James Holmes, 25, is charged with 160 criminal counts, including murder, for a July 20 shooting rampage at a movie theater that left 12 people dead and dozens more wounded.
CENTENNIAL, Colo. -- The suspect in the Colorado movie theater killings returns to court this week for a hearing that might be the closest thing to a trial the victims and their families will get to see.
James Holmes, a former neuroscience graduate student, is charged with killing 12 people and injuring 70 by opening fire in a darkened theater in the Denver suburb of Aurora last July.
At a week-long preliminary hearing that begins Monday, prosecutors will outline their case against Holmes, the first official public disclosure of their evidence. The judge will then determine whether to send the case to trial.
Legal analysts say that evidence appears to be so strong that Holmes may well accept a plea agreement before trial. In such cases, the preliminary hearing can set the stage for a deal by letting each side assess the other's strengths and weaknesses, said Laurie Levenson, a former federal prosecutor and now a professor at Loyola Law School in Los Angeles.
Preliminary hearings "are often the first step to resolving the case, a mini-trial so both sides can see the writing on the wall," Levenson said.
Judges rarely throw out a case at this stage because prosecutors must only meet a "probable cause" standard — much lower than the "beyond a reasonable doubt" standard for a guilty verdict at trial, said Mimi Wesson, a professor of law at the University of Colorado Law School.

Holmes, who faces more than 160 counts including first-degree murder and attempted murder, could have waived his right to a preliminary hearing, allowing lawyers on both sides to prepare for trial. But defense lawyers sometimes go through with the hearing because it gives them a clearer picture of prosecution evidence.
"In this case, I think it likely that the genuine purpose of the hearing would be information-gathering by the defense," Wesson said.
Court officials expect many survivors and family members of the dead to attend the preliminary hearing, along with scores of spectators and reporters. At least two overflow rooms are being prepared where the hearing can be observed by video and audio feeds.
District Judge William B. Sylvester has imposed a gag order on attorneys and investigators, and many court documents have been filed under seal, so little is known about Holmes' path from promising graduate student to suspect in a mass murder.
The few details that have been made public suggest a disturbing descent.
Holmes enrolled in the University of Colorado, Denver Ph.D program in neuroscience in 2011. In the spring of 2012, authorities say, he began buying weapons, high-capacity magazines, ammunition, explosives and combat gear. At some point in the school year, he began seeing a university psychiatrist. He failed an oral exam on June 7 and withdrew from the university three days later.
He was arrested outside the theater shortly after the July 20 shootings. Federal authorities have said he entered the theater with a ticket and is believed to have propped open a door, slipped out to his car and returned with his weapons.
Hours later, investigators found his apartment booby-trapped with potentially deadly explosives, police said.
In previous hearings — many witnessed by victims and survivors — Holmes' appearance and behavior ranged from bizarre to unremarkable. On his first day in court, his hair was a shocking orange-red, his face was covered with stubble and he seemed to be in a daze.
By last week, his hair was a natural-looking brown and he wore a full beard. He sat quietly and seemed to be aware of the proceedings.
Holmes could get the death penalty or life in prison without parole if he goes to trial and is convicted of murder. He could avoid the death penalty if his lawyers argue he is mentally ill or innocent by reason of insanity.

Holmes' mental health is expected to be a major factor whether his case ends in a plea agreement or goes to trial.
His lawyers have told the judge that Holmes was mentally ill, and court records indicate they may call witnesses in the preliminary hearing to testify about his mental health. The defense team has not said whether Holmes would enter an insanity plea.
An insanity plea is different from the competency argument used for Jared Loughner, who pleaded guilty to killing six people and wounding 13, including then-Rep. Gabrielle Giffords, in Arizona in 2011.
A judge ruled in May 2011 that Loughner was mentally incompetent to stand trial and ordered him to undergo psychiatric treatment. After Loughner spent more than a year in treatment, the judge ruled he had become competent, and Loughner accepted a plea agreement that carried a sentence of life in prison without parole instead of execution.
The decision on whether to seek the death penalty will be up to the new district attorney for Arapahoe County, George Brauchler, who was elected in November and takes office Tuesday, after the preliminary hearing begins. Brauchler has not indicated what he will do.
A spokeswoman for outgoing District Attorney Carol Chambers, who oversaw the filing of charges against Holmes, declined to comment.
If prosecutors do not seek the death penalty, and if Holmes is convicted of or pleads guilty to first-degree murder charges, he would face a mandatory sentence of life without parole.
Gun control continues to rile both sides, with gun collectors holding a show near Newtown, Conn., and with the launch of Vice President Joe Biden's gun-violence task force. NBC's Mark Potter reports.

