86-year-old woman charged after bringing BB gun to town meeting, police say

CONNECTICUT -- Westport police arrested an 86-year-old woman accused of bringing a BB gun to a town meeting.

When detectives retrieved the gun, Estelle Margolis, 86, of Westport, Conn., told officers she brought it to make a point during a discussion about gun control to show how easy it is to purchase a gun, according to police.

At 9:15 p.m. on Tuesday, a Representative Town Meeting member approached a Westport police officer and reported that he and another RTM member believed a woman walked into the auditorium with what they believed was a weapon under a white cloth, police said.

The Westport officer and a detective retrieved the rifle from the auditorium where the public meeting was in session and then found Margolis in the main lobby, police said.

Officers determined that the rifle was a BB gun rifle and Margolis told officers that she was planning to go up on the stage when the topic of gun control came up and make a point to the audience on how easy it was for her to purchase the gun, according to police.
In addition to the BB gun rifle, the woman had a box of 46-caliber pellets with her at the meeting, police said.

Margolis was issued a misdemeanor summons for breach of peace second and is due in court date.

“Regardless of what her reasoning was to bring the BB gun rifle to the meeting, it was a poor decision that created alarm and concern to the public. This incident could have clearly escalated into a tragedy,” police said in the news release.

Wow. Where can I get a BB gun that shoots 15/32" pellets?

Lots of companies make them and most stores that deal in high end pellet rifles sell them. A quick search will find you a store.

ottermann,

denver bill 2 was talking about a plain BB Gun where the projectile is much smaller & less powerful than an actual "Pellet Rifle" which has power close to that of a 22 rifle or handgun.

please dont speak unless you know what you are talking about, a pellet gun is not as powerful as a 22 not even close. it is a hyped up bb gun for all you idiots that know nothing, yet, spew hot air like you invented the gun, pellet guns come in several different calibers. when i was a kid we used to shoot tin cans etc with them, it absolutly cracks me up as to the panic in america these days. for god sake dont walk out your front door you might fall and hurt yourself. panzy usa guns are not illegal in the usa the last i heard, the paniced public is a severe problem though. there was no reason in the world to treat this woman like a criminal. the out of control public needs an enema. I cant think of words to describe the childish like imoral values used in this case, A 6th grader would have known better. fools just fools.

She purchases a BB gun to prove how easy it is to buy a BB gun then brings it to a town hall meeting? It only proves how ignorant the general public is on the purchasing and use of firearms. The only requirement for that purchase is to be 18 which i am pretty sure she looked older than that!

This woman wanted to demonstrate the ease of buying a BB gun? A child's toy? A non-lethal rifle? As if it's the same as buying an actual weapon that uses bullets? Keep an eye on this old lady. She's probably got 48 cats at home and confuses her brake pedal with the accelerator. Sheesh.

RL19, I see you don't have a clue about air rifles. The RBS will shoot over 200 FT faster than a 22cal short. Either way that was a chicken @!$%# charge against that lady.

She paid $600 for an Air Rifle used for hunting medium sized game to make a point?? She could have bought a nice .22lr rifle for half that. And I doubt she could have walked in to a town hall meeting lugging that beast unnoticed. I call BS on the caliber. Almost all air rifles sold in the US are either .177 caliber or .22 caliber. Both are projectiles under 1/4 inch in diameter. A 46 caliber is just under 1/2 inch in diameter, larger than 99+% of ALL handguns sold today.

Air rifles have been around for HUNDREDS of YEARS and bring down BIG GAME.

PROOF
Air Rifle used on Lewis and Clark Expedition.
http://www.lewisandclarktrail.com/lewisairgun.htm

Air rifles come in various calibers. 46 is a typical medium game round. A Benjamin Franklin pump air rifle has a muzzle velocity of anywhere from 1100 to 1500 fps(feet per second) a .22 long does 990 fps.

Now, which one is faster?

The lady, while seemingly insane, DOES have a valid point.

John Carr,

Your arse is out. Check the ballistic tables on .22 rimfires and you will see that none are rated below 380 fps.

The stupidity level in some of the comments here is off the freaking chart. The woman brought a rifle into a meeting hidden under a cloth. Who knew what her intentions were and who can tell from a glance if it was real or not. Should they just ignore it and end up like the guy in Florida who showed up at the school board meeting in 2010 and opened fire before killing himself? Some of you jokers act like they should assume it's not real until proven otherwise. What kind of sick retarded logic is that?

