STATE COLLEGE, Pa. — A new report commissioned by Joe Paterno's family challenges the conclusion by former FBI director Louis Freeh that the late Penn State coach conspired to conceal child sex abuse allegations against retired defensive coordinator Jerry Sandusky.
An executive summary of the critique released Sunday said the "observations" of Paterno by Freeh in July were unfounded. The team reviewing Freeh's work included former U.S. Attorney General and Pennsylvania Governor Dick Thornburgh, who called the report fundamentally flawed and incomplete, resulting in a "rush to injustice."
Joe Paterno's wife Sue has broken her silence more than a year after the Jerry Sandusky scandal to praise her husband, who was fired as the head coach of Penn State's football team. TODAY's Jenna Wolfe reports.
The family released was what billed as an exhaustive response on Paterno.com.
It called Freeh's report a disservice to Paterno, the university community and Sandusky's victims.
Freeh's findings were cited by the NCAA when college sports' governing body levied unprecedented sanctions against the football program for the Sandusky scandal.

This family needs to quit trying to save a reputation that deserved to go down in flames. I'm with Oldhamletman on this. Every time I see the name Paterno I immediately think of dozens of victims and their parents with no one to turn to because Penn State and the Attorney General were dragging their feet and covering things up for the good of Penn State's reputation. Shame on Paterno, the University and the state of Pennsylvania. I actually think the entire College Football Culture is to blame. Something was said that kept Sandusky from ever being hired as a Coach even though he was very successful. So yes, I think all of college football knew the rumors but no one acted. Shame on all of them.
I think Paterno is a stark warning for all of us to SPEAK UP against WRONGS. His family needs to come to terms with the fact that, at the least that was his crime which has tainted his reputation forever. All of his fame fortune and even good deeds were not sufficient to plug the hole in his character that was left by his cowardice and failure to do the right thing.

Tom Corbett, the PA Governor, used Freeh to scapegoat Paterno, et al. so that he (Corbett) would not be blamed. He controlled the Penn State Board of Trustees that arranged for the Report and accepted its incredibly biased conclusions (read the Report and you will see that the evidence cited does not support the conclusions). The only real evidence against Paterno was the testimony of McQueary. McQueary was a very unreliable witness (he changed his story many times) and his testimony was directly contradicted by the testimony of Dr. Jonathan Dranov. Dr. Dranov is a very reliable witness, graduated Phi Beta Kappa, attended a prestigious Ivy League medical school, is a Board Certified Internist and Nephrologist, has more than 30 years of experience in questioning patients to get accurate histories and is familiar with the mandatory reporting requirement for child abuse. He interviewed McQueary on the night that McQueary says he saw Sandusky and the child showering together. Dr. Dranov testified that he asked McQueary three times if he had seen anthing of a sexual nature and three times McQueary said no. It can safely be assumed that Dr. Dranov did not report this himself because from his extensive knowledge and experience he didn't think it crossed the threshold for reporting. So this is what Paterno, a layman, and the others heard. They also had access to a report by the police in 1998 when Sandusky gave a child "a bear hug" and was investigated by a police detective, the PA Department of Public Welfare in Harrisburg, the Centre County DA's Office, and a CCYS counselor who interviewed the child and wrote a report. The conclusion of the police report was "no sexual assault occurred" and no charges were filed. Since this is all that Paterno and the others knew, what are they guilty of?
As delusional a family as you're liable to find. They have millions of dollars and will spend heavily to resurrect the reputation of Paterno and thus the family fortunes. Venal, corrupt and immoral, these people need to go away. I do not see this as the Paterno family being in denial. I read the entire Freeh report and can tell you that many of the statements made in the executive summary and the conclusions reached in each section of the report simply are not supported by facts. They are based on suppositions and innuendo, but there are no facts presented anywhere that point to Paterno knowing about Sandusky's actions prior to the conversation with McQueary or that Paterno did anything to try and cover it up. Paterno did what he was supposed to do and reported his conversation with McQueary to his bosses for them to take action. Part of the problem is that McQueary kept changing his story about what he actually saw. Someone who talked to him the same day he supposedly saw the abuse says that McQueary said that he did not actually see anything of a sexual nature going on. McQueary was asked directly about this and answered no. It was only later, long after he met with university officials, that McQueary started to re-characterize what he saw as being a sexual assault. McQueary changing his tune is very suspect and his testimony about what he told who and when during the investigation into Sandusky that resulted in the trial was no doubt colored by his being upset at not having his coaching contract renewed by the university. He obviously had an axe to grind and his credibility because of that, as well as the different stories he has told at different times, makes anything that comes out of his mouth suspect. In all, I found that the conclusions reached in the Freeh report were largely unsupportable by any facts or evidence. This was particularly true in his conclusions regarding what Paterno knew and did not know as well as regarding Paterno's actions following the report by McQueary. There is no evidence that Paterno tried to cover this up or influence the actions being taken by the university against Sandusky. In fact, Paterno wanted to bar Sandusky from any future use of Penn State facilities following McQueary's report but was told he could not do that because of the emeritus status that Sandusky had been granted.
I am glad that someone if finally pushing back against the heavily biased Freeh report. Maybe this new report can be used to get the NCAA to reexamine the sanctions leveled against Penn State since they were largely based on taking the Freeh report's conclusions as facts.
Joe Paterno is not the saint his wife and family are trying to make him out to be. He knew what Jerry Sandusky was doing because of what McQueary had seen. Reporting it to the administration was not enough. When he saw that they were covering it up he should have spoken. The same goes for McQueary. As a result of their inaction or participation in the coverup Sandusky continued his abuses of several boys that could have been spared the pain they will go through in life.

