James Holmes, accused of killing 12 people and wounding 70 others at a Colorado movie theater last year, is scheduled to be arraigned Friday after a judge ruled that there was enough evidence to take him to trial.
Earlier in the day, lawyers for Holmes, 25, a former graduate student at the University of Colorado-Denver, asked Arapahoe County Chief District Judge William Sylvester to delay an arraignment, saying Holmes wasn't ready to enter a plea. They gave no reason.
In an order filed late Thursday, Sylvester said he was convinced that prosecutors had established probable cause and ordered that a status hearing scheduled for Friday be converted to a formal arraignment. He ordered that Holmes continue to be held without bond on 166 felony counts, most of them murder and attempted murder.
The murder charges could carry the death penalty. Once Holmes is arraigned, prosecutors will have roughly two months to declare any intention to seek a capital sentence.
Sylvester noted the defense request and told prosecutors to come to court prepared to respond to what he said was a likely motion for a delay, however.
Scott Robinson, a prominent criminal defense attorney in Denver, said that was no surprise.
"It's not unusual for defense lawyers to want more time to prepare," Robinson said. "After all, the prosecution got a huge head start in the case."
The ruling came after three days during which prosecutors laid out some of their evidence against Holmes, who they said meticulously collected weapons and ammunition over many weeks before he went to the Century 16 Theater in Aurora on July 20 and opened fire on a sold-out audience for the premiere of the movie "Batman: The Dark Knight Rises."
They also described how they believe Holmes fiendishly booby-trapped his apartment, turning it into a bomb-filled death-trap for law enforcement.
The hearing closed Wednesday with prosecutors' showing Sylvester a photo, recovered from his cellphone, of Holmes smiling into the camera while gripping a semiautomatic handgun just six hours before the rampage.
"He didn't care who he killed or how many he killed, because he wanted to kill all of them," Arapahoe County Chief Deputy District Attorney Karen Pearson said.
Holmes' attorneys offered little response, calling no witnesses of their own and cross-examining only a handful of the prosecution's witnesses. Holmes sat impassively during the three-day hearing, the dyed red hair he sported in pre-slaughter photos replaced by messy brown hair and a beard.

Let the families of the murdered, the people of Colorado, United States and the world benefit from this murderer to die by lethal injection. All murderers are insane and all people who are against delivering this particular murderer to another place beyond life on this planet are more insane. I am tired of murderers being so precise in their planning and execution of humans only to claim they are insane. Let them be gone forever and in a fast track process.
The defense wants to delay things so they can continue building their case for an insanity plea. It is time to get this trial started so that it can end and the victims and their families can get some closure. Until this trial is over and done with the people effected by this lunatics actions can not really start to heal.
Let us hope he pleads guility,, save the tax payer money.. They will just give him life and then the taxpayer will really pay!!!!
This guy bought his movie ticket days in advance showing premeditation and chose to forgo movie theaters closer to his home in favor of a theater, that unlike others in the area, restricts the carrying of legal gunowners so the body count would be higher. We're debating on taking the rights of legal gun owners away when we should be sending a message to potential POS's like this guy that if you survive committing an atrocity like this, you would surely be executed in a similar fashion to pay for the crime.
Also, going forward, the media should be limited as to what information about the perp. is released to the public. They should not become "somebody" as a result of such reprehensible behavior.
He is mentally ill which means that he was insane at the time.We as a civilized society do not put mentally ill people to death.It seems that nothing has been learned by reading some of these posts.If you would read up on mental illness maybe you would spend the time advocating for mental health care so that this will not happen again.We need a solution not a hateful wanting to see him die.
Well, you see...even if he pleads insanity...he will be institutionalized for the rest of his life. They might let him out on a short leash when he is an elderly man if he has been good, but no matter what we are never going to bump into him in the grocery store. So I'd rather him not get the death penalty. I'd rather have him and people like him suffer for the rest of their lives. Death is no punishment...living in a straight jacket or a prison cell for the next 50 years is. Yeah it sucks that the tax payers have to pay for it, but I think this is a case when it is worth every penny.

He may be mentally ill, but often that is a concurrent and not a causal aspect of a crime. He cleary planned this, which shows he has the ability to think clearly enough to organize a intricate plan and implement it. The reasons behind it may be based in delusions or madness, but does not mean he does not know right from wrong or is too ill to be held accountable.
I believe our country needs a better mental health system and a better understanding of mental illness. However, we also should not excuse crimes committed by those with socio-pathic or antisocial behaviors or personality disorders; by defintion and diagnosis clinical treatment shy of severe sedation and structure/supervision will not improve the signs and symptoms for those individuals or deter their destructive behaviors. There has to be a better way to assess, treat and deter or detain for the safety of the individual and community.
He is obviously insane, but that should not be a reason stall the death sentence.

owning guns. While background checks need to be mandatory for all purchasers we need a mechanism to
address the problem of current gun owners or people residing with them who may have slipped into mental illness. There should be a way for family, law enforcement, neighbors, and other concerned citizens to request an evaluation. If the person is found to be mentally ill by a competent mental health professional, a legal hearing should commence to adjudicate the removal of the guns and that name be placed on the registry to prevent further purchases.

Personally, whether in prison or in a hospital, I think spending the rest of my life locked up and not allowed to make decisions for myself, what room I occupy at any given time, what I do, what I eat, when I eat, where I eat, who I eat with, where I go, what medicine I take, how much time I spend out doors, what I can see of the landscape, if any, when I sleep, where I sleep, never a cold beer on a hot day or a sip of cognac on a cold night, and worst of all--who my "roommate" is, etc. (no wait, worst of all is never again having intimacy with a woman!) and knowing this will never change would be worse than knowing exactly when I will die--by a relatively painless method (injection that "puts me to sleep").
The rest of my life is a long time, even if the rest of my life is only one day.

I was discussing this terrible tragedy with a co-worker yesterday and both of us were referring to holmes as "the Aurora killer", "the nutjob in Colorado", some other names and it occurred to us...we can't remember his name. The deed comes through loud and clear but the name??? Pretty much dropped from memory and our discussion took a turn with the realization that these people committing these hideous crimes are forgotten. The crime is certainly remembered but the perps??? Nothing more than a page on Wikipedia.
He was a smart guy. Too bad he couldn't have become famous the old-fashioned way by doing good for humanity. Then he would have become someone worth remembering.

Demons do not exist. Hearing voices doesn't provide evidence of mythological beings. It provides evidence of a brain in crisis, that's malfunctioning. The brain is a hugely complex organ, and defect in one area doesn't mean the entire mind ceases to perform its other functions. This person is highly intelligent (more so than most of you), so a defect in one area of his brain doesn't mean his high intellect was rendered inoperable.
Let me make it very plain: The ability to make plans of varying complexity is in no way indicative of sanity. Being insane does not specifically, invariably, or necessarily impair your complex, upper-order thinking skills to the point of incapacity.
An insane person can still easily be capable of making complex plans.

My biggest question would be why didn't the school psych he saw alert authorities of his condition.??.As well as the parents that seemed to have know of their son's mental illness ??..Where were all these people who know this was a great possibility.??..Why are they not being held as part of the problem??...Do they get to walk free ??...Are they not part or a big part of the problem? since their intervention could have stop this from happening in the first place.
