MIAMI - A Florida judge has approved the adoption of a 22-month-old baby girl that will list three people as parents on her birth certificate -- a married lesbian couple and a gay man.
The decision ends a two-year paternity fight between the couple and a friend of the women who donated his sperm to father the child but later sought a larger role in the girl's life.
The ruling means the child's birth certificate will include a biological father and both women as parents in an unusual arrangement approved recently by a Miami-Dade Circuit Court judge.
The women, Maria Italiano, 43, and Cher Filippazzo, 38, had made several unsuccessful attempts to become parents using fertility clinics.
They then turned to Italiano's hair dresser, Massimiliano Gerina, and asked if he would provide his sperm for artificial insemination.
"When push came to shove, they figured he would understand the situation," said Kenneth Kaplan, an attorney for the women.
"The mistake they made, however, was there should have been a written document spelling out what his rights and responsibilities were going to be."
According to Filippazzo, the three reached a verbal agreement before Italiano became pregnant. Filipazzo said the agreement meant she would adopt the baby and the two women, a longtime couple, would raise the child together.
But shortly before the baby was born, Gerina decided he wanted to be considered a parent and not a sperm donor. The women disagreed. Under Florida law, sperm donors have no legal rights to children.
Gerina hired a lawyer, setting off nearly two years of legal wrangling.
Under the judge's decision, the two women will have sole parental rights, although Gerina will be allowed to visit the child. He will not be expected to provide child support.
"We're trying to do the right thing for Emma," Filippazzo said. "We want Emma to have it all, and we believe by doing it this way, including him in a birthday or Thanksgiving, it'll be a nice addition for her."
"We believe the best interest for Emma is for him to have a role in her life, but not as a parent," she said. "The role is this is mommy's good friend who helped your moms have you because they wanted you so badly."

I don't have anything against gays or lesbians, but in cases like this...Just because we can, doesn't mean we should.
That poor kid has to live with the consequences of selfish adults in her life. I hope she receives only the best, but somehow, with the idiots she has for parents, I doubt it.

The man in this picture had no rights to the child. He was nothing but a sperm donor. If the judge truly felt he was on a parental level with the couple, he should have made him equally responsible for the financial well being of the child.

On this I agree. To me, if he want's to be listed as a parent, then he is financially responsible for that child. You truly can't have it both ways. To me, this man should have done the HONORABLE thing, and given up his parental rights all together. The attorney for the women should be sued as well. They (in my opinion) did not receive proper legal counsel.
Not entirely correct. This is why we have family courts in the United States of America. If this individual does not fulfill his obligations, (which I believe we both agree) on the financial part, then the parents have every right to pursue legal action. I was raised a child of a divorce early in his childhood. I fully know what its like to be in a family courtroom.
Please read the last two paragraphs on the article. If the couple (who did disagree with the earlier preceding), are trying to do what's right for their daughter, let's let them deal with it. Its none of our business.

In some cultures Kimbo Bimbo your family structure would be considered perverse. Your step father had your biological father's name removed from your birth certificate? So if you fell in love with your half sister from your biological father would that not make your relationship legal...though immoral. For many women, heterosexual or homosexual, who conceive through sperm donors (personal or professional) making a distinction between a sperm donor and a parent are important - in the relationship and legally. The problem is not these women...who were good enough to trust that their verbal negotiation with the sperm donor was sufficient to protect them from any legal wrangling or complication. If the couple were heterosexual and the male partner were infertile and they sought a sperm donor (as many such infertile couples do), the situation would be exactly the same as in the Floriduh case.
But for some unknown reason it seems to bug you a lot more simply because the primary parents are gay.

I agree with Steve. There are only two people involved in the biology of the child. In this case the sperm donor and the biological mother should be listed. Birth certificates should not be political footballs.
Sperm donors are just that ... donors. There should be no ongoing involvement, by the donor, with the child unless it is specifically spelled out prior to the use of the donated sperm. If the donor now has rights and is listed on the birth certificate as a parent, he needs to pay child support and contribute to health care costs, college tuition expenses, etc. If he wants the privileges of being a parent he must assume the responsibilities as well.

A birth certificate generally denotes legal parentage at birth, and DNA is largely irrelevant. In other words it's actually a legal document, not a genealogy document.
For example no paternity test is performed on married fathers to determine if the kid really is his, as married men are legally the presumptive father of any progeny.
Similarly, the adoptive parents of infants frequently and successfully petition a court to change a birth certificate to list their names. While a court won't change the original vital record recorded with the state's vital records department, the data used for generating the birth certificate is changed and affects all subsequently issued birth certificates, as well as the legal rights of the parties listed on the certificate. The legal rights and responsibilities of the parties listed on the old birth certificate are terminated.
The only thing that's odd about this case is that the sperm donor is listed at all, since all 50 states specifically don't do that normally. It's also strange for the judge to do that at all since he could simply grant visitation rights without listing the donor on the birth certificate.

This sort of thing wouldn't have been a problem in a marriage equality state. There's a recent precedent in Iowa which demonstrates exactly that point, where the court ordered the state to treat the gay parents of a newborn the same as they would straight parents for the purpose of issuing a birth certificate. In other words, the court ordered the state to simply follow the requirements under their existing marriage equality law.

Equality under the law? Regardless of gender identity, no one has the right to marry anyone of the same sex, under the legal age limit, or a close relative. Everyone has the same right to marry someone of the opposite sex. Spare me! As it pertains to her birth certificate, the girl only has two parents: the biological father and mother.
Think this won't flare up in court if and when the couple breaks up? Think again. Custody cases are already intense enough without a "third" party on the birth certificate.
BS, the birth certificate is just a record of a birth. The original purpose of vital statistics was for tax purposes and for the determination of available military manpower. A birth certificate establishes who you are and gives you access to the rights, privleges and obligation of citizenship (Paraphrased from Desmond Tutu) It has 0 to do with DNA, if it did when a child is adopted, they wouldn't change the birth certificate.

