Two Irving, Texas, women are suing two Texas State Troopers and the director of the Department of Public Safety after they say they were violated during roadside cavity searches in full view of the public and without probable cause.
On July 13, while driving along state Highway 161, Angel Dobbs and her niece Ashley Dobbs were stopped for littering by Trooper David Ferrell. In the dashcam video released by the women and their attorney, Ferrell can be heard telling the women they would both be cited for littering for throwing cigarette butts out of the car.
Farrell then returned to his cruiser and, in the video, can be heard calling female trooper Kelley Helleson to the scene to search both women whom he said were acting weird.
While waiting for Helleson to arrive, Farrell asked Angel Dobbs to step out of the vehicle and began questioning her about marijuana use. In the video, the Trooper is heard telling Dobbs he smelled marijuana coming from the vehicle while asking her several times how much pot was in the car.
Farrell: How much marijuana is in that car? And don't lie to me.
Angel Dobbs: I don't smoke marijuana.
Farrell: OK, how much marijuana is in that car? That's my question.
Dobbs: I swear to God, I don't smoke marijuana.
Farrell: I'm not asking you if you smoke it.
Dobbs: I don't think there is any marijuana in that car.
Farrell: OK, when was the last time somebody smoked marijuana in that car?
Dobbs: I honestly don't know. It's my boyfriend's car. So, I just borrowed it.
Farrell: There's an odor of marijuana coming from the car and that's why I've got to talk to you further about it. Um, and the more upfront you are the better it's going to go for you. So, you're telling me there's no marijuana in that car?
Dobbs: To the best of my knowledge, no there is not.
Farrell: Is there anything hidden on your person?
Dobbs: On my person?
Farrell: On your person, in your shoes, in your underwear?
Dobbs: No. I feel like I'm being treated like a criminal right now. What's going on?
Farrell: I've got a female trooper up the road, she's going to come down here and we're just going to check a little bit more.
After Helleson arrived, she can be seen in the dashcam video putting on blue latex gloves to conduct a search of both women. According to the lawsuit, when Angel Dobbs asked about the gloves, Helleson "told her not to worry about that.
In the lawsuit, Dobbs said the trooper conducted the cavity search on the roadside, illuminated by the police car's headlights, in full view of any passing motorists.
"This has been an eye-opening experience for me. I've never been pulled over, never searched like this. I was totally violated over there a few minutes ago... this is so embarrassing to me," Angel Dobbs said on the video.
"I've never been so humiliated or so violated or felt so molested in my entire life," Angel Dobbs told NBC 5.
Dobbs said she never gave consent for the trooper to "frisk, pat-down, search, or otherwise touch her" and that she never gave consent for Farrell to search her vehicle -- which he can be seen doing in the dashcam video while the cavity search was under way.
Dobbs said she was powerless to stop it. "What are you going to say? What's going to happen to you if you challenge that authority?" she said.
With the cavity search concluded, Farrell then asked Dobbs about prescription medications found in the car. Dobbs said they were for her thyroid and for migraines. According to the lawsuit, Dobbs also suffers from a medical condition that was irritated by the search.
Meanwhile, Helleson can then be seen performing the same cavity search on Dobbs' niece, Ashley.
"It's because somebody is a daily smoker in that car. OK, you can attribute it to that," Farrell can be heard saying on the recording.
The lawsuit further alleges that Helleson performed searches on both women, touching both their anus and vaginas, without changing the latex gloves between searches.
"I don't think anybody needs to have to feel, or go through what we went through," Ashley Dobbs said. "It crosses my mind every day. It's humiliating."
After searching the entire car and finding no narcotics, Farrell then administered a DWI test which Dobbs passed, the lawsuit said. The women were then issued warnings for littering and released at the scene.
The lawsuit goes on to say that a bottle of prescribed Hydrocodone was missing from Dobbs' car and purse after the search. The women returned to the scene of the traffic stop the next day to search for the medication, but it was nowhere to be found.
Their lawyers say the search was illegal and a complaint about it was filed in August but that DPS Texas Rangers who investigated the incident took no action.
"This is outside the constitutional grounds by a mile. It's not even close," attorney Scott Palmer said. "This has to stop. These two need to be stopped. There's no telling how many other people they've done this to and we hope that others come forward."
Attorney Charles Soechting, Jr. said his father was a DPS trooper and he has great respect for the agency. "But in this instance they have completely failed the citizens of Texas," Soechting said.
Soechting said a records request to DPS produced no policy that allows for cavity searches of any suspect in public.
"What we're dealing with is a Class C Misdemeanor. It does not justify any type of pat down, let alone an invasive search of cavities of women,"” he said.
Calls for comment to the DPS Austin headquarters were not returned Tuesday.
The women are requesting a trial by jury and are asking for unspecified, compensatory and exemplary damages and interest as well as recovery of attorney's fees and court costs.
The Dallas County District Attorney's office tells NBC 5 it has received the case and will refer it to a grand jury in January.