You need to become better informed before you make defamatory comments. According to Dr. Dranov's testimony, on the night of the incident McQueary told him he had seen a child who did not appear to be upset and then had seen Sandusky but he did not see anything of a sexual nature. At the time McQueary spoke to Paterno, et al. no victims had come forward. There was nothing to "cover up". Paterno was scapegoated by Tom Corbett, who controls the PSU Board of Trustees because he did not want to be blamed. It would hurt his political career. He was the DA for the region of PA that had jurisdiction and delayed investigating Sandusky. He also made contributions to the 2nd Mile.
Loius Freeh has much credibility and no axe to grind. The Paterno family has little credibility and a big axe to grind. End of story - their version of events is not worth reading.

That may be on the surface, but it's pretty clear the Freeh Report had an agenda if you actually READ it. Very little factual evidence. Much speculation and hearsay. Obvious bias. I don't know WHY Freeh had this agenda .... but it's pretty clear in the report that he had one.
Fleetwood, the Paterno family's credibility is irrelevant. This report wasn't written by the Paternos. It was written by a team of experts across the board, including the former top legal officer of the United States, a former FBI profiler and child molestation and behavioral expert, and a top psychologist at Johns Hopkins U. They have just as much credibility as Louis Freeh (more, if you consider Freeh's history of cover-ups and insubordination) and their account deserves to be regarded just as highly as his was.

And how the money will be laundered so as to leave no trail. What is irrelevant is the c.v.'s of their team of 'experts'. It is naive to believe they stand to gain nothing. If they were so concerned that the best interests of society be served, why didn't they come forward sooner?

Louis Freeh does not have "lily white" credibility. He had to resign as FBI Director after a Business Week article on "Carnivore". He left with a history of: the Waco seige cover-up, insubordination to Attorney General Janet Reno, the Robert Hansen mole case, ordering use of FBI sharpshooters at Ruby Ridge which led to the death of Randy Weaver's wife while she was holding their child in her arms, etc..
The Freeh Report is: (1) an "ex parte" document (not an independent report) that was funded with millions of dollars by parties who have a conflict of interest in the case (Tom Corbett controlled the PSU Board of Trustees and was the PA DA who had jurisdiction over the original complaints against Sandusky but failed to investigate them in a timely fashion); (2) written in a prosecutorial fashion with no apparent concern for innocence; (3) criticises the actions of people using a hindsight perspective that employs information that none of them knew; (4) does not contain a response by the accused parties (Curley, Spanier, Schultz, Paterno); (5) is written by someone who has a checkered history and may have a biased view of the case.
Of course that's what the family "discovered". Did anyone expect them to come out and say, "Hey, our dad was wrong"? It's easier to live in denial.
The family didn't "discover" anything. Since the Freeh Report was so obviously fraudulent, they organized an investigative team that is composed of highly reputable people (much more reputable than Freeh) and that has issued a very objective report. Whether you like it or not, this new, objective report finds the Freeh Report to be inaccurate and biased - to put it mildly. Why should they say "Hey, our dad was wrong" when their dad was falsely and maliciously defamed?
Well isn't that clever, what a way to spin. wonder how he describes the testimony of several witness's and of course the testimony of those "pesky" victims. That his ol pal jerry was abusing? ... He knew, period.

McQueary's testimony couldn't convict anyone since it is so variable it borders on perjury and is directly contradicted by a highly reliable witness, Dr. Dranov. None of the victims had come forth at the time that McQueary spoke to Paterno, et al.. The unmitigated gall (note that "Gaul" was a division of the Roman Empire) and clownery is all on your part.

That would be true, if you assume that all of the eight victims who testified were so traumatized that they didn't speak to Paterno while he was raping them.

The Freeh Report played fast and loose with the facts and was based more on speculation and bias. It was pretty clear it had an agenda.
The truth is apparent to all except the desperate fan-boys who still cannot accept that Joe Paterno is the patron saint of all child-molesters.
That is the only truth that history is going to record. All the shrill denials and claims of investigator agendas come from only 3 sources, the Paterno family, Penn. Governor Thornburg and md22mdrx.

