Judge to hear arguments on Whitey Bulger's immunity claim

A judge is set to hear arguments on reputed Boston gangster James "Whitey" Bulger's claim that he was given immunity to commit crimes while he was an FBI informant.

Bulger, the former leader of the Winter Hill Gang, is awaiting trial in a sweeping racketeering indictment accusing him of participating in 19 murders. He claims a federal prosecutor gave him immunity for his crimes while he was providing the FBI information on local leaders of the Mafia, his gang's main rivals.

Bulger's lawyers want to use his immunity claim as a defense at his trial. Bulger contends former federal prosecutor Jeremiah O'Sullivan, who led the New England Organized Crime Strike Force, gave him immunity while he was an FBI informant in the 1970s and '80s. O'Sullivan, who died in 2009, denied ever making an immunity deal with Bulger during his testimony before Congress in 2002.

Federal prosecutors have called Bulger's claim "absurd" and have asked U.S. District Judge Richard Stearns to decide the issue before trial.

Stearns has scheduled a hearing Wednesday.

Bulger, 83, fled Boston in 1994 and was one of the FBI's most wanted fugitives until his capture in Santa Monica, Calif., in 2011.

Right Whitey......by any chance was Eric Holder in charge at the time? If so this might be plausible and a no brainer for the Judge.

interesting claim; the problem is proof; I have never seen a blanket immunity, i have seen some immunity given to persons in witness protection, but it is always for a specific crime, not full for all crimes.

    I am guessing that IF he has any proof of immunity the following scenario will ensue:.....

    Deputies smashed the cabin’s windows, fired in tear gas, and tore through the structure’s walls using an armored personnel carrier, a source close to the probe told NBC. A single gunshot then rang out, according to the source, and flames and smoke began to emerge from the remains of the building.

    His FBI handler testified that he was ordered to provide immunity as long as Whitey fed Mafia-destroying information to the Feds. Once his information was no longer needed by Federal prosecutors, Whitey was cut loose and his handler was drummed out of the FBI.

    That was definitely a case of the Feds making a deal with the devil to take down the Mafia. BUT - if you make a deal, stick with it. If they weren't prepared to accept a thug doing thug-like things they never should have made him an informant - and kept him one for years...

    It's joke, why this guy should even have a trail about this. He should be put in jail and tried. He didn't claim immunity years ago, he just fled. Well, was in hiding. You know they knew where he was all a long.

    I agree with all of you... However, is it beyond ones logic to think the government representative thought he was the word... Or just decided to lie to whitey, saying he had immunity as long as he supplied information... Typical government behavior.

    Whitey is a bad guy, we all know it... But we also know "cops" can be equally crooked.

    Don't be so sure the government agent didn't tell whitey he had immunity if he killed bad guys for the government.

        Although it may look ridiculous at first blush, there's much more to this story. GQ did a great article on it. Once the New England media started exposing the FBI's ties to Bulger (and alleged complicity with his crimes), the FBI turned on his handler (John Connolly) and hit him with a bunch of murder and conspiracy charges. Bottom line is that the FBI used Connolly and Bulger to take down the Italian mafia, then once it started to look bad for them, they turned on both of them.