Here's how a far more enlightened state than Floriduh handled a similar issue:
Part of the problem in Floriduh is that they lack marriage equality and discriminate against gays in other areas, two-parent same-sex adoption is a relatively new thing for the state and the rest of the law hasn't yet caught up, and the couple rather foolishly lacked a written contract with sperm donor.
But had this case happened in a marriage equality state like Iowa the outcome would have been far simpler - the two women would have been listed as parents, and the sperm donor wouldn't have been listed at all.

Generally speaking the biological and social parents were the same but that ideal is not always true. Adoption, divorce, gay marriage and a host of other circumstances muddy the water. It might be a good idea to amend the traditional birth certificate to include both biological and social parents where possible. It would better reflect reality.

AZSkye - It really comes down to what state the birth takes place in. My wife was a surrogate for friends of ours and even though she was just an incubator she was considered the mother on the birth certificate and the husband of our friends was the father. It all happened in Virginia but if we were in Maryland it would be different. Our friends went thru formal adoption for the wife to be added as a legal parent. Heaven help you if you live in Louisiana. Completely different there.

Not as offered to state DNA origin (what do you do abut surrogates? - another situation with 3) What about sperm donor (immaterial about the genders of the couple but for there to be a donor, there has to be AT LEAST 1 MALE and AT LEAST 1 FEMALE involved. the BC just documents "status". I can see a possibility of 4 names where a donor egg is fertilized with donor sperm and implanted into the female member of a couple - with the additional member of the couple "just along for the ride")

Fork - In those other cases, all of which happen all the time, the birth certificate is still filled in with the biological names of the male and female whose DNA the child now carries. Now, I am not a legal expert by any means, but I've never heard of three adults listed on a birth certificate. If someone is trying to trace family history one day (especially for medical reasons) how are they going to know which female it is?
I think the reason this concerns me is that one of the foundations of parenthood (for right or wrong) is that the biological parent has the most rights, because the child is their offspring. I would think an action like that really screws with that foundation...

Actually it does - because there has been no judge that has approved a heterosexual birth certificate to include more than one set of parents, even in surrogacy cases unless the parents agreed to it ahead of time.

There are very few cases involving more than two parties on a birth certificate at all. This case in Floriduh only exists because Floriduh law doesn't have marriage equality and doesn't adequately protect the rights of same-sex couples or the rights of their children.

I dont get why he can't take credit for his part of parenting this little girl. Eventually she's going to have questions of who her father is, so why lie about it to her and just let him do his part as a father and take credit for it.
I agree he should get "credit" for it, especially because the kid could have medical issues of a genetic origin, so it's important to know where your DNA came from. But the one woman who is not biologically responsible for the kid being here - there is no reason to list her on the birth certificate.
I am very happy for all involved. This child will have two loving parents and will be able to know where she came from as well, instead of some dark secret.

This very well could be the new normal. How many kids are born that technically have two parents, but the kid never, ever sees one of them because they refuse to man up to being a parent. If these parents are so willing to fight for their right to parent, then this child is in far better hands with three parents, than any child is with two parents and one is missing in the action of being a parent. Just because you can have sex, certainly does not mean you can be a parent. These people seem more vested in the cause than a lot of parents. I think this is very right.

The reason Emma may have a difficult childhood has nothing to do with her parents and everything to do with hateful bigots like you. Everyday I deal with abused and neglected children. The sexual orientationn of the parents has never, ever been a determining or contributing factor to the abuse or neglect of a child. The fact that you believe that homosexuals cannot parent children safely and effectively say volumes about the hate in your heart.
Birth certificates are amended all the time in cases of adoption. They are legal statements of parental responsibility. They do not address biology or even societal norms.
Homosexuals are gaining acceptance around the world. If that scares you and your fragile existence perhaps you should move to Iran where they share your beliefs. You might have to convert to Islam, but it sounds like you embrace some of their tenets anyway.

Frankly, I could care less about seeing gay people on TV or in the streets. I grew up surrounded by a large and vocal gay community. I live in Long Beach, we have a HUGE (and profitable for the city) Gay Pride Parade every year. I've attended a few, and had a great time. Check some of the videos out on Youtube. I watch Lost Girl, a show on SyFy who's main character is a bisexual Succubus and it's not shy about showing sexual situations (gay, straight or otherwise) and lots and lots of skin.
I think we need to draw the line somewhere, and putting multiple parents on a birth certificate (especially when one only intended to be a donor), is beyond the pale.

With many children being raised by single parents today,this young girl will have the benefit of three parents.I'd say that she is off to a great start in life having three adults who want to raise her and be in her life.I think the judge used common sense and did the right thing.

It's about time - I am an athiest, but even I knwo that God is all over the Constitution of the United States. All the men that wrote that thing were Chrsitian, which meant that their moral code, value systems, everything that they were was influenced at least in part by Christianity. It is a Christian document, just not overtly so. This does not mean that Christianity should be given special treatment in the courts or in law. The Founding Fathers intended that the government stay out of any religion, regardless of which one. But those documents have at least one root in Christianity, simply because of who wrote them...

Black Sheep, there was a similar incident not too long ago, whereby this lesbian couple split up and the one left with the child could no longer afford to care for the "sperm donor" baby they had. She attempted to get welfare, they asked who the daddy was, and the state went after him, and I believe he's paying child support for a sperm donated child, he wanted NO INTEREST IN, nor claim to! Can you imagine how angry this man is? Should the worm turn in this case, at least the donor father won't mind ..... I hope!
