A Texas police officer who fired 41 shots at a chase suspect in August has been fired.
The Garland Police Department confirmed that it fired Officer Patrick Tuter after an internal investigation into the Aug. 12, 2012, shooting.
Michael Allen, 25, was shot and killed after a high-speed chase that began in Garland and ended in Mesquite, Texas. Allen was wanted on suspicion of eluding police in Sasche a few days earlier.
Garland police spokesman Officer Joe Harn said Tuter violated the department's general order of use of force and its pursuit protocol.
The department at first said that Tuter opened fire in fear of his life, but dashboard camera video raised concerns after it showed that Tuter had rammed Allen's truck and fired 41 shots after he cornered Allen. Tuter reloaded twice, police said.
"He did not deserve the death sentence," said Allen's mother, Stephanie Allen. "Patrick Tuter was not judge and jury, and that's what he made himself out to be."
Allen's father, Randy Allen, said he is glad the department finally acted on the matter because he doesn't want any other families to feel what he, his wife and his son's 4-year-old daughter feel every day.
"Maybe the streets are safer now," he said.
The Allens have filed a wrongful death lawsuit against Tuter, seeking damages in their son's death.
The lawsuit says that Michael Allen did not have a weapon and did not pose a threat to officers. The lawsuit also says that Tuter's use of force was excessive.
"That's what tears me up -- that they weren't only just excessive, it was excessive on top of excessive," Randy Allen said.
'Justified'
The Allens said their son should not have run from police but also know that nothing can bring him back.
Tuter's attorney said his client does not agree with the department's decision to fire him and will appeal.
"The indefinite suspension was based upon alleged violations of the Garland Police Department's internal, administrative policies," the attorney said in a statement. "However, Officer Tuter's actions were justified under this state's penal code, and the indefinite suspension will be appealed under state civil service law."


How could he be in hot pursuit and reload his gun and shoot 41 rounds. The kid didn't even have a gun. Things are getting crazy.

You say "Texas" as if the problem of excessive force is restricted to just that state. Have you already forgotten that during the Dorner hunt two different pickup trucks, neither matching the suspect's vehicle description in any manner, were rammed off the road and had multiple reloads emptied into them? In both cases it was not Dorner, and it took place in California. Police corruption and excessive force is rampant in this country. It's not a Texas problem, it's a United States problem.

I have to agree, We have a serious problem where you can be killed for nothing at all, just because you may have moved your hand, Our so called protector have decided that they are the Judge and Jury, don't people think its pretty weird that all of a sudden We have all these people killing themselves and there is never someone there that saw them shoot themselves, I can believe one or two but seems like every single one takes their own life, I find that hard to believe. If you ban high capacity clips for guns the law should apply to the police as well. This was likely a Glock Gen 4 that holds 15 with one chambered. He would have had 3 on his belt as a reserve. I got mine and will never give it up.......Overkill by this COP and outrageous.

Statistic say that even the best trained gunners (law enforcement and military) MISS 7 out of ten times when under duress. Thats on average. This guy just upped that number. Nice to think of that when you hear that citizens can stop unwanted crime by being able to carry firearms. Maybe it has not happened yet but somday several people with guns will be at a supposed crime scene and try to play john Wayne and I hope I am no where near that. 40 plus shots? I live in this area, and for people saying that those of us who live in TX are proud of this, have no idea what you are talking about. Like any other state, we have had much increased police brutality, and in this case, murder. Most people here are angry that this guy is not in jail, which is exactly where he should be.
To everyone in every state, please note that the majority of cops sign up because they want the power that comes with a badge. They are itching to use their weapons, innocence be damned. When we speak out, and there will be posters on here to do so, other people say that you must be a criminal if you don't like the police. We are not criminals. We are people who want police held to the same standard as the rest of us, and if you can't handle the job, you need to do like everyone else and find a job you can handle.
A lot of people who live in the other 49 states would feel safer if this problem could be blamed on one state in particular; but that is not true. Every state has police officers that are unfit for duty like this man and unfortunately all the warning signs are ignored until after a tragedy takes place. It takes a special kind of person to be a police officer, face the dangers they do and still hold on to both their sanity and humanity....
It is a reasonable question to ask why "firing" this police officer was suitable punishment for killing an unarmed man.

