Updated at 3:51 p.m. ET: NEW YORK -- A 30-year-old former deli worker has been arrested on second-degree murder charges for allegedly pushing a New York subway rider off the platform and into the path of an oncoming train at 49th Street after an argument.
Law enforcement sources say Naeem Davis has made statements to detectives implicating himself in the deadly push. Information about an attorney was not immediately available.
A law enforcement official told NBC 4 New York the man is suspected of pushing 58-year-old Ki-Suk Han off the platform at the N, Q, R station Monday afternoon. Han was hit by a southbound Q train and died.
Han's family spoke publicly for the first time Wednesday. Daughter Ashley Han, 20, said: "I just really wish I had one last chance to tell my dad how much I love him."
A bystander recorded part of the fight between the two men and turned the video over to police. The man who allegedly pushed Han is heard cursing and saying, in substance, "Leave me alone... stand in line, wait for the R train and that's it."
He then pushed Han onto the tracks, police said. Han tried to climb back up onto the platform but died after getting trapped between the train and the platform's edge.
Asked Wednesday if she wished someone would have helped pull her father off the tracks, Han's daughter said it was difficult to dwell on the past.
"Yeah, the thought of someone helping him up in a matter of seconds would have been great... what happened has happened," she said.
The Q train operator, Terrence Legree, told the New York Daily News he saw the man on the tracks and tried to pull the emergency brakes on the train, but couldn't stop it in time. Even after he heard the sound of the train hitting the man and the locomotive screeched to a halt, Legree said he jumped out of the control booth and tried to help the victim.
"If someone can be saved, you have to do what you have to do," Legree, a 21-year employee with New York's Metropolitan Transportation Authority, told the News. But Han couldn't be saved -- a tragic fact that had Legree struggling with an range of emotions and questions more than a day after the man's death.
“All kinds of emotions from ‘Why is this happening?’ to ‘Why was that guy down there?’ to ‘What happened?’” Legree told the News. He was treated for shock after the incident.

Police had released several photos and video clips of the suspect wanted for allegedly pushing Han into the path of Legree's train. A law enforcement official tells NBC 4 New York that co-workers from a nearby deli where the suspect works tipped off police that their colleague might be the subway pusher after they recognized his voice from video.
Investigators then saw the man on surveillance video in the street talking to street vendors outside the subway station, and when they went back to the area Tuesday, he was there, speaking with the same vendors, sources said.
Subway pushes are unusual. Among the more high-profile was the January 1999 death of Kendra Webdale. A former mental patient admitted he shoved her to her death.

Following that, the state Legislature passed Kendra's Law, which lets mental health authorities supervise patients who live outside institutions to make sure they are taking their medications and aren't a threat to safety.

First off, as a New Yorker who had lost a friend to an accident on the train, you have to react fast to this kind of situation. And, IMHO I find that people will freeze up in the face of danger. NOT all people, but alot of them. This was a total tragedy for this man, as well as the motorman, who will not forget this incident for the rest of his life. But secondly, the accused man has got to have some kind of problem, but I don't think Sharpton or any of these usual folks would have anything to do with this guy. But of course he decided to "warn" a train operator who already KNEW he was about to run over someone and could not stop. His story is that he flashed his SLR camera at the train, as he took a photo with each flash, and in perfect focus! Not buying it. He should be charged with something! I was in a Beijing subway station where they had a glass partition blocking the rail area, then the train and partition doors open simultaneously for access, but that was a brand new track, train, and subway stop built prior to their Olympics. To retrofit this here would be near impossible without replacing all the trains and a hell of alot of station revamping. There is no money for this, maybe as systems age out they will be upgraded but that could be a very long time.
They have'm in the airports, glass doos are closed until the train stops! I've also seen where there are, at least, hand-rails up.
Sounds like a wise idea to me. Also, not looking at or speaking to anyone in line etc... etc... ;)

Either way, let's start eliminating this trash from society with the death penalty. I've read that the victim was a 58 year old husband and father. So sad that his life ended this way in such terror.
While I will agree that this is indeed a tragedy, being a husband and father does make his life anymore valuable than any other person, regardless of age, health, wealth, familial status, or any other criteria.

Still wondering about the photographer who said there was no way he could save him since the train was coming so fast. I can believe he didn't have time, but what bothers me is the fact that he, nor anyone else, even tried to run toward the man to help. Seems there should have been others in the photo running with their arms outstretched to help the poor man.
But, I guess we never know what we'd do in that situation until it happens, so best not to judge.

