to some extent. He is most certainly and deservingly going to be put to death, so let him die with his beard if he so wishes.

The POS on trial is a member of the United States military who signed on the dotted line saying he would abide by their rules and regulations. But now that he is facing charges for his heinous acts, he gets "religion" and grows a beard. There should be plenty of time before Major Hasan's execution to grow back that beard before he meets his maker. I am so pleased to see the within military tribunals there is still some sense used.                                     Uniforms mean a lot to military people - they are worn with pride. Even when I was up all night yawning and polishing brass before inspections, I still felt good the next day wearing my Class As. If Hasan wore a beard when he joined the Army, then you could say that Army had given him implied permission to continue with a beard....But that wasn't the case. He knew the rules when he joined.

                                    This guy is just a terrorist that infiltrated our military and our government refuses to see him as a terrorist because of the imbarrassment. We know from his email records that he was in contact with Al-Qaida members. As far as him not shaving, he joined the military and so remains under the UCMJ he agreed to when he joined. He should never have been permitted to grow a beard in the first place. Shave him, then shoot him!!!                                         Constitutionally "Ordained" there is no such thing. She is a soldier first, lawyer second and like every soldier sugject to the UCMJ. Civilians fail to understand this. Also, she is a Captain, most likely was comissioned as a First Lieutenant or Captain as some military skills come in at a higher grade. She's clueless (As demonstrated by her comment about the beard) about normal army standards and dress. See, the judge isn't asking him to shave or even telling him to shave, it is an Order.
