The man charged in the 2009 Fort Hood, Texas, shootings, that killed 13 and wounded more than two dozen has been granted a stay of his court-martial proceedings to appeal a ruling that he must appear in court clean-shaven, Fort Hood announced on Monday.
Former Army psychiatrist Maj. Nidal Hasan, 42, was clean-shaven when he was serving in the military. Since he has been in jail, he has grown a beard. He has said that as a Muslim shaving his beard now would be a sin, because he believes he is close to death, the Los Angeles Times reported.
If convicted of the Nov. 5, 2009, attack, Hasan faces the death penalty or life in prison without parole.
Military court requires that defendants be clean-shaven, and the court has found Hasan to be in contempt and fined him $1,000 each time he has appeared in court with the beard.
A military appeals court in Virginia on Thursday upheld a judge’s ruling that Hasan can be forcibly shaved for the court-martial.
But on Monday, the U.S. Court of Appeals for the Armed Forces issued another stay to accommodate an appeal. The court did not say how long the stay would remain in place.
Hasan's court-martial was initially scheduled for August.

the way "the Greatest Generation" would have handled this is, the sergeant would go up to HQ to check on paperwork "for maybe a couple hours, dammit", and the other guys in the barracks would pin him down and shave him bald as a billiard ball with the back of a rusty rake.

How distressing it is to see how our military justice system has deteriorated. This man is violating the long standing rules yet he is not forced to comply. If he were anything but a Muslim his claim would have long ago been dismissed.
One thing for sure , I hope the murderer is right about one thing. I hope he is close to dying. If he isn't tried , convicted and executed for cold blooded murder then our system has failed us and justice has been denied.
The biggest absurdity in this whole situation is that the government refuses to call this murderer a Muslim terrorist. If he had had business cards identifying himself as a Muslim terrorist the present administration would still deny it. In point of fact , he essentially had such a card which said he was a soldier of Allah.
Why must this continue to be an issue??? In spite of his murderous and treasonous actions, he is still in the Army, he is under their conditions and like some viners have already mentioned, he was clean shaven when he committed these atrocities. He killed many of our soldiers and was in a position where others trusted him. Have him personally pick the bullet out of the box, hand it to the shooter, have the shooter dip the tip of the bullet into pigs blood in front of him then off to the range they go. Although he can and probably will be forced to shave . I would first give him two options and see how he feels then. Option one. He shaves and has the possibility of life in prison or the death penalty with available appeals. Option 2. Death if found guilty in two days following the trial without possibility of of appeal since these things are not options in the Muslim world he will not be afforded them here if he chooses to stick to his Muslim beliefs..

Mr. Nidal Hasan is correct, in that it is the religious duty of the true Muslim to kill plunder or subjugate the infidel, but he lives in a secular land where the secular laws are above his religious obligations, including the personal affect of maintaining a beard. He joined the military voluntarily and is subject to it's rules until he is discharged, (which will likely be in a coffin).
If the rules were in place before he signed his name as a volunteer, then he is beholden to those rule. If he insists on coming to court naked, he can't do that either. The dress code is an enforceable rule based on a voluntary commitment.
If forcible shaving is required then so be it. There can be no special accommodation for any religion. No exceptions. Please use a sharp razor, sedate the prisoner and avoid razor cuts or rashes so the whiner cannot complain about torture. Then shave his hairy Neanderthal face clean so that he at least appears semi-respectable.
I trust the judgement of the military tribunals. They have proven to be exceptionally fair and impartial, and even more effective than the civilian court system.

The problem is we have a legal system, not a justice system; so this kind of foolishness is allowed. This is simply legal maneuvering. The court should take into consideration whether he shaved prior to this, for military duty, NOT what his religious beliefs are today.
Some of the nasty remarks made on here are really disturbing, if you have no respect for anyone else, HOW can you expect ANYONE to respect you? If we act like the criminals who have done our country injuries, then WHAT are we fighting to preserve?