Let me ask you this, smart*sses. Suppose this lady walked up on stage, dropped the cloth and held out what appeared to be a real rifle? Suppose someone with a concealed carry permit reacts thinking to prevent a mass shooting and shoots this woman? Not only does she lose her life over a dumbass act on her part, but now someone gets to spend the rest of his life knowing he killed someone over what's later found to be a bb gun.

To blame the cops and call them idiots for taking her gun and citing her for breach of peace before she could carry out her plan is just plain idiotic.

Why would she buy such an exotic air rifle? I never even knew any caliber air rifle pellet above the miniscule .22 existed.

I read the psi requirements for that, you would have to have an O2 tank pressurized to several thousand psi to the 600 psi required to push such a huge projectile. I amazed its' use started in the 1800's, how did they get that high a compression back then?

I should get one, air rifles aren't quite as regulated as firearms are. In fact there is no restriction that I know of in my FFL rulebooks.

Not RBS. RWS and the pellet (.177 cal.) is lightweight and sheds velocity at a rapid rate. They can be lethal at short range but not nearly as deadly as a .22 cal. rifle at even a modist range. It sounded like she purchased those soft pellets that kids shoot at each other in the back yard. We used to shoot eachother in the butt with our Daisy Red Ryders. Hurt something awful but no penetration. There are also .20 cal. pellets and .22 cal. pellets for air guns of those calibers too. If ignorance was gold this site could pay off Obama's national debt.

Ok kids..they said they "determined"...which meant it looked like a regular gun...which meant there was a possible threat of a real gun...which meant they didn't know what it was capable of until they looked at it...which meant they didn't KNOW it was a BB gun...which meant they had to err on the side of caution...which meant they did the right thing...which makes us all wonder, after all the @!$%# that has happened, WHY would you be surprised this happened.

Use your common sense, people. If your family was at that meeting, what would you have done? I know some of you think the Bill of Rights makes it ok to be careless and stupid, but the authors were probably counting on people being quite the opposite....

Don't bother with logic bluepanther20. Too many of the chumps around here are so rabid about the gun control issue that to them it's perfectly logical and permissible that someone sneaks a realistic looking rifle into a large group of people with the intent of shocking them. How dare the cops err on the side of caution!

      @arslp

You are absolutely correct. There was a very good likelihood that had she whipped this gun out on stage as she planned, she would have been shot by either one of the cops there or by someone legally carrying. Of course if the cops had shot her, the rabid gun folks would have screamed murder. And had a citizen done it, they would have been applauded for their actions in defense of the crowd.

      Freakin hypocrisy...

      RL19, you don't have a clue.

A .457 pellet gun (144 grain ball) at 800 fps hits harder than a 22LR.

22 LR has about 125 foot pounds of energy. 144 grain ball at 800fps is over 200 foot pounds.

Up the psi in the pellet gun and use a lighter .457 bullet, and a 22 magnum can't hold a candle to it...

The Girandoni Air Rifle is lethal to 150 yards. And was first produced in the 1700's...

DUCK! She's got a BB gun, she'll bruise us all! Get real, folks. Most BB guns are in the $20 to $50 range. Air rifles, slightly more dangerous at distances up to 50 yards or so, run $50 to $4000, depending on quality. The best rifles are fine tuned for accuracy at 33 feet, and used in serious competition. The hunting rifles in .177, .20, and .22, can take down squirrels, rabbits, other small game at short distances, typically less than 50 yards. .22 cal rimfires are actually deadly, since the typical lead airgun pellet weights less than 8 grains (7000 in a pound), and the typical .22lr is 35 to 40 grains. There is a really nice pellet rifle in .25 caliber that can actually take down a feral hog, but that gun costs something like $1000. Since neither BB guns or air rifles are firearms, they do not require background checks, merely proof you are over 18. And that is merely to purchase, not to own. My son owned his Daisy Red Ryder at age 12. Also, typically, you buy packages of pellets of 250 to 500, and BB's in packages of 500 to 6000. No big deal, except to those who have no concept of it. I went into Canada once with my air rifle, a very fine HW55, that shoots a .1 MOA. Border agent was confused about it, until I called it a BB gun. It isn't, and that hurt my pride to use the term BB gun, for such a fine air rifle.

Here are some things. She had this gun (even though it was a BB gun) concealed under something. She could have put someone's eye out! But, she had a right to carry it openly into this meeting under the law. You need a permit to carry a concealed weapon. But you can stap a .45 onto your belt and by the law, you should be able walk into any Walmart as long as you purchased that weapon legally.

