Man must write 'sorry' letters to airplane passengers over explosives hoax

A pizza cook who admitted making a hoax call warning of liquid explosives on a plane, causing the flight to be diverted, must write an apology letter to every delayed passenger.

Kenneth Smith Jr., 26, pleaded guilty Monday to malicious false information about an explosive, and false information and hoaxes, according to a press release from the U.S. Attorney’s Eastern District of Pennsylvania Office.

The Philadelphia man's call to airport police led to US Airways flight 1267, bound for Dallas-Forth Worth, being diverted back to Philadelphia airport shortly after take-off on Sept 6.

Sixty-nine passengers and five crew members were on the plane.

Smith faces up to 15 years in prison and fines of up to $500,000 when he is sentenced on April 16. He has agreed to pay restitution and write an apology letter to every passenger who was on the flight when it was delayed, and reimburse the emergency response costs, prosecutors said.

Smith’s reasoning for the hoax, according to federal prosecutors, was to target a passenger on the flight, Christopher Shell, who was at the time identified as the ex-boyfriend of Smith’s girlfriend.

Reportedly Shell had posted a compromising photo of the woman on Facebook.

Shell was removed from the airplane in handcuffs. He later wound up making it to Dallas where we was arrested on two outstanding warrants, police said. NBC Dallas spoke to Shell in October about the plane hoax and how it derailed his career.

Stupidity knows no bounds, nor the lengths others will go to, nor numbers they put others through for mind games. How glad I am that this immature individual must write letters to all he has caused problems for.Bringing home the more personal consequences he has created for so many others by his actions. That he must pay for the damages he caused in peoples lives, time and resources wasted and hopefully will serve a long sentence. He will need it to perhaps, grow up and serve as a warning to all the other foolish folks out there(though I KNOW they will still think it doesn't apply to them, they are TOO SMART) willing to try to "teach"someone a lesson.

Whether he can pay the fines or not - once released from prison he should serve community service, never again receive a tax refund, and have his wages garnished until he retires. Furthermore, he should never be eligible for any government assistance except for social security once he retires. That is if social security will even exist once he retires.

        I agree that he needs to pay the price. However the price has to be relative to what he did. He can not be punished FOR THE REST OF HIS LIFE. People make mistakes and regardless of how foolish the person the law can not abuse them.

          The one problem I am having here is that he is going to be fined $500,000.00 . Now lets consider if he can make that payment which I doubt he will be able to do since he is going to prison for the next 15 years. Who is going to get that money? If the gov gets that money then why? Shouldn't the airline get a large chunk of it considering the damage that was done to their reputation from his actions. Just thinking out loud here and would like to know what others opinions about this are.

His court appointed lawyer is going to write it, have him sign it, and then the lawyer will mail them out, or just post it in different local newspapers.           As the article mentions, he faces fines UP TO $500,000.00. It is very unlikely he will be sentenced to that amount. With no prior convictions, most likely he will be looking at paying for the costs involved and a much lesser amount. He will also serve time. But the Judge will want him to be able to pay what he owes.

          As someone who has testified in court many times and seen judges sentence those who needed to pay fines, I can tell you, often individuals will be given both sentences and probation, with fines which the judge feels will both cost the criminal something which reflects the harm he has caused to the community, while also serving as a reminder to provide a lesson he will not forget soon.

          However, he also wants to give the opportunity, depending on the crime, for the criminal to start with a fresh slate at some point, after he has paid his due to society. Recognizing there will always be a shadow which follows any criminal. Paying ones due includes restitution and fines. Making it so high, a criminal can never pay it over a normal life, is counter productive for smaller stupid acts like this case. Most likely actual costs incurred, plus a much smaller amount as punitive will be added. But sometimes judges will go beyond standard practice, just to create an example to deter others.

          Had he done that, he would be facing assault and battery charges, plus possibly a civil lawsuit. In addition, some states have a three strikes rule. Being arrested and charged for minor things, can land one in prison for life on a third strike. Which for one guy, his girl friend accused him of stalking because he came by to visit while she had a new boyfriend he didn't know about. He admitted he came by, and was found guilty. But because he had a DUI conviction, and failure to show up for court on parking tickets warrant in his past, pushed him into that third strike. Bummer. It is always best to act with maturity. Feelings are never worth violence over.

            This is crap. He should be charged with terrorism, regardless of what his intentions were. And if I was a passenger on that plane, I would gladly tell him to shove his apology letter fair up his arse. He's 26 years old, certainly enough to know better than to cause fear in absolute strangers on a flight. As for the $500,000 fine...that amount will not be enforced. But whatever fine is enforced needs to go to reimbursement for the airline and reimbursement for the emergency response costs. Any remaining amount should be divided amoung the crew and passengers on that flight.

                            Shell complained the hoax side lined his career. Methinks it was his outstanding warrants and arrest. Smith was wrong for the hoax but because of him the police made an arrest of Shell. Does Smith get any reward from crime-stoppers?

                                Ya can't joke about a bomb. But why is it just jokes? What about a riddle? Or a limerick? How about a bomb anecdote? Ya know, no punchline, just a really cute story. Or, suppose you meant it not as a joke, but as an ironic musing?

                                    So everyone is pissed off at Smith because he made what is essentially a prank phone call, but not pissed off at Christopher Shell who had two warrants for his arrest for drug possession. And not only that, he's a douchebag, hateful ex that posts photos of his ex-girlfriend just to get back at her. I'm sorry, but guys who use pictures of their ex-girlfriends to get back at them for leaving them are pathetic. That girl, whatever the picture was of (according to Smith's lawyer it was a picture that would incense a boyfriend), obviously gave it to him or let him take it when they were in a relationship and she trusted him. Instead of deleting that picture (and whatever other pictures) he decided to post it on facebook like an ass. Guy deserved it, happy his career is ruined.

                                    Ya, a prank phone call that cost a lot of people valuable time and money. Not to mention the stress of thinking they were gonna die because they thought there was really a bomb.

                                    Two wrongs don't make a right. I hope Smith gets sued by every single passenger on that plane for emotional stress.