I agree with myspellchecker. Police departments attract a certain type mentality and therein lies the problem. The type A power hungry military types should be weeded out and replaced with men and women that feel their job is to serve the interests of the people.
This cop should be indicted and tried just as any other citizen would be.
Ed - the police in our towns and cities are a reflection of the people they are pulled from. That being said, cops are being put under more and more pressure to ensure they do not use any type of force, until some sort of force is place upon them. A lot of times it's too late. They are place on the back end of a bad situation. That doesn't describe this cop, as he was clearly in the wrong, and should likely be charged with any number of felonies.
IXLR - So a 10 round magazine would have been better in this circumstance? I wonder if he would have re-loaded (like he did). Smaller clips mean you can carry more of them. You can carry single stack doubles, which equate to roughly the same amount of rounds.
If all the pertinent facts are in the article, (what are the chances) the cop will lose his suit, the Dept will get sued for putting a man out there who can't control himself thus creating a public hazard and more. And public pressure may cause the DA/ADA to charge him with a crime. Who knows what an investogation will turn up. Maybe the cop has overreacted before and the Dept knew his tendencies. Maybe this was a "snap" and nobody would ever guess it would happen. The trial will get facts out.

They leave out where Tuter's fellow cops tried to destroy dash cam and cell phone video and they also leave out where after shooting Allen 40 some odd times they then send a dog into the truck after him. The dog biting Allen on the neck and face then the dog dragiing Allen out of the truck.

Yes, it does happen under duress -- especially when the person doing the shooting either has very little training -- or fails to remember their training. And then you have the cops who deliberately go out of their way to just plain arsewipes....
The problem with that is the average cop is held to a lower standard of responsibility than ANY private citizen who has gone through the background checks and licensing procedures to obtain a Concealed Carry (or just Carry, depending on where they happen to live) License. Cops get to draw their weapon, wave it around and shoot at "perps" who they think have a gun or are going to harm others. Us private CCW Citizens have to be 95% beyond-a-doubt certain that we, or someone else, is in imminent danger of being harmed or killed before we can even think about drawing our weapon(s).
They did fire him -- for excessive use of excessive force. It took SIX MONTHS for them to do it, though.
So he was a "dirtbag" just because he didn't stop when the cops told him to? Ok, then the next time a cop tells you to do something and you fail to comply immediately, no matter what it is they want you to do -- perhaps that cop should be allowed to shoot YOU.

Trust me this cop did not miss 7 out f 10. More like he hit 7 out of 10. You need to do a search and read the other accounts and video of Allen's truck. The shots are in patterns one near center top drivers door(about 14 or so), another 10 in rear drivers door angled towards driver and a bunch at the door handle.
The aticle also does not mention(I think) that Allens girlfriend was in the truck when all this went down. I would bet that he shielded her from the bullets

As for the lawyers who defend such people, I cannot agree. Right or wrong EVERYONE deserves their day in court and the best legal defense they can afford.

Very tragic event. Although there is no video to watch of the shooting itself, there is video of the truck being taken away ( link is in the article above ). You can see the side of the drivers door has a tight grouping of bullets. These shots look like they would have hit a person sitting in the vehicle in their chest. There was many other shots in the side of the vehicle that you can see too. 41 shots is a lot of rounds to be fired.

He should not have been pursuing the boy out of his department's jurisdiction, to begin with. Dispatchers should have already alerted the next city and the local cops there to take over. This cop went way over the line and should have several charges levelled against him. This is way too close to where we live, and my teenager will be driving soon. There are less than 30K people where we live, but almost everyone I see pulled over that looks to be under 21 seems to be getting their car searched. It's scary.