People, you have to remember this is NBC so you have to read the links they give you so their poorly written articles make sense. If you hit the link on the NBC Connecticut article link then you get the source article. She had 45 caliber ammo, a box of pallets and a bb gun. I seriously doubt she had an obscure box of 46 caliber pellets but if she did it wouldn't fit her bb gun. There are some pretty serious air guns out there but she most likely bought a $30 Daisy Red Rider; Ralphie, eat your heart out. She was just randomly buying things that an 18 year old can buy.

Had she brandished the BB gun on stage, the publics initial reaction would have been panic. he police in attendance would have drawn their guns and targeted her, demanding she drop the weapon. If, in the confusion of the panic she unwittingly caused, moves the barrel of the gun so it faces the crowd, BOOM! Cops shoot her.

People could be hurt in the panic, she could get shot, she could accidentally fire the BB gun, (you'll shoot your eye out, kid!), a stray/ricochet from a police fired bullet could strike another person....

Yeah. It could have been a tragedy. It wasn't. And if she had revealed the gun on stage as she planned, it probably wouldn't have turned into a tragedy. But it could have. It easily could have.

I think most of you on here are idiots, like cops. You all missed the overall picture, grandma bought the BB rifle in an effort to prove that it's easy to purchase a weapon. A Mcguyver type of person can actually modify the rifle to a more lethal weapon. But the biggest issue that she proved unbeknownst and without premeditation is that she managed to sneak that rifle into the auditorium. Had she actually had deadly plans with intention to kill, it may have been too late by the time someone discovered it. Which is why the moronic, cowardly cops with no common sense, and their fragile ego were compromised with embarrassment. Hence as to why they arrested her. Think about that.

Deerhunterbow1, Depends where you live. Not sure about the laws in Conn, but in NJ a bb gun is a firearm and you need a firearms ID card to own or buy one. Stupid law but a law nonetheless.

Counter to what the story reports, a BB gun is NOT a "rifle." That's for sure. Whether or not it could even be used as a weapon is less clear, but if so, it's in the same category as a slingshot. (By definiition, weapons are employed against adversaries, victims, etc. A rifle is not a weapon when used, for example, to shoot at paper targets on a rifle range.)

That said, good judgment was absent from a decision to bring something that looks like a rifle--because rifles are usually thought of, and are most often employed as, weapons--to a public gathering.

I am pro-gun. But what she did is scary to people, especially today. No one walks just around with guns unless they have a concealed carry permit or are of law enforcement. It was unnatural to do what she did. Actually, she could have been shot by an officer.

Thank you for your "in the real world " comment. Here in Montgomery county Maryland, a BB gun is a firearm ! So is a sling shot, a fiberglass target bow with a 30lb draw and lawn darts.

            I'm not kidding !

See, we don't let our boys play with war toys. We teach them to run, hide and pee their pants instead.

Actually, in most places in the US, a person does not automatically get arrested by bringing a weapon to a public meeting unless the weapon is brandished, concealed without permit, or illegal to posess by the bearer. A group of local "concerned citizens," in fact, for some ungodly reason only they can understand regularly bring openly-carried legal handguns to the city commission meeting in Grand Rapids, MI. This causes the police to hold up the meeting while gun permits, ownership papers, identification etc. are determined and these citizens are kindly asked to "...please stop making trouble," while they yell and make noise about their rights to own a gun - which nobody disputes, by the way. The point is, why do you want to make a scene with your gun? You have a right to own a tennis racket, too, but will you bring it to a meeting and wave it at people while swinging it around in the air and yelling? Does this make you feel like you have made some sort of point? I have several guns and a permit to carry them, but no other person needs to know I have one with me and I surely don't need to bring it to any meeting I'm going to...

Thing is Idaho-Steven, bringing guns to public meetings increases the risk of assasination of a public representative. Gabby Gifford is one example. If you have some time research the shooting of Mayor Loveridge in Riverside, California a few years back. If I were a public figure with an armed audience, I would be afraid to make any proposal that might cause hostility. I've tried to look at all of the Amendments to determine if any of them are applied as absolute and without exception, and I can't name one. I agree with the right to bear arms and at this point trying to ban anything that is popular in this country is and has always been a negative experience , prohibition and marijuana to name a few, but the right to arm has limitation and exceptions, it also has, like all other rights, an equal measure of responsibilty. I wouldn't have arrested Grandma. Once the officers learned of the intent, all they had to do was confiscate it for a few days and give it back and tell her not to do it again. Those pellet pistols are used quite frequently for strong-arm bluffs. Most victims don't take the time to look down the barrel to tell whether it's a firearm or and air-gun

