I live in Hawaii, on the Big Island, for the last 15 years. A year and a half ago this family moved in from the Main Land, a couple and their two kids, and two dogs. There is a leash law in Hawaii, all outside dogs must be on leashes. This guy never got the memo, his dogs were always loose, @!$%#ting on my lawn. If I wanted to mow the yard I'd have to go around and pick up his dog @!$%# in my yard. I told him over and over, he didn't care. I threw the dog @!$%# in his driveway. I thought about just killing his dogs, but they were nice dogs and their kids liked them. I can see where this could come to fighting. I was so pissed. I finally I called the cops gave them the story, they said he had to keep his dogs a on a leash. The next day I told this neighbor he had to tie his dogs or the cops would be visiting his house. The very next day the dogs were leashed. I could see where this could end in a shooting, very easily. I hate dog @!$%#. I also hate that this couple's kids will be growing up without them, these people it seems, were truly stupid.

What happened was the two dead people were sweeping their dog sh17 off their balcony onto Kim's, instead of acting like normal, good neighbors and bagging it for the trash. From other stories I've read, Kim tried many times to get them to stop, INCLUDING going to the landlord, who refused to do anything about it. Then the couple started piling their dog sh17 in front of his door, apparently for him to step in.

I would not say that these two got what they deserved, but it certainly does sound like they had been repeatedly provoking Kim. That, of course, does not justify him shooting them but it does explain things a little. I wonder how many times Kim had contacted the apartment management and/or the police before this happened. Far too often when people do call the police over things like this the police do absolutely nothing. They will at most talk to the neighbor, but are reluctant to even write a ticket for a code violation. Even getting police to respond to a complaint like this is pretty difficult, particularly when it is in an apartment community. They will most likely tell you to call the apartment management, implying that it is not a police matter because they do not want to be bothered. Unfortunately, in most cases it is only when confrontations like this escalate to violence that the police will do anything. Getting police to respond to complaints about dogs crapping in your yard, running around off leash (where there are leash laws), or incessant barking is pretty difficult. If they do respond it is usually hours after they are called. In the case of barking or dogs running around off the leash, often by the time the cops get there, if they show up at all, it has stopped so they will not do anything because they did not witness it. The same is true with dogs crapping in your yard because they say you have no proof whose dog it was. Calling apartment management is often just as futile, unless they are getting multiple complaints from multiple tenants about the same dog. None of this excuses what Kim did, but it does help to understand the frustration that likely led to it.

I Googled Sable Ridge apartments in Dallas--wow! It has some bad reviews. Evidently, dog poop is a HUGE issue! Dog poop and children. Reviews mostly say, "don't move there".

My neighbor has a great dane that roams the streets at night. Craps all over the place. The neighbor says it isn't his dog. Well, it's not from a bunny, must be a horse. So stupid! We had this problem - we fought it with video cameras and talking to the neighbor, and with calls to Animal Control when one neighbor did not comply. Problem solved!

Couple upstairs had a dog. It pooped in the apartment because they were too lazy to take it outside to do its business, and when they cleaned it up they threw the feces on the patio which was right over Kim's. The smell was driving Kim crazy and he repeatedly argued with them about it.

To show Kim who was "boss" they carried it a step further and left deposits at his door until he, in a fit of anger, killed them.

Orientals, by virtue of being packed together in very small spaces, usually have a determined politeness with their neighbors that leads them to be aware of their own noise levels, cleanliness, and things of that nature... at least the ones I was fortunate to live around in my lifetime. The dead couple lived above the shooter and would just push the feces over the edge of their balcony onto the lower patio. If you read the articles from DFW media that others have pasted in, you'll see that they had been dumping the dog crap off their deck onto his patio for several years, and when their dog took a leak on their deck of course there was only one place it had to go.

Kim had talked to the landlords and the couple living above him. Sometimes you can't help it if you have to hear little kids running around, but them letting the dog piss on his patio, and their lazy man's disposal method of just sweeping the turds down onto his patio is certainly something that would make just about anybody see red after enough episodes. He had dealt with it for two years, and apparently the landlords or cops weren't willing to take any tangible action to stop it.

Indeed, they rubbed his face in it and taunted him with the fact that they were going to keep doing it, when they placed the piles of dog turds in front of his door.

The article didn't say all of the details, but the general events leading up to the shooting apparently went something along the lines of: Imagine if you're just minding your own business enjoying your old age and a new couple moves in above you. Unfortunately the woman is a puppy mill, who already had four kids and was soon to get pregnant with "lucky number FIVE!?!" so there's a lot of noise from those kids compared to a typical upstairs neighbor. Plus two adults. Plus a pit bull!

So the noise already has you a bit unsettled, as the relative peace and quiet that you've enjoyed in your apartment (possibly for years) is suddenly gone. Then on top of it all, they have no idea how to have a pet dog and so they let it piss on the deck instead of taking it to a nearby patch of lawn like EVERYBODY ELSE in the building who has a dog. So the piss drips down on your patio, and your chairs (or possibly YOU out reading on a nice afternoon), and saturates the boards of the deck enough that any time you go out to your patio, you can't help but to notice the lovely aroma of dog piss.

