Other Americans have rights besides gun nuts, the right NOT to bear arms and feel safe in their community. like schools, movie theatres, the mall, etc. again, there are other people in this country who have rights also. remember, this is the second amendment, let's not forget the first.

Ban military assault style weapons and ammo. Ban internet sales of all guns and ammo. Mine is this: I agree that it means exactly the same thing EXCEPT the times and conditions BACK THEN are not and DO NOT apply to today. In other words the citizens back then had a valid reason to bear arms since they were the militia and the government didn't have a standing military force to protect this country. Today the government has a standing military force to do the job. Therefore the original intent of the 2nd admendment no longer applies.

First - the vast majority of the deaths in Chicago are criminals killing criminals. (Yes the non criminal kid that goes down to the local drug market to buy drugs and gets killed is a criminal - buying drugs is illegal)

Second - Chicag has some of the strictest gun laws and still the criminals get the guns.

Third - How many of these murders were committed by law abiding gun owners? ZERO......

Fourth - How many ASSUALT WEAPONS were used in these killings? (My guess is Few to None since the press did not make a point about it.)

Fifth - How did the police protect any of these 500 people? Were they there to guard them?

Sixth - STOP BLAMING THE GUN WHEN IT IS THE PERSON BEHIND THE GUN.

Most Americans just do not understand the need of military style guns and ammunition unless you are in the Military! Seriously, if you feel that unsafe in your home then it is time to move or perhaps you can hire the military to stand guard on your property. Spiddas: Great explanation of the 2nd amendment. Liberals (like Richard) continue to try and interpret that the second amendment was INTENDED to imply that ONLY guns used for military purposes are allowed AND that being the case then guns should not be allowed to the private individual.

But there is one MAJOR flaw in that argument and that is when you look at the founding fathers and what THEY said about the 2nd amendment clearly shows that the intention of the 2nd Amendment is to make sure the private individual DOES have access to guns.

For example Thomas Jefferson helped write the Constitution AND the 2nd Amendment and here are some comments he made about the 2nd Amendment. And for people like Richard see if you can tell if he meant GOVERNMENT militia or "the people":

1) "The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government."

Boy THAT quote should be enough to tell but let's look at some more:

2) “Laws that forbid the carrying of arms...disarm only those who are neither inclined nor determined to commit crimes... Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.” (Quoting Cesare Beccaria)

In this case Thomas Jefferson was quoting another but clearly making a point.

3) "The beauty of the Second Amendment is that it will not be needed until they try to take it."

Who do you think Thomas Jefferson was talking about when he said "they"? The people? No, only government could take away a right so "they" meant government and what he was saying is that the people won't NEED the 2nd amendment until government tries to take it away and the PEOPLE must fight against the government.

4) "The two enemies of the people are criminals and government, so let us tie the second down with the chains of the Constitution so the second will not become the legalized version of the first.".

Not related to gun control but Thomas Jefferson did not trust government at all and is related to #3. He was a firm believer that the people must be able to defend themselves not only from criminals but from the government itself. Which is why he also made this comment:

5) "When the people fear their government, there is tyranny; when the government fears the people, there is liberty."

And finally:

6) "Those who hammer their guns into plows will plow for those who do not"

Which means those who give up their guns will find that they are subservient to those who retain the power. In this case government.

The one thing Thomas Jefferson knew was those countries who took power away from the people ultimately took the freedoms and individuality of the people as well. So Thomas Jefferson was specific when he stated the PEOPLE have the right to keep and bear arms if for any other reason than to protect themselves FROM government.

So this whole argument that "militia" in the 2nd Amendment means the GOVERNMENT are the only ones allowed to own guns only comes from illogical and unintelligent individuals who do not study history nor the founding fathers.

Ban military assault style weapons and ammo. Ban internet sales of all guns and ammo. I am a gun owner who believes in the second amendment, but, believes military style weapons belong with the military, not civilians. where does this all end? when we can afford bazookas to hunt down bigfoot? should we be able to keep suitcase bombs and missles in our homes? seriously? where does it end?

