Grand jury considers charges in Etan Patz disappearance

Etan Patz vanished in New York on May 25, 1979. Despite an extensive search, his body was never found.

NEW YORK -- A Manhattan grand jury is hearing evidence against Pedro Hernandez in the 1979 disappearance of Etan Patz, NBC 4 New York has learned.

A decision is expected by Thursday whether Hernandez will be indicted on kidnapping and murder charges.

Police have said Hernandez confessed in May to attacking Etan. They said he admitted to grabbing the 6-year-old off the street and killing him in the basement of a SoHo bodega where he had been working. The body was then allegedly left in a trash bag out on the street and was never found.


It was 33 years ago when Patz disappeared as he walked alone for the first time to get his school bus.

Developments in the case have made headlines across the globe for decades as police tried to rule in or rule out possible suspects.

Defense lawyers have said Hernandez has a history of mental illness and his confession is unreliable. Hernandez's attorney, Harvey Fishbein, declined to comment to NBC 4 New York on Tuesday about news a grand jury had started meeting.

A spokeswoman for Manhattan District Attorney Cy Vance also declined comment.

After his arrest in Camden County, N.J., Hernandez was held at the Bellevue Psychiatric Center but was later moved to Rikers Island after receiving medication.

A court hearing is scheduled for Thursday at 100 Centre St. at which prosecutors are expected to announce any possible charges handed up by the grand jury.

Last week, one-time lead suspect Jose Ramos was released from a Pennsylvania prison on unrelated child sex crime offenses. He was immediately arrested on a Megan’s law violation for allegedly not correctly listing an address where he would be living after his release.

Patz’s family continues to live in Soho. They have not commented on the arrest of Hernandez.

It's so sad to have your child go missing, get killed, and have no closure. Now after all these years there may be some sort of closure. I pray for the family this must be heart breaking. I hope justice is served for Etan. I know he has been in much better place all these years but it is thise who are left behind who suffer so much.

The guy didn't do it. He is three bricks short of a load.So he will go to trial, but the result will either be an acquittal or a hung jury.

    This is so sad. If he had any siblings I bet his parents became overly protective and never let them venture out alone. This society we live in where children are murdered is just sickening.

        I lived in New York City when Etan disappeared, my son was two years old. I felt so sorry for his parents and when I see his little cute face, it still tugs at my heart. I think just about every parent feels for his family. I must admit I wondered why they allowed him to go to the bus stop alone. NYC was a very dangerous place even back then, but I can't judge them to harshly, the mother said Etan wanted to do it so badly I know the parents have suffered extremely because of their decision. We moved out of the city when my children started elementary school but I always took them to the bus and was at the stop when they came home. I was blessed to be able to work part time until my oldest child went to Jr High School and then a friend next door looked after them when I went to work full time until they were old enough to care for themselves. Parents have a hard time sometimes when it comes to child care. I pray for the family, this sort of thing is hard for anyone who has lost a child.

          Pixie1 you said some great things I Am glad I visited this site again; But there's little hope for the next 4 years you said that but there are things at work that you do not understand OK Sure we were lied to for the first four years but that is changing everywhere cops are starting to see that they have been enforcing allot of useless laws that have been oppressing the people; Our teachers have noticed that just school is not enough they are starting to take them out-to nature where they can learn way more than in any classroom, that it's valuable to show children that frogs, are very important mice an trees, they are a part of-us and maybe science was pressing these kids too hard. OK in the opposite direction than they should have been-going inn. Just wait tell next year when you see bubble schools made of glass, so children can actually play in them in the winter, even filled with butterflies and all sorts of harmless creatures, which are equally as important to us. OK where nature is a fun thing it can also be dangerous and is equally important to teach them, that even they have their place, to be seen but not touched also; Things like dangerous snakes, mountain lions and wild bears, “OK Science” These teachers taking telescopes with them, so they can study space, teachers can take them out-of the classrooms with the parents’ permission and bring them along also make parent teacher-bonds stronger so that children trust them more. OK so they can be called a friend a teacher is just a teacher, if all they do is stand there and talk ever here blah, blah, lol If they do all this other stuff they can become a friend, also and even someone the parents can one day confide in. But we must be careful there are some awful kinds of programs, that have harmed this open- resource and that is CPS made to destroy families harm the parent-teacher trust, and those awful setbacks will have to be dissuaded if we are to move forward and reach space! And enter the higher understanding of what we really are, why we are here and what is best for us all! Not just the wealthy the true wise men-women that made our country, the founding fathers of America new we must learn to stand up for what is right! To put away our differences and look beyond what we want, they knew this day would come where the rubber meets the road! And speak out about all this communist nonsense that our country is so stuffed with like you said!

                            This case caused an axiety on us young parents back then. Children had their finger prints recorded at the local police. We became more vigilant and paranoid about the people around us. I cannot imagine the parent's pains all these years still waiting for their son to come home. Our society has to do better diagnosing the mentally ill so they are under watchful eyes before they cause harm.

                              Now, if any of you people who are assuming he is guilty have actually looked up the real information on this case you would find that the DA didn't want to go forward with this case because they felt he (the bi-polar schizophrenic Hernandez) likely wasn't the killer and that there was nothing connecting him to the case other than a confession from a man who is schizophrenic and likely thinks he did even if he didn't do anything. They also complained that the move forward was purely political between NYPD and the Feds, each trying to show who had the bigger badder manhood with the case when neither one had anything to go on. Look up the article written by LAURA ITALIANO and JAMIE SCHRAM on the New York Post as an example of this information. All easy to find that there was no evidence of Molestation, murder, or anything. For all they know the child could have been simply kidnapped and sold off into child slavery in another country. (Or sold off in this one. God knows it does go on in this country.) Look at the evidence given, don't let the 'press' prey on your emotions to make a dollar. I feel bad for the child's parents for not ever being able to have closure and the press and police department using them to make money.

                              I hope the police taped the whole interrogation. Mentally ill person off his meds and how long did this interrogation take? I will wait for the trial to judge. Former member 528th MI (interrogation) unit.

                                The saddest part of this whole story it took so long to find this person and the parents have suffered so long. Now that he has been found I hope he frys but that won't happen because there are to many bleeding hearts out there and sadly that is a fact.

                                    This is a tragic story and the boys family has lived with this nightmare for so many years, I hope they have some closure, but I also wish this person never leaves prison. All will stand before God someday and be judged for their sins....

                                    10 minutes. Thats the maximum amount of time it should take for the court and judge to take this losers confession and convict him. No jail time. Have the chair ready in the next room and rush him to it. Throw the switch and it's over. Stuff him into a trash bag and throw him on the dump. The case is closed at minimal cost to the tax payers. The family doesn't have to hear any more from this a-hole and he gets an express ticket to GOD where the Al Mighty will pass the final judgement.