Yes, living in the Midwest for the last twenty years, I had forgotten how different things are in New York City until my son and I visited there two years ago. I was standing in line at one of the many Starbucks one morning to get my morning cup of joe, and attempted to strike up a conversation with a young woman in front of me just to pass the long wait. As soon as I spoke, she gave me a look as if she were unnerved that I was even speaking to her. Sigh. People avert their eyes and rarely even smile in return when they cross paths with you.
It's a different world there. A wonderful place to visit, but I like a little friendlier atmosphere myself.

I have read what I could on this and yet I have not seen any mention of what the pusher did after the fact. Did he realize the man got hit by the train and ran away?? Did he walk off not knowing what happened to the other gentleman after he pushed him? Did witnesses try to chase him down? Person taking pictures and video.. did anyone watch to see where the pusher went? The police had to go to him.. it is obvious he did not turn himself in.. very troubling story all the way around.

I am soooo upset about this incident, I cant imagine the poor guys family, why couldnt someone at least try to get that poor guy from the tracks, that photographer and someone else could have had that guy out in seconds, no but his freezing moment involved taking a picture so he could sell it to the newspaper. Never been on a subway train. My question is why is there not some kind barrier on the platforms to prevent this kind of accident. Also some hand holds so if a rider should slip and fall on to the tracks he has a way of pulling himself up on the platform.

Getting the trains to line up with the doors is. We would need a hell of alot of upgrading throughout the system. China "Metro Stops" have all been built recently, it's all new infrastructure. The areas that are older are far more dangerous than what we have here. I've seen busses with no lights full of passengers driving through city streets at night in Shenyang, everything is not rosy there either.
Heck, go to ANY amusement park and wait in line for the rollercoaster!

With over 400 subway stations in NYC (in all boroughs) and assuming it is the usual union-controlled work at 10 million per stations not assuming the usual MTA under-estimates, it would cost billions of dollars. 1 accident or in this case criminal push every 20 years does not warrant a complete revamp of the subway system.
On another note, when you take the fools that fail to realize there is a gap between the train and the platform and they fall through, would you like us to individually carry them over the gap?
This city is full or people with no common sense and think it should be completely safe like they are wrapped in bubble wrap....while this was a 'tragic' crime, the person who pushed him should suffer the same fate, being pushed in front of a subway. It was mentioned previously that the train was already pulling into the station when the man was pushed off of the platform. If the train couldn't stop in time, no one there was going to be able to do anything any quicker.
The photographer said it was something like 10 to 15 seconds that the guy spent on the track. Count that out. It certainly leaves enough time to get over to where he was. Had someone been nearby, they could have pulled him up. Then again, hindsight is 20/20.
Wasn't it in New York that someone jumped onto the track recently to save someone by holding them down? It's been a while since I've been in NY. I can't remember if there's space under the trains. Lying down might have been the better option.

Witnesses say the perp was talking to himself and having a whole conversation with himself and the victim approached him and tried to engage him. If you approach a possibly crazy person and he perceives you as invading his space it's not considered "racially biased". The victim's wife said that her husband had been drinking that night is maybe why he would approach this degenerate in the first place. This isnt a hate crime, because the suspect did not attack the victim because of his race.

maybe the tracks could install a device that automatically slows the train down as it approaches the opening to the tunnel where people are so that the train is literally going 5 miles an hour. with a little more time maybe he could have got off the tracks. i am surprised this does not happen more often - even if by accident.
That would make for some very very long subway rides
they can zip along ion the tunnel but slow up where the loading statiuon is - maybe not stop at every stop - i do not live in a city where we have transportation like this - maybe this happens so in frequently it is not worth it but what is the price for a human life. we go through a litany of security to catch a flight - i guess take an earlier train by 15 minutes.

It could only be a hate crime if he intended to push Han into the path of the train and his reason for doing so was that Han was Asian. I don't think hate crimes as a separate category are needed, after all if you kill someone you probably do hate them at least at that moment, it should be considered as an aggravating factor at sentencing in my opinion that being said just because people of different races/sexual orientation/religion commit a crime against each other it is not automatically a hate crime, those differences have to be a substantial part of the motivation for the crime. If you beat a guy to death because he's black or whatever than that's a hate crime, if you beat him to death because you caught him sleeping with your wife that is not a hate crime.

Well put. Obama in his formative years was not exposed to the Black culture of mainland America. He has much more of a world view and I doubt he ever felt that he was a victim of anything because of his race. It certainly didn't hold him back.