The man has problems. Lock him away! Heal him and keep him locked up so he can think about what he has done. Having to live with that the rest of his life would be a good punishment.
There is no need to put anyone through a dragged out legal process. This is a straight case and there is only one satisfactory ending to this. I am not a monster but what I am talking about does not involve locking him up.
If only his and Adam's father were not set to testify in the Libor scandal. Seems a little odd to have two of the children of the fathers set to testify in a case that has so much money on the line to both commit mass murders.
I wish there was some video evidence that shows up like Holmes in his orange hair buying a movie ticket and entering the theater (since no one actually saw his face). Could it be possible that someone drugged Holmes, kidnapped him, and had him waiting outside. Bought a movie ticket, committed the shooting, and set him up. Why was he waiting for police outside? Why not flee or try to shot the police?
Adam could have been a set up too. No one saw his face either and he decided to kill himself without a fight when he heard police coming... Someone could have killed both Lanzas and easily framed the son.
You are going to saw "you watch to many movies", except I do not. What are the odds/probability that the sons of two people set to testify in the same case commit mass murder? Has that ever happened before? It would only take a few corrupt individuals to make something like this happen. Granted if something is "possible" it will eventually happen, but why in a case with so much money on the line.
When there is that much money and power are on the line I expect people to bend and break the rules. When it comes to profit, a hundred lives or so is nothing. History has proven this time and time again.
Sucks for the residents of Colorado if he pleads out and gets life without parole...they get to support this murder for the rest of his life.

It's funny how the "media" never mention this little coincidence about the fathers of these two guys that allegedly committed these mass murders. In the Newtown situation, the facts reported have been changed and streamlined so many times, it's nearly impossible to separate the real facts from the fake facts. Remember that there were initially multiple gunmen reported at Sandy Hook Elementary, the Bushmaster was recovered from the car, etc. etc. In the case of Aurora, think about the possible use of Scopolamine. Really, what about the bloody foot prints that went at least a hundred feet past his car to another parking space and mysteriously disappeared while HE was found sitting in his car with no bloody footprints nor any blood on his shoes? Once again, it costs far less to incarcerate for life than to execute. It is also a much harsher punishment than being put to sleep. The death penalty doesn't deter, and it must stop being used. It's as barbaric as stoning.
I dont understand why people cant keep this straight. It costs far more to execute someone than it does to keep them in prison the rest of their lives. They sit on death row at least 16 years filing appeal after appeal after appeal which costs a fortune. Rarely do the appeals work and they are eventually put to death but it is dragged out for years and years. I am not pro-death sentence except maybe for monsters like this but again I feel it is the easy way out for them. I saw "let them suffer" before they get the needle.
Agreed Buffaloe51, even without the added cost of execution, it gives the person a LONG time (or short) in prison to think about it, and worry whether or not someone will get to them beforehand. Misery lasts a lot longer than immediate "out." I also don't believe CP is a deterent.

I know that many people want to see this person punished severely, and some seem to feel the bother of a sanity hearing, or a trial, is an unnecessary bother. But there is such a thing as being too crazy to comprehend the wrongness of one's actions. I don't know if James Holmes falls into that category. But I certainly think it is worth finding out.
The checks and balances of the legal process are not there just to protect guilty parties from justice. They are there to prevent the innocent from being railroaded by either over-zealous prosecutors, or an angry public.

Only because the lawyers drag it out, appeal after appeal. And they get paid regardless of the outcome of those appeals. As of 2010, the average wait on death row is 15 years, with all accompanying legal fees.
One solution, if the defense attorney loses an appeal, he doesn't get paid.
My solution; Best 2 out of 3. First a Trial. if found guilty, you get one appeal, all evidence is open and available. that way neither can argue suppressed evidence. If there is evidence to show a bad verdict, the state gets an appeal. This has a 2 year maximum. (obviously my solution has more detail than this, but this is the jist of it)
Also, I would add, that if a convict is later found to be innocent, the Prosecutor and the Defense Lawyer should both be disbarred. As it becomes obvious neither one did their job competently.

I am glad I am not the only one who thinks the reporting on these incidents is speculation and sensationalism. Where are the time lines? Usually the MSM has a minute by minute account of what these individuals did before and during the attacks. Where is the follow up to the "other" individuals found at the scenes? What happened to the guy they tracked down? (they showed aerial video of the foot chase into the woods) An innocent bystander I am sure, but where is the verification?
And btw, the gun they found in the car turned out to be a shotgun, not a rifle as reported.

