There was more gruesome testimony as the pretrial hearing continued for James Holmes the lone gunman in the Aurora theater shooting that killed 12 and injured 58 others. And for the first time, in words attributed to Holmes, a detailed description of what he expected would happen when he left for the theater complex with four guns and hundreds of rounds of ammunition. NBC's Mike Taibbi reports.
Updated at 11:21 p.m. ET: After two days of presenting evidence against accused Aurora theater shooter James Holmes, the prosecution prepared to interview a detective, its final witness, on Wednesday, according to the Denver Post. The defense may then set forth its case.
Among the more vivid accounts in Tuesday's testimony was the description of how Holmes booby-trapped his home, hoping to distract officers from the theater shooting.
Holmes used a thermos, frying pan, remote-control car and volatile chemicals to rig his apartment to blow up during the Aurora theater massacre, an FBI agent testified Tuesday.
On the stand for a preliminary hearing, bomb technician Garret Gumbinner described the diabolical contraptions authorities found when they went to the grad-school dropout’s Colorado apartment.
There was a trip-wire leading from the door to a thermos filled with glycerine that was perched over a frying pan filled with potassium permanganate, Gumbinner said.
If they combined, there would be a spark that would set off a chain-reaction: fast-moving flames and a series of explosions as homemade devices scattered around the apartment ignited.

On top of the fridge was a remote-controlled “pyrotechnic” box filled with 6-inch fireworks shells. Holmes left the remote for it outside, in a trash bag with a toy car and a boom box on a timer, the agent said.
His fantasy was that someone on the street would hear the music, open the bag, decide to play with the car, fiddle with the remote and detonate the explosives, Gumbinner said.
In all, there were more than a dozen explosive devices in his apartment loaded with napalm, smokeless powder and live ammunition. Carpets were soaked with oil and gasoline to fuel any blast.
His computer was set to play loud music at a designated time. He was hoping “someone would call the police and that the police would respond to his apartment,” Gumbinner said.
"He said he rigged his apartment to explode or catch fire in order to divert police resources to his apartment,” Gumbinner said, recounting an interview with Holmes.
No one played with the toy car or banged on the door, though. And when Holmes was arrested outside the Century 16 multiplex – after allegedly killing a dozen people and wounding 58 – he quickly told police about his traps.
The scope of the bizarre setup was revealed during the second day of a hearing to determine whether there is enough evidence to put the neuroscience scholar on trial for first-degree murder.
A parade of law-enforcement officials took the stand to describe Holmes’ painstaking preparations and the horrific aftermath of the July 20 shooting at the Century 16 multiplex – but there was no mention of motive.
The picture they presented was of a methodical killer who left nothing to chance and foreshadowed his own fate in a question posted to two online dating-service profiles: “Will you visit me in prison?”

Holmes bought his ticket, through Fandango, 12 days before the opening of the Batman flick “The Dark Knight Rises,” police testified, though it emerged that he was supposed to see it in Theater No. 8, not No. 9 where the ambush took place.
With so much evidence against their client, Holmes’ legal team is expected to mount an insanity defense, and his attorneys tried to highlight his state of mind at several points during the day’s testimony.
They questioned Aurora Police Department Detective Craig Appel about why Holmes wasn’t tested for drugs or alcohol even though his pupils were hugely dilated and he acted strangely after his arrest.

Appel told the court that police had placed paper bags over Holmes’ hands to preserve gunpowder residue, and he pretended they were puppets. He also ripped a staple out of a table and tried to stick it in an electrical socket.
Earlier, the defense asked an agent from the Bureau of Alcohol, Tobacco and Firearms whether there is any legal process in Colorado to stop a “severely mentally ill” person from buying guns or ammunition.
The agent had just ticked off the items Holmes legally purchased in the two months before the rampage, including two handguns, a shotgun, a rifle, more than 6,200 rounds of ammunition, body armor, chemicals, fireworks and practice targets.
Holmes – wearing a beard and jail jumpsuit and looking disheveled – showed little reaction to any of the testimony.
He simply stared straight ahead when prosecutors played a heart-breaking 911 tape of a 13-year-old girl pleading for help for her mortally wounded 6-year-old cousin, Veronica Moser-Sullivan.
Veronica’s father, Ian Sullivan, wept with his eyes closed as he listened for four long minutes to the chaos that marked his daughter’s final moments.
The day’s proceedings ended with Sgt. Matthew Fyles reading a grim catalog: the name of every person wounded and the nature of their injury. When he got to Ashley Moser – who suffered a miscarriage, was paralyzed and lost her daughter, Veronica – he choked up.
Wednesday is scheduled to start with the prosecution calling a detective as its final witness, according to the Denver Post. The defense could then call its own witnesses.