Trial date arrives ask him to shave. If he doesn't shave, forcibly shave him. Simple. He needs to face the Military Court system for the crimes he committed. If he gets the death sentence I volunteer to carry out the sentence of the court. May justice be served in this case.

I really don't care what military appearance rules are or what tradition says, as it would be incredibly easy to overlook those rules and traditions just once so that this case can run its course and justice can be served. Our society includes many guys with beards of this length and even longer and whether or not someone has a beard does not exclude anyone else from court appearance nor from the consequences of failing to follow our laws either.
Just because Major Nidal is a member of our military should not matter one iota as to whether he is fit to stand trial wearing a beard. Anyone who says differently is guilty a playing a stupid game, too bound by semantics to realize that their actions are turning this case into a circus. If the military can't try him when he is wearing a beard, then why not expel him from the military on an egregious violation of personal appearance responsibility grounds and then try him in civilian Federal court instead, since the action that he is accused of occurred on Federal land?
Both Major Nidal and a number of us are also guilty of promoting a view that says that all Muslims have been, will always be, and are now all engaged in a holy war against anyone who believes differently. There are several different factions of Islam, and the vast majority of those people are not violent radicals. We have to remember that there are various minor factions of Christianity which have over time wanted to kill in the name of God and the teachings of Christ too.
As recently as the 1980s there was a splinter sect of the Mormon Church in Kirtland, OH that wanted to kill any of their members that were not as devoted as the leadership was, and even the patron saint of the Mormon Church, Joseph Smith, ordered the massacre of the members of entire wagon train including women and children on religious grounds once too, a terrorist act if there ever was one. If we go far-enough back the Christians inflicted the Crusades on the Muslim world too. And yet most Christians are not on a continuous holy war against non-believers either.
The Major Nidal circus must end one way or another, and justice must be served. My own feeling is that this circus has gone on far longer than it should have, and I personally fault whatever judge said that the show couldn't go on if the accused was wearing a beard. If he wants to wear a beard in court it is just fine with me and I am sure that it would be just fine with the vast majority of America too.
This sideshow has gone on long enough and it is time for the main act. If our military is too chicken to try a bearded man for mass murder let me assure you that our civilian courts have no such problem.

If this animal believes he is near death, help the animal get closer to death. Take a rope tie a noose on one end, attach the other to the top of his cell/light fixture or whatever, place a chair under the rope. His choice - meet death or dry shave - his choice. Leave him alone for an hour or so to decide, it's his choice. This poor excuse for a human is trying to delay/control his trial for multiple murders there is absolutely no question he is responsible. He's still on active duty with the Army and is subject to the same rules all of us are re: dress, grooming and deportment. If he refuses a direct order to shave, he can--and should--be forcibly shaved on a daily basis until the trial is finished. As an alternative, refusal to obey a lawful order can be added to his charges with his appearance in court with a beard de facto evidence of guilt--meaningless compared to the current charges but would at least allow the trial to proceed. As for the criticism directed at the DoJ for refusing to characterize this as a hate crime or terrorist act, I reluctantly concur. By trying him as a mass murderer, he loses his status as a political prisoner and martyr and just becomes another tacky criminal. Executing him would then be a matter of due process and would not give Islamo-facists a rallying point.

@Oldtimer- As a retired Colonel from the Army Medical Corps I can see that you have no concept of discipline. The Army Regulations are specific-no beards unless there is a skin condition which merits a beard profile. If he is allowed to get away with wearing a beard and flaunting the regulations, then the discipline of the Army is in jeopardy, others will demand to be treated equally. He is in the Army and is subject to the rules and regulations. There can be no exceptions. He needs to face the court with proper military bearing. He is NOT a civilian!