I AM A LIBERAL, with guns, trigger locks and they are locked away with bullets elsewhere. It is called responsible ownership! I swear, they opened the flood gates to the nut houses with you irresponsible people. With any right comes responsibility. I own several gun, am a woman and am 67 yrs old. Learn to properly use a weapon as a kid in the desert for good reason. I don't give a rip who uses executive rights as long as something is done to keep automatic weapons away from nuts like you. No more open gun shows and EVERYONE must have a background check. And this should go into effect on anyone that is renewing his gun permit! You people can't see beyond your own nose. Obama did NOTHING ABOUT THIS yet you fools have been buying up every gun you can get your hands on since he was elected. Now there is a run on the weapons we DON'T WANT on the street. Bet you were never in any war or saw anyone die from a gunshot. God, you people frustrate me! You just had to make this a liberal/political thing didn't you? If it had been me, I would have left a RIFLE in my car and gone and gotten an officer to escort me into the building and on stage! But then she only had a bb gun which is legal almost every place! Please, educate yourself about responsibility and rights!

sandyv; Please, educate yourself about responsibility and rights!

Funny, you claim to be a knowledgable repsonsible liberal gun owner, but you don't know that automatic weapons are already banned without a very difficult to obtain class III license, and that the "gun show loophole" is a scare tactic. You go to a gun show and try to by a firearm from any vendor on the floor and try to talk them into selling you a firearm without a form 4473....let me know how that works out for you. Private sales are what the media should be pointing to, but it doesn't carry the same "scare" as gun show loophole.

You would've just been better off spouting your rhetoric without lying about being a knowledgable, responsible gun owner. Now you prove yourself a liar AND minsinformed......good job.

USA...here in ALabama the gun shows are as popular as the football...and I have personally heard people around here talk about how easy it is to get pretty much anything. So much responsibility....

                      #17.3 - Wed Jan 9, 2013 10:20 PM EST

As you should be able to figure out from a biased media led agenda, what you "hear" and what are "fact" can be polar opposites. I don't claim to know Alabama law, but I'm 100% certain that you wouldn't get any vendor at any type of show that holds an FFL to sell you a firearm without a 4473. They are already under incredible scrutiny and would not risk their FFL to make that sale. FFL for you folks here that pretend to know about firearms and the laws that you keep thinking don't already exist means "Federal Firearms License".

Now is some Joe Bloe attending the show doing a private sale in the parking lot or making a deal with another show attendee? Don't know, but EVEN if thats the case, I am allowed in my state to conduct a private sale with another resident of MY state. But, law abiding citizens don't sell firearms to known felons. I have sold personal firearms on a few occasions to other residents of my state. The only way I will do it is if it's a relative that I know their history, or somebody with a valid CCH, or CCW permit. If one of those conditions don't exist, I will only let the firearm out of my hands through an FFL. I don't know any law abiding citizen that would knowingly risk losing their 2nd Amendment right to put a firearm into the hands of a felon.

But, we're using common sense here right? RIGHT, so lets scare people with words like Gun Show Loophole, Weapons of War, Assault Rifle, Unlawful sales. The only unlawful sales that I actually know about were conducted by our Government via the Obama adminstrations Department of Justice and BATF. But, it was intended to support a narrative and just blew up before they could complete the task. So, swept under the rug it went and on with the agenda! R.I.P Agent Terry and many Mexican Nationals who have died at the hands those firearms.

USA; that is a great post. I find it amazing how many anti gun nuts keep making it sound like we can buy an automatic weapon at gun show for a dollar without ever going though any background check. They have no clue of what they are talking about, just more useful idiots.

One point to add to your great comment; Have you noticed that since the fast and furious fiasco backfired on obama, holder and clinton that there have not been any more mass shooting incidents along the mexican border? kind of strange that almost everyday we had either clinton, holder or obama talking about how firearms from the border states keep going into mexico and that there was a shooting almost everyday on the news or one of them morons were on the news standing behind a table of AK's or AR's that were found at a supposed shooting in mexico. I kept telling my wife that all of the firearms being used were coming from the US government and they were going to try and take our rights away. Now that they got caught the shootings have some how moved into the USA, look at what has happened now and the anti gunners and libs are loving it!!!!!!