STOP making him a household name with info we don't really need at this moment.
What, you don't want to hear how he could have just as easily used a bomb in that theatre if he had not had access to a gun?
But having the access to an assault rifle he was able to inflict mass damage with accuracy according to the following: “they heard two 911 calls from the theater as the chaos unfolded – including one in which 33 shots could
be heard in 27 seconds"
It's not so much gun laws that will stop violence, it is people... Hopefully, whatever was bothering him, he may become at peace with. I think by showing our compassion to him though, others will feel compassion, and this type of crime will not happen again. I always say, forgiviness is the road to healing, and we should lead by example. This is something we can all rise above, and show others that walk down a similar dark trail that there is light in all of us that can be shared with them. Only that will stop this from happening again.

I'm still wondering why his booby-trap(s) were so amateurish. I read somewhere that he was a decent student, so I'd think he would be able to manufacture something akin IED's that would have the ability to take many more lives.

I can see we have people here who DO NOT know much about weapons!
First of all an actual "assault rifle" is selectable and able to fire semi automatic AND either fully automatic or a three round burst! A civilian AR15/M4 is ONLY able to fire semi automatic (one round per trigger pull) therefore it IS NOT an "assault rifle"!
Second, with a civillian AR15/M4 it is highly unlikely to fire 33 rounds in 27 seconds! First you would need more than a 30 round magazine! Doubt me? Go try it yourself! Two shooters anyone (like several wittnesses described)? DUH! And please don't bring up "quick fire systems", etc. that are highly in-effective!

Thank you U.S. Army Vet for the primer in firearms. I am a U.S. Marine Vet. As a civilian, prior to my service, I had never once owned, held or fired so much as a BB Gun. Nothing against them, just didn't happen. Once I was exposed to semi automatic rifles one of the first thing that came to my mind was, "Are you kidding??? ANYONE can own one of these???" That was back in 1972. I love the "... in case the government comes charging up the cul de sac I'll pull out the trusty AR and stop 'em in their tracks!!!" Seriously? Really? Now whose the novice who doesn't have a clue? Then there's those who keep them handy, dandy and loaded within arms reach of the kids. Oh yeah, that's what the framers had in mind. Someone bullies your kid at school, he grabs the AR and it's off to the cafeteria to make some headlines. I'm all for the second Amendment but somewhere along the line a little common sense might come in handy. When the 2nd Amendment was written the good guys had single shot powder loaded muskets as did the bad guys. It would take a month and a half to fire off 35 rounds and odds are you'd miss 99% of the time. They had no idea that (A) "we the people" would have access to weapons that would enable a single individual to fire off more rounds in 5 minutes than were fired during the entire Battle of Bunkerhill and that (B) "we the people" would include hundreds of thousands of bull-headed, sociopathic, Jodie Foster fixated, fame seeking blockheads.
When someone buys so many assault weapons and so much ammo, AT ONE TIME, wouldn't that be kind of suspicious??? Wouldn't that be the kind of thing to alert police about??? Just wondering.
Actually BS even if they had firearms capable back then they would still have written it into the constitution. And They were a heck of a lot more accurate then your giving them credit for, most country folk used Pennsyvania Long Rifles key term here is "rifle" they were not smooth bores like the army used they fired maybe 2 rounds a minute compared to the 3 rounds a minute of a smooth bore musket, but they were deadly accurate as you can read if youstudy the likes of George Rogers Clark and his troops , or the Green Mountain Boys. These were not the boys who stood in line and tried to shoot it out toe to toe with the British Regulars they sat back and sniped the Officers and NCO's trying to throw the British lines into Chaos.