It will be a travesty if these officers are not disciplined and these ladies are not compensated substantially. It is obvious the officers overstepped the bounds of their authority. Getting a whiff of marijuana is no reason for publicly humiliating the women. There has to be something else behind this, or these two officers are completely deluded by their own self-importance.
I don't know about the body searches, the courts will have to make those determinations, but I'm damed happy to see they were pulled over for littering. People seem to think that the roads are their garbage dumps for someone else to clean up. If they suffer from public humiliation it should be because they were too damned lazy to put their car trash in a garbage bag and put it into a trash receptacle. I can't see where their butts could be any more publicly engrossing than the innumerable butts available on the internet, beaches, and adult entertainment emporiums, but thats for the court to determine. As for more public liter and trash however, we need to see far less of that. If you're too lazy to clean your car out into a garbage bag, what other forms of social insensitivity do you suffer from.

You are hearing one side of this issue. If the officer(s) have a reasonable belief that there is something illegal going on, then they have the right to take the investigation further. You can see by the transcript that the officer is questioning them about the smell of weed and he is making it clear that this stop has gone from a misdeamenor littering stop to something more. That being said, after an initial pat down, the two women should have been taken to the station and further searched if that was deemed necessary. Doing it in public is BS.
The other thing escaping these two women is this, if they hadnt littered to begin with, they wouldnt have been pulled over to start this whole chain of worthless events. There will be no winners in this one. Not by a long shot.
My condolences to these women for what they went through. From personal experience, I know body cavity searches are one of the most degrading, humiliating experiences a human being can go through, and it can be physically painful or leave you bleeding if you are at all tense or nervous.
I can't imagine why, with all the technology available today, can't they come up with some sort of x-ray wand so you can be searched without someone having to physically touch you. the constitution prohibits against unreasonable search and seizure and this was definitely unreasonable. Although this is small consolation, at least these women had a female officer do it--it's much much more psychologically humiliating and physically traumatic when a male does it--and having someone else watch is atrocity.
The sooner Tex-ass secedes, the better for the rest of us...

Cigarette butts are biodegradable and therefore not littering, fire hazard yes, but littering no. Just a couple of pervert cops that like to dominate people. Fire them and they can never work with another law enforcement agency ever. Then make sure that they can never have firearms again. Rule #1 remember cops only look for things to get you in jail. why would you want to assist them to put you in jail? always say no to a search.

What an interesting week....2 cases, Both in Texas; the first an officer who gave a motorist $100 to pay for his vehicle registration so he would be compliant with the law and now this. Apparently the "community" isn't too concerned with the body cavity contents such as bottles full of urine, disposable diapers, and whatnot that is along our highways and byways, to be picked up by people who have the decency to volunteer to keep our outdoor community pleasant, and environmentally secure. It's not just cigarette butts, bottles, fast food wrappers, and an occasional empty lip gloss container. It's anything from poisons and dead pets to appliances. It's up to the courts to determine if littering is worth a traffic stop, and it's up to the taxpayers to give lazy people millions of dollars for doing so. Littering is littering. If you want to dump your ashtrays out for people to enjoy, you have a perfectly good living room floor to do it on and to invite them over to see.
People, you needs to know your rights. This search was completely unconstitutional. The officers should be fired or have to take an extensive civil rights college course.
A similar thing happened to me when I was 17, thank goodness I wasn't strip searched though. I was pulled over for having a tag light out. I had a few friends in my car at the time. The officer said he smelled alcohol and that was his reason for calling a K-9 cop and pulling me out of my car. At the time, I didnt know exactly what my rights are. He proceeded to search me and my car. There was no open container nor any other form of alcohol on my persons. I ended up getting arrested on vulgar assault on an officer and spent the night in jail.
I got myself a lawyer and went thru the same thing these ladies are doing. I didn't sue but more of a harrassment issue. The arresting officer was a joke. He was one of my baseball coaches in HS and his younger brother was in my high school, a cpl grades under me. The officer's brother would tell him things to help him make a name for himself. What a Loser!
Not only did I get my charges dropped, I also had a harassment charge put against the officer. He pulled my over for an inspection violation. He illegally held me at the scene waiting for a K-9 unit to arrive with no probable cause except for the smell of alcohol. The officer made threatening remarks about strip searching my there on the spot, which was a busy highway during the evening. Nothing was found on me nor in my car, no breathalyzer test nor field sobriety tests were conducted.
I find that a lot of cops tend to over step their bonds. You have a constitutional right from illegal search and seizure. Law enforcement officers require a search warrant to search your property (house, car, your persons- pockets or body). If you haven't committed an offense that requires your arrest, the officer has no probable cause for search. An officer may pat you down for weapons (for their safety- LOL!) but they cannot reach in your pockets for any reason, let alone a cavity search. Never consent to a search. Once you say yes, they can search you and your property. If you invite them into your home, that is considered a "Yes" to consent for search, so don't invite them in either unless it is necessary. If you are patted down and the officer asks whats in your pockets, as long as its not a weapon, you don't have to tell them.
Given this, there are officers out there that may just wreck your day. A lot of them don't really know what they can and can't do. Some think that they can do whatever and may give you a hard time. Stand your ground and don't give in, even if they threaten to arrest you. You may be able to ask for their supervisor to be present.
What happened to these poor ladies was absurd and horrific. They have a really good case here. I wish them the best. The best advice that I can give would be to stay out of trouble and don't do anything illegal. Good Luck on that!
The entire "I smell pot." or the ever equally popular "I smell alcohol." is the catch all phrase said very very loudly for the dash cam so the officer can usually fake probable cause. It's complete and total BS most of the times it is stated. They are simply establishing an excuse (lie), on audio and video record, to search your vehicle or your person.
One of the issues here is that even if these officers are 'disicplined' and or fired, it isn't enough. Even if the women get a settlement it isn't enough. They, the officers, need to be prosecuted, arrested, fined, and jailed. Only when we start holding both Police Officers and Prosecutors to the same laws, we 'common' people follow, will the situation ever correct itself.