But he was allowed continued access to the facilities as if he WAS a coach.

You are right. People HAVE made up their minds based on wild speculations and a biased report. I don't think this is going to change anything, but there was a REAL injustice done to JoePa and the entire Paterno family. It needs to be corrected.
Just because you don't like what the report says doesn't invalidate it. Only those painted in an unflattering light have dismissed the report as strenuously as you have.
You use wild speculation and bias in an attempt to refute what you claim is wild speculation and bias in the report; this makes your arguments not only suspect, but laughable.
This is like the denial of the crimes against children by the Catholic Church. Does that stop people from being Catholic? It's like the recently disclosed "slavery of women and children" in the laundry in Ireland who cleaned the priests clothes. Does that stop people from being Catholic. It's like the disputes of the US nuns. Does that stop people from being Catholic? It's like the questionable financial issues of the Catholic Church? Does that stop people from being Catholic? Individually, a scandal won't diminish the number of believers, but when you start adding up numerous scandals and cover ups, then you will start to diminish the number of believers, and hence what you see now are fewer believers in the Penn State Football program. There are other football programs, there are other football coaches. Paterno had his day, lost it, and his days of glory will never be rekindled. The Catholic Church had its hey day in Middle Ages European monarchs and their armies. What needs to be faced by the "believers" is the Age of Decay. You can't cover up sex crimes against minors with football uniforms nor clerics robes now.
Sometimes its just best to say nothing and move on. Whoever is advising the Paterno's is doing a very very poor job.

It WAS biased and based on speculation over facts. This is the TRUTH of the matter.
For example, Sandusky wrote 3-4 books. Only one title of his books was mentioned in the Freeh Report. That title? "Touched: The Jerry Sandusky Story". Why choose THAT title to mention if you're not trying to impart bias upon the reader?
Secondly, Paterno was hardly mentioned at all. When he was mentioned, it was said that he was told by police that Sandusky didn't molest the kids and a psychologist interviewed Sandusky and reported that he "wasn't the type" that would ever do such a thing. It's also mentioned that Paterno did his job in reporting the hearsay to his superiors (who were the head of campus police) ... so ... he actually DID report it to police. The rest of what you've "heard" is just that ... rumor and speculation.
Unfortunate the title of his second book was "Just The Tip". Death penalty to pedophiles.

Worse yet, it does even more damage to their legacy - look at who their expert is: Dr. Fred Berlin. Do you know who Fred Berlin is?
This "doctor" was the expert who testified for the defense of homosexual child molester Rabbi Jerrold Levy, as well as for the defense in the trial of Jeffrey Dahmer! This is the guy who started a sex therapy clinic with Dr. John Money, and claimed that "If I were to see the case of a boy aged ten or eleven who's intensely erotically attracted toward a man in his twenties or thirties, if the relationship is totally mutual, and the bonding is genuinely totally mutual, then I would not call it pathological in any way."
Most importantly, at that clinic, they told their clients that the Money-Berlin clinic guaranteed sex criminal applicants that nothing they did while they were clinic patients would be reported to the authorities.
Berlin is also a consultant and defender of the Catholic Church in its pedophile scandals. He is on record as saying the following:

some people are ignorant, they'd believe anything they here in the media, and they really dont do anything to investigate the matter further. when the allegations came out about Sandusky, it became a witch hunt. who is the biggest name in Penn State Joe Paterno, and the people just ran with it. even today when the report came out reading these posts, i see the blind are still blind. this proves that Joe Paterno did what he was required to do all along. He did not cover, he did not ask to cover he did not attempt to ask to cover up these allegations. That would be the board of directors responsibility. There is a guy named kron14 who didn't even seem to know the whole story, and created his own version. There is more to the injustice at Penn State then just the children who were molested. a football team has been punished for the actions of somebody who wasn't even a member of the faculty which can hurt the college itself. A mans reputation for being a good person, somebody that donated more than half his earnings back into the school, has been witch hunted and drug through the mud, in Joe Peterno. I've read the Freeh report which was rushed to give the families and victims retribution, and it is flawed. no witnesses subpoenaed meaning nobody under oath, and half assed conclusions. this didn't go to trial to find out the truth, and if it did Joe Paterno wasn't around to defend himself. its easy to kick a man when he's down isn't it people. The new report shows the flaws in the Freeh reports findings. its not about money or a statue, it about giving the students at Penn State their honor back. The NCAA will have to respond in court which will probably rule in favor of those involved with clearing the colleges name. As for joe paterno, he did take responsibility in perhaps his last public statement when the kids were rioting in happy valley. he said he should have done more. he should have went to the authorities. he didn't. he trusted that his bosses would do the right thing and they didn't. so he wasn't upset he was fired. he knew that somebody was going to be sacrificed for this tragedy and it would be him. In that to me makes him a hero with honor.
jOHN7475, Thanks for your comments on this tragedy. It seems the majority of the people replying on here are just Paterno haters. They are bashing him as if he did the deed. He did what he was supposed to do. He reported it. As for people talking about his millions, maybe they better look and see how many millions he gave back to the University. The Universty wanted a scapegoat and they choose one. As far as I am concerned they picked the wrong one.
I can understand the pain this family must be dealing with. And I do think Mr.Paterno was very harshly judged. But I don't think he was misjudged.
As the head man in that department, it was his job to know. And it was his job to do something if students safety was even slightly in doubt. A message had to be sent, you are responsible when you have such a job. The world is demanding more accountability. This is just part of it.
I don't know what happened exactly between him and Sandusky, if he turned a blind eye because it was his friend. But one thing is for sure, he did fail those kids who were abused.