It is ok to take certain rights away from those people who are not of sound mind and judgement to use those rights, But if those mentally ill people still find a way to break those rules and that includes getting a gun through illegal or legal means punish that ill person, for the crimes he knowingly commited and try the person who provided said means if he did it knowing the person was not allowed to have them. But do not take away the rights of those who are just minding their own bussiness.
By the thought of banning guns so the mentally ill can not commit crimes with them you may as well ban cars for the same reason, and if we let them plead not guilty by reason of being mentally ill, why convict a drunk driver, he was not in his right mind either at the time. So by the same thought he was "temporarilly insane"

What you fail to realize about the Second Ammendment is that it is also meant for "We The People" to have access to the same types of weapons (almost, non-automatic firearms) as the government to prevent/stop Tyranny! 2012 NDAA, UN-patriot act, etc., spy drones over the US, or BILLIONS of "Hollowpoint" ammo bought by DHS/Gov. ring ANY bells?
As an very good example of what happens to an UNARMED population take a look at what happened when the jewish Bolsheviks/Communists (yes they were jewish, FACT) took over Russia in 1917! It resulted in between 40 to 70 MILLION people murdered (MOSTLY Christians)! There are many other examples!

Kjgal, that is not a red flag in and off itself, a competitive shooter may go through a couple thousand rounds or more every week just to stay in top form as a shooter , so you would want him reported to the police every time he bought ammo?
Yea, guess the riffles jamed a lot, even though they shot straight, back then. The British perfered the burst of bullets when twenty men fired at once. We proved deadly in hit and run attacks, but their approach worked better on the battlefield attacks.

Actually the rifles did not jam much, it took longer to fire a rifle because of the "rifleing in the barrel which imparted the spin to the ball making it more accurate. It had to fit very tight so gasses did not escape and so that made it harder to push down the barrel, smooth bore were easier to load because the fit was not as good.
And the british just had more guts then others to stand there and soak up the bullets fight of that kind was very bloody and the attrition could be very high.

I agree with you on this. During terrorist countermeasure training one of the first things taught is to minimize what the terrorist are doing, and don't publicize it becuase it gives them what they want which is publicity, but more importantly it gives copycats something to shoot for as in " I can out do that" .
The hit and run tactic, along with gain support from their enemy, along with hold out long enough that support for the war fades in their homeland. I never said the US approach was not better. It worked just as well when Vietnam did it to us, many years later.
I still thought I read the riffles jammed, and our troops often had to bang the bullets down with a hammer, (at least that is what I read, for I was not there at the time) Oh well, different sourses give different details. The British did well fighting elsewhere at the time.

First off, as explained by others above, it was NOT an assault rifle, it was a plain semi-auto rifle, with a plastic stock and colored black, so it was scary looking.
Second, with 5 speedloaders handy, I can easily fire 33 rounds from my revolver in 27 seconds, but I practice, so I'm pretty fast with a speedloader.
Third, he had a mass of people densely packed into in a small area, given the population density in a movie theater, pointing at the group and firing as quickly as possible will almost guarantee a hit on every shot, so accuracy is not an issue, it's just a red herring by the article's author.

Lol, I don't think they know what it means since it really hasn't been too useful since they days of the forts. It's like saying I'll be back in a fortnight, which most people would not know how long that is. Yea, the radio has made flying the flag upside down to call for help not needed in most cases. Plus, flying the flag upside down would tell the attacking force that you feel you're about beat in the fight.

Your welcome, but know I did not do anything to deserve your debt. I love my Represenative Republic! I think most veterans just want to be respected, war veteran or not! They also want to know that what they attempted to do was for a REAL REASON (say in actual defense of their country), which most do not see, at least for the past 50 yrs or so! Examples- Vietnam, and let's say WTC Building 7 (CONTROLLED DEMOLITION) from 9/11! Hope you understand.
As for making a weapong fully automatic, a civilian AR15/M4 is hard to make fully auto. It takes drilling, tapping and parts that are illegal to own, even when not installed, if you already own an AR15/M4.
Now an AK47 is another story, but this IS NOT the weapon that were are now being BRAINWASHED into believing is so evil!

Don't take this wrong, but how did McVeigh get bombs INSIDE the building? Kind of like WTC Building 7's clear cut CONTROLLED DEMOLITION from 9/11 ("Assemetrical fires" CAN NOT cause a semetrical collapse, PERIOD, as claimed by NIST)! Sorry about my spelling.