Because the police believe they are above the law. It's plain and simple. Cops where I live are way more worried about being tough-guys than serving the community. And, Elayne, it doesn't matter how much of a "scumbag" he was he is still an American with rights. Most of the police I know are great people who really do want to be of service to their communities and this kind of event just makes their jobs much more difficult. Department heads enable and cover up that behavior, just as the military. Military men and women need that aggression in order to fight the enemy. The problem is, we are American citizens, we are not the enemy.
I can understand they need some form of immunity when they use force or they wouldn't be able to perform their job, but when it's found they've used force above and beyond what was necessary, why are they often allowed to just walk away, free from prosecution. The system needs to change. It's broken.
It's no longer just the black community of South Central Los Angeles or Detroit, or any other rough community who are complaining and seeking change and justice. It's spreading across every community.

I don't know about Texas, but many states forbid officers from continuing a high speed chase unless the suspect is wanted for a violent offence. This is intended to minimize the possibility of "collateral damage". The officer could follow at a safe distance and coordinate support to set up roadblocks or stop strips and take the suspect into custody with minimal damage all around.

Elayne, the police's 1st & foremost job is to uphold the law, not protect you. If they fail to protect you in some situation, generally they can't be sued. There's an interesting book, Dial 911 and Die: the Shocking Truth about the Police Protection Myth, by Richard W. Stevens, Attorney at Law, Mazel Freedom Press, Hartford WI 1999, that relays some truly horrifying stories about police actions (or inactions) leading to the death of ordinary citizens, i.e., non-criminals. "...next time someone breaks into your house, call your mother..." ? You might get a faster reaction time than from 911. (Actually, my mother has a S&W model 10 in .38 Special, so calling her might not be such a bad idea....).
For the record, I believe most cops, at least in my city (Columbus OH) are perfectly ordinary people w/ families, mortgages, dandelions in the back yard, etc etc, and have no blood lust in their hearts.

This may be true in some places, but by and large, American law enforcement officers receive excellent training. The problem is that a few years in a typical law enforcement department or agency and some time out on patrol will effectively nullify the majority of the training in the officers who really weren't suitable candidates for the job in the first place. Of those who enter law enforcement careers, a startling proportion are NOT people who are suited for the job. Of those, some will actually grow into it and what the office and field environments subject officers to will bring out the worst in the rest of them.
One could liken it to students taking drivers' ed. The training is very good, but within a year or two, a lot of those same students amply demonstrate that they got no benefit from it.
Perhaps anyone who has had a pet monkey could relate. They can be very cute and charming as infants and they might take to training very well. In a couple of years, though, most will become aggressive and tend to destroy anything they can get their hands on. If the monkey hasn't figured out that you are in charge, he will by default assume that he is in charge and can do whatever he wants to.
There are a lot of veterans who go into law enforcement, but the majority of officers have no military background. Few rookie officers really understand and appreciate what their job is all about because that is counter to nearly everything society hears or sees in literature, television, or movies about police officers and law enforcement. A lot of officers don't really 'get it' until they're at least age 30, and many never do. Too many start out with a lot of promise but turn toward the dark side within a few years. The job requires a balance in personal traits that is not often seen today; an officer needs to be aggressive when called for, and a gentleman at all other times. At this late date, aggressive men tend to be those who are always aggressive. There aren't very many gentlemen left, and many of those thought of as such are really just wimps who are adverse to taking any risks or getting their hands dirty. You'll never see them in law enforcement.
The real trouble comes when a new officer starts to lose the ability to keep everything in perspective. Working with the worst society has to offer on a daily basis does this to a person after awhile. It is very important to have a balanced life when you work in law enforcement, but this becomes increasingly difficult to do. Thanks to the nature of the job, it is extremely punishing to families and home life. People who aren't cops tend to not understand, so before long a police officer finds that most all of their friends are other police officers. This isn't good. The divorce rates for police officers are astronomical in many jurisdictions, and the suicide rates aren't too far behind.
A police officer should have lots of off-duty time and needs to take not just vacation but a real hiatus every now and then to stay in touch with the real world where everyone he or she meets isn't another dirtbag lying to them or a potential threat to their life or health. Unfortunately, this just isn't going to happen in this day and age. Everyone is trying to get by with fewer officers doing the work and one of the inevitable results is that the work ends up consuming some of them.

