Teen pleads not guilty to throwing boy off Bronx roof

NEW YORK -- A 17-year-old boy accused of throwing a 9-year-old boy off the roof of a Bronx apartment building pleaded not guilty Sunday.


Nine-year-old Freddy Martin was found Friday night on the pavement unconscious with severe body trauma in front of the five-story building on Nelson Avenue in Morris Heights. He was taken to Columbia Presbyterian Hospital where he remains in critical condition.

On Saturday, police arrested his neighbor, 17-year-old Casmine Aska, who originally told investigators that he threw Martin off the roof after they got into a fight, a police source said. The boys are not related, but live in the same building.

But according to court documents, Aska now says he grabbed the boy by the legs and then slipped, causing Martin to fall.

Aska was arraigned Sunday on attempted murder, assault and reckless endangerment charges.

only way Martin would of fallen is if the 17 yr. old was holding him over the edge by his legs and then he slipped.

If I read this right the 17 year old is not saying he wasn't responsible but that he didn't throw the 9 year old. It sounds like he is claiming that he was holding the kid over the edge by his ankles (as seen in lots of movies) but lost his grip. Guilty either way, but the degree of charges can change.

No, there is nothing funny about a 9 yo getting thrown off a building. Hopefully the court won't accept a plea deal and give this future career criminal a light slap on the wrist. He's facing Attempted murder, and if the kid survives the attorney will try and get a misdomeanor assault charge to plead guilty to. This will never go to trial. The article doesn't say if he's being charged as an adult or not, but should be, and should face adult prison sentence.

He's not a "future" criminal. He already has a rap sheet for robbery, assault and menacing. The nine year old was said to be a nervous type child who takes anti depressants, and is highly intelligent with top grades in his class.

Someone posted yesterday that both boys were in the same grade at school.

The article didn't mention a prior wrap sheet. He's underage and those should be sealed, unless he's charged as an adult and priors are mentioned in the charging documents.

    Just got back to the thread.

    The NY Post, when the story first broke, said that the 17 year old already had a rap sheet for the crimes of robbery, assault and menacing. Somehow, that information was released.

    It was not reported on this news site, but was reported on a couple of others.

              From earlier reports, the kid already has a very substantial rap sheet. The juvenile system has failed, several times, to accomplish any real rehab. It will be up to the DA to take this to adult court. As an elected official, feedback received at City Hall may determine how he/she wants to proceed....

              I hate to say this but seems to be more an more true.. It is time to start charging the parents for the crimes of the children (as well as the children). Clearly something went wrong with the upbringing of this kid which resulted in this tragic event. When we start going after the parents for screwing up their children maybe things will start to change. Being a parent I think it sucks to think this way but on the other hand I can't believe my sons would ever do anything like this. People blame guns, video games, and TV and movies. but who is it that allows these things to be handled or seen by their children.. The parents. If we do not stop the issues at the source they will continue on. Guns, TV, movies, and video games are not the issue.                 The 17 year old either lured or forced the the nine year old to the roof of the building with full intentions of pushing him off. The nine year old boy is not going to go to the roof of a building to have a fight with someone twice his size. The truth will come out once the critically injured boy can speak, that is if he will ever be able to.

                It has been reported by news agencies, that the 17 year old drug the 9 year old out of his apartment, up three stories of stairs to the roof. Mean while the 9 year old was kicking, yelling, screaming, and fighting all the way. This happened while other apartment dwellers stayed in their apartments behind closed doors.

                This is so tragic. This young punk has the nerve to plead not guilty. I hope that the little tike gets better real soon. I don't think that this low-life will get a "get out of jail free card". What is wrong with kids today? Do they have no respect for anyone?                 Lawyers will usually advise their clients to plead not guilty initially. It gives them time and will usually result in a better plea deal.
