New Jersey U.S. Sen. Robert Menendez talks to NewsNation's Tamron Hall about his knowledge of the situation surrounding the arrest of an unpaid intern working for him.
Sen. Robert Menendez confirmed to msnbc TV’s Tamron Hall on NewsNation on Wednesday an AP report that an unpaid intern working in his office had been arrested by immigration authorities for being in the country illegally. The Associated Press reported that the 18-year-old from Peru was also a registered sex offender.
The Homeland Security Department instructed federal agents not to arrest him until after Election Day, a U.S. official involved in the case told the AP. Menendez, a Democrat from New Jersey, told Hall he knew nothing about that allegation and did not learn of the arrest until just before appearing on msnbc Tuesday. He said his staff learned of the arrest Monday.
Luis Abrahan Sanchez Zavaleta was arrested by U.S. Immigration and Customs Enforcement agents in front of his home in New Jersey on Dec. 6, two federal officials told the AP. Sanchez, who entered the country on a now-expired visitor visa from Peru, is facing deportation and remains in custody, the officials told the AP. The officials spoke on condition of anonymity because they were not authorized to discuss details of Sanchez's immigration case.
A spokesman for Immigration and Customs Enforcement did not immediately respond to an AP request for further details.
Menendez, who advocates aggressively for pro-immigration policies, was re-elected in November with 58 percent of the vote. Sanchez told ICE agents that he worked on immigration issues for the senator, according to AP. A spokesman for Menendez told the AP she was looking into the matter.
Online jail records did not indicate whether Sanchez has an attorney. Immigration officials there were relaying a request from the AP to speak with Sanchez in jail.
The prosecutor's office in Hudson County, N.J., said Sanchez was found to have violated the law in 2010 and subsequently required to register as a sex offender, the AP reported. The exact charge was unclear because Sanchez was prosecuted as a juvenile and those court records are not publicly accessible. The prosecutor's office confirmed to AP that Sanchez registered as a sex offender, although his name does not appear on the public registry.

Authorities in Hudson County notified ICE agents in early October that they suspected Sanchez was an illegal immigrant who was a registered sex offender and who may be eligible to be deported, according to the AP. ICE agents in New Jersey notified superiors at the Homeland Security Department because they considered it a potentially high profile arrest, and DHS instructed them not to arrest Sanchez until after the November election, one U.S. official told the AP. ICE officials complained that the delay was inappropriate, but DHS directed them several times not to act, the official told the AP.
It was not immediately clear why federal immigration authorities would not have been notified sooner about Sanchez's status.
During discussions about when and where to arrest Sanchez, the U.S. reviewed Sanchez's application for permission to stay in the country as part of President Barack Obama's policy to allow up to 1.7 million young illegal immigrants avoid deportation and get permission to work for up to two years. As a sex offender, he would not have been eligible. U.S. Citizenship and Immigration Services, which oversees the program known as Deferred Action for Childhood Arrivals, notified Sanchez of that shortly before his arrest, one official said.
During the final weeks of President George W. Bush's administration, ICE was criticized for delaying the arrest of President Barack Obama's aunt, who had ignored an immigration judge's order to leave the country several years earlier after her asylum claim was denied. She subsequently won the right to stay in the United States after an earlier deportation order, and there was no evidence of involvement by the White House.
In that case, the Homeland Security Department had imposed an unusual directive days before the 2008 election requiring high-level approval before federal agents nationwide could arrest fugitive immigrants including Zeituni Onyango, the half-sister of Obama's late father, according to the AP. The directive from ICE expressed concerns about "negative media or congressional interest," according to a copy of that directive obtained by AP. The department lifted the immigration order weeks later.

This whole scenario is surrealistic and disgusting. If I am expected to obey the law of the land, why is this expectation suspended for senators, illegal aliens, Obama's Aunt, employers of illegal aliens, and anyone else who wants to flaunt the authority of the U.S. government. Where does this stop? Why should there be any surprise when Too-Big-to-Fail Bank presidents go free, or when our infantile representatives in Washington fight for their rigid positions instead of running the government that is supposedly "of the people, by the people, for the people."