To all you Vet's in here. First Thanks for your service. But when it comes to the second amendment, You need to read it for yourself. A amendment to the Constitution are made to keep up with the times. The Second amendment is what like 200 years old. Here are the facts. We did not have a standing army, National guard, Navy, Or Air force. In short we were a citizen army. When we were not at war, the army went back to farming or what ever they did. The right to bear arms was not to over through out government, it was to fight against England. Also much of the country was still a wilderness, we need out rifles to hunt game, Protect ourselves from Bears and Lions and such, and yes against bad people. Fast forward to day. Yes we still use guns to hunt, I do. I use my many guns to hunt, and if someone tried to break into my home or tries to do harm to my family, That gun is for the time from the time of a threat until the police get there. And its just as likely as not, the police will find a dead body of the intruder, when they get there. But for me, My 12 gauge, my 30-30, my 22m rifle my 20 gauge will do the job. Maybe in Tx on the boarder you need a Ar-15 and I have no problem with that. but other then that WE THE PEOPLE do not need AR-15 and alike. Back to the second Amendment. We now have a standing army, National Guard, nave and air force. We have township, County, state and several federal police dept.'s. Yes we still have bears, lions and bad people. For the most part our hunting guns well protect us if needed. The way you guys want to say it, People can have RPG's Tanks and any other fire power they want. That's not what the 2nd amendment said.
I would really hate to break the news to anti-gun fanatics, but 2 hand guns can fire more than 40 rounds in 20 seconds, just fire alternating. Rifle takes 2 hands and mobility is less limited.
Let's not forget, it only takes 2 seconds to detonate a bomb and you would have 100% casualties.
The fact that he may, very well be mentally ill SHOULD be the point. The fact that he was able to buy guns, buy ammo, buy chemicals for elaborate explosives, buy appropriate gear and map it all out... all under the nose of Homeland Security, should be a major red flag.
Let's make sure you fully understand, he had Napalm rigged to explode... folks, this is not legal to possess in the USA. So he went to extremes to get it.
Laws forbidding citizens never stop criminals, unless they happen to get caught in possession.
Comparison, Iodine is a major chemical used in Crack Cocaine. It's also a major chemical used in explosives.... after OK City bombing, it was suppose to be regulated... yet illegal drug dealers get around it.
So they only people you will be restricting is those that respect laws and human lives, meaning any ban would be against the sanctity of human life, period.
Statistically, controlling firearms DOES reduce the number of fire arm crimes, but it also increases the other forms of violent crimes. Making it inconvienant for a criminal does not deter them, never has, never will.
Just look at the Prohibition Era, people risked their own life and limbs just to have a drink. And because of it, the criminal element actually gained strength, especially using fully auto weapons that were already deemed illegal (and still are today!).
Which doesn't stop gang members who have been found in possesion of already banned weapons.

Back up your timeline, the AR-15 was banned on the Brady Act... guess what, number of deaths from one did not drop. In fact, the total number of homcides, as reported by the FBI have decreased in the last 9 years.
What has changed is the number of suicides. Also the number of individuals on medically percribed chemicals that have been linked to almost every case, like this. Mental Illness has been the major point, not they used.
Like in Conneticut, where after the fact, they finally figured out the AR-15 was left in the car, and the boy walked the school with 4 hand guns, 2 at a time, firing rounds quicker than the AR-15 fired alone.
Or the fact, that a derranged mind can build an explosive device and set it off, with far more casualties...

Seriously, the fact he chose to go with the more elaborate firearms, instead of the quick 2 second bomb is baffling! It also has me scratching my head.
Think about it... He has a superior knowledge based in chemistry and physics. That is how he chose the elaborate death trap at home, Yet, he lugged 1 rifle, 1 shot gun, couple pistols, smoke bombs and riot gear to the theatre, went to major steps to get the gear in the building (note: illegal to bring a gun into the building, so laws did nothing). Then went through the long process of the nights events...
It would have taken 25% the work to do 300% more damage (Bomb would have extended beyond the immediate area, along with structural damage). Thing is, he would have known this!

A "truck bomb" DID NOT do all the damage to this building! Ask a Demolitions Expert! I am not an "expert", but do have working knowledge of explosives and their effects from the Army (Eng.).
And that's not to mention the news, and witnesses reported more bombs inside the building after the first explosion/s, and the FBI even moved people away to "disarm" them (up to three more bombs)! Please check the news reports, etc.!
Oh, let's not forget that just like 9/11, etc. the FBI immediately seized ALL CCTV Video, and WILL NOT show it! That in itself makes the whole "event" very questionable.