Then on top of it all, since they don't ever bother to walk the dog, they have it crap on the deck - and of course since they're clearly A1 classy people (lol) they sweep the turds off their deck to land down below instead of using two or three brain cells and put out a lidded trash can on the deck to collect them. That would have required common sense, however, so instead of disposing of the turds in a sanitary (and legal!) manner, they swept them down onto his patio.

Like anybody would, he complained. The couple was spoken to. Instead of realizing that they were being world class asses, they got mad that somebody would DARE tell them how to behave. So they piled their dog turds right in front of his door, so unless he was looking down as he came out, he was sure to step on them. Most of the time the turds were swept down, but now and then there would be a pile at the door.

Please don't tell me that if you had to deal with a similar amount of crap that you would be all cool and collected about it. They turned your patio into an area filled with piss and turd smells, and a number of dried out ones there too mixed in with the fresh stinky wet ones.

When you tried to respectfully get them to stop, they made you ruin a pair of shoes by stepping into a big pile of pit bull turds, and more importantly directly insulted you in a very exceptional manner. People can get angry when somebody gives them the bird - imagine somebody defiles your home with DOG TURD.

Well I know that you know nothing about any law's outside of Chicago. In Iowa at least you MUST be a resident 18 yrs old to buy rifles/shotguns and pass a background check. To buy a handgun you must be a resident 21 yrs old, posses a permit to purchase or a permit to carry, and pass a background check. To get a permit to purchase you must submit proof of residence and be fingerprinted, pass a background check and you will be issued a permit to purchase good for ONE year. A permit to carry is the same except it is valid for 5 years. So to buy a handgun in Iowa you need to pass a background check TWICE and prove you are a resident TWICE.

And for the whole argument could you please tell me where they're getting the 'legal drugs' that they're shooting each other over from? (That is your argument right, that strict bans do no good when nearby jurisdictions have lax laws.) Please point me to any nearby jurisdictions with lax drug laws that are importing into Chicago.

Janine...the Coroner conducting the autopsies will disagree with you that it was the person and not the gun. What killed them were the bullets entering their bodies. The bullets did not come out of the trigger finger of the person. The bullets came out of a gun. If he did not have a gun the victims would have a much better chance of surviving. actually tony it is not legal, Illinois is on the do not reciprocate list for gun sales from other states. you cannot sell a gun legally to a person from Illinois in an other state.

They realized they were in the wrong house. The owner went inside his house. The driver started pulling out of his driveway. The house owner came out with a firearm and shot at them while they were leaving killing the driver. He said they were traspassing. He was arrested and charged with murder. Gun owners are dangerous morons!~

the problem was he had called the cops in the past, but nothing was done. the abuse had been going on for over two years. the people that live above him where constantly harassing the poor guy, who knows maybe they even threatened him so he was in fear for his life. we dont know all the facts yet about that part of it. i do feel sorry for the trauma caused to the children though.

Eric...but at the time of the killing he went looking for them. The lady was in her porch and he shot her. He is a coward. Her husband tried to escape. He shot him too. After her husband was wounded he shot him two more times. Mr. Kim is a coward. His balls were in his hand. Why didn't he punch the husband on his face or chalenged him to a fist fight? you also dont seem to be knowledgeable about current gun laws as well. you keep stating that people from Illinois keep going out of state to buy guns legally. other states cannot sell to a resident of Illinois, the state is on the do not reciprocate list. you cannot buy a gun out of the state of Illinois if a resident of that state.

For you Legal eagles out there, every state is DIFFERENT in terms of it's "Home-is-My-Castle" laws with regards to the use of REASONABLE FORCE to detain or STOP intruders or threats.

Some states such as Texas or Vermont are rather more liberal in their interpretation of their
laws. New York is quite specific as to WHAT situations count as a "Threat To Life and Limb".

In this case, it is highly likely a Jury will find that UNREASONABLE FORCE was used
based upon the circumstances presented publicly by the media. One defense would be
a "Crime of Passion" where "Kim" was so incensed by acts or words of the couple that
a temporary insane rage is a mitigating factor which could allow him to plead down the
sentence to 2nd degree Murder or about 25+ years in the pokie.

...BUT...because Kim stood OVER the man and shot him a few more times, that would indicate
a behavior that supposes WILLFUL AND MALICIOUS INTENT TO CAUSE DEATH which would
likely cause a DA to motion for Murder in the First Degree, which is a capital crime in Texas...
it's then Death by Lethal Injection or the Electric Chair if convicted!

Hey I like guns too. I still think there needs to be gun control laws passed. No one wants our guns except a few misguided people. They don't count. They are fringe like the fringe that are afraid of government.

I see that a lot of people don't understand the concept of the Stand your Ground, and Castle laws. Yes, you are allowed to use deadly force to neutralize a threat to yourself and family, but are to be responsible enough to only use the force necessary to end the threat. Once the threat is gone, if you continue to shoot, or like one poster here put it, "finish what you started", that is murder, premeditated.
