Judge denies Manning motion to dismiss charges in WikiLeaks case

A military judge denied a motion to dismiss charges against Army Pfc. Bradley Manning, who is accused of providing reams of classified documents to WikiLeaks, but agreed that Manning should have a 112-day reduction from his sentence, if convicted, due to mistreatment during confinement.

Col. Denise Lind, who made the announcement during a four-day pretrial hearing that started Tuesday at Fort Meade, Md., said that Manning's confinement at a military jail in Quantico, Va., was "more rigorous than necessary," and "became excessive in relation to legitimate government interests."

Even so, Lind said dismissal of charges is "not appropriate," and would make sense only in the case of "outrageous" conduct on behalf of Manning's jailers.


Manning faces 22 charges, including aiding the enemy, which carries a maximum of life behind bars.

His defense attorney David Coombs argued that the military held the 25-year-old intelligence analyst in unduly punishing pretrial conditions for nine months after his 2010 arrest.

A 28-page motion filed in August said Manning was locked up alone in a small cell for nearly nine months at Quantico and forced to sleep naked for several nights — treatment his lawyers say constituted illegal punishment.


The document said Quantico officials operated in a culture where "anything goes" and "nobody is held to account for their conduct," willfully ignoring the advice of medical professionals who did not support the solitary confinement.

Jailers at the Marine Corps brig in Quantico testified that they considered Manning a suicide risk and that they were only trying to keep him from hurting himself and others by keeping him in a windowless, 6-by-8-foot cell for 23 hours a day.

In December, prosecutors conceded that Manning was improperly held on suicide watch for seven days and recommended he get seven days' credit at sentencing.

Manning has been held in pre-trial detention since May 29, 2010.

The judge's rejection of the motion to throw out the charges had been expected by legal observers.

This week's pretrial hearing includes arguments on whether Manning's motivation matters.

Prosecutors want the judge to bar the defense from producing evidence at Manning's March 6 trial regarding his motive for allegedly leaking hundreds of thousands of secret war logs and diplomatic cables. They say motive is irrelevant to whether he leaked intelligence, knowing it could be seen by al-Qaeda.

Manning allegedly told an online confidant-turned-informant that he leaked the material because "I want people to see the truth" and "information should be free."

Attorney Coombs said Tuesday that barring such evidence would cripple the defense's ability to argue that Manning leaked only information that he believed could not hurt the United States or help a hostile power.

Manning has offered to take responsibility for the leaks in a pending plea offer but he still could face trial on charges that include aiding the enemy.

I agree with this. Put him in prison for the rest of his life. When he dies make o note on his death certificate that he could leave 112 days before that.

An American soldier who turns his back on his country and becomes a traitor deserves no civil rights. He has dis-owned his country and should not be given the privilage of it's protection. Plan and simple. Hang him.

There is no doubt in my mind that it is an act of treason. The evidence was laid out plain and simple. Not only that, but manning even admitted to doing so. They(our U.S.A) may not necessarily kill you for acts of treason any longer, but Manning should face life in prison.

Let that be a reminder to those that decide to join the military, once you sign the contract, you are hereby United States property. Your opinions do not matter, and your political affiliations do not matter. The people you answer to are your NCO's, your General's, and your President(Commander in Chief). Any Actions that disregard your commanding officers orders as well your duty to your country should be held accountable to the fullest extent.

I' am sorry but, going out on a limb here, I'll bet you that 99 percent of the people who are currently incarcerated would tell anyone who will listen or could who gives a dam, that they think their confinement is "inappropriate." I, for one, can not understand just how in the heck, does the condition of confinement have ANYTHING to do with the question of whether or not to dismiss all charges. Two completely separate, unrelated issues.

We need to make an example of Pfc. Bradley Manning.

Telling the truth shouldn't go unpunished in America.

Besides, if we're soft on Pfc. Manning, other people of conscience may emulate him and more of our war crimes may be exposed. We can't have that!

Let's get the hanging over with so that we can concentrate on fabricating the pretext for our next resource war.

As the wife of a career military man, I am outraged at the molly-coddling and pacification this little weasel gets! TREASON (and why are supposed "news" agencies so afraid to use this word?) is a crime against every single American- he played Russian roulette with our LIVES, it is a crime against the country itself, and a crime against the military.

Just get on with sending the little puke to Leavenworth so decent people can forget him. THAT will be his punishment- being totally ignored and forgotten. Also, I don't think he should be buried on American soil once his life ends. But that's just me, and possibly not a good way to think, but hey, it is only thinking that Manning himself caused.

George pauljohn.... (what happened to Ringo??!!) We did not need this guy to show us the crimes of the Bush/Cheney regime. Anyone with half a brain could see what they were up to 10 years ago. However, we are dealing with militay law... you know...the uniform code of military conduct and all that good stuff. Military justice is much more strict and offers no "wiggle room" in interperatation, unlike civilian law. It doesn't matter what the information was. It could have been classified information on the recipe for Mrs. Field's cookies. He chose to break his oath and post classified information for the world.... including our enemies....to see. He has confessed to this crime. It is likely that he will will be given a life sentence, which is merciful compared to hanging or a firing squad.

So... if my being analytical shows a lack of compassion or mercy, I am sorry. We are dealing with the military criminal code. The military demands a much higher level of accountability.

But seriously, drop the most serious charge and take his plea deal before we spend another million dollars on this. Do you folks realize that your tax dollars paid to have a previous Garrison Commander flown in from Afghanistan to testify at a hearing (not trial) and then flown back a couple of days later?