It's a popular job choice for veterans, always has been. But you need to consider the source. The military establishment makes a lot of statements to the public that roughly parallel the rosy things that college admissions departments claim about abundant opportunities and future growth in various segments of the job market that, gee, they just so happen to offer majors in! What a coincidence!
If an applicant for a law enforcement opening was an Army MP, an Air Force Security Policeman, or something like that, that would be looked upon favorably in most places. Anything else just depends on what it was and how the municipality's civil service commission feels when they convene to select candidates.
What you posted above, if anything, used to be true. If you came of age at any point from about 1940 through the early 1970's, you damned well better have been a veteran if you applied to be a police officer. The prevailing view was that the only men who weren't veterans in that era were either farmers, draft dodgers, or rejects. Since the early 70's, and especially since the early 90's, the percentage of the population of career-starting age who happen to be veterans is shockingly small. Out of a hundred applicants for a law enforcement position, maybe ten to twenty will be veterans at this late date. Most of the applicants, however, have taken criminal justice courses in community colleges or other post-secondary schools and had been planning to get into law enforcement. The remaining number, possibly up to 10% or so, were just looking for a job and showed up to take the Police Officer Selection Test on a lark.
I would say that police departments in communities that have a significant military presence (i.e.: San Antonio, Seattle, etc.) are likely to have a far greater number of military veterans within their ranks than communities that are nowhere near a base or other installation. Of course, a higher percentage of their population in general are veterans, too. Such a community is likely to have a civil service commission that seeks out veterans. Few if any out here in the hinterlands do, and would probably try to AVOID hiring a veteran if they thought they'd have to pay him or her more than the standard applicant with just an associate's degree in criminal justice.

We're not talking about the last 100 years. We're talking about the current afflictions affecting law enforcement and the alarming increase of abuses/corruption occurring today. This increase in unwarranted police violence is no longer limited to mainly rough neighborhoods of the country.

Oh, yes the military does have a motive.
First, it's recruitment. Prospective enlistees are told several times about how available military specialties 'translate' into civilian careers after a term of enlistment has been completed. This is one of the recruiter's biggest 'selling points' to induce a young adult to sign the dotted line.
Secondly, the armed forces actually pressure service members to separate. The military is very much a pyramidal hierarchy. They generally need all the privates, airmen, or seamen they can get. However, they need far fewer Non-Commissioned Officers, or sergeants. If you enlisted, you cannot just keep reenlisting on your own volition for as long as you like. 'Up or out' has long been the order of the day; either you perform well enough to be routinely promoted, or else you're forced out when you've stayed in your pay grade too long. Not everyone can be promoted, however, as the number of slots in the higher pay grades that need to be filled become increasingly rare. I know from experience that the Air Force requires that you be approved for reenlistment before your current term ends. Encouraging service members to not seek to reenlist alleviates things somewhat. Suggesting various civilian careers that an enlisted service member may look into helps to keep the upper echelons of the 'pyramid' thin, like they're supposed to be.
This isn't any more true now than it has been at any other time in recent history. There is no massive demobilization like there was following WWII. The percentage of the population that has been enlisted during the past decade is largely the same as it was during the 70's, 80's, and 90's. Most enlistees put in their four or six years, and then they're out looking for a career job. Law enforcement is a popular choice, but hardly the only one.
The larger factor is that many communities do not want many of the most recent veterans as law enforcement officers. There is a lot of concern over PTSD out there, and this is not lost on the civil service commissions who do the initial selection of police officers. They often strongly prefer that a police officer is as available as possible to serve the community, which is why there are often rules that an officer must live in the community or within ten miles of it. It's not 'proper' and, yes, it's discriminatory, but if an applicant identifies themselves as a current member of the National Guard or Reserves, that's usually a black mark on them because that commitment can pull them from their job as a police officer at inopportune times. The Individual Ready Reserve obligation for several years afterward is also a concern, and knowledgeable Civil Service Commission members prefer that an IRR obligation has expired before hiring a veteran as a police officer so they can't get pulled back into the service in time of crisis.
Most of all, many recent veterans simply are not fit for induction into law enforcement. You cannot just 'transfer' from the military to the police. It doesn't work that way! You have to be hired by the municipality that will employ you, who will then train and certify you. Large cities often have their own police academy, but quite often they have to send new hires to the state police academy for several months before they can receive state law enforcement officer certification. Typical cost is several thousand dollars to the local tax payers. Law Enforcement Academy is very intensely physical and involves lots of running. A veteran who has bad knees and a bad back from lugging all of his body armor and gear around for a number of months isn't likely to fare well, and this is hardly a secret to civil service commissions that have been burned a time or two by paying the tuition for a veteran police officer trainee who the Army or whatever service had transformed into an old man by age 22 or so. It's not a mistake they make more than twice before they figure out to only send new hires they know will be able to get through the training and be certified at the end. No certification means they can't be employed anywhere in the state as a law enforcement officer.
Most law enforcement agencies in the United States and around the world have always been paramilitary organizations. Most fire departments are, too, for that matter. Absolutely nothing new about this. The main difference is that police officers are not warriors and sometimes this is forgotten by those who are in such a position that they need to be the ones who remember it the most.