Well to start of the cop had a cold and was all stuffed up. I have know these ladies for many years. These cops are crooked and if you U Tube that cop Ferrell, you will see that he has done this more than once and there is anoth video where he threw a man on the ground for no reason. I am so proud of them for standing up and telling everyone so no other female will ever have to go through this kind of abuse.

What is really scary is that this practice is probably wide spread in Texas...these "police officers" acted like this blatant invasion of privacy and illegal search is standard procedure, something they do on a regular basis, but people have been too embarrassed and mortified to come forward. Thankfully, these women were not too intimidated to come forward and expose this outrageous abuse of authority. Let's just hope that the Texas judicial system is not as corrupt as the state troopers, and these two are punished to the full extent of the law to send a message to the "good ol' boy" network that this won't be tolerated. Who knows how many people are languishing in Texas prisons for years due to illegal searches and antiquated, primitive drug laws that result in multi-year sentences for possessing a small amount of marijuana. My hair stands up every time I see a cigarette butt or other rubbish flying out of car window, grubs they are, but to subject them to a body cavity search is a bit too much and unjustified. I recall last year, wildfires in Texas caused tremendous damage and lives were lost, properties destroyed and huge areas were affected by raging blazes.
A more appropriate way to “penalize” rubbish chuckers would be to get the state authorities to provide a $ cost of property damage caused by wildfires and work out penalty fines for the cigarette butt chucker’s in particular. No doubt they would think twice before throwing anything out of the car next time.

I'd act surprised, except that I'm not. Ever since they locked up a bunch of people for selling white powder that was later identified as sheet rock and almost every suspect claims they had no knowledge of it, this isn't a surprise.
I live in Texas. I love this state. But, honestly, these kinds of things happen everywhere. It's a country-wide problem, so please don't hate on all of us Texans, lol.
I went on a night ride with an officer one evening because I was interested in serving as a police officer. I asked him about marijuana and how they handle situations of illegal drugs. He told me that there could be a small amount, or paraphernalia and what they do at that point is write the offender a citation. That offender goes to court and pays a fine. the stuff is confescated of course and booked in as evidence. We actually pulled over a car that had a couple pipes and some marijuana. The officer did exactly as he told me they do. With this mentioned, I can say that these troopers definitely give other officers a bad reputation.
Now, in this incident, I know this highway as I have gone to the Casino in Oklahoma too. The troopers are usually on highway 161, 75-north, and 35-north. The state troopers will pull you over for anything. If you go to the casino, be on your best behavior and make sure all lights work on your car, etc.
Here's what's so wrong with this whole thing.....how in the world are two women going to hide weed in their cavities, in the time that a trooper pulls them over? And really, if this search were legal, the troopers should have taken the women into the station and have them cavity searched.....had they been under arrest!!! I have a brother-in-law, he has to do the cavity searches on inmates who have been caught with illegal drugs, or if they are known to be dangerous and repeat offenders. He works with the males, but he hates having to do that part of the job. Any officer, doing this in front of a camera, outside for anyone to see this, is doing this to get some type of perverted high!
I support our law enforcement all over this country, but this is highly uncalled for. Citizens deserve respect and we don't deserve to feel intimidated. It's like the lady said, what choice did she have? Because these troopers, as sick as they are to rape these women on cam, who's to say they wouldn't have tazed these women out of pleasure too?

first of all, a CAVITY search means examining the internal parts of the anus or vag. area. This search seems to be an underwear search which is not pleasant but hardly a cavity search. The cops stretched the law but i don't think they actually broke it. They did not need to go so far. This is another example of why we need to legalize marijuana.