I get what you're saying, but showing forgiveness is easier when it doesn't involve a family member.
On a few subjects:
1) The SCOTUS has ruled that flying the flag "in distress", when the union is secure, is the same as yelling "fire" in a crowded theater, when there is no fire. Which has been ruled the same as dialing 911, when there is no emergency. They have NOT ruled on a digital icon of the "distress flag". US-Army-Vet is free to use it as he pleases. 3) Effective bombs are difficult to procure or create. Most include an artillery shell or other explosive to level their destruction. Reference the IED's of the last few wars. Likewise, the process required to make a large bomb is very difficult. McVeigh had to make his "ampho explosive" from chemicals that were not that easy to obtain (farmers excluded). AND, the government has been closely monitoring them ever since (and somewhat before) the Oklahoma City bombing. (He also had a truck, barrels, help, ect..) He didn't just grab the guns and ammo from his mothers closet!

A military grade M-16 also has the capability to fire in a semi-automatic mode along with 3 shot burse suppressors and fully automatic. The ability to fire in those modes does not make the determination of it being an assault rifle. In fact, if you have ever served in the military, you would know that you are encouraged to fire the weapon in semi-automatic mode and train your shots in tight groups. This is done for two reasons accuracy and ammo conservation. I’m surprised you don’t know that.
Second,with 5 speed loaders handy, I can easily fire 33 rounds from my revolver in 27 seconds, but I practice, so I'm pretty fast with a speed loader.
I very much doubt you could aim as accurately as someone who doesn’t have to take time to reload their weapon 5 times, despite being "pretty fast".

CHuck2111043: I would like to make a couple points to you in which your interpretation is wrong, I speak to you as a Vetran of both the Regular Army and the national Guard, I have 2 tours in the middle east and tours both in Europe and the ROK. I am Currently in school to become a Teacher majoring in History, so I have to study a lot of both History and Gov't including both the Constitution and the Articles of Confederacy which preceded it. I also had to study those as well as the original set up of state militias and the COngressional act which set up the current National Guard.
The 2nd Amendment was not set to fight England, it was in fact written by our founding fathers as a balance for the people so that Gov't could not become over bearing and oppressive, as they saw the Gov't of England when they decided to break relations and seek independence. Which they did only b/c they were ignored by their gov't and in fact treated worse then many other parts of the empire, so in that regards oppressive.
If a Gov't in any country choose to oppress it's people they do it by disarming the people, who can then not bring them to task, and the idea that there is an Army, NG, and multiple levels of Law enforcement to keep that from happening, again you would be wrong, all of them answer to the Gov't , whom they take oaths to support. I am not telling you our Gov't is planning to do this, but you can look at world history and current events to see all I say is true. Look at Germanyin the 30's, Russia in the late teens, Iraq, Iran, Pol Pot, China in the 30's and 40's, and South American countries, many who found freedom as we did, and who today have lost their freedoms to gov't who have suppressed them and taken away their options to control their oppression.
And I and many other veterans and non vets use AR's to shoot competitively, which is something I can not do with my 30-30, or my 12 gauge, except I can use that in the 3 gun competition. But all the Anti gun people need to do is look at places where gun control is strict, england, where they still have shootings in schools despite the ultra strict gun laws, Mexico which has the strictest gun laws in the world , has the highest murder rate, in both these and the other countries, the criminals and evil doers do not really care what the laws are they do what they want, it is just like the pad lock on your shed, a lock only keeps the honest people out, and for them you do not really need it.

As I explained in my previous post, a movie theater provides a "target rich" environment, with potential victims sitting very close together, so the "accuracy" comment of the article becomes a moot point. This was my point about the author of the article talking about aimed accuracy, with a crowd sitting shoulder to shoulder, accuracy is immaterial.

I'm sorry that you find my effort to practice rapid reloading as a part of accurate shooting creepy. I also did NOT profess to hit "every shot". Go stand at the front of a crowded movie theater and see how much distance there is between each patron, and picture trying to NOT hit someone.

