A Miami Police officer was arrested Wednesday on charges of armed sexual battery by a law enforcement officer and armed kidnapping, authorities said.
Luis Hernandez, 27, a seven-year member of the police department, was arrested by internal affairs detectives after DNA evidence backed up a woman's claims he kidnapped and sexually battered her in November 2011, police said.
"The findings were enough to have a Miami-Dade County judge sign an arrest warrant and charge Officer Luis Hernandez with sexual battery by a law enforcement officer and armed kidnapping," Miami Police spokeswoman Officer Kenia Reyes said.
The charges stem from an early morning alleged attack by Hernandez on Nov. 26, 2011. That day, he was called in to relieve an officer going off-duty by transporting a 44-year-old woman to to the Miami-Dade County Jail. She had just been arrested after an earlier bar fight, police said.
'I'm going to help you'
Hernandez picked up the victim from a colleague at police headquarters just after one o'clock that morning. Soon after, she said, he drove her to a parking lot off the 2500 block of Northwest 2nd Avenue. She recalled that Hernandez told her, "I'm going to help you," police said.
The victim told police internal affairs investigators that Hernandez gave her some gauze and told her to clean up her face. With her shirt torn from the fight hours earlier, she recalled Hernandez poured a liquid onto a scratch on her breast. Then, she said, Hernandez lifted her shirt, and began fondling her.
Police documents note the victim told investigators that Hernandez, dressed in police uniform, removed his duty belt and exposed himself. According to the victim, the officer then told her to "get down," a demand, she believed, for oral sex.
The victim refused, and she claimed Hernandez began fondling her private parts. According to police, she said he then ordered her to turn around, and she begged him to stop.
After the encounter, the victim said she was handed off to a detention officer, but because of her wounds, that officer asked Hernandez to come with him and the victim to jail. While being processed, the victim, who is a Spanish-speaking undocumented immigrant, felt comfortable sharing the story that would launch the investigation, police said.
Within months, DNA evidence linked Hernandez to the crime, they said.
Mayor Tomas Regalado told NBC 6 the investigation and arrest proves the city demands the best of its officers.
"To me, this is not a scandal, this is a clean up of the department," he said.
Hernandez is being held without bond, online Miami-Dade Corrections records said. It was not known if he has an attorney.


You have to wonder how many other women this guy did this sort of thing to. Women who were afraid to complain.
This type of abuse of police authority is quite common in Mexico. Floridians should get used to it.

Some of the craziest news comes out of Florida. Yet, people still want to retire there. Key Largo is nice. Miami is a traffic-choked disaster. Republicans like Rush Limbaugh and Ann Coulter have homes in southern Florida and the Aryan brothers seem to favor it. It makes you think. I didn't think much of the trendy part of Miami. I had to pay four dollars to get two bottled waters, after looking fruitlessly for public drinking fountains. Cops can be corrupt criminals and break the very laws that they are there to enforce: normally they do get caught and when they are they are normally prosecuted.
Politicians CREATE the laws that the cops enforce (or break) and some of those laws do nothing but lawfully enable large corporations (banks, big oil, etc) to screw the average citizen through a variety of loopholes or "incomplete" laws that have negative consequences that "weren't intended". On top of that, normally politicians AREN'T caught because the house and the senate in the US rarely police their own. Unless they are outed by a third party and the media gets wind of it, you never hear about their abuses.
SO, according to my father's logic the bad politician will always top a bad cop any day of week. If this doesn't make sense then have a few pints and then read it again...

Let's not forget politicians and lawyers. I had a male friend in Miami that had a unbelievable experience by cops while being transferred from one hospital to another. You wouldn't believe me if I told you the story. It was worse than you would expect from a third-world country.
Meh, these cops are in the minority. You just hear about the bad things more than the good. To think that most cops are like this and there are only a few good ones is ignorant. You won't often hear about the one who saves someone from a burning building in the national news, but the one that does something bad will surely get coverage.
At least this dispels the notion that cops get away with stuff, more times than not it seems cops are getting prosecuted when they break the law.

Dennis, the point was as a whole. We're suppose to give up our guns because cops can protect us. This story shows that sometimes we need protection from the police themselves. A gun wouldnt have helped her in this situation, but it shows that we cant depend on police for our security.
On the West coast the individuals involved would have a common story: The officer would be the anchor baby for his parents, an affirmative action educated and hire to fill the government quota despite mediocre grades and marginal qualifications, marginal performance on the job but kept as the token cop given "make work" around the station like transporting prisoners. The female as an illegal alien needs no explanation. What it boils down to is neither the officer or the female would be in the country if a real "immigration" policy was in effect: The parents of the officer would have been deported and he would not be here and the female would either have been stopped at the border or transported to federal agency for immediate deportation when arrested. Now the officer will end up in jail, the female won the lottery in that bar fight(?)and because of the crime gets all her documents in order.

2) The scenerios just illustrate how the chain of events were made possible through lack of rational border security and lack of immigration law enforcement. Rational enforcement and neither party would be in the U.S. to begin with.
3) West/East coast has different problem groups and, though the outcome is not effected, have different origin cause, nothing more than that.
4) Corruption is not the issue, corruption is just the symptom, degraded society is the ROOT problem. This situation is just the result of a chain of circumstances traced back that root.

To be an officer of the law you have to assume it is by right of the 14th amendment or naturalization therefore a legal citizen and deportation is not an option. Every day, we read about these rogue cops. Who does the pre employment screening for these criminals? The last thing that happened to me was a photo camera enforcement ticket in maitland, which according to the majority of the legal community is illegal. They sent me a ticket from an office in new york. I thought, and still think, it is a scam, perpetuated by the state. They suspended my license and didn't even give me a court date to appear to defend myself. A SC&MB&G judge signed the order. I had to pay hundreds to get my license reinstated. I moved from Florida because of that incident, last year. F*CK Florida.

The only problem I have with this story is that it took them 14 months to arrest this man. I wonder when the victim,illegal alien talked? And yes, she is illegal so before we mince words let's just put it out there. The woman is a victim and has rights. If the officer is guilty then he goes to jail. I just have a hard time with the time it took to get to the arrest.
I would imagine that it took a long time to get the DNA analysis back from the forensics lab. In an area the size of Miami I'm am willing to bet the lab is inundated with evidence to analyze. It takes months to a year easily.
Plus who is working on it, more Latino cops? Good luck with that.

No room in law enforcement for scumbags. These men and women are put into trusted positions and there they must be honest and trustworthy at all times in order for the current justice system to work...
The cop should do 20 years in jail and while I have sympathy for the victim being assaulted she committed a criminal act in the bar and was only in America because she violated our laws. She's not undocumented. She's an illegal alien who shouldn't be here at all. Stiff penalty to pay for not going through the legal process, but my concern about criminals assaulting each other is at best negligible.

This kind of behavior happens all the time, the only reason why you hear very little of it is because these thugs with badges cover for each other and the politicians worry so much about their careers they have a blind spot for this corruption.
Documented or not, he was there to protect and serve, period. When he decided to cross that line and break the law he vowed to uphold, then he became no better than the criminals he arrest. He should be prosecuted to the fullest extent of the law for the crime he committed. Once she is finished with her own court problems, as well as this one, she should be deported back to where she came from. Then if she so desires, try and re-enter the legal way.

They are the biggest threat and danger to the law abiding citizens, yet the Gov. is after guns, I think they're looking down the wrong barrel.