Yes the smell between weed and cigarettes is a completely different smell, so a non smoker (who has a generally much better sense of smell than a smoker) should easily be able to smell the scent of either on a person and be able to tell the difference.
Even tobacco can smell very different based on what type it is - as a Camel and a Marlboro have enough of a different smell to be able to tell them apart from each other, so in premise it's very possible that the cop could have smelled a bit from the boyfriend's use earlier in the day, but as many others have said this is just too easy a line to lay down (untruthfully) so that you can claim probable cause.
Cops need to have lie detectors permanently affixed to them while on duty, so that alongside the dash camera recording are his full biometrics - some would be able to fake it, but even those would be less likely to lie about a simple pull over. They'd lose the "sport" of being able to f with innocent citizens because they were bored, and that would be better for all. Some people did go into police because they wanted to be able to order people around, and they weren't management material so to speak - and sadly that ruins it for those who got into it to actually serve the community.
As to the female officer, she really did screw up that cavity search. As another poster mentioned - you MUST follow the order of pink then stink - not the other way around or you're putting fecal coliform and all sorts of other nasties right into her box. And when going from one woman to the other, she also needed to change gloves - what if the aunt had herpes and it was transmitted to the niece by the filthy glove that had just been in auntie's warm spots. Stupid cops...
The two cops were asked for their side of the story and refused to give it. That pretty much settles it. If they had a reasonable reason to do what they did, they'd talk, but they're not. We know why they did what they did. 'Nuf said about that. Now, here's what needs to be done. The police department must pay the victims of this sexual assualt a whole bunch of moola dollars since it has within its employ two people who are sexual assualters. Second, the two officers are fired. Three, the two officers are charged and arrested with sexual assualt. After they're found guilty (the female officer at least), they are sentenced to prison for sexual assualt. Four, they are sued for sexual assualt and everything they have is turned over to the victims. End of story.
And, again, let me reiterate, they were asked to give their "side of the story." They won't. We know why. 'Nuff said about that. Let them all now pay the price.
Wow, I cannot believe what happened here. These two women were physically violated "IN PUBLIC" because some NAZI police officer just THINK he smells something. While I know not all cops are this bad, this one, and the female officer should be not only fired, but put in prison and given those same cavity searches that they like to do so much. I would really like to know how many of those they have gotten away with. While I am sure that they may find drugs in some of the searches, what they are doing is totally violating the constitutional rights of their victims, as well as assaulting them sexually. Unless you are under arrest, a cop has no right to search your person, and then, and I do mean only then, may they do a body cavity search and it must be in a private location. To do this on the side of the road is a crime, committed by the people that we are supposed to trust to follow the law.
Unfortunately, I have heard many of these types of stories from many states like Texas that don't believe that people actually have rights. This is one of the main reasons that I have never, and probably never will go to that state. I would be more than happy to give it back to Mexico, as it is so full of their citizens illegally residing in this country anyways.

Police arrest people for indecent exposure for going off the side of the road into the trees where no one can see them to urinate, then her they are pretty much exposing these women on a busy highway on the side of the road? If they really suspected these two women were hiding something, then they should have taken them to the police station to conduct this sort of search. But, it seems as though that would have involved paperwork and I think that is exactly what these two officers wanted to avoid.

My 6 fellow troops and I were riding in a van going back to base after a church service. Got stopped by CHP who made us all get out of rented van. He crawled around in van and found what he said was a marijuana seed. Being such a 19 yrs old country bumpkin at that time I never had even seen pot or knew what a pot seed looked like. So this CHP calls for back-up and a local Sherrif deputy responded some 10 minutes later. It was about 10 pm in the evening. The CHP made us all line up and told us to drop our pants and drawers in front of the van facing the road. He was getting a good look when many sets of head lights came down the side road we were coming from the church on. The CHP started yelling "pull your pants up." We instead just stood there as a long line of the cars coming from church sevice passed by each one bathing us in theoir headlights and we are all standing there with our pants and GI issue underwear around our ankles. Some of the cars honked as they went by. The CHP was livid then the last two cars happened to be first the Sheriff's deputy the CHP called for back up and the last car was the church pastor. The Sheriff deputy was cracking up, but the CHP was berating us for not pulling up our pants and was threatening to take all of us to jail for indecent exposure. The church pastor asked what was going on. The Sheriff's deputy looked at the so-called pot seed and told the CHP it was not a pot seed.
After the Sheriff's deputy, CHP and pastor had a little conference the CHP jumped in his cruiser and tore out throwing dirt all over and took off. The Sheriff's deputy came back and told us to be on our way. The pastor invited us back to church services the next Sunday. I served as a fed LEO for 9 years and never did more than a weapons/contraband check frisk of males I had arrested. If a female was to be arrested I called a female officer in to do that. She used latex gloves and in most extreme ran her hand down the front of underwear, bra if the subject was wearing them. Searches were with clothes on. Bodily cavities searches were never done out side of holding facilities. Some cops love to humiliate civilians whenever they can. I was trained to only search someone that has been detained and handcuffed if the subject agreed to be searched. After they are arrested it is common procedure to search them prior to putting them in vehicle for transport. Even then I had found contraband stashed in my patrol rig but never a weapon. Wonder what would have happened if these Texas cops would have pulled over GDUBYA's wife and daughters and did the skin and soft tissue finger probe searches on them?

