A naked intruder who was trying to choke a pet Rottweiler was shot by a homeowner in Miami Wednesday morning, police said.
The bizarre incident happened around 5 a.m. when the occupants of the home were awoken when they heard a commotion and dogs barking.
When the homeowner went to check out the noise, he confronted the suspect, who was completely naked and trying to choke one of the dogs, police said.
"He comes out and spots a person who is not only fighting with this dog but is naked fighting with this dog," Miami Police spokesman Det. Willie Moreno said.
The homeowner opened fire twice, hitting the suspect in the leg once. The homeowner held the man until the police arrived.
The intruder was taken to Jackson Memorial Hospital where his condition was unknown. Police said he tried to bite the homeowners and police and workers at the hospital, and may be under the influence of drugs.

"For right now it does appear to be a justified shooting," Moreno said. "This individual was acting irrational, fighting with the dog, and not only that, but at the point that the homeowner attempted to get this individual's attention, he immediately jumped onto the owner and started fighting with him."
Police said the suspect, who refused to give his identity, will be charged with burglary of an occupied dwelling with assault, animal cruelty, resisting arrest with violence and lewd and lascivious behavior.

So I guess you are right he should have invited him in for some hot cocoa by the warm fire. Your as looney as this guy was. Yes, they are very big and very strong but they are noted for cornering and not releasing until given an ok command by their owner. It would save a lot of bile and posts if people who are being sarcastic would put something like "begin sarcastic rant" and "end sarcastic rant" when they are writing sarcasm. Without it, there's the risk of looking like an absolute idiot or sounding like a maniacal troll.

That defeats the who purpose of both sarcasm, irony as well as innuendo laden rants... the whole point is to see if the target is "smart enough" to tell the difference. Its a waste of effort to provide any more than necessary.
You might say the if a person can't tell the difference ... they may be a few bulbs shy of a Fully lighted Christmas tree. You have to leave enough undefined hints that the target has to reach for it, putting space for a little effort - that's the whole point of sarcasm. I'm thinking these dogs, outside in the middle of the night, barked endlessly until they drove the man literally crazy. It may have gone on for years.

Now, not to be a conspiracy theorist, but here's yet another naked deranged Floridian with an apparent compulsion to bite people, and as in every other such recent case we're told it must be drugs. If so, this one, who's still alive, ought to come down after a while and be presentable in court, and the media really ought to tell us about that when it happens. Apparently none of the folks saying this have considered the possible difficulties of getting a nice clear shot at a guy who is latched onto your dog, whom you presumably want to avoid shooting.
@jane, he could've fired a lethal shot afterwards when he was waiting for the cops and whacko was trying to bite him. i'm impressed....this homeowner was able to keep his cool under some extremely *weird* and alarming circumstances.

@teamdirtdogs, I'd have been mighty tempted to do that myself if I thought the ballistics report would've looked okay - but I also can't fault the guy for choosing not to kill a man when he didn't have to. He deserves lots of credit all around - he certainly saved his dog's life, and maybe more.

It's always better to read the whole article before stating an opinion. Give the guy a break with the "CENTER MASS CENTER MASS" stuff. He was being attacked and bitten and was defending himself and not the dog at that time. The dog owner managed to shoot the guy in the leg in spite of the fact that he was being attacked. The naked guy then continued to fight with police and hospital workers... kinda hard to control an uncontrollable situation like that in real life... although on tv and in the movies it all works out perfectly.

I love my dog, but if my wife and kids are in the house at the time the perp is on my property and there is any chance they could be in danger, I'll shoot through the dog and then go adopt another one. Sorry to disappoint you, but my wife and kids come first.
You give up too easy.... an emergency doesn't give you immunity. If you are flying down the highway at 100mph and have an accident and kill someone, its not going to matter to the other guys family that you did it - while rush you wife to the hosipital to give birth.
The plain fact is - this home owner was able to do both. Save his pets and protect his home. When it comes to protection or using a Gun ... its better to be a hunter - not a cowboy.

If a gun owner is going to use a gun to defend him/herself and his/her property, the gun owner needs to use it properly and not wince about where the intruder is being hit. Take a gun safety course and learn how to use your weapon.

Dear C NJ Mom: The fact that he is on your property naked wrestling with your dog is a gray area.. Castle doctrine or not you still have to prove the shooting was justified. If you manage to hit him twice in the chest, that headshot to finish it all up is called OVERKILL. That wouldn't be justified, and would land you in a maximum security facility for 25+ without parole. I hope your kids have a good daddy, cause with that sort of rhetoric they will be C NJ Mom-less should anyone cross you in your dwelling...

IMHO, if a NAKED INTRUDER was on my property and trying to take a bite out of me, I'd definately be justified in putting his a$$ down because the crazy nut had the potential to physically hurt me or my family. IMHO.
By all means, a shot or two to the chest is justifiable and will pass in court, you would not see prison. But to put two on centre mass then execute him with a headshot is absolutely unjustifiable. Once hes been incapacitated theres no need to kill him. That would just ruin YOUR life...
Haha, unless he is a better shot than I am, he may have been trying to hit the chest. I have several pistols, some air and some bullets but there's no way that I would try to use one for self defense!

