The new North Carolina license declares to everyone that the bearer has "no lawful status."
RALEIGH, N.C. — A new North Carolina driver's license set to be issued to some illegal immigrants has a bright pink stripe and the bold words "NO LAWFUL STATUS," raising concerns about whether the design will brand those who show it.
The North Carolina Division of Motor Vehicles announced last week that it would begin issuing the licenses March 25 following a lengthy legal review. The Obama administration's Deferred Action for Childhood Arrivals program grants valid federal work permits to qualified applicants brought to the U.S. as children without legal authorization.
Some Republican lawmakers in the state have balked at the idea, filing a bill Thursday to bar the DMV from granting the licenses until at least June.
Cinthia Marroquin, 22, of Raleigh, head organizer for NC DREAM Team, an immigrant rights group, is awaiting approval for a DACA permit. She said the longer the license issue is delayed, the longer it will take for her to get a job and drive herself to work. Even if she is able to get one, she is worried about presenting a license declaring she has "NO LAWFUL STATUS" at a police roadblock or while writing a check at the grocery store.
"A lot of us are just scared," said Marroquin, who came to the U.S. from Mexico when she was 15. "We just want to be able to get a job and drive to work. Having that license is just going to show everybody you're here illegally, just buying a beer or writing a check. You don't know how people might react."
The American Civil Liberties Union of North Carolina also takes issue with the designation.
"North Carolina should not be making it harder for aspiring citizens to integrate and contribute to our communities by branding them with a second-class driver's license," said ACLU attorney Raul Pinto. "There is simply no reason for officials to stigmatize people who are in the U.S. legally with an unnecessary marker that could lead to harassment, confusion, and racial profiling."
Almost from the moment President Barack Obama announced the program in June, states across the country grappled with how and whether to issue driver's licenses to those granted legal presence.

The U.S. Department of Homeland Security has said it is up to officials in each state to make their own determination about what to do. Many states, including Oregon and Georgia, have announced that they will grant driving privileges to those eligible.
In Arizona, where Republican Gov. Jan Brewer has pledged that DACA youths will not get driver's licenses, the state's DMV still lists federal work permits among the documents making people eligible for one.
The issue is especially politically charged in North Carolina, where current state law ordains a driver's license will be issued to anyone who holds valid federal documentation of their "legal presence" in the United States.
The office of the state's Democratic attorney general in an opinion last month said that under federal law, DACA participants have a "legal presence," even if they do not have "lawful status." Therefore, state law requires that DACA participants be granted licenses. Republican Gov. Pat McCrory's administration agreed, announcing last week the DMV would begin issuing the licenses.
That has upset many conservatives in McCrory's own party, including Rep. Mark Brody, R-Union. He is one of four freshmen legislators who introduced a bill Thursday to bar the DMV from issuing licenses to DACA participants before June 15, potentially giving time to craft a permanent change to state law.
Brody said he believes strongly that the DACA program violated the U.S. Constitution because it was implemented without congressional approval. Obama said last year he was forced to take executive action by the decades-long failure of Congress to consider meaningful immigration reform.
"We need a time out," said Brody, a construction contractor. "We don't need to have the federal government dictating to us how we are supposed to issue licenses in this state. We do it, and that's a privilege we have under our Constitution."
Among the concerns raised by Brody and other bill sponsors is that illegal immigrants might use their new licenses to access social programs or register to vote, despite the bright pink markings. An extensive 2011 review of the state's 6.4 million registered voters by the N.C. Board of Elections found 12 instances where a non-citizen successfully cast a ballot.
Jose Rico, a 23-year-old Raleigh resident from Mexico who has already been issued DACA work permit, said he plans to be in line at the DMV on March 25 to get a license, even if it's pink. He will be extremely disappointed if state legislators pass a bill delaying or a denying his ability to do so.
"I don't know what's wrong with these people, why they're so afraid of people like me," said Rico, who has lived in the U.S. since he was 13. "It's so frustrating. I passed a federal background check, done everything right by the book. I'm paying taxes. I mean, we're just kids trying to go to school."