Thanks so much for exposing the poster named US ArmyVet (and thanks for serving our country). I have not served in the military and have never owned an assault weapon (have owned a couple of small handguns in the past), but I thought this guy sounded like he was full of hot air, too.
I am sick to death of hearing these gun-know-it-alls come here and try to dispute what is considered an assault weapon and what is not. Everybody knows we are talking about military type weapons (handguns, rifles, magazines, etc.) that can shoot many people within a matter of seconds.
It makes no difference what kind of weapon it is or what you want to call it.
NOBODY IS TRY TO TAKE AWAY ALL GUNS, WE ONLY WANT STRICTER GUN LAWS.
AND THE NRA AND ITS SUPPORTERS KNOW THAT.
But, the NRA loves to whip the paranoid, uneducated followers of its group into a blind frenzy trying to make them think that the Big Bad Government is going to come and take away all its firepower, etc. etc. And then it tries to make people think the Second Amendment is being violated. Well, I am fed up with the NRA and its bullies infringing on the First Amendment Right of Free Speech by trying to shut anyone up who is against a gun-free-for-all.

Silverton: I am, like several others on here a Vet, from both peacetime and war, I have a CJ degree just a 2 year, but I am also back in school finishing a teaching degree, (which I switched to a few years after my divorce) while I await a medical retirement due to injuries received while I have been serving. I also own several rifles, shotguns, a few handguns and even an AR which I use for competitive shooting. Because I try to educate people about weapons, I do know a few things about them as one of my 5 Military MOS's ( Job Specialties) is 45B Small arms repair, which means I work on all weapons from a .38 pistol up to towed artillery, and because I did theater support as well as front line work, it makes me one of knowledge, or so they tell me.
But yet because of the position I take you call me an uneducated follower of the NRA....despite all I do I am not even a member of the NRA. This does not mean I am any less of a defender of bothe the 2nd amendment or the 1st or any of the other ones that make the sovereign laws of our Nation, I ask you though you do not want anyone to infringe on any of your rights, why do you feel it acceptable to infringe on the rights of others? These AR styled weapons are used in legitimate shooting matches which like hunting have been done in this country since it was formed.
The issue here should not be the guns, it should be how do people who are mentally ill or so their lawyers and Mental Health profesionals tell us, are able to get in the position to commit these crimes in the first place? Most Gun owners have no issues with rules for purchase, or background checks or anything else designed to keep guns out of the hands of criminals and the mentally incompetant. But most anti gun groups are not intrested in that they want to take them away from everyone, citing the cry "we don't want all of them just the dangerous ones". And the thing is you talk about the NRA "bullying" I hate to break this news to you , but the gun control advocates are just as guilty of the same type of "bullying" and they want to infringe upon the 1st amendment rights of their adversaries, by calling them bullies and paranoid and that what they say makes no common sense.
Both sides need to learn to give the same respect they want from the other......kind of like the respect I give you to your opinion, why not give me the same? If you look back at my post you will see that I tried to word the part about the NRA trying the whip the "paranoid, uneducated followers of its group" as a segment of its members, and not include every NRA member. Perhaps I did not make that clear enough. I am sorry if it sounded like I included every single gun owner. If this were true, then I would be including my own self, my father who owns a couple of hunting rifles, and my son and his young wife who both have concealed weapon permits and carry small handguns on occasion.
I still maintain that nobody needs any type of weapon that can shoot multiple people within a matter of seconds. A witness to the Newtown massacre said the killer shot more than 100 times in less than TWO MINUTES. Each of the children and teachers killed were shot between 3-11 times apiece. There is absolutely no reason for anyone except the military or police to have weapons of war like this, even if they are fun to target shoot with.
And no, gun control advocates are not bullies, but anytime they have spoken up they are mocked, villified, shouted down, and bullied by the NRA and its followers. Fortunately, the time has come where people who want more gun laws are not going to be shut up or stifled anymore. Our first amendment rights say we have a voice, too. The NRA will continue to bribe dishonorable politicians and attempt to buy control of the masses, but fortunately in this day and age of social media, the millioins of American citizens who want stricter gun laws do not have to just lay down and be walked on anymore.

I tried to word my post to make it clear that I was referring to only a segment, but needed to make that clearer I suppose. I live right in the heartland of gun country among good ol' boys who talk of stockpiling for the day the government turns on us and whose macho bravado revolves daily around how big their guns are and how many they own.
There is no good reason why we can't have limits on the types of weapons the average citizen owns, or enforcing laws that require background checks even at gunshows, and that require stricter laws in order to keep any weapons out of the hands of mentally ill people.
I have not read a single post anywhere since the Newtown shooting where somebody said "let's take away all guns." If you have seen one, please tell me where to locate that post, the name of the article, and the number of the post. I would be interested in seeing it because gun advocates here maintain that people are saying that, but I have not seen one single post anywhere that stated that.

