A Maryland first-grader has been suspended for pointing his fingers like a gun at school.
The boy, a student at Roscoe Nix Elementary School in Silver Spring, was suspended for one day. The incident happened a week after the Sandy Hook Elementary shooting in Newtown, Conn.
The family's attorney says the 6-year-old was playing with friends, not making threats.
"Evidently, he was pointing his finger at someone and saying, 'Pow,'" said Robin Ficker, an attorney for the family.

The boy's parents were scheduled to meet with school officials Wednesday.
The school system will not comment on individual disciplinary matters. But they did issue a statement detailing their typical procedure with younger students.
"Generally, in an incident involving the behavior of our younger students, we will make sure that the student and his family are well-informed of any behavior that needs to change and understand the consequences if the behavior does not change," said Montgomery County Public Schools spokesman Dana Tofig in a statement.

When growing up in the 60's we brought actual cap pistols to school and, after school, do you have any idea how many Indians I killed playing "Cowboys and Indians" or how many Germans or Japanese I "killed" playing World War II? But back then we were able to separate "reality" from "playtime".
But our society is so screwed up our kids are told not to point a finger and say "POW" but then go home and play a video game slaughtering children and police in a game so realistic it doesn't look or feel like a video game? Or watch one of the many movies where shooting others is glorified? But then blame the law-abiding gun owner as the "cause"? No wonder our country is so screwed up.....

This is completely absurd. The kid did not have a weapon, he was playing. When we were kids we did this all the time playing, pretending to shoot the other side - whether it was cowboys and indians or some other battle. This is all part of kids developing their imagination and having some fun. These school administrators need to take a valium and chill out a little. My husband is a third grade teacher and has had a knife pulled on him twice by a third grader. Think about it, folks. Children today attend day care and pre-school from 8 weeks until kindergarten, then K-12, then be ready for college! They never have the time and freedom to JUST ACT THEIR AGE! None of you have any way of knowing from this story, other than the comment of the family retained attorney who assures all of us that this is doe eyes, milk drinking innocent kid just kidding around.
How different would the story be if this was the sullen bully who shakes down kids for milk money. Or that strange little kid who sit in the corner all day and eats paste?
How about the phrase 'The families attorney"? At which point did the family lawyer up? As a last resort or right out of the box? Do we know if there is a discipline history for this kid? If so, were the parents cooperative or obstructive.

A first grader won't generally be suspended for a first offense. As the Superintendent alluded in his comment, parents are normally informed of the behavior before serious action is taken. A normal series of events for this would be: First time; talk from the teacher, second time; note home, third time; disciplinary referral to the school Administrator, which is where the suspension would come from. If the child had a history of bullying, this "harmless" gesture would be interpreted as a threat toward the bullied student.
The lawsuit would come from parents who were in denial regarding their child's bullying or perhaps one of the parents is a bully. They would not have taken the note home seriously or might have told their child to do whatever they wanted anyway.
The majority of posters here seem to be completely ignorant of what goes on in today's elementary schools but are more than willing to lemming themselves off the cliff.
Welcome to the socialist state. While they would control all actions and words, they anxiously await the technology that would allow them to control thought as well.

Ray and Brian -- I have 2 sons in public schools and have 2 grown sons. I can tell you that kids ARE being suspended for these things without prior incidents. There is no common sense left. None at all.
I've had one problem child that definitely deserved all the punishments handed down. He broke all rules to the extreme. I don't pity my kids when they are wrong. On occasion I find the discipline doesn't fit the crime, but rules are rules (generally).
However, kids figure out quickly when adult rules are plain stupid. Which undermines the whole school experience even if parents back the school. A first grader knows his finger is NOT a weapon!!!

I think there is more to this story than has been reported. It does seem absurd to suspend a child for pretend shooting with his finger. Like the poster above who said maybe this was a bully child, etc., we just don't know the details. But, I bet if you could talk to the teacher and other kids in the classroom, this was not just a case of pointing your finger and saying pow.
@ Silverton - I doubt there is much more to the story. Many school districts now hove zero tolerance rules that spell out crap exactly like this as punishment. I would have a tough time allowing my child to be taught by a school district that passed such absurd rules. All this teaches children is that authority figures are stupid and bullies.

Don't act like you are suprised, this was on the horizon 20 years ago. I remember a bunch of Busy-body moms - telling people not to give little Billy any toy guns, bow and arrow sets, darts... 'cause it makes violence seem acceptable. Problem is - when the boys went out to play, they would find a stick on the ground and still play Cops and robbers, "Soldier" or as this little hooligan did - make his finger a gun.
Boys are not girls (thank god - he is the one that set uo genders, must have had a reason for that?) and Modern Mothers need to back off sometimes and understand it. Kids do need to understand the difference between "Play" and real life, take some time to sit down and talk about it... instead of changing the world to match your personal "sensiblities".

I'm not 100% sure but I believe that school records are permanent and are used when someone wants to attend say a prep school or college. My guess is that the parents are concerned that years down the road this could effect their child's future. Just saying.....

When I got in fight in elementary school and bloodied some kids nose...I didn't even get suspended. The principle just had us in the office to talk about it and then we were done. Apparently pointing your finger at someone is now brandishing a deadly weapon. Let's give him some jail time, and heck...let's put him on the sex offender registry. Why not. Makes as much sense as suspending him.