It's really simple. Make it so that anyone who hires them knows by their driver's license that they are breaking the law. I think its a great idea. That way the employer can't say they didn't know they were an illegal. If they can't find a job, they will then self deport themselves.
Parents who bring their children here illegally do so in order for them to have a better life. Once they find out they can't, you will literally see thousands of young illegal immigrants leaving the country when they turn 18; knowing full well that they can't get a better job here.

How in the hell are they even getting ID's at all ? AT my DMV you need a slew of information just to get an id card. Like your SS #, Birth Certificate, bills at your current address. But to me anyone can have these, or make them up. It is so hard to get a Valid ID, yet these illegal aliens are walking around with ID cards ?

I was in our local DMV the other day, and an older gentleman of Latin-American decent was in trying to get his van registered. He inquired about his license being renewed also. The lady behind the counter professionally stated that he had to provide proof of legal residence before she could be of further assistance.
In the military you are required to know if an order is lawful or not. If you obey and unlawful order you are liable in a military tribunal. So with that in mind is not the executive order by the President an unlawful order since it is directly opposed to laws passed by the Congress? So the states should ignore this unlawful order until the President takes them to the Supreme Court for clarification. Until then only the established law passed by Congress and upheld by the Supreme Court after judicial review should be enforced. All other law is unlawful as described by the Constitution and the many state and federal courts.
Just saying the drivers license is illegal for illegal immigrants. Hope that clears up the confusion for all the states.

Before you even get to apply you have to meet many requirements. You HAVE to show proof that you live in the united states, birth certificate, a passport, you have to have came before 2006, a clean criminal record,and cant be older than 30. you can not just simply walk in and get an ID, and some students dont even get to apply because they simply dont meet the requirements to begin with.

There are many people that have the opportunity to make something of themselves but choose not to.. high school drop outs.. college drop outs! people that show up to work dragging their feet, complaining about how their job sucks.. people that show up to work late, and leave early.. and then they wonder why they cant keep a job?? I personally know some of these people, I work with some of these people.
and I also know people that are hard workers and cant find a job.. people that show up to work and get things done because thats what their there to do! students that have a 4.0 GPA, and have received letters from Universities, Team Captains... but simply cant chase their dream.. why? because their legal status prevents them from it.
No, not everyone is like that.. some of my friends dropped out of high school and have a criminal record. Yeah, people like that dont deserve to be here!

I feel for you! We escaped the sanctuary cesspool state of California last year! Very sad. I live there all of my life and it truly was once the Golden State. I'm of the opinion that if someone were brought here as a child by their parents they be given licenses and the opportunity to become legal citizens. They graduate high school, have no criminal convictions, they deserve the chance. It's the parents who made the decision to come illegally.
Think about it. You have a child brought here who is simply coming with their parents and had no say in it. These children grow up in the States and this country is what they know; they have no connection to Mexico after a while. I wouldn't want to see them deported. Their parents? Send them home.

These are not people who came to the US illegally as adults, these are people who were bought here as kids, children, many of whom had no idea they were bought here illegally at the time--there lives have totally been here, everyone they know and everything they have lived has been here.

Under DACA you had to be bought here before you were 16, must now be under 31, have graduated from High School or presently be in school or in or honorably discharged from the armed forces. You cannot have more than 3 minor misdemeanors, any significant misdemeanor or any felony convictions. IE there are not criminals, punks, gang members etc. THis is not an ongoing program but only for those who are already here and have been for 5 years.
I do not extend the same privilege to those who came here as adults, that is different...some of you feel the solution is to deport deport deport....but that is not the real solution. You want them to leave and not return...the solution is for those who employ them to be arrested, and heavily fined. If you don't want hungry cats to be on your doorstep day after day, then don't put out a saucer of milk.

The DL says the truth they have no lawful status i the US. I know that is harsh but it is truthfulMaybe instead of complaining about being here without status these kids should eb asking their parents why they did this to them. the sins of the parents are pased onto the children.
How about no dl at all, then they could not find something else to complain about. Here in Oregon they are going issue them regular dl's without any restrictions. Then they will be able to register to vote as democrats and apply for welfare like alot of democrats do.