Of course I don't have the article and post number, I don't need it and neither do you, and I don't care that much about proving anything to you. Just hang around for a while, though. EVERYONE (except you apparently) has probably seen those posts.
There have been proposals (not just in these mindless forums, but from politicians, news outlets, so-called "gun experts", other news forums that I read, etc.) to "come in through the backdoor" so to speak by making gun ownership prohibitively expensive. The thought was that, if we can't ban guns, then raise the price of ammunition and gun powder and highly tax it, require annual psych evaluations paid for by the individual, an ownership license (apart from license to carry, simply to own) and annual renewals, an "ownership tax" to completely pay for all the new regulations and enforcement thereof, special insurance on each individual gun, a requirement to register not only the gun, but movement of the gun through the public (as one man described it in this forum, requirement to report to the police that you are taking your gun from point a to point b, and the route you will take), geo tags to be placed on each instrument to prevent undocumented movement from one location to another and to alarm police officers in the area. So many off-the-wall, probably impossible to enforce regulations as to be insane. Yet they have been proposed, both here and in the media. Read, man, READ! You'll see them.
C'mon, people, please. I know there are extremists in every group, but there seem to be an inordinate number of people like this in the "gun control" crowd. How would you like it if your pocket knife were subject to the same overkill regulation? After all, knives can kill, too. (Don't come at me with the "number of people killed in 2 minutes" BS. Remember your mantra, "if it can prevent one death, it's worth it." Knives kill one at a time.)
Most reasonable gun owners have no problem listening to, discussing, possibly agreeing to reasonable, prudent, effective gun laws. It is the lunatic fringe in the "gun control" crowd that cause us all to be skeptical of your true intentions.
I have read that there are currently about 20,000 "gun control" laws on the books in this nation. Those 20,000 couldn't prevent the Aurora, Sandy Hook, Giffords massacres, because criminal and criminally ill people don't know about, don't respect, don't care about those laws. If the 20,000 we already have are ineffective, then get rid of them. Enact some reasonable and effective laws. Law just for the sake of a law just doesn't work.

I'll keep looking for those posts that say "ban all guns." I cannot say that I have seen even one and I post in this forum quite a lot. Perhaps there are one or two individuals with extreme anti-gun views, but I have not stumbled across them yet. Wait ... I do think I might have read one that responded to a post I made about the 1996 Dunblane Scotland massacre of schoolchildren where all handguns were banned in the UK after that slaughter and how the UK gun homicide rate is now one of the lowest in the world.
Anyway, I am not against all guns, and have made that clear in all my posts. Actually, you and I are probably closer in our thinking than we realize.
As you said, enact some reasonable and effective laws, and (my addition) enforce them.
Don't let the NRA or the anti-gun extremists on either side influence a sane and rational solution that will satisfy most everyone and help save a few lives as a result.

Honestly we need to do things like take this stuff out of the media, we are trained in the Military, becuase of the war against terror, not to glorify what these terrorists do, the punks in Aurora, and Newtown are just that Terrorists, but as much media attention as they garner, and allthe blogs all over the internet, it just highlights it, and gives them fame, and helps other terrorists, see what they have to strive for.

And as forSpeed of shots, I was not there, but I know both from my schooling in Law Enforcement and My Military training, that people in shock do not always remember things how they actually happened but remember things much worse, and in some cases may have not seen other events that also happened. I know for myself that I have missed things in a firefight that my buddys 50 feet away saw and heard, and they in turn did not see or hear everything I saw. ANd at times others have seen and heard stuff , but which turned out to be vastly different weapons.
And I read in an Artice today where the Gov of NY made a statement way out of line when talking about Gun COntrol "that Confiscation of currently owned weapons was to be considered". He made that statement only once, realizing the mistake in saying it and the furor it would cause, but if he said it that means he beleives it, and it probably means he is not the only gun control advocate who agrees, and while you may not, your not the rabid, mouth foaming member of your beleif as I am not the uneducated, caveman redneck of my side, though I am a good country boy up in the great white north of the midwest and I know and have as friends people from both camps and all stripes of those camps.
We need to curb the symptom causing this not the device, the Mentally ill and criminals are the symptom not the gun, laws to stop them are fine , but not laws to take away the guns, those are just tools same as an adze, or a saw.