The way I see it:
1. It was inexcusable to do that to those woman. Enough said there.
2. Don't litter, or give cops any other reason to pull you over. Generally of a cop is looking to pull you over, they'll find a "reason" to do so if you give it to them. This goes for all things, not just this unfortunate incident. I'm not even talking about body searches, which I have never heard of being done right on the highway like that. I'm talking about anything a cop might suspect you of, from drunk driving to smuggling and more. If you do something minor like run a yellow light or litter (for example only), they can use that as an excuse to pull you over and check for other things they may be more concerned about but don't have evidence for like drunk driving or drug trafficking. AND IT IS PERFECTLY LEGAL FOR THEM TO DO THAT SO LONG AS THEY DON'T TAKE IT TOO FAR.
3. Let me just say that if you are going to smoke, please don't throw your cigarette butts all over the place. That is disgusting. Not all smokers do this, but far too many do. It isn't hard to just put them in a bag or something and throw them away later PROPERLY when you get the chance. I'm not saying don't smoke (although health wise I would advise against it) or anything. That is your right. But please don't litter,and especially not with cigarettes and that sort of thing.
4. It still doesn't give them the right to do that to them. What I said in # 2 and # 3 is true. But again, it still doesn't give them the right to do that. Again, I have never heard of full body searches right on the highway like that. This is just wrong on so many levels. I really wish people wouldn't throw cigarettes out the window like that, but it still doesn't warrant what happened to them. And as far as I said about number two being perfectly legal so long as they don't take it too far: THEY TOOK THIS WAAAAY TOO FAR.

In that video in the link you left, the guy was a complete jacka**. One thing I would advise against doing is antagonizing a cop. Nothing happened in the video you left a link for except him being difficult. Generally, if you answer the questions straight and forward and they have no reason to stop you, they late you go. There is no reason to hassle like that. Occasionally they might suspect you of something in which case they go into vehicle checks. After that, if they still aren't satisfied (which is rare) they generally ask you to come to an area for questioning and such.
This incident that happened to these two woman had nothing to do with the video you linked us to. It was just a guy being a jerk to get his 3 minutes on YouTube. And the last thing you need to do is give a cop a reason to suspect you. I have some friends who are cops, including several who have worked or are working in an airport. I don't know how many stories I've heard of people who would have normally just been sent on their way, but weren't because they gave the cops (or other security agents) a hard time. This incident with these woman was inexcusable, but generally things like that don't happen. And when and if they do, you get a lawyer and sue. And again, it has nothing to do with your video.
Medical problem: A serious infection can result if feces from a person is put into a vagina, even a little. These can result in urinary tract infection or damage to the reproductive organs. If one of these women had been pregnant, it could have killed an unborn baby too.
The there is the medical problem of transmitting possible diseases from one woman to the other, because the gloves were not changed.
Psychological problem: Any body cavity search had better have an extremely good reason. I would only allow a doctor to do it as part of a health exam. Any force of a body cavity search of that area is sexual assault, and violence, and gross violation of their privacy. Exposing these women naked in public is also a gross violation of their privacy. Doing a body cavity search in pubic is like being raped in public: anybody could have taken a picture of them.
Legally: This should be a criminal action before it is a civil action. These police officers were also performing criminal acts while in their uniforms and on duty.

I have friends who live in Texas, because they own land. These are nice people, and they ignore the politics. I don't know if I would be able to do that. She (cop in your video) was just asking him (jacka** in your video) a few questions and likely would have originally just sent him on his way. I'm all for standing up for your rights. But in your video none were broken.

Cops have a right to question you. It's ridiculous to think otherwise. The cops don't have a right to do what these ones did to those woman. But what that guy did in your video was looking for trouble. What I'm saying is that a cop can legally detain you if you give them reason. And most don't go too far like the cops did with these two woman. The guy in your video gave the cop plenty of reason to do so (by being difficult) had she wanted to. Generally, it is better to simply answer the questions straight and let them move on to someone else. It goes a lot easier for everyone that way. But of course then you can't put it on YouTube.
The cop should have given them the DUI field sobriety test and then determined if they were under the influence of alcohol and/or drugs and then taken them to jail if they flunked the test. If they passed then they should have let them go. On the other hand the girls probably thought a cavity search involved checking their teeth.