Wow! What a tough call! Seemingly a lot is too arbitrary with not a definate starting point to begin from, which then seems to be only leading to and fueling the arbitrainess! There is no "objectively cohesive" framework and definition of the factors of the problem to try to be working within. I use the term "problem" as something to be solved, not as something that is automatically negative because it's "problematic".

In this country , it used to be like that where we had the oppurtunity to make something of our lives. Now we live in an era where the Government, power, greed of money, does not even give a chance for the little man to make it in life. You cant hardly own a small business any more because of so many federal regulations, taxes, all kinds of money, and paper work , permits, license , all kinds of insurances, you just cant make it like you used to back in the day. We are shifting more towards Big business, corporations, and the little man will be obsolete. So those dreams so many immigrants had of coming to america and being successful are a thing of the past. Hell even our american born and raised kids cant even get that any more.
This society will fall one day, just as so many greater societies before us have fallen. Its only a matter of time.

His uncle, who has been here 35 years, has been deported many times, and just keeps coming back. We're going the wrong way here. ALL illegals need to be deported, just as many have said. The thing about separating families - do we worry about that, when any person commits a crime, and goes to prison? No, the family has to fend for themselves. Our entire justice system is on the brink of collapse itself. We have laws. The average citizen pushes those laws (let's say traffic laws) to the limit of what they think they can get away with. Then there's lawyers, who know how to circumvent the laws. If we allow illegals to stay, who ARE CRIMINALS, then we are showing the American public that our laws don't have much strength. Many more illegals will come, knowing they don't have to follow the legal means to enter the US. And what about all those people who are trying to immigrate LEGALLY? Pink stripes- perhaps letters "M" or 'C'. Every State- US DOJ- AG- Pres.Obama himself- ask illegal /guest workers to take out a valid International Driver's License. US is committed by treaties to issue and honor International Driver's Licenses.
You don'tknow anything about being eleigable to get an International Drivers Licence.
Likewise,they are expected to adhere to the laws of the country they are entering. If you expect one party to follow the rules ,then you must also. Nice try though! Are you always looking to beat the laws mimi?

There are laws prohibiting employers from hiring illegals. But they have never been enforced. This is probably because of how much profits are made with all of this super cheap labor by people who can't complain if they don't get paid or get screwed in some other way. If illegals couldn't get a job they would have no choice but to leave. So called "guest workers" are part of the larger scheme to drag down the value of an hour's work for everyone, citizen or no citizen.
if there were no government benefits given to the ILLEGAL ALIENS and they were not allowed to work the sucking noise you would hear would be the winds of 15 million mexicans heading south back to mexico. we could eliminate our debt and deficit plus a lot of our social ills by sending them home and going after our natural resources. if the illegals wont stay in their own country and fight for it what makes you think they would fight for the u.s.
there were several busloads of 'illegals' flaunting their status on a bus trip to washington, as i recall, several months ago saying they were here to stay. the trip was on tv news channels nation wide.
QUESTION....why weren't they stopped by I.C.E. and escorted to the border under armed guard and made to go back to mexico.

That does give them some legal status and they had to come as children 16 or under, be in school or have graduated from High School Or be in or honorably discharged from our armed services. They must have NO felony or significant misdemeanor convictions. They must have been here for 5 years.

"No Lawful Status" means just that. They have no lawful right to a driver's license. Bring them in, take their picture, issue them a "No Lawful Status" license - and then deport them.
The State of New Mexico gives illegals valid driver liscences.....and the people who aren't illegals and are citizens of New Mexico will have to get passports to travel by air to other parts of the USA. Here in CA the farmers and ranchers no longer employ migrant workers due to E-verify. The farmer contracts out labor to a "Contractor" who has 1099 independent contractors. The Farm Labor Contractor has to e-verify. By hiring the workers as 1099 contractors they do not have to give benefits.
