Woman denies luring man to his death in revenge for husband's murder

Janepsy Mesa Carballo gave emotional testimony on the stand at her trial Monday.

A woman accused of luring a man to his death in revenge for her husband’s murder told a Florida court Monday that she acted in self-defense.

Janepsy Mesa Carballo, 35, who is on trial for second-degree murder, , told a Miami-Dade court that she feared that Ilan Nissim would harm her and her family when she shot him.

“In my mind, he was chasing me,” Janepsy Mesa Carballo said of Nissim. “His people, as he called it, were chasing me.”

She testified in hopes of having her murder charge thrown out under Florida’s Stand Your Ground law.

Carballo said that she lived in fear of Nissim, who was an acquaintance and business partner of her husband, Orlando Mesa.

Shot six times in the back
Mesa and Carballo’s toddler son were shot outside their North Miami home in April 2008. Her husband was killed and their 2-year-old boy was injured but survived.

A month later, Carballo shot and killed Nissim inside her home, according to authorities.

Prosecutors say Carballo was out to avenge her husband's death, claiming that she lured Nissim to her home the night she fatally shot him six times in his back.

But Carballo said that she wasn’t expecting Nissim that night, and said that his visit turned violent. She acted in self-defense, she said.

Based on what this story relates (at 7:55 am EST), I'm not sure why anybody is make loud pronouncements about the cops, gun control or anything else.

Even in Great Britain, this woman could legally have a gun in her house, a smooth bore shot gun, and the story tells us nothing about what circumstances brought the slain man to her house.

Until we know a little more you cannot really assume anything about this shooting. Self defense, revenge murder, or something in between? We just do not know.

This story could use a bit more detail and context. E.g; what was somebody who'd killed her husband and shot her toddler doing outside bars?

That earlier shooting that supposedly set the stage for this one is even more interesting...

This clearly is self defense, in Florida. She had her front facing his back which was approaching her and the lethal threat of him turning with his left hand towards his right was the legal situation justifying her action of putting 6 bullets in his back. I always look out for backs with hands towards other hands, that is a sure sign to cock your gun.

There is not enough information in this article.Why let a person into your home that you are afraid of in the first place?Even if he was suspected of killing her husband she had to right to take the law into her own hands.

It also doesn't address why the alleged "victim" was not already in police custody for the murder and attempted murder of her family. She wouldn't have been able to lure the man anywhere had he already been where he belonged.... in a jail cell awaiting trial!!!

Not putting the sole blame on the cops, but they have a job to do too and that shouldn't be exclusive to the low hanging fruit cases like Ms. Carballo's.

I was thinking the same thing. If police knew he killed her husband and nearly killed her child why wasn't he either in custody or why didn't they have surveillance on her thinking he might possibly come back to finish the job.

    Instead, police say that when he arrived she had Nissim help her move sound equipment from one room to another and then she told Nissim she was “ready” and pointed the gun at him. He pleaded for help and she replied “Orly (her husband) asked for help too, [expletive],” the police statement reads.

            I'd be more interested in hearing why she thought he shot and killed her husband as well as shot her child. Guilty she is but on what level. If someone shot and killed my wife and shot my child and the courts and law allowed the sucker to walk free in front of me is almost at the extent of being entrapment.

              I know we are a nation of laws, but that is not justice. The woman was the victim of a horrendous crime, and by law she is charged with 2nd degree murder...there is no justice in that.

              Nowhere in the article does it mention that the guy she shot had anything to do with her husbands murder. I'm pretty sure they wouldn't have charged her if they had evidence that the guy was involved in the murder and had come back to finish the job. She should have shot him in the face instead of the back. Shooting someone in the back makes it hard to prove self defense.

              Sorry, Todd, but the man was tried and found not guilty.

              Wish we had more details than the writer of this badly written story deigns to include. He seems to assume we are familiar with the case, and that's poor journalism. Still, who knows what happens? Maybe there was good evidence and he got off on a technicality. But perhaps there was no real evidence, and her ugly suspicions may be totally in error. In which case she killed an innocent man.

                If your husband was murdered and your child was shot, and you think the murderer is out to get you and a few weeks later you find the murderer is in your home - would you have the presence of mind and training to follow standard police procedure? (By the way, you aren't a police officer.)

                Word on the street was he killed her husband. As far as her story goes, he showed up unannounced and with her knowledge of the street talk, she was scared for her life and shot him.

                Yeah, 6 times is a little excessive but she probably never shot a gun before and wanted to make sure she stopped him before he can harm her however, talk on the street is she called him to come over and "then" shot him. They'll figure it all out with phone records or she'll break down and either admit it or not.

                The usual. The only time "Stand Your Ground" law should apply but there are wrinkles out the gazoon....

                The term "lured" never appears in the article. The term "accused of luring" does ..... it's what prosecutors do when they want to put someone away. Although I must admit that explaining away 6 in the back is gonna be a chore.

                    I agree that there are more questions than to be able to comment on. How did the guy get into her house? Had he been arrested? These reports are getting more diluted to where there are very few facts.

                        Typical MSN Non-news - was the man charged with killing her husband? Acquitted? Out on bond? Maybe she had really good reasons for killing him, maybe she was just out ot get total control of the business they shared - who knows? Certainly no one who reads this story.

                        But as a general policy/ethics statement: from my own perspective, if someone DOES kill my mate and tries to kill my child, guaranteed, I will do whatever is necessary to take them out. Justice in this country is a commodity, sold to the person with the most powerful accomplice (Err, I meant to say, lawyer). You cannot depend on the police or courts to make things right, so we are back to the law of the old West - and justice is dispensed out of the barrel of a gun. Pretty bad, but it's the way it is any more.

                        this is a classic love-triangle in that everyone's lives end up getting ruined. the wife has an affair with the nissim, the husband confronts nissim and ruins his image so the nissim stakes out his house and shoots him when he's walking his son from the car to the front door. the police have trouble getting physical evidence that implicates nissim as the shooter but everyone (the wife included) knows that he did it and since her reputation and family-life has been similarly destroyed she lies to the nissim a little while later saying that she wants to get back together with him then blasts his @%# in an emotional rage and will be found guilty of murder and the kid left without any parents... how about just staying faithful to your spouse next time?

                          Not enought information in this article to figure out what happened or what is going on. It is a shame the taxpayer has to provide salaries for all the people in the law enforcement and legal systems to address the actions. Very costly for emotional, criminal activities.