Unlike Congress, I believe citizens like you and me could come to a meeting of the minds and find a compromise on this issue that would satisfy both parties. If this is so, then it is important for us to encourage others to find middle ground as well. I am hopeful that Gabby Giffords and Mark Kelly will help us on this road to a safer America.

I'm not an attorney, but I have to think this bit of information is significant and important. If he bought the ticket well in advance of his crime, it suggests premeditation, making it possible to charge (and convict) him of premeditated murder - a more serious charge. If he bought the tickets in advance, as well as entered once to block open and door and a second time to bring in weapons and commit the crime, it makes it much more difficult to claim he was insane as he was capable of relatively complex planning.
I think it's obvious to even a casual observer that he carefully planned this out long before the event. You don't just suddenly, haphazardly appear at a movie theater dressed in armour and armed to the teeth. When he bought the ticket is almost irrelevant in light of all the other preparations he took. Life in prison without parole. I doubt he'll even go to trial.

@Amused fully automatic is 700-900 rounds a minute or 10+ times faster then semi-automatic. Due to the barrel and heat build up however a rifle cannot shot that many rounds at a sustained pace.

Not according to our resident weapons expert KenN (post 1.53) he even is proud to claim his profienciency at reloading his revolver in that time period and still have the acumen to be able to hit moving targets easily. His definition is that a rifle has to be fully automatic to be an assualt rifle, I guess when the selector is switched to semi-automatic it transforms into "not an assualt rifle"
The M-16 that I carried in the military had both Auto and Semi-Auto settings. It certainly was an "assault rifle". The AR-15 is simply a civilian version of the same weapon. The point of my comment is that fully automatic is not necessary to kill many people quickly, nor is it necessary to constitute an "assault rifle". If you need a 30 round clip to hunt then you should restrict your hunting to the meat case at the local supermarket. We need to start the discussion with eliminating these and making it criminal to tape two smaller magazines together so that you can quick change them. Most will follow the law. The bad guys will do whatever the hell they want to anyway.
Hunting and 30 round magazines have nothing to do with each other, which is why that argument is non-sequitur. The right to keep and bear arms has nothing to do with hunting.

Every antidepressant I've seen, or used, carries a warning right on the bottle, that one should immediately consult one's doctor if one experiences mood swings, homicidal or suicidal thoughts. There's a whole lot more that are listed in the accompanying literature. And if he was unable to perceive the changes and thoughts, or process them accurately, he should have been monitored by his family.
Sometimes these products can be useful, and sometimes they can be harmful. If you have family or friends who use such drugs, keep a discreet eye on them. Early warning signs can be spotted, and used to adjust the medications.
That said, I think we need much stronger procedures for evaluating mental illness, and for deciding when it is OK for a mentally-ill person to be allowed to own them. My vote would be for never. Even the Framers would know about that. There were plenty of mentally-ill people in the colonies, too.
Why, oh why, didn't he point a gun at the officers so they could have just taken him out at that time. Then none of this trial crap would be necessary. I can't believe that there are scum attorneys in existence that would defend a person like this. Insanity or not. I also can't believe that through taxes, we are paying for all of it. The news article mention about a timer being set but did not do disclosure to say it was ON. So, assume it was OFF so subsequent events can provide outcome of news you are reading. This assume holmes left it off (devil?) or forgot to turn on timer (human!).

I was amazed when reading what he used to boobytrap his apartment. I think I read somewhere that he was a borderline genius and I can see that reading all this. I only wish his mind had been working towards good not evil. Actually Greg the right to bear arms is not tied to being a member of a "well regulated militia" , the two are linked as being part of what helps keep the security of the state, but if you do want tie them together, by the rules in most states which have not been changed mind you all males between the ages of 16 and 60 are in time of need considered part of the militia by the state, and are required to own a firearm suitable for that purpose if they have the means. Do you own a firearm?
I would disagree. Though militia not being what it was it's intent is the ability of the public to protect itself. Our military and police can not do it all and it only takes watching the news to see that.