Where Homeland Security is concerned--any branch or division thereof--national safety is paramount. The different divisions of Homeland Security (Customs and Border Protection, or CBP; ICE, USCIS, TSA, FEMA, the Secret Service, etc.) pretty much have unilateral authority to perform any act which may protect national security.
The Office of Civil Rights and Civil Liberties is now part of Homeland Security, as is the Office of Legislative Policy. Hence, employees of the various divisions of Homeland Security has the authority to search yourself, your property, etc. without informing you of their reason. They can also 'arrest' you without having a chargeable reason--it's called 'civil detention'.
Although the letter of the law says they can only detain you for 24 hours, and after that they HAVE to charge you with something/arrest you or let you go, the law has been ignored at will by certain authorities.
You can be remanded to an authority's custody without being arrested. It's called 'civil detention'. While this has in the past been limited to no longer than 24 hours, cases are popping up of people held for longer periods.
I was civilly detained for three years when USCIS lost my adoption paper. I was internationally adopted as an infant, never told before my parents passed away in a car accident, so when ICE came to me asking for a copy of the adoption decree, I couldn't give them one since I never knew.
A missing adoption paper is not an arrestable crime, and I had a valid, legal SS Card , DL and my birth certificate (issued after my adoption decree was shown to a judge) showed Dad and Mom as my legal parents. Those documents were, however, not acceptable as proof that I had been legally adopted so I was civilly detained (but not arrested since it wasn't a crime for me not to have my adoption paper, wasn't a crime for me not to know I was adopted, and it wasn't a crime for the government to have lost a piece of paper.)
Since I was abandoned as an infant at an international orphanage overseas without an accompanying birth certificate or other documentation saying where I was born or when or to who, there was no 'home country' to deport me to, so I was simply told I would remain in civil detention until I gave them a copy of my adoption paper. The strip search and body cavity search administered immediately after that pronouncement was one of the most embarrassing, humiliating, degrading experiences of my life to that time--I was 18, and a very sheltered private-school bookworm only interested in my books and my painting, so this was a huge reality check for me.
The deportation camp I eventually ended up in was in Texas--the Willacy processing center in Raymondville, a privately-owned for-profit deportation camp that Human Rights Watch called 'Ritmo' because it reminded them of Guantanamo Bay. There was little supervision, the guard could do pretty much whatever they wanted, so there were random strip searches and body cavity searches (especially of the 'Female--18-25' pod) and we didn't have the right to ask that a female officer do the searches--whoever was available did them and it was always guys. There was one guard we all hated that would stick his fingers into us, say that he felt something but it was too far up for him to reach, and call his buddy over to stick his fingers in us too. If they decided they still 'couldn't get it out' we'd be taken to the infirmary, put up on the exam table and a doctor would open us up to 'have a look' and the guards would stick around as 'witnesses to contraband discovery.' Of course they never found anything, but as I stated in post 1.11 above, having people watch was...atrocious.
This was also the same guard who, when bored, selected one of us stateless ones (stateless=having no country, and therefore no rights under any country's laws anywhere) told us to strip, made us kneel and pointed a gun to our heads while giving us a lecture about how we were a waste of air and space, and pulled the trigger--on an empty gun.
After the first few times it happens to you, you get used to the idea that it was empty and they were just trying to scare you...but there was always the fear that one day there might be a forgotten round in the chamber and you would die, and we all knew no one would ever know about it--your death would end up as a fine-print statistic on the back page of a prison report and no one would ever know or care what happened to you. Most of the deaths in the deportation camp were never reported, families or relatives never informed, bodies put in cold storage for a short amount of time then cremated and ashes sent to a landfill somewhere. After all, we were stateless-no laws applied to us, we had no rights anywhere, since we didn't officially exist as citizens of any country.
(I did eventually find the adoption paper--took three years of writing to every courthouse in every state we'd ever lived in to find it, but I did eventually find it and my citizenship was restored and I was released.)

And if you say something to a cop that may make them suspicious, they have every right to stop and question you. They don't have the right to do what they did to those woman. This story the article is about is an example of cops going way beyond the bonds of what they are or ever should be allowed to do. However, cops do have the right to do vehicle searches and stop and question you, particularly at checkpoints. I don't see how or why it is so hard for you to understand the simple concept of security.

But in Debi's case, it's less about understanding the concept of 'security' and more about the Constitutional right of freedom from unreasonable search and seizure. The Fourth Amendment states:
The keyword here is 'reasonable.' The root of that is 'reason', meaning they SHOULD have a reason to search you. Yes, they can stop you at a checkpoint, but unless they have a REASON to do so, US citizens (i.e. 'The people' as set forth in the amendment above) are exempt from having their houses, vehicles, and persons searched without probable cause. If Debi is carrying her passport at the time of the stop and displays it to the officer,she's proved she's a citizen and is entitled to Constitutional right against unreasonable search.

Perhaps we need to remember that the event related to these two women happened on the side of the road so that anyone passing by could see. No man or woman would want to see their child or spouse treated in this manner, regardless of the political affiliation. It is against the law to conduct such searches in public--not in airports, bus stations, train stations or any other public venue! For any person to be given cavity searches in such a condition would be an outraged and the victim, regardless of gender, would be powerless to do anything at the moment, similar to what these two ladies experienced. This event evidences the worst of humanity, to publicly humiliate another simply because of positional power. Remove them from this power as they are not worthy to call themselves officers and protectors of the public!
Marti - I think you need a history lesson. The 2nd Amendment DOES apply to individual gun ownership. Unless the citizens have a way to defend the Constitution, it isn't worth the paper it is written on. The Founding Fathers placed that Amendment in the Constitution specifically so the other rights could be protected.

The facilitation of a crime is the same as doing the crime. Never mind the fact that it was the male officer who ordered the search and then stood and watched, no doubt getting his jollies. He can be charged with facilitation, conspiracy and rape, in the same way that someone who commits a felony can be charged with murder if a death occurs doing the commission of the felony. Something I can't help thinking about: When someone murders a cop, the punishment is higher supposedly because of the threat to public safety it causes. So when bad cops give the public a reason not to to trust the police, shouldn't that be seen as at least as damaging to public safety? Shouldn't the offending officers get stiffer penalties for their misdeeds? And yet, these 2 will most likely get swept under the rug with half-hearted talk about how "their many fine years of service" somehow makes them deserving of a lesser punishment.