Who in their right mind would believe a report issued by the family of pervert Joe P. The pervert pedophile helper knew what was happening but all he cared about was winning at any price. Having attended Penn State a number of years ago, I have mixed feelings on this issue. I don't think JoePa did enough, and even he admitted that in an interview. Of course he was on his death bed at the time and hind sight is always 20/20. From this article, independent investigators fact checked the Freeh report at the request of the Paterno family. So its really their credibility on the line, not the Paterno's. And access to the facilities comes from the Board of Trustees, not JoePa himself. I know this is a charged issue, but we really need to be patient and stop rushing to judgment.
As for the Paterno fortune, JoePa donated a lot of money back to the university over the years, including a $15 Million library. He led an extraordinary life supporting the university and its students. Its a shame that he got tangled up in this mess at the end. Its even worse that he didn't live long enough to have the chance to clear his name.
The real tragedy is this. people will believe in anything the media tells them. Peterno was found guilty before the Freeh report was ever published. as soon as it was reported by the news you witch hunters with your negative comments were wanting Joe Paterno's blood. Why? Because he is the face of Penn State football that's why! The Freeh report was rushed, the conclusions were half assed, and its findings were inconclusive, read it yourself if you have any type of legal mind you'll find its full of holes. You say this new report is made by a spin doctor to try to preserve the Paterno Name, the Freeh report was created to drag his name in the mud, and you naysayers are buying into it. This isn't just about the Kids Sandusky molested, its not about the Statue or the name on a building. This has also affected students in the programs sponsored by the NCAA who are being punished for something a man who wasn't even part of Penn State did! As far as Joe Paterno, the man stated in an inprompto interview while the students were rioting in Happy Valley that he could have done more, he took responsibility for not having directly contacted the police or welfare authorities. and that weighed more heavily on him then the loss of his job, so befor you all say he didn't do the right thing, he still did what was required of him at the time. Penn state Administration didn't do the right thing.

The only thing Paterno had to do, same as anyone else, was stand up and do the right thing when it mattered. He failed. He can only be remembered as a coward and a hypocrite. Weighed in the balance of history, nothing he ever did can overcome his complicity in evil, his dereliction of duty as a coach and guide of young men, or his ultimate failure as a human being. I don't understand why people think Joe should have known about Jerry when the PA agencies did extensive interviews with Jerry and allowed him to adopt multiple children. Those people are trained in spotting pedophiles and they were fooled on multiple occasions and over a 15 year period. And, the state child protective services and police investigated the 1998 incident and were fooled then also.
If Joe should have known, what does that say about these people? Were they part of the cover-up also?
The other interesting aspect was the part about the NCAA.

Simply denying the content of the report isn't the same as actually refuting it.
The school should not be sanctioned, but the individuals should who were involved with not allowing this to be uncovered. This is a moral issue, not whether someone can coach, or teach. Paterno was a great coach, his moral judgment, if he failed to follow through, was flawed. I wish we would put more effort into wallstreeters and bankers who raped our citizens and are not called on the carpet for it. Their moral judgment is zero. They had victims as well.
Sandusky was an individual with a sickness, he wasn't Penn State and he doesn't represent them or any of the alumni or anyone else. Each of the others are individuals Curly, Paterno etc. Each should be treated individually and against what policies they failed to follow, if any.

Joe Paterno did take some responsibility when the riots were going on on campus. he said he should have done more, and he didn't, then he urged the students back into the classrooms for their midterms. responsibility is hard when you have polocy and rules to follow. when i was in the navy we knew of things going on in the command that shouldn't have been. we were always told to go through the chain of command. when we did it either got taken care of or not. i would have never went to the CO right off the bat because if an investigation was launched and the accused was innocent it was my but on the line. same with Joe. if he would have went to the Police, instead of the College, he would have been fired for going over the boards head. Sandusky wasn't even a member of the faculty!