Same thing for me Z, but I was in school when these changes started to begin. Got a talking to for a fight in elementary school, got suspended for one in Junior High, and by the time I was in High School they had a no-nonsense expulsion rule for fighting and luckily I got in no fights.
Parents were also different back then too, when I was in 5th Grade I broke my collarbone during recess and the school nurse sent me back to class and refused to call my parents, she thought I had just bruised myself and was overreacting. Later that day after returning to class I started to have trouble breathing because the broken bone was poking my lung, then they called my parents and off to the hospital I went. Could you imagine what type of settlement parents would get for that nowadays?

Same here Z, but when my son was in junior high in the '90s I remember getting a call from the vice principal. She went on and on about what a good kid he was and how he didn't do anything wrong, but she had to suspend him violating the school's "zero tolerance for violence" policy. Apparently my son saw a bully that had a kid down in the hallway and was beating him. My son pulled the bully off of him just as a teacher came around the corner. Even the teacher said that my son was just helping the kid. But they still had to suspend him. These people remind me of the Star Trek Borg, completely devoid of individual thought or judgement.
Honestly it's a wonder our kids learn anything of value at all in public school if this is a sample of the wisdom they pass on to our kids.

I always find it funny too when people say they "get summers" off and imply they are getting pay. Teachers are only 10 month employees and only get paid for 10 months. Many have an option to take less pay during the year and spread the money from their 10 month salary over the summer so they don't have to budget during the year on their own enough to pay the bills, but they aren't paid for the summer time while schools are closed.
Just like if a construction worker didn't work all 12 months of the year. He/she isn't getting paid when work is down...but somehow that is ok and all other professions that aren't 12 months a year, but teachers are somehow vilified for not getting paid while not working? Seems reasonable to me.
hockeyguy - Teachers receive an annual salary, whether they choose to take it in 10 payments or in 12 payments. Teachers also have summers off. Your logic is not much better than that of the administrators who suspended this child.

My 8 yr old Grandson got In school suspension for taking a plastic "sword" from my Bloody Mary glass that had the olives stuck on it. School said he broght a weapon to school. I guess it was far more dangerous than a sharpened pencil.

It seems like an overblown reaction by the school district. Couldn't they sit down and explain to the child that the behavior was unacceptable at school, without the suspension? Really, how did that action protect the other children in any way?
Obviously all school districts are taking security and gun threats even more seriously since the tragedy at Sandy Hook, as they should, but this type of knee jerk reaction is ridiculous and does nothing to actually protect the school or the students.
Maybe the districts parents should explain to the administration what behavior they expect and the consequences if someone doesn't start using some common sense. Now the district, which I'm sure is short of cash, as they all are, can defend itself against the inevitable lawsuit from the parents of the child.
Just a little common sense could have taken care of this situation in about 5 minutes.

By "Prof" I assume that means you do not teach at a public elementary school. Your attempt to invoke authority is hollow. Fact is, at an elementary school any gesture with the appearance of threat is subject to disciplinary action. At first grade it would not normally lead to suspension until a third or subsequent violation.

Whether you like it or not, the pointed finger simulating a gun is a well recognized gesture of threat, Parents should have taught their child better than to make threatening gestures, but more likely, they're sitting on the couch with them watching reruns of The Sopranos, unconsciously encouraging that behavior.

When one is dealing with children especially elementary children, educators know and understand that children must be reminded of positive behaviors over and over and over... (FYI, this is beginning teacher education 101)
However, to come to the conclusion that this behavior is *abnormal* when it clearly isn't for young children, points to the much more concerning issue of appropriate behavior for the adults in this particular school system.

I just don't get it... suspend a kid for playing a kids game?? I was shocked when I read that kids couldn't play dodge ball or tag (no touching other kids), and now this??? What's next, no talking to another kid (you might say "hi" in a bad way to offend him/her).
Come on America! It's not these kid's fault... it's PARENTS! Stop trying to be their friend and BE A PARENT. Stop spending 100% of your time worring about work and spend a few hours a day with your child. My parents worked all day, every day, but they ALWAYS spent a few hours with us four kids. They knew how good, and badly, we were doing in School. My dad punished me when I did something wrong, and said "I Love you" almost every day. I grew up in inner city Detroit, so don't talk to me about underprivilged or welfare... I lived it, went to College, and make $100K a year. If I can, ANYONE can... and besides my time in the Military, I never killed anyone with a finger.

What have things come to, when we can actually have self-claimed adults support the action of a school board that SUSPENDS a FIRST GRADER, when their stated policy is:
"Generally, in an incident involving the behavior of our younger students, we will make sure that the student and his family are well-informed of any behavior that needs to change and understand the consequences if the behavior does not change," said Montgomery County Public Schools spokesman Dana Tofig in a statement."
Baloney. These are a bunch of gutless high-paid adminustrators who haven't got a semblance of common sense between them. They are protecting their butts with the suspension, not using one iota of leadership and judgment.

LOL. A one day suspension for something like this when I was 6 would have gotten them an ass chewing from my Mom and and me an extra day outside to shoot things up with my Red Rider BB gun. I just listened to my Marty Robbins Gunfighter Ballads CD as I was brushing my horse and getting him settled for the night. It was a sloppy job because of all the rain we're having and Marty seem to fit the bill.

This is a good lesson for the kid. When I was about the same age I pointed a toy cap pistol at my dad and received a real good paddling. He told me never point a gun at anyone unless you plan to shoot them. To this day I remember this and I don't.