Kind of reminds me of a case in Washington state in 1994. Mitchell Rupe was convicted of murder and in that state, the only method of execution (until the 90's) was hanging. He then proceeded to eat himself so fat that to hang him would cause his body to rip from his head and that is "cruel and unusual punishment" and therefore cannot be used. He deliberately ate himself into a position where it could not be used, yet they had no backup method of execution so he ended up spending life in prison. I think bread and water until he was thin enough and then hang him would have been better than spending all that money housing him until he died of liver failure, probably due to the amount of food he had to eat to keep from being hanged. THIS is the kind of idiocy that people read into laws. Like separation of church and state. People twist this around all the time to make it read that you aren't allowed to display religious items when it simply means that the government cannot make up a religion and then force people to follow it. It also says in that same statute that you cannot suppress the free expression of another's own religion, yet athiests force others to do it every day. When are they going to read that part of the statute???

The US Army demands clean shaven. I believe the US Airforce does, too. The US Navy allows beards as long as they are kept clean and neat. During President Eisenhouer's administration, he was petitioned by an Indian who had been drafted. This man's religion required he wear his hair long. (I supposed he was allowed to shave because I don't remember any mention of a beard.) The president sent him a letter giving him permission to wear long hair, provided he kept it clean and neatly bound above his collar (At the same time and probably today, female military were already routinely allowed to wear their hair thusly.) IKE also suggested in the letter that the man ALWAYS carry the letter with him when in uniform.
Even today, Army men are allowed to remain unshaven under certain circumstances, a skin problem, for instance. I also know of a case where an army sargent, cast in an amateur production of a play was allowed to grow a beard by his CO as long as the play ran. WHAT I AM GETTING AT<<<~~~~~>>> although I have NO sympathy for the Major, I feel that by sticking to its guns, the army is just arguing about the shape of the table. So, let the man grow his beard and let's get on with it already.
Everyones' post are very eloquent and descriptive(and I would concur with most). Forcing him to trial by breaking the rules will only provide a loop hole to be taken advantage of. Some crackerjack military expert can certainly come up with something - like a temporary allowance of beards and mustaches like the Navy did - the precedence is there and change it back after justice is served. I'm sure somebody on the Joint Chiefs of the Military could propose it and Mr Panetta could OK it. If it was me I would be fertilizer by now.
@Matilda you are wrong about Navy regulations, beards are no longer permitted except for skin problems. Navy regulations also specify that a prisoner held in disciplinary status(Brig for Navy stockade as translated to Army parlance) may not wear facial hair-not even a moustache, besides that is a moot point Major Hassan is in the Army and the Army has every right to insist on proper military bearing-NO BEARDS! and be properly attired in uniform when present at his court martial. There is no wiggle room as that is NOT consistent with proper disclipine.
The fact that there is no wiggle room is what is preventing closure for a lot of people. To bend the rules shows weakness and to forceably shave would be considered anti- this or cruel and unusual that, gaining sympathy for the accused. Time for an unfortunate accident. Everybody goes home except them that shouldn't.

[Evil].....it's a military court. The Constitution only loosely applies here. The primary standard applied to how he is tried and how is is punished is the Uniformed Code of Military Justice. For everyone on here trying to apply typical civilian court logic to this case, you can stop now or be annoyed for evermore. The court trying this case is a military court. While he was portraying himself as a loyal American in the military his Muslim beliefs permitted him to have no facial hair but now that he no longer has to deceive us and since he is a devote Muslim he must have a beard as his religious right. I guess being clean shaven is permissible, in his belief system, only while deceiving the "Americans".

It really gauls me that our tax dollars pay for all his medical needs, food and maintenance while other Americans might go without. But I guess that is what separates us from other societies.

Sorry but the military has a dress code and he can not appear with a beard. For those of us who have served we understand it but civilians don't. It also is very frustrating that he hasn't been forcibly shaved yet and executed by firing squad.

Simple answer to the question.....was he wearing a full beard at the time that he murdered our military heros? If not, then his cowardly attack had nothing to do with his religion then and therefore should have no bearing on his case now. Let justice be done.