I wonder if 'Menendez' is here legally? Were his parents? If not, then they are criminals, and he is nothing but an abomination of the 14th amendment. The Dept. of Homeland Security admonished ICE several times not to arrest this kid until after the election. If that isn't corruption at the highest level I can't imagine what is. Now, while this certainly, on first blush, looks a little fishy, before we go too crazy, try to remember this man was not an employee, he had an unpaid internship, and did not sneak into the US but overstayed his visitors visa. I seriously doubt most senators get very involved in the placement of every unpaid staffer. That is what a Chief of Staff is for. And not all registered sex offenders are rapists, or violent at all. Many nonviolent offenses can draw such punishment, including flashing or relieving one's urges in too public a place. We don't as yet know what this man's offense was. He might be vicious, or just a creep.
Nonetheless, it seems a few people have some explaining to do.
Also, Sen. Menedez's parents immigrated from Cuba before he was born. That is similar to the story of the parents of GOP Sen. Marco Rubio, who arrived in the US a few years after the Menendez couple.

Since he's still a minor the papers are sealed so we don't know and may not know whether it was a violent act or something like relieving himself in public while gross is nowhere near rape or assault. Also, I seriously doubt the senator hires all the staff personally which probably a chief of staff would. Bottom line is that he's here illegally and should be deported violent act or not.

The problem is that illegal aliens can have all kinds of criminal backgrounds that are undetected. That's why so many of us have focused on the illegal aspect.
It's horrifying to us that our government doesn't seem to think it's any big deal that millions of illegals are roaming around without any background checks on their either their criminal history or their medical history with regard to any infectious diseases they may be carrying across the border. That, after all, is the purpose of immigration laws.
Perhaps you can tell us how this young man's sex offender status could be discovered without first discovering his immigration status, and after discovering his illegal status, even if he did not have a criminal background, why it would be okay for a government official to keep him on a taxpayer payroll.

I have always felt that the illegals should share in the punishment and should not be allowed to just walk out the door and move down the street to the next business. As far as E-Verify goes, it's a joke. As long as the computer says the information checks out, what else is the business supposed to do? That is not to say most of what you posted on the second one I quoted is wrong. First if the feds were serious they would just look at Social security data. If the same number pops up twice or if a dead persons number starts getting used then there is a good bet something is wrong. Second I dislike "Amnesty" for the reasons you quote, along with the fact it makes a mockery of the people who went through the correct process to gain entry, work rights, and even residency/citizenship. Filling our prisons with hundreds of thousands of these non violent offenders though is complete lunacy especially when the country cant even pay its other bills.

This Red vs Blue hatred seems to be getting even worse since the election, and it's quite heartbreaking as an American. If everyone focused on working together with both sides, instead of fingerpointing and playing this back and forth blame game, then maybe we could restore this country back to the greatness it once was.

Long ago, I spent a lot of time in DC as an advocate for the passage of the Clean Water Act. The representatives we elect depend almost entirely upon their aides and assistants to filter information from the mountain of requests they get from constituents as well as from citizens across the nation pelting them left and right when they are on a particular committee.
The senator most likely had no direct input on the interviewing or hiring of the young man, and was probably told that with immigration being a hot topic of the coming election, it would be a good PR play to have the guy on staff. It's politics, and the senator isn't the only one of either party playing the game.
The person who brought the illegal to the senator's office should be immediately fired. The rest is a tempest in a teacup. I choke on my own words because I am so anti-illegal aliens, but there you have it.

Well, I've done 3 internships, 1 in the US Senate and 2 in the House of Reps. No background check for the unpaid internships, other than they verified that I lived / went to college in their district / state. For the 1 internship where I got paid, I did have to provide proof of citizenship. So I can see how any elected official may not know someone that is an unpaid intern or volunteer is here legally or not.
I'm sure this bozo senator knew EXACTLY whio and what this illegal jerk was and is, as is evident by the fact that they waited until AFTER the election to have any of it checked or for the news to come out. Unpaid internships are still checked out by everyone else. Most internships are unpaid (sorry if you missed other discussion boards on that topic re. exploitation and privilege) and this guy probably had the same access to everything in the office as the paid employees, and would have still required a background check. Heck, to even work as a volunteer receptionist at the county courthouse requires a background check nowadays, due to insurance issues.

