Florida judge approves birth certificate listing three parents

MIAMI - A Florida judge has approved the adoption of a 22-month-old baby girl that will list three people as parents on her birth certificate -- a married lesbian couple and a gay man.

The decision ends a two-year paternity fight between the couple and a friend of the women who donated his sperm to father the child but later sought a larger role in the girl's life.

The ruling means the child's birth certificate will include a biological father and both women as parents in an unusual arrangement approved recently by a Miami-Dade Circuit Court judge.

The women, Maria Italiano, 43, and Cher Filippazzo, 38, had made several unsuccessful attempts to become parents using fertility clinics.

They then turned to Italiano's hair dresser, Massimiliano Gerina, and asked if he would provide his sperm for artificial insemination.

"When push came to shove, they figured he would understand the situation," said Kenneth Kaplan, an attorney for the women.

"The mistake they made, however, was there should have been a written document spelling out what his rights and responsibilities were going to be."

According to Filippazzo, the three reached a verbal agreement before Italiano became pregnant. Filipazzo said the agreement meant she would adopt the baby and the two women, a longtime couple, would raise the child together.

But shortly before the baby was born, Gerina decided he wanted to be considered a parent and not a sperm donor. The women disagreed. Under Florida law, sperm donors have no legal rights to children.

Gerina hired a lawyer, setting off nearly two years of legal wrangling.

Under the judge's decision, the two women will have sole parental rights, although Gerina will be allowed to visit the child. He will not be expected to provide child support.

"We're trying to do the right thing for Emma," Filippazzo said. "We want Emma to have it all, and we believe by doing it this way, including him in a birthday or Thanksgiving, it'll be a nice addition for her."

"We believe the best interest for Emma is for him to have a role in her life, but not as a parent," she said. "The role is this is mommy's good friend who helped your moms have you because they wanted you so badly."

      Mskat - no it can't. Not when there is a much larger normal in the house. The very definition of normal and uncommon are completely opposite.

      Homosexuality is not normal. I'm not saying it is evil, or wrong, or whatever. But statistically AND biologically it is not normal.

        Shame on the judge for allowing this and shame on you 3 irresponsible adults for putting your selfish selves above the welfare of the child.

        This was not about what was in the best interest of the baby, this was about what was best for the selfish parents and their own self glory. As a result of this, the child will be teased for it will be abnormal and the parents get the pat on the back. What a foolish judge and foolish parents. Another child set up for Hell.

                  My two closest friends are lesbian, they have been raising a boy since he was 7 months old and his mother abandoned him. He is definitely not confused about his orientation. They legally adopted him when he was 10, he is 15 now.

                  I guess the role I played in my kids' lives (father) doesn't mean squat, because apparently having no father in your life doesn't hinder you in the least from "having it all". I'm going to have to confirm that with my kids, and I'll get back to you.

                  Then it isn't a birth certificate. It is a title like to a car or other property. A birth certificate is supposed to list the biological parents, a man and a woman, not a laundry list of people who wish to have some place in the child's life.

                    I wonder, from a purely legal point of view, if a judge can alter a birth certificate to include three adults on it? I don't know that there is a standard birth certificate out there (I'm sure they are different at least a little bit from state to state), but if there is any law mandating a certain minimum infotmation on them then wouldn't it be up to the legislative branch to alter the form? I've never seen one with space for three adults to be listed.

                    If anyone is a legal mind maybe they can share their opinion on the legal aspect of that...

                    Unless he donated through a sperm bank (which I doubt since he knows he is the father), how is the gay man allowed to get out of child support for the rest of his life? There are volumes of cases of men that donated sperm/fathered a child for lesbian couples who were subsequently sued for child support...and they had to pay it. What mkaes this guy so special?

                    I basically see the GLBT's and courts doing the same thing to this child in Florida. They have chose for this child not to be in anyway normal and because of the selfishness of all 3 parents, the child gets to explain why the child has 3 parents on the birth certificate when the rest of society has two.

                    Society through the government abused the girl in mexico and soceity through the government just abused this child, for the pretense of normacy. Has anyone asked what about the babies rights and the long term results. You and I don't have to live with this, the kid does and the child was not given a choice by the judge or the 3 parents.

                    I don't care if your GLBT's or heterosexual, if you are going to be a parent. Consider the long term results on a child while making self motivated decisions, or don't be a parent if you are to selfish to do that.

                        By the way, marriage is not a right. It's a section of the tax code. Like a driver's license or a business license or any other license you can get, if you meet the requirements and pay your fee to the government, you can get one. In some states that means any two people, in some states it doesn't. Obtaining a license is not considered a right according to the Supreme Court...