The military doesn't need military style weapons, they already have military weapons. These "assault weapons" you want to ban, only look like military firearms. They are not fully automatic and they do not fire in bursts. One trigger pull, one bullet. Nothing on them makes them more deadly than any other semi-automatic rifle. The round that a Bushmaster rifle uses is .223 caliber. A common deer hunting rifle uses .308 caliber. The .223 round is smaller and less powerful. If you want to ban the Bushmaster, you might as well ban deer hunting rifles too.

For informational purposes, I can take a Ruger 10/22, a .22 caliber rifle, made before 1994, and put it in a polymer body with an adjustable stock and it becomes, by definition, an assault weapon. Does that seem right? Surely something as minor as being able to safely adjust the stock for a proper fit into your shoulder can't possibly mean it's an "assault weapon". Indeed it does.

You are using the First Amendment like a gun to demand removal of the Second Amendment. Who are you to decide what or how many guns we should have? There are people that collect knives, some collect cars, some people collect fancy plates, and for some reason, some people collect creepy, smiling clown faces, some people collect guns.

Semi-automatics are the most popular and prolific type of gun in the world. If you ban them, you do mean the police would not be allowed them as well, right? The Supreme Court ruled that the police have no obligation to protect the citizens. Police carry guns for self-defense. Their defense, not yours. If you want to ban semi-automatics, you remove the ability for every citizen to defend themselves from the criminals who definitely will not be getting rid of their banned guns. I don't know what you mean about conversion kits. The only conversion kits that I am aware of are legal ones that will allow you to convert an AR-15 or handgun to a .22 caliber.

The damage is done when the bullet expands or knocks around inside the body. A rifle round typically would go straight through at close range, causing damage more akin to a being stabbed with a rapier.

In 2008, the Supreme Court held that the Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home.

The real problem is finally identified by someone other than me...the Drug War. It's killing 40-70% of the people killed by guns in the USA every year. The reason those gangs kill so many people is because they exist and are funded via the Drug War's propped up black markets. No Drug War, no black markets, no funds from illegal drug trade, no gangs, no 40-70% of gun murder.

By comparison, mass shootings kill 2% of gun murder victims. After the Drug War, the next biggest cause of gun murder is domestic violence...not mass shootings.

You don't fix the Drug War by banning or further regulating guns. You fix the Drug War by ending it and legalizing drugs. A good first step would be full decriminalization of drug use.

The Drug War is more correlated to gun murder, murder rates in general, and violent crime rates than even gun ownership and gun laws in study after study. Where you have a severe Drug War you have lots of violent crime, suicide, and murder. The same cannot be said of gun ownership rates.

I can't give you enough credit for this post. I'm so glad someone else sees the obvious truth in the studies that are available online to us all. I've been preaching this message for a long time now...it's nice to have an ally.

And props to Spidda on his history of the original intent of the 2nd Amendment. It was not GRANTED to us, nor can it be repealed. The Bill of Rights was a short list of important pre-existing rights that are unalienable (not subject to borders or laws), natural (you get them by being a human), and individual (not based on militia or any other group membership, per se - and that includes citizenship). The idea we get these rights from our government, or that they can repeal them, is nonsense, ahistorical, and against all original intent of those rights being listed in the Bill of Rights. Hamilton feared this...that we'd think A) this was complete list of rights, and if it isn't listed we have no claim to it, B) that this quick short list if highly important rights would somehow be misconstrued to mean we could ever legislate on them at all, let alone repeal them, and C) that we'd confuse the government for the granter of rights because of the existence of this list, as opposed to the state simply recognizing these pre-existing rights we get by virtue of our humanity.