This just shows the ignorance of most of society and as I read these comments I just laugh. The trooper clearly stated that they smelled marijuana. This established probable cause for the troopers. Their actions are not a violation of the 4th Amendment. Florida has the exact same law to establish probable cause which is called "the plain smell doctrine". I love how everyone automatically sided with the women suing just because she did not like the procedure of the troopers. What I hear in this story is basically this woman whining because she did not like being searched. Nobody likes being searched, but what is hilarious is she does not deny the smell of marijuana just that she had no knowledge of any marijuana being in the vehicle since it was not her's. This tells me that the trooper probably smelled marijuana. If she had a lick of common sense she would have told her boyfriend to clean his car and get that smell out of it. Who she should be mad at is her boyfriend who is probably a pothead! Maybe she should use better judgement. There won't be a check written here, this is standard procedure. The troopers did a good job. Here is my caveat, if you dont like being searched then don't leave your vehicle smelling like marijuana or let people smoke marijuana in your car. Under Texas Law there is a Skin Deep Clause, which states that at the road side the only search which is permitted is a pat down of the body or a visual inspection of cavities (No touching), if further suspicion is suspected and a cavity search is deemed necessary then an arrest should be carried out and the individuals taken to a PRIVATE room, with two members of the same sex present including a medically trained officer to perform the cavity search.
The Texas Supreme court also made note that if police officers suspect evidence being hidden in a body cavity that the evidence would still be present on arrest and further investigation by trained professionals.
They got searched..on the road where any one could see. I could MAYBE see it if they took them to a police station and searched them, But no one shoves weed in their bits and pieces.

To add I am pretty sure a visual inspection of the cavity openings cannot be done at the road side. I suspect it must also be done at the station however I am not totally clear on this point of law. I'll do some digging if anyone is interested.

I have a nephew that is on the drug task force. He said you are stupid. That just smelling what you think is marijuana is not a reason for search. That if an officer thinks he may smell something he is to call in the task force with drug dogs. According to him there has been too many cases where other things smell simular and good policemen get sued. Also, he has stated there is never a reason to do a cavity search in the open beside the road.

These ladies are American Citizens on American Soil. Not only were their rights violated, so were their bodies. There are procedures to be followed and these officers went from step 2 to step 18. If the officer smelled something suspicious and consent was not authorized, he should have called for a K-9 Unit, not for a public strip search. If the dog hit the car for drugs, then arrests can be made and searches conducted in a suitable environment, not road-side.

Law enforcement run amok. I hope they prevail in their lawsuit. The women were littering, which is a violation and warrants an appropriate fine. However, the stop should have ended there. Since no marijuana was found in the car, the male officer was obviously lying. He had no grounds to conduct a search of the vehicle let alone the women in the vehicle. How does the law enforcement community expect us as citizens to respect them as lawmen when they pull this stuff? I *used* to respect police officers. Now, I basically keep my mouth shut around them because I don't trust them. Period.

I live in Texas and you are allowed to have guns in the car. You were always allowed to have long guns (rifles and shotguns), but two or three years ago legislation was passed allowing handguns in the car too, without a CHL. I do have a CHL and have been stopped two times in as many years for speeding and the cop, both times were DPS. Each time I was asked if I had a gun, I said "yes" and he asked where it was, I told them in the console. He said "leave the gun in the console". I got a verbal warning for speeding once and a written warning for speeding once.
Note to women in Texas, carry a gun in your car, the police will treat you with more respect!

Constable pct 5 Troy Morin pulled me over in Houston, TX at a drive through ATM because he said I looked suspicious and proceeded to search my vehicle without my consent then jailed me and towed my car because he said he saw me stop and pick the female up and that I stopped in the middle of the road obstructing traffic. He later denied these facts in court and my traffic ticket was dismissed but not after being violated. They are lying pigs. I hate cops and spit on them all. I am moving to Mexico where I feel more free then this land of the free and will spend all my Veterans Affairs Disability income to help the economy of Mexico and not the U.S. I hate the U.S. though I served in combat for them and was born in Colorado.

This sort of thing happens in other states besides Texas. I am a Texan and I hate to see crap like this in Texas, that is for damn sure. I think the main cause of this type of problem everywhere is the hiring of poorly educated and trained police officers. I will say that the Texas DPS is one of the better trained police organizations in Texas, and I think Texas has as good or better LE than the other states. We need improvement in police respecting peoples rights everywhere.
It has nothing to do with their poor educations or poor training. I'd say they were well trained: they'd been trained to claim they smelled marijuana as a pretext for a search. Is there any evidence there actually was a marijuana smell? No, it's not education or training. It's the law enforcment culture that's the problem.

When I first moved to Texas, I lived in Kingsville. My boyfriend was in law enforcement so I met many officers. I overheard some conversations between law enforcement that surprised me. This is standard practice in Texas. At that time (10 years ago), the Drug Task Force in Texas was the most effective one in the nation. Officers from other states were routinely sent to Texas to learn the methods that made Texas enforcement so successful and this is how they did it. Any time there is a traffice stop, if the officer thinks there is the slightest possibility that there may be drugs they use the 'acting funny' card to justify a search. There does not have to be any concrete evidence of wrong doing. They will often take the person to jail on a DUI charge, if they make a fuss about the search, based on the 'acting funny,' even if they can pass a field sobriety test. There are not many things about Texas that I do not like, but this is one of them.