And like Leroy Jethro Gibbs says, "I don't believe in coincidence". (I do actually) But something smells awfully fishy here. I am not a conspiracy theory type, but I do know these things are possible, however improbable they may seem.
That is to say, the logically reason for this is just plain down right pi$$ poor reporting. Trying to get the scoop on the story and reporting things that aren't there. (Most so called journalists I have the misfortune of meeting aren't that bright or knowledgeable and wouldn't know an M-60 from a butter knife let alone a K-Bar) However, given the discrepancies, it sure opens the door for other likely scenarios.
After seeing videos and pictures of James Holmes, hearing his replies when questioned and then watching his reaction to some questions he was asked in a court of law, it is blatantly clear the guy was doped up. I'm guessing scopolomine. I think we have the same drug being used in Sandyhook. Something is really wrong here and it's not getting reported. The kid in Sandyhook shot his mom directly in the face, literally blew her face off. That is NOT NORMAL BEHAVIOR, not even for shootings like this. These shootings are off the wall! As tragic as all of this is, we've simply got to question the oddity and realize we've got probelms here that seem to lead to bigger fish.
I heard about the Libor case too but I haden't heard the parents of both boys were set to testify. I don't know if I believe that, I just haven't seen any proof to back that up but... the drug scopolomine turns people into walking zombies willing to do anything they are told and with ZEST! However, they hold no memory of involvement. Sure looks just like that. What I don't want to see is losing sight of the drug angle due to false info around the Libor case.
As far as the Libor case is concerned... everyone should read up on that for their own good. Talk about white collar crime. Whew. Seems like we are plagued with it these days.

Is that a little short sighted? My vote is to learn everything we can from him and his particular violent pathology; that means a lifetime of hospitalization and treatment.
I feel this was too costly not to examine him to exhaustion from every conceivable angle. Learn to treat him, learn to identify any signal that may exist in other people and maybe we'll get a little closer. Does he deserve the death penalty? That's a very hard question; what he did was inhuman and evil beyond measure in rational terms but he was also completely out of his mind.
If you think this is some sense of misplaced mercy, I personally think keeping him alive at this point is probably as cruel as any execution would ever be. We could make his life worse, for sure, but given the nature of his crimes and his mental illness, I don't know what purpose that would serve. I doubt he even remembers most of what happened if my past experiences with schizophrenics is any kind of prologue.
I think the public would benefit by finding out who he was treated by and what drugs he was given....but theres not much chance of that.

It is illegal to drink and drive, yet thousands are injured and killed by drunk drivers every year. You can pass any law you wish and they will all be ignored by those who wish to ignore the law.
It was an arsenal. Normal people don't just wake up and say, "I'm going to go buy 3 semi-automatics, body armor and tons of ammunition" A database would have denied the purchases pending further questioning. You know, the same way a drunk driver can be pulled over if they're caught weaving on the road or gets caught in a checkpoint because it is illegal to drink and drive and the cops can legally arrest you for doing it. Not so with sudden gun purchases out of the blue from people who have no history of even holding a taser.

The point is that almost all guns are INITIALLY purchased legally, then sold to people who should not have them. I'm sorry I did not make that more clear. Something needs to be done about these secondary market sales of guns.

Why are you gun people so concerned about auto deaths. The two kinds of death have nothing to do with one another. However, if you wish to make the comparison, let's think about the fact that REGULATIONS are in place to reduce the number of auto accidents and there is no doubt that those regulations have been effective. The regulations range from safety engineering requirements of the vehicles, laws defining maximum blood alcohol (which has been reduced in recent years), rules of the road, etc.
We ARE trying to reduce the number of auto deaths. What are we doing about GUN DEATHS?

About the smartest ideas I have heard of. No one should be able to buy or own a gun unless he/she has a mental evaluation by at least two Psychology experts. A person going into a school or a theater to kill people is like shooting fish in a pond.
Trust_verify - Just how many guns make up an arsenal? I think 4 purchased in a very short time particularly by someone who's just making their first purchase would be something that would make a good case for checking into it. That is about the dumbest idea I've heard of. It's a waste of time and money. It's not difficult to act and appear normal to a doctor if you are in fact mentally ill. Psychology is not an exact science so it's also possible a normal person might be found mentally ill.
How many times has a person committed a crime where everyone thinks the guy must be crazy, yet he is found competent.
At what stage do we decide that a person is to mentally ill to own a gun? Is depression a reason not to own a gun, or should it be a social disorder?

My point I was making is that you can make all the regulations you wish and you will NOT stop some one who wishes to ignore them. You can demonize guns and gun owners until the cows come home and folks will find other ways to kill. (OJ used a knife, Teddy used a Caddy, McVeigh used fertilizer.) You can be like the fools in Cook County and believe that taxing gun owners is the way to stop the violence, and you will fail as miserably as they are. (I really don't believe that the gangs of Chicago have Corporate accounts at Bass Pro)

The NRA is the LEADING group in the US advocating gun safety. Their President was just vilified for daring to suggest that school have armed guards, yet it was similar to what Barbara Boxer (D-CA) suggested when she advocated using the National Guard and she was applauded. Why is this? Could (horror of horrors) Politics be playing a part here? Or could it be that some just don't want to have a "good tragedy go to waste" (from Rahm Emmanuel).