We shoot to stop a threat. If a perp dies of a gunshot wound, well, that's unfortunate. If he's scared someone may die, he ought to sell his gun.
But then there is : " I shot three times, hit him in the torso once, the head once, and then torso...it all happened in seconds! " Who can argue about that, other than than the ACLU?
OK, OK - maybe a shot to the back of the head or upwards from under the chin would be suspicious. Nothing wrong with kicking 'em in the heuvos and/or, your choice ;-0 stomping on the leg wound a few times.
You can explain that you thought he was trying to get up... they would be willing to go along with that.
How many is to many, when the entry wound, exit wound and the hole in the ground all line up, that may be one to many, otherwise do what you got to do.
Double tap, center mass with a .45 acp or 10mm. Take your time calling 911 and no need for a head shot.
I would shoot someone for just breaking in naked since that in and of itself is good enough reason for me to take them down ...if they were strangling my dog i would shoot them till they quit twitching and let my dog their face off until the cops arrived
Unfortunate, it is common in today's world. Now, if he would have broken into a chicken coop I'd be laughing my ass off.
You would be amazed at how forensics can determine kill shots. Perhaps the third shot to the head might be excessive, but if I drilled one hole in center of mass and then as he stutters forward drill the second shot to the head that should be enough. If I shot the third shot while the hydrostatic pressure of the headshot was forcing the blood out of his nose while laying on the ground the forensics analysis team could easily determine the third shot was excessive and that could be used against you in a court of law.
Always shoot the assailant while they are standing up and facing you. It answers a lot of questions when the police/detectives arrive. Shooting the assailant in the head should certainly incapacitate the perp should they actually survive the shooting- hopefully to the point that they cannot carry a complete thought or maintain coherent speech or use fine motor skills to write down their version of the story (kinda bull@!$%# that you can be liable for a home invader gaining access to your home).
The only way I know to double tap a perpetrator is through practice. The more range time executing those maneuvers in rapid succession the better off you will be at drilling a minimum of two holes while the perpetrator is still vertical and assessed as a threat. Start at 20, then 15, then ten, then five meter target to engage them and engage them with precision. A five meter target is the closest you ever want to really engage an assailant; otherwise the assailant can close that distance in less than two seconds.
I prefer my Smith and Wesson .40cal M&P with Crimson Trace laser designator with 165gr JHP to deploy an effective hydroshock on the assailant. Even if you immediately dialed 911, the average response time I thought was six minutes but lately I have been hearing that it is really ten minutes. A LOT of blood can pool out in ten minutes and the assailant, not receiving enough blood to the brain, will become brain dead/vegetative status in less than ten minutes. If you shoot and hit the assailants heart, in ten minutes it won't matter either way; The assailant will have expired.

ps, more than a few dozen times have i performed a quick draw to destroy a 1"x2" object bobbing in wind driven waters at 25 ~ 30 yds.

But I was always taught that if you have to draw your weapon, YOU SHOOT TO KILL. I do not intend on maiming the SOB just so that he can sue me in court at a later date. Cross my threshold uninvited and you have only one chance to vacate with your life. Then they will be pushing up daisies...
in a situation like that, i want information. a kill shot would be too easy and cost me the info i needed.
Never pull out the gun unless you intend to shoot (don't wave it to intimidate - no warning shots.)
Never fire at a person unless you intend to kill them (a leg/arm shot can easily kill, and will probably not eliminate a threat to you or others.)
So do as the police are trained to do - check for bystanders in the line, then fire in bursts, because even trained, experienced shooters have lousy aim in life-threatening situations. Aim the bursts at center mass. If body armor is seen or suspected (no effect from hits), aim the second burst at the center of the head. Eliminate the threat, and try to not hit non-threats.
I have no interest in conducting an after-action debriefing with a crazy drug-head who is totally out of control on bath salts, PCP, meth, or whatever. If his blood must be in my house, it would be best to let it ALL out. And some brain matter - that's OK. I want the threat to be thoroughly ended.
Agree 100% One choot is not garranty you can stop the criminal if you are a bad shooter, I have a friend in argument he received 6 shots and he still manage to overdue his atacker (shooter) he tell his history, he was a bully and after time a fight with him also, but no guns...

Florida gets all the wierdos , that come from other states. Winter is the worst time for dirt bags homeless and on the street, traveling down to key west, where all the flotsum and jetsum end up. Most of them will steal you blind, if they don't kill you first. Real floridians are not like that, I know i am married to one,and he would not have missed center mass. And the Dog would probably have gone for the family jewels, and that would have been the end of it. Florida has a law, that says if someone is threatening you, you can shoot them, or what ever to keep them from hurting you. It has to be a clear case of self defence which this looks like it was. So the guy cannot sue he might try, but I think the homeowner has the edge here.

Any person has the right to defend themselves though, as mentioned, one has to always be concerned about being sued even if in the right. In this case the homeowner did have an intruder -- and it is probably good that he showed some control and didn't just outright kill the intruder. I myself feel he would be in the right to do just that. The law, on the other hand, will consider if the owner is justified in using DEADLY FORCE, IE: did the intruder have a weapon of any sort ( gun or otherwise )? which could harm or kill the homeowner. I do not know the laws in Florida concerning a crook breaking and entering someones home so who knows what will become of this case BUT, AS MENTIONED , it would be nice if MSNBC would do follow up reporting of this case.

As long as we are writing laws, the home owner should also be required to provide his dogs with protection, or adequate health insurance coverage, to protect against rabies and aids in the instances when the naked home intruder actually bites the dog, or rapes the dog.