Unalienable rights are not negotiable. They are not to be limited by laws or borders. Our govt is supposed to always uphold those rights regardless of anything else, even lack of citizenship. Even visiting foreignors and illegal immigrants have a natural individual unalienable right to life, liberty, property, to keep and bear arms, speech, due process, to not incriminate themselves in court, to not testify against their spouse, to not be searched or have property seized without suspicion, probable cause, and the rest of due process, etc., etc., etc. These rights are not subject to borders or laws. You get them from being human, not from winning a birth lottery.

Enough ignoring the causes of most of the gun murders in this country (and it isn't guns; it's the Drug War). Enough trying to rewrite history or re-interpret intent to fit your "modern" arguments. Enough denial and sophism. It's time to try and save lives by expanding rights (ending the Drug War), not by limiting them further (gun control).

Let me remind you all...during Prohibition of alcohol, where Chicago played a major role, the crime rates went up 78% over the 13 years of that stupid law. They went up over 20% the very first year of Prohibition alone (1920-1921). The year Prohibition ended, in just one year the murder rate fell 40%.

What are we waiting for? More people to die or be thrown in prison like animals for nonviolent "crimes"?

The last ambassador killed in office happened in 1988, (August 17, 1988 to be exact, and was in a plane crash) under George H. W., and before that it was an ambassador in Afghanistan on Valentine's Day in 1979 (which would have been Carter's watch... which by the way is also not GWB)... So I'd love to know where you are finding this information. Mind you, I'm not taking a side here... I'm just curious as to what information you have that the rest of us do not.

The regulations of these things, drugs and alcohol, were put in place in the hope of helping people, keeping them from harming themselves and others in the process of attaining their fix, yet no level of laws have helped because people are people and laws matter little to most. Though it is legal, alcohol still kills a large number of people every year (roughly 75,000--not including auto-related). Though many drugs are illegal, drug overdose still kills a large number of people every year (roughly 34,000 from all drugs--not including violence related deaths). Though they are legal, guns still kill a large number of people every year (roughly 30,000--including homicide 12,000, suicide, 17,000, and accidental 1000). The commonality in all of these things is that the individual is broken. We aren't going to regulate or deregulate away broken individuals no matter how hard we try. Our problem is that our society has moved away from the effort to be good, decent people. If we all wanted to be law-abiding citizens, we could just make a regulation for anything, and that would be enough to stop people from doing wrong, but that's not the world we live in. Unfortunately, we suffer a society-wide moral decay.

Until recently, I was a bit naive and thought that most people were inherently good and all the bad things people did were mistakes brought on by circumstance. If it is true that "most" Americans do not understand "why", that is because of our [lack of an] education system. Without a basic understanding of history, I wouldn't expect anyone to understand why there is a 'need' for these guns. I think it has been repeatedly pointed out that the Second Amendment, of the Supreme Law of the Land, is not about hunting. It is about two distinct things only. The need for the militia, (not the military, as it is a different beast altogether), and the Right of the individual members of the People to have the necessary arms to defend themselves from and defeat criminals, and any potential for tyrannical government invasion or takeover. Like it or not, THAT is what it is for.

And as with any law/document, we must look at both what is says, and what it doesn't say. What it says is painfully obvious to those who KNOW their history, (American AND world), but it's what it doesn't say that really drives the importance of this one, single Right home. Without the trust of our law abiding neighbors, our freedom, security and safety vanish. We must live virtuously for this trust to take place. We are "our brother's keeper". And it is not required for everyone to possess the arms necessary to keep the States and country in its proper condition. Though it is a duty for all capable citizens to be ready to be trained in the event they are called to duty. (Homework: Get a copy of your State's Constitution and STUDY IT! And considering that America is the freest when it comes to personal liberties, I have no inklings of moving anywhere. As a matter of fact and a matter of principle, IF anything was to happen and I would get called to militia duty to defend the State and American Constitution and American way... I'll be here. But considering the level of gun control you, and many weak minded individuals who think like you desire to have, why don't you take that ticket and move to those highly restrictive countries you are pointing out.