You were trying to make a point by comparing gun deaths to auto deaths due to drunk driving. We HAVE stricter DUI laws than in the past and the deaths due to drunk driving have decreased. Therefore your point is not valid. You believe that you are proving your point with your anecdotal evidence about Linsey Lohan and illegal aliens. Amusing stories, but the fact is that stricter DUI laws have resulted in decreased DUI fatalities.
And ...... the NRA is the LEADING group fighting any impediments to lots of people getting lots of guns with lots of firepower and, if they want them, large capacity ammunition clips. Hunter safety is a good issue, but compared with the deaths involving hand guns and semi-automatic weapons the hunting deaths are negligible.

Again he did NOT buy all FOUR guns at the same time. He purchased them in pairs of one long gun and one hand gun. NOT an unusual purchase. He purchased them 30 days apart. The amount of ammunition is NOT that unusual either. Many people, especially on Colorado, go to the range on a weekend with friends and go through hundreds if not thousands of rounds. He could have produced his own in greater quantities had he chosen to do so and no one would have known until the shooting.

BETTER safety equipment and life saving techniques have reduced the number of deaths.. that is borne out by the overall reduction of traffic deaths even as the total number of vehicle miles has increased over the years.
On the other hand the total number of firearms, and percent of households owning firearms, has increased while the overall crime rate, including homicides by all means, has declined and the percentage of homicide by firearm has remained relatively the same. The number of "mass" shootings has remained about the same for the past 50 years. I'm not saying even one is acceptable. The biggest thing has been the immediacy of reporting and the ability of "individuals" to participate in the discussion.
Mass shootings, the current emphasis, is a relatively small number of the annual gunshot deaths in the United States. The number of total gun fatalities in this country is roughly 1000x greater than in most developed countries, for example England, Germany and Japan. That shameful statistic is related to the large number of non-hunting firearms and the woeful level of regulations regarding responsibility regarding guns.

You look at these countries that do not have that right,they are fighting to live the best way they know how. As far as buying a gun from a dealer, you fill out some paper work,it then goes to the D.O.J. for you to be checked out. I want to know if I see that guy in the streets or at my door, or if he ends up being my neighbor, that he is a mass murderer, because our laws are often too soft for "people" like him. Haven't you heard about Fast & furious? The government sells weapons to the drug lords in Mexico that return to the U.S. Lets start there instead of with people who already obey the laws as they stand. Then go after the criminals who don't care about the laws. These semi automatic weapons that their talking about could include everything from pistols, rifles & shotguns since if they have more than bullet in them they will fire every time you pull the trigger. you are clown: I agree with you. I understand it's a freedom-of-press issue, but unless the shooter is at large (which they usually are not), we don't need to know their identity, just what happened. The press isn't always free anyway; details and identities are often witheld to protect the integrity of a police investigation or to protect victims. Why not withold the identity of a mass murderer to protect THEIR FAMILY MEMBERS from retaliation and harassment? The media prematurely identified the Newtown, CT shooter as his older brother Ryan! How the remaining members of the Lanza family will find any kind of peace after being branded like this is beyond me.

We need to have a database of gun purchases, close the loop holes and not let mentally dangerous individuals purchase guns. I fully agree that Mr. perpetrator (May his name be blotted out for eternity) acquired an arsenal and that should've been a red flag. Also no one but no one should be able to own semi- automatic weapons that can shoot a god awful amount of bullets without reloading. Just as fully automatic weapons are difficult if not impossible to obtain.

There should be a fast track process when people are so obviously guilty. Just a question of sentencing, really. Why should the taxpayers pay for a long legal process, and the families of the victims have to wait it out which can be so painful? They were not referring to any specific guns, they were referring to the right to protect yourself, your family, and your country, either against a potential enemy, or against a government that would become a dictatorship. The potential enemies didn't have semi-automatic weapons either at the time.

New gun laws that ban some guns is the easy way out for DC but will accomplish nothing. We do however need to find a way to keep the "nut cases" off the street and keep guns out of their hands. This is a very hard task, one that DC, I fear, will not address as they should.

I we had better enforcement ,more scrutiny, especially in the selling of weapons,stricter penalties for weapons violations and much longer sentences for convicted weapons violators that would help. The US Justice System is a complete joke, FRAUD. This guy's trial should have started the night this clown did what he did. 1) punish the perpetrator for committing the crime
2) be an example to others of what will happen if they commit a similar crime.
So if someone else commits a similar crime 1) they get free board and room; 2) they get all the sex they can handle; 3) they get freemedical treatment; etc. Hummmm that is called punishment??