                                The man is her father and she should know that. At some point in the child's life she will understand that she has a father. Someone's sperm led to her birth. That is the man's biological daughter and she should know that. These women are selfish and foolish.

                                I may be in the minority in my views about parenthood, and they have nothing to do with writings in ancient holy books by anonymous authors. I really don't know - does anyone? - whether homosexuality is inborn (genetic) or caused by environment or conditioning. I am absolutely in favor of homosexual couples having legally-recognized bonds, with all of the tax, visitation and inheritance rights that married couples do. And I make no judgments about any sexual activities between two consenting adults.

                                But a homosexual couple is, by the constraints of simple biology, a sterile couple. Two men can't make a child, neither can two women. They should accept this as a result of their lifestyle. No law or authority can make them homosexual; they either are by choice or by fate. I believe male children need a father, and a female child needs a mother, and both have a more complete environment with dual-sex parents.

                                Sometimes one or both parties in a lesbian coupling decide she wants a child. To get pregnant, she must go outside her lesbian relationship to obtain the sperm from a male, which is, after all, what nature requires for the fertilization of an egg. I'm not talking about what some holy book claims, but the obvious design of nature. Reproduction requires dual-sex intercourse. To love only another woman, and being repulsed or turned off by a male, yet claiming the right to be a mother, is like eating your cake and still expecting to have it. So one of the women in a lesbian relationship gets sperm, by whatever means, and thus has a child to raise in the lesbian union. Can gay men do something like this? Of course not, because it takes the eggs and the uterus to bear and birth a baby. So, the lesbian couples are demanding, as their right, something a gay male couple cannot have. I don't see this as fair or just.

                                As a hetero who has been married twice and had offspring from both marriages, I feel rather strongly that reproduction is something that should be reserved for the kind of union that nature obviously intended. We might apply the Universal Imperative and ask, what would be the result if all other people were homosexual? They would either have to be unfaithful to their emotional bond, or the human race would cease to exist.

                                I have no wish to deny homosexuals their rights, but I do not feel that their rights extend to the artificial creation of a child. Bearing a child is uncomfortable for the mother, painful in the delivery, and, especially when the child is an adolescent, often heartbreaking. And as adults, offspring can often turn on their parents or be huge disappointments. There are straight couples who voluntarily decide not to have children. In an overpopulated world, this is even commendable. That being said, why must lesbian couples demand the "right" to bear children when it requires them to betray their own union to do so? Whether she has sex with a man, or gets the sperm from a man, she is still going outside her relationship, and she knows full well she has to, because a same-sex couple is naturally sterile.

                                Ron - I've often tried to bring up the subject of the cause of homosexuality, or even if there can be more than one. But every time I do I get blasted by those who either don't care or are afraid of the possible truth. Pyschologists insist it can't be environmental, although there has never really been a comprehensive study on the issue. Many believe you are born that way, but again without any real scientific study done I don't know if that is conclusive. No one dares broach the subject despite the amazing advances in genetics and discoveries in the biomechanics of the brain over the last 15 years.

                                Homosexuals fear that any such study will be a facade for oppression, and I can understand that concern. But a real study of the topic could be done, and done without disrespecting anyone, if only we could get past the PC barriers that exist.

                                  There have been LOTS of studies on the origins of sexual orientation. The current thinking is that it's largely determined by epigenetics and the prenatal hormone environment, with a possible but lesser early influence by the post-natal environment.

                                  The two main problems with getting a definitive answer are:

                                  1) it's likely a complex interaction between genetics, epigenetics, prenatal hormones, and environment (and thus different for each individual).

                                  2) there's no practical or ethical way to perform a controlled experiment on human sexual development.

                                      This is dumb. I dont care who WANTS to be the kids parent.. a birth certificate should have listed who is the BLOOD parents of the child. I dont want my father on mine but he is there cause he is BLOOD related to me. To start listing non blood relatives is dumb and can confuse things down the road.. Birth certificates are used to look up family and blood relatives NOT people that want to be related... This is one thing that should have the biological father and biological mother on it... end of story.. NOW other than that how they want to raise their kids is up to them. id doesnt matter

                                              Evangelicals quoting scriptures to justify their prejudice just muddies up the waters. There are valid secular reasons for objecting to homosexual attempts to go outside their sexual orientation to artificially create a child.

                                              Take your holy babble, written by unknown authors thousands of years ago, and copied by hand by unknown scribes through the centuries and translated and revised who knows how many times, and put it to rest.