It is fishy if the Senator was in any sort of contact with the intern that no BG was able to get his Peruvian sex offender records or that he was on a sex offender registry here. His Visa running out and not being renewed is another questionable.
As far as the importance of this as more than a news blurb, there is not much other than the postponing of detainment until after elections. This makes my Righty friends sound less bugged out when they chirp over the Benghazi incident being a cover up and National Disgrace(I do believe it was avoidable, but...another day). Yet none of them ever have much of a retort when I hit them with the "What about Iraq? Having had the time to think about this one I am feeling the need to ask a few questions. The President has the Secret Service, getting into a Federal building falls just slightly below cavity check standards, but any Tom, Dick, or Harry can have what amounts to easy unlimited access to a U.S. Senator?

Funny how a possible scandal envelopes a politician and all these people (mostly) from the politician's party don't show up, while all these people from the opposing party come out of the woodwork to nail them on something that hasn't been totally proven to be their fault. This is the same whether it's about a Republican or a Democrat. Home base hides (mostly) and the opposition comes out to delight in grilling them, while they would be the ones to hide if it was their party's guy. Had this been a Republican, the democrats would be out ripping him and the Republicans would be nowhere to be found. The extreme party bias and lack of objective reasoning in this country is tearing us in two.
Disclaimer: I mean in general. Of course there are exceptions.
Now before we get too caught up in grilling Mr. Menendez, how about we wait to find out more of the details. Hmmm? So far we know:
1. He was illegal and a registered sex offender. No excuses for anyone who knowingly let him stay.
2. He was not a paid employee, but an unpaid intern provided to Mr. Menendez by the college who recommended him. An employee would have had a more extensive background check. Also, from the article:
"The prosecutor's office confirmed to AP that Sanchez registered as a sex offender, although his name does not appear on the public registry."
^ I'm assuming that made the background check more difficult.
3. There was a hold off on his arrest until after the election. Major scandal. It remains to be seen just how many people were involved versus in the dark. I don't know why, but everything from this to fiscal cliff has been put off until after the election by our government on both sides of the party line. Apparently the country can't operate until after the election. It ticks me off because there is no acceptable reason for it.
So far we don't know:
1. If Sen. Menendez knew or not. The same goes for his staff. Claiming no knowledge of things like this is the go to defense for situations such as this one, but we must reserve judgement until we know more.
2. Exactly how he got by the radar of the college which recommended this person, or how many people the background check went by. We also don't know how many of them knew. At best, it was a terrible job of screening candidates. At worst, it was at least a few people conspiring to help a criminal. It remains to be seen if Menendez was one of them. He obviously claims to know nothing. So far, we can't prove that true or false.
3. Who was involved in holding off the arrest until after the election. We know it has something to do with the department of homeland security (or maybe lack thereof) but we don't know how deep the scandal extends within it or beyond it. This has the potential to really blow up in the next few days.
So an objective analyses from an independent (me) says:
We don't know enough to say Menendez is truly guilty. I'm not by any means saying he's innocent, either. We need to wait for more information to come out in order to be able to judge if Menendez actually did know anything. If he did, then the Senator should be canned. However, I reserve judgement for now until we know more. So hold off on ripping him for now. Remember, in this country we are supposed to be innocent until proven guilty.

We change the law to require any elected or appointed office holder must resign their current job when they choose to run for a different office, we pay them to do a job not to run for the next one - so for example McCain when he started his run for the Presidency in 2007 would have had to resign his senate seat - OH and so would Clinton and Obama they would have had to resign thier seats. The governors of their states would have had to appoint new Senators to finish out their terms. The folks from those states would have had the representation they deserved, and we might not have to put up with 2 year election cycles.

Actually, I have a have a bigger question. Agents were instructed to not arrest him until after Election Day. It was a FULL MONTH after election day that he was finally arrested. Why was he not arrested on Wednesday, November 7? Why wait another full month before finally doing their job? As usual, we're not getting the full story on this one from NBC News or Homeland Security is really trying to cover up something.
Funny this illegal immigrant wasn't in any of our mid-eastern consulates prior to the election. Would have been more convenient to cover him up along with the other 4 dead americans.
Homeland security is run by the D.O.J. (Eric Holder) so what can we expect. Holder will lie about it, Obama will claim Executive Privelage over the matter And Napoltano won't know anything about it, and the whole thing will be forgotten. Just one big cover up like Solyndra or Fast and Furios. In the meantime a overweight Mexican Girl is appearing on T.V. and running around the U. of Colorado wearing a Tee Shirt that saya " I AM AN UNDOCUMENTED ALIEN". So figure anything out.

