Smokers light up at Texas oil storage facility, tanks explode, official say

Two people were critically injured in an explosion and fire Tuesday morning after smoking on a catwalk over oil storage tanks, officials say.

According to Van Zandt County Fire Marshal Chuck Allen, at about 3 a.m. firefighters were called to a fire at an oil storage facility north of Van, Texas, along state Highway 110.

At the facility are at least six 400-barrel fiberglass storage tanks, three of which caught fire and exploded.  Multiple fire departments responded to the scene and ultimately decided to let the fire burn itself out.


A short time later, a 24-year-old man with burns to his face, chest and arms, and a 24-year-old woman also critically injured, showed up at the Van Fire Department seeking medical attention. Both were both taken to the East Texas Medical Center in Tyler before being transferred to Parkland Memorial Hospital in Dallas. 

The names of the victims have not been released and neither person has been identified as an employee of the storage facility.

Allen said the victims were believed to be trespassing and smoking on a catwalk above the storage tanks.

Allen added that most of the tanks had very little crude oil in them at the time of the explosion.

The fire marshal is working to identify which company owns the facility.

NBC 5 will continue to update this story with more information as it becomes available.  As this story is developing, elements may change.

        Doesn't the company deserve to share some of the blame? Security must have been near nonexistent to allow two people that had no business on the property access to the catwalk. Maybe they were in the break room polishing their AR-15's.

        "Harley Mike", we all know there are no intelligent people west of the Sabine River. After all they voted for Tricky Rick numerous times. Smoking on top of oil tanks is exactly what those "intelligent Texans" think as being tuff. No wonder Texas is in the shape it's in. I moved out of that state in 1977, the job market around Baytown was so illegal yet nothing was being done about it. There was an "unspoken rule" not to hire someone that had a job at another company. I tried to change jobs for 2 years and no one would hire me, I was wondering what I had done wrong. I quit my job at Dixie Chemical outside Bayport Texas, we decided to move to Seattle. In the 4 days I resigned my position at Dixie I was called by Phillips Petroleum wanting to know if I wanted the job I had applied for 3 months earlier. I told them that I was moving and they told me that they could not hire me before because of "their agreement with other chemical company's". I started work with Monsanto in Seattle as soon as I got up there. The only use for Texas is to hold the overflow from Florida, you know the totally incoherent ignorant ones.

        If these two idiots had hand guns, they could have caused destruction like that anywhere. They could have blown up a gas station, or a tanker truck. That scene in the movie Thelma and Louise should have been a wake up call to America showing everyone how hand guns needed to be banned immediately.                         Summs - all it takes is a greedy lawyer with no scruples filing suit against you on behalf of the trespassers. Even if you win a case against a trespasser, you're still out the cost of a lawyer to defend you against the idiot trespasser. Sometimes it seems that the law is made to protect the criminal and not the victim.

                        As for the storage tanks in this story...I know of locations where the access is over a cattle guard and nothing else. Putting a gate or chain up sometimes creates a safety hazard for trucks that move in or out of the area where the tanks are at.

                                The "hot coffee in the lap" issue was not as stupid and simple as this case seems to be. McDees was previously court ordered to lower the temp of their coffee and officially warned twice with reprisals before the elderly lady was severely burned. The local McDees superheated their coffee to slow the rate at which their coffee was drank in order to save a few pennies. Sometimes being a cheap bastard costs you much more in the end...

                                I need to find out more about the law on this. It seems to me that, if the owner had maybe 1 sign on the main road to his property warning those around that they were tresspassing, and no fence, then he might be liable for creating a potentially hazardous situation, and could be sued pursuant to claims of people being injured on his property.

                                If, on the other hand, he had a deterrent fence around the whole thing, with adequate signage, in good repair, then he may be able to get the injury suit dismissed and countersue for tresspassing and destruction of property. Or, maybe he won't get that lawsuit dismissed, but could countersue anyway?

                                  Janstince- generally, children are more protected in trespass cases when there is an "attractive nuisance" on the property (something that a reasonable person would know a brat may climb/jump on etc..) or if the landowner is aware that children frequently trespass yet the landowner does nothing to prevent it.

                                  This case involves adults who climbed up to a catwalk over the oil containers. Assuming that the property is likely surrounded by a fence, has "no trespassing" signs on it, and involves adults that should be able to appreciate the danger of what they did...it is doubtful that they will be able to recover money. Don't believe the hyped "cases" that people will claim exist- like a theif stealing wire from an abandoned missle silo sues the Gov't for being electrocuted- those cases do not exist. Same with the McDonald's hot coffee case- what really happened is much different than what McDonald's PR firm put out into the media.

                                    I know about the whole children thing. People with a swimming pool get reamed on the insurance because it is considered attractive to kids, and if a kid gets injured around their pool, they have to pay big time, even with fences up and everything.

                                    I know there isn't a thief that sued the govt for getting electrocuted while stealing wire. I also know that the McDonald's case wasn't nearly as cut and dry a miscarriage of justice as most people like to pretend.

                                    The law allows for some strange things. People can put themselves in ridiculously dangerous situations, and if they're on somebody else's property, that person can be held liable well beyond the bounds of what most would call common sense.

                                      There is more to this story than is being reported at this time. The four tanks had static tops, meaning they were not venting at the time of the explosion. If these had been floating covers then maybe.

                                      *IF* these individuals had been trespassing, then there are serious problems with the security of this facility. I would fully expect to hear that it wasn't just a simple case of a lit cigarette.

                                      It will be very interesting to see the results of a full investigation. The As-built records should shed some light on it.

                                      You can see the tops of the tanks on both google earth and bing. There is something not being told here.

                                      LT you don't live anyplace near oil and gas production, do you. All the tanks are vented. Anyone with an IQ over a small appliance light bulb knows you don't walk into a pad site with 3-4 gas wells producing with a cig burning. You can hear the gas flowing when you get close.

                                      Wonder how far they flew when the rocket ignited??

                                          Security guards usually do a walk through where they go through the facility and sometimes check in on certain time clocks set up at different intervals. I don't know how big this facility is, but the security guard could have been at a different check point at the time they came onto the catwalk. Unless there are cameras set up all over the place and the guards just check out using those.

                                            There is no substitute for on the ground, walking rounds. Even if you have 200 cameras and two or three officers monitoring those, you still need to have a person walking the grounds at some point or you're sure to miss something.

                                                            One of the ways that you could do something about those things that you detest so inherently and emphatically would be to communicate your viewpoint clearly and concisely.