They have paid for his ex company commander (while in pre trial confinement) to come and testify on multiple occasions even though he is now stationed elsewhere?

You tax payers are paying hundreds of dollars a night to house Manning while he is away from Fort Leavenworth (and he's been away for months this trip). Those Soldiers you see escorting him around are from FT Myer and are drawing TDY and lodging money every time there is another hearing. Plus, Manning is drawing full pay while in pre trial confinement because he hasn't been convicted. He's been locked up for going on 2.5 years now.

Do the math. We are spending MILLIONS of dollars trying to get a conviction on a guy who is ready to plead out just so a bunch of lawyers can get another feather in there hat. Stop wasting OUR money and just take the plea and get down with this whole mess.

if your commander breaks the law, and you expose him for it. that is not "Treason". There is no enemy. People in iraq where murdered routinely and this kid exposed it. The leaders and then president broke the law. They also sent in mercenaries who shot people at random to get the insurgency started.

think back. when our tropops came into bagdad, the iraqi people where celebrating. a few weeks latter, they where shooting at us. what happened? men fromm Ageis (a security firm) and other companies, put on military uniforms, ran around in Milatary vehicles and shot people. maybe you remember the early days of that war. the news showed 4 people who had been burned to death and where being draged through the street. Those guys where the mercenaries and they where killed as they where murdering civilians,. the civilians fought back and be came the "insurgency".

People of the same company took over the operation at ABU Grab prison and the torcher began. Children raped in front of their fathers to get information was among the tactics. two american pfc's went to jail and the private security guys went home with cash filled bags. General karpinsky was blamed even though she was not allowed on her own base. and relieved of duty and rank. This guy exposed this kind of thing. God bless him. I hope the rest of you have a high tolerance for heat when you get to hell.

The government is going to have a very hard time proving he intentionally provided material support to the enemy for the simple fact that he could not have known what was in the 400,000+ documents that he "leaked", which is also the same reason he can't claim whistle blower protection. A vast majority of what he released was worthless old information that didn't hurt a fly other than the feelings of some diplomats who should have known better than to insult their counterparts in official email traffic.

Everyone has a right to their opinion, and I'm basing mine on what I know about PFC Manning's situation. There is very little doubt that he is guilty of providing classified documents to Wikileaks, and he will no doubt get convicted on that alone. However, the government's case is pretty weak about the most serious charge, and couple that with the Judge's ruling that he was mistreated at Quantico, Manning stands a good chance of winning on appeal of any guilty verdict. Accepting his plea deal will send him to jail for a few more years and ensure that he cannot profit on his crime when he gets out. If the case is thrown out on appeal, he stands to make millions for his criminal acts and will be treated as a hero by many left wing anti establishment folks. We are approaching 17 trillion in national debt, spending millions more on the chance of getting a few more years in jail just for the sake of saving face is not worth the cost or the risk of losing everything.

    Most people up here posting that are wishing him death don't even know half the details of the case.

    Here's the logic in this I've been able to see: Most Americans say you don't trust the government, Manning supposedly releases cables that show that the American government has not only been lying to other governments around the world, but it's own people, a open-and-close case of governmental deceit, but these Americans who are so distrustful of government believe every word that comes out of Washington's mouth.

    Am I missing something here? You boys and girls sure do love shooting yourselves in the conceptual foot.

    There are some people who honestly believe everything that the government says, even while they admit that they don't trust the government. The far scarier people, however, are those who seem to derive some satisfaction from the idea of the government lying constantly to us as if this were a normal, expected, and laudable thing to be doing.     They are sworn on the Constitution to defend this country from enemies both foreign and DOMESTIC. Lots of people remember that last word but when someone properly implements its usage, oh my how the chickenhawks come out of the woodwork. For the past decade our constitutional rights have been trampled upon over and over. We are going bankrupt because of us fighting in two wars, one of which should have landed a bunch of the previous administration's tops in a court of law. There is an obvious disconnect between Washington and the common man, and if you had paid attention to any of these cables, you would have seen where Washington secret files did not match their actions.

Medical staff can tell you how they disagree with conditions all day but unless it is a direct threat to the physical well being of the individual or the psychological well being, then the threat of self harm or harm to others trumps your violin for a criminal. Yes this kid swore an oath against foreign and domestic but he also swore to uphold the US Constitution and as a servicemen who handled classified intel, he swore to protect and keep all material from every getting into the hands of enemies, foreign and domestic as well.     Rob, the UN had already taken and secured any Wmd's from the gulf war. One of the few things left where the super high explosives kept locked in a warehouse waiting for trasnport out of Iraq. Those explosives where ignored by the Bush people and where latter used to make IED's. So tell me again how this war was for WMD's. Please. "Obumas" didn't start that war, or the other one. As far as this case it is fairly straight forward. Despite what manning felt about DADT, despite what manning felt about anything to do with the war, HE did not have the right to release confidential documents to the world. Pfc Manning is not bigger than the US Military or the US Government. Calling this weasel a hero is a slap in the face to all the patriots in our country. A Pfc in the Army does not have the authority to release info and then try and justify it based on personal and political beliefs. He deserves life in Leavenworth breaking rocks.

      Julian Assange is an Australian national. I think you're confused as to what Wikileaks does. Wikileaks is an open source that accepts undisclosed information, meaning they don't name their sources or request it to be published. It's meant so that people in countries where governments attempt to restrict information can do so without threat of persecution.

I just think some of you people don't understand. When you stand there and take that oath it means something deep inside.