I'm certain this is all about the money they expect to get. Their attorney is hot for his 30%. I would be interested in knowing more about these women. Are they working? Do they have kids? Do they have husbands? What was the woman on hydrocodone for? How about a urine test on the women...would they have been willing to do so? This is too much about "outrage" and "humiliation" against a group with deep pockets for me to take it more seriously.
This is not to mean this search was not out of line, but its also not worth the million dollars they will probably sue for.

I'm having trouble reconciling the idea that anytime someone sues the 'deep pockets' the suit is without merit and the other side of the coin that says rich people are all lying, cheating weasels that will do whatever is necessary to make a buck. This was about money to the cops as well. Drug busts are big bucks for law enforcement what with property confiscation laws and what have you. I'd be more interested in seeing a fiscal budget for the department than a marriage license for the victim.
As a former police officer, I am appalled at the behavior of these DPS officers. The pat down of a suspect is allowed only when the officer is in fear for his safety. An officer cannot search a vehicle without a warrant or a consent to search signed by the owner. Only upon an arrest can an "inventor" be done on the vehicle without a warrant. Cavity search on the side of the road? No drugs were found, no weapons, no threats, but pull down your pants and open wide. This is outrageous!!!! This could be your daughter driving back to college or your mother coming home from work. If this behavior is allowed without punishment, you endanger all women in the State of Texas. These officers were not trying to protect, they were amusing themselves with their power. DO NOT let them get away with it.
The officers should get disciplined severely. I don't think these women should be compensated at all. Why do we always have to pay people money?? Our society is sooo sue happy that it's a joke. They should seek justice for the injustice done to them, but not compensation. And you wonder why our society is in such a mess. Lets just sue everybody because I bet someone somewhere has done you wrong. Lets over react to everything and lets make as much as we can for it. It happened in Texas so I guess it makes sense since they once elected George W. Bush for their Governor, oh wait...and the rest of the country elected him to the Presidency, TWICE!!
Why should they get money? Because they reported this to the proper authorities and nothing happened. So you make them give you a lot of money and the next time they pay attention. Money talks. If they get enough, they can get the hell out of Texas and move to a state that still believes in the Constitution.
I think this incident is a good example of why pot should be legalized. It's absurd that the two women had to go through that experience merely on suspicion they had some marijuana in the car. The cops should be out pursuing drunk drivers, rapists, murders and burglars. Instead, they spend all that time harassing two women as if they were hardened criminals.
It's true, some cops don't deserve the authority they have. Some people get a badge and a uniform and they act like they can bully people and harass them over little things. I guess these two cops felt they were earning their pay. For throwing butts out of the car they should have gotten a warning, not a cavity search.
I remember a bullying incident by cops when I lived in Santa Fe. An elderly gentlemen with a good reputation went to a nursery and bought some marigolds in little planters. He had them in the back of his station wagon in clear sight. Two dumb local cops got it into their heads he was transporting marijuana. He got out of the car and tried to explain, but one of the cops roughed him up and threw him against his vehicle, injuring his shoulder. He sued the city for this abuse - and yeah, the plants were proven to be marigolds. When the cop in question heard he was suing, he actually called up the man and made threats against him.
Anyway, why should these ladies get money? Because local budgets are tight, and having to pay out money for abuses like this will get the attention of the governor and the local authorities. A mere slap on the wrist would be forgotten overnight. That's why they should sue for money. Cops like that we don't need, and can't trust or respect.

Don't see that this is much different than what the TSA does.
Having been strip searched by airport security, I can truthfully tell you this is NOT what happens with the TSA. They do not strip search you in full view of the public; you and all your items are taken to a closed, private room where you are searched by an officer of the same sex with another in attendance.
The search performed by the female officer was in complete violation of the women in this case. There is NO reason for anyone to be cavity searched while traffic is passing by. The male officer should not even have been present for this search; but he was also violating their rights by searching the vehicle without permission. If they said no to his search, he should have called in the drug dog. Then maybe there would have been something to back up his story about there being pot in the vehicle.
As abhorrent as TSA practices are, they don't conduct strip searches in the view of other travelers. They take them to a private room and conduct the search. There's a big difference.

The TSA is still violating your 4th Amendment rights. There is no "reasonable" about searching you, just because you are flying.
I have yet to have a problem with TSA and I keep forgetting take stuff out of my pockets ... that being said, I'd like to see DHLS go away ... that would save some money in the budget ... they have outlived their role ...

You and your male hating ways seem to forget that IT WAS THE FEMALE POLICE OFFICER WHO VIOLATED THESE GIRLS!!! She could easily have refused to do an unsubstantiated search and sent the women on their way. It was the FEMALE cop who violated both these girls without changing gloves.
I hate all cops evenly, male or female. Pinning the blame on one sex and not the other just shows how much you hate men. Place the blame where it belongs, not just on the male cop, but the whole judicial system.(male AND female).

In Utah, the Highway Patrol has been covering up for one of their now fired troopers. She was trumping up alcohol and drug arrests.
The head of UHP, and some lower minions, were aware of this let her continue. The only reason we know about this is the "liberal media" figured it out.
The lawsuits are just beginning. People lost their jobs, time and money because of the UHP's actions and in-actions.
But Utah is a Republican state and, contrary to what Republicans say, they like the idea of a Police State. They will protect and retain their UHP criminals.