Oh wait! In Israel, to become a citizen, IIRC, I believe you would have to do active military duty for something like 2 years if you're a female, and 4 if you're a male. And if you go to "some other Middle Eastern country", if you're a man, you either are in the military or you're essentially an unarmed slave. And if you're a woman... Well you're just a screwed second class piece of property. Yeah, they got gun control there. BIG TIME gun control. The government has the guns, and the control. The world is a brutal place and most Americans don't have a clue as to how bad the rest of the world really lives. In Illinois, we have the "Catch and Release Program". The cops catch them, the courts convict them, and the Governor runs around waving his hands in the air shrieking, "We can't afford to keep them" and turns them loose. A few days later the releases are rearrested and the process starts over again, except for the ones that are shot and killed. As for those that are rearrested it is no big deal, three hots, a cot and hanging with the homeboys watching cable tv till the Governor turns them loose again.

This is where capital punishment comes in. Should be federal law so that local politicians cannot get their pals off.

The mayor should find these criminals fighting over turf put them head to head in a big abandoned warehouse with weapons laying all over the place and tell them the one left standing gets a million bucks and a plane ticket to another country of their choice. I believe no man or woman has the right to decide another person fate unless they were protecting themselves or another innocent from the fate of death. I will always stick up for the unborn child as they need someone in their corner. reeblite, you obviously know nothing of guns. An Ar-15 "assault rifle" only has a .223 caliber bullet...which is quite small compared to many rifles. In fact that is the smallest caliber allowed to hunt deer, for example in many states. A standard deer rifle would often have a caliber closer to .300 or .308 etc. Most any rifle could have "blasted it's way into that school...or shotgun for that matter.

The issue is the higher capacity magazines that come with some of these "assault rifles". The sad part is, people that want to make gun laws know nothing of guns. Many hand guns also hold a lot of ammo, and are a much higher caliber than the Ar-15. A whole bag of these types of weapons would be very easy to carry into a school. Banning guns is not the answer!!!! Educate yourself about the topic of guns before you come up with any more "wonderful laws".

reeblite, not to get too into a discussion as this would be for another day. I believe abortions are okay in terms of rape or health reasons. The facts show that more women are having multiple abortions and are using it as a form of birth control. I also believe that the death penalty should be allowed to people serving multiple life sentences once they are in prison for a certain time (I would say 20 years). After that time period, the chance of having any evidence turn up that will overturn the conviction is slim. The one major problem I have with abortions is it doesn't take into account the father's rights. If the father doesn't want the kid, I don't believe he should have any obligation to support the child unless rape is proven. I usually get the most heat over saying this because when you turn it around, why can't the father make the mother have the child and then force her to support the child? I know that's not how it works and there is little chance it will ever change. Sorry for being so long winded but like I said, I would rather not get into a deep discussion on the topic but I'm open to reading your views on my thoughts.

Funny story about that. When I was in college, I took a Human sexuality class and in that, we had a group of students went up to debate abortions and the person I was debating said that she found it funny that many people that are against abortions were for the death penalty. I asked her if she was for the death penalty and she responded with a "no" like I was kind of stupid. I got up and started walking out of class. When the teacher asked what I was doing, I told her that if the girl I was debating didn't see the stupidity in her reasoning, there was no reason to continue. The teacher told me to take my seat and gave me an A for it. Which was really funny because the highest grade for anyone else opposing abortions was a C.

I think profiling would actually help in cases like this. But you can't do a nationwide profile, you have to change the person you are looking for in each area. Like in inner city Chicago, there is a good chance the killer would be black. In the suburbs, there is probably a bigger chance of them being white. Most likely, it will be a male with a history of mental health problems. You also need to look for kids whose parents treat them odd. Like in the case of Adam Lanza, his mother always deflected questions when out with friends and (I just heard this today so it may not be correct) warned the babysitter never to turn her back on him.