He still has a job because he hasn't done anything illegal. First, the immigrant in question was an UNPAID intern. No IRS documents, no way of knowing status. Second, it appears from the article that the illegal had registered with the sex offender registry, but his name was not on the public site. Anyone vetting him wouldn't have found his name on the registry. The worst the congressman can be charged with is basically harboring an illegal if he knew his status was illegal. Since the kid was 18 and a volunteer i'm wondering how deeply they even checked. There are tons of unpaid interns working for legislators over the u.s.a. I don't think the officials worry too much about the high school student volunteers.

To become an intern requires a background check. They don't just pick people off the street and give them access to offices in the capitol without first knowing who they are and knowing where they came from.
I researched the incident in the Dominican Republic. I didn't know that prostitution was legal there. Since prostitution is legal, and he isn't married he didn't commit a crime. If the story the ladies said is true, then he is guilty of being cheap and repugnant. But I have to say, their claim was weak. One call to a radio show, wouldn't give their names or pictures, absolutely no proof. They called with their attorney (why would they need one?). Sorry, that story doesn't pass the smell test. But, I hope all future trips to the DR are closely followed by the press. If there's proof he's using pros. services, legal or not, i'll be the first one to start the attack.
okaywhatever - actually if the senator hired him without checking his immigration status or hired him knowing he was an illegal he is actually in violation of the law. What I as a LIBERAL DEMOCRAT don't understnad is this - were there no US Citizens he could hire? I would think to work for a senator or representative you would have to be a citizen, and I would also think a smart politician would not hire non-citizens (bad mojo and bad politics).

I certainly hope ICE didn't tell the Senator. That is one of the few checks/balances we have. They should have investigated it like Sen. Menendez was joe citizen, not telling him about the investigation until the Senator's role in it could be found out. ICE telling the Sen. ahead of time is worse to me. That would have given him an opportunity to cover up, destroy evidence, etc. Now, I am also basing that on the fact that nat'l security wasn't involved, that no girly/guys would have been exposed to any sexual situation, etc.

One would think that DHS should be held responsible for making the call to wait until AFTER the elections to arrest the guy. Why? Is there a connection between the senator's campaign party and someone in DHS? I know if they did arrest the immigrant before elections, the senator's voting results would have been drastically lower and could have cost him.

They really need to do something with the sex offender registry. It needs to be more specific, or broken down into categories. We don't know what kind of sex offender this guy was, and as it stands, you get on the same list for urinating in public or indecent exposure as you do for being convicted of rape or child molestation. For the record, I have done none of these, but I do know a guy who is on the sex offender registry because he was caught peeing on some bushes outside a parking garage at 3 in the morning while drunk.

Think you might want to wait for all the information to come in before condemnation? The kid was 18 and a volunteer. Since he wasn't paid there weren't any IRS docs to fill out. While we all think sex offenders are in the natiuonal database, this kid wasn't (probably because he was under 18 and the juvenile rule applied). So unless we know that Menendez knew this kid was illegal, he has not done anything wrong. Also, how many hours had this kid worked? I know when I was a high school volunteer for a local congressman, we volunteered maybe 2 hrs at a time every two weeks. There were tons of us. Not saying he shouldn't be responsible for checking these kids out, but let's look at everyone's practice and see if he willfully violated the norm. If that's the case, i'll be the first to say don't let the door hit you on the a@@.

Sorry, State, but it's just not true. The parade of corrupt democrats FAR outweighs the republicans. And it's especially true in NJ. There are countless numbers of elected democrats led away in handcuffs in this state. It's almost NEVER a republican.

I agree with you. I am scratching my head as to why the order was made to wait until after the election. The only thing I can think of was there could have been a connection or deal made behind closed doors so the senator's results were not affected. It doesn't make sense to delay the arrest though considering the circumstances. Makes you wonder what was going on behind the curtain.
Of COURSE they ordered the arrest be delayed until after the election so that it wouldn't affect Meneddez's results. Duh!!!
I think Mr. Menendez......is a good CANDIDATE for a CONGESSIONAL HEARING.....regarding this matter. He is also a GOOD CANDIDATE for a RECALL on his successful election. This should not be the END of this STORY. I expect to hear MORE from this in the coming days...or weeks.