Your statistics are dead on (no pun intended) according to the LA County Sheriffs, and New York City PD studies I've read. The carnage that can be anticipated should armed citizens open fire in a mall, school, office building, theater is horrifying. Where we live is less than an hour from the Dallas area, and less than 20 minutes from Oklahoma. Kiddo will be getting their license soon and that scares me...not because of driving, but the road police for about 50 square miles around us. Every cop I know (and they number many, here and in a couple of nearby counties) are wonderful. They'd go to any lengths to protect someone. But I also know several here, and in nearby Okla. areas that are road cops, and they are some very scary people.

It has become painfully apparent over the past 40 or 50 years the police know, without reservation, that they will not be prosecuted no matter the situation or the body count. Voluminous documentation exists that proves this point.

The cop didn't know the guy was unarmed? I guess that means we citizens should go around naked so cops can see we're not armed. But that doesn't work either, awhile back cops in Miami shot and killed a naked guy in the street.
The police need to held accountable when they use excessive force, in this case that excessive force resulted in murder.

How did he know the person did have a gun? It was another officer who said the cop violated policy according to the article. Shooting at a person 41 times is excessive to anyone's way of thinking. Role model or not nobody deserves to get shot 41 times.

While the idea if we go naked cops won't shoot us might seem to give us a better chance, there have been cases quite recently of cops shooting citizens who were completely naked AND unarmed. In fact they were surrounded by several cops and STILL shot dead! Nope, we must face the fact even butt naked unarmed we run the risk of getting shot. Looks like the only safe folks are already locked up or in nursing homes. Then again I don't know how safe those in nursing homes are either.The only safe place seems to be home, and yet so many of those are terribly abusive. Then one has to watch out for break-ins, robberies and random drive-by shootings . What a crazy messed up world!
Cheesehead is right. Where do you get to shoot someone when you're not sure if that someone has a weapon? You certainly couldn't get away with that. And cops don't get to cry "I was scared for my life". They sign up for the job knowing it's a dangerous job. More power to them. Something about this issue reminds me of the Florida case, Where George Zimmerman set up a web site to solicit a legal defense fund. Then used the money to stop working and sit on his sorry, phatazz, butt for the last year. I hear he back to his ol' fighting weight - not the slimmed down, suit and tie wearing guy who was looking to fake out the court - like some scared teen had attacked him, for no reason.
Now the trial is finally coming up, after he has found myriad excuse ofter excuse to delay the trial.

Reloading twice, and firing 41 shots at a person suspected of "eluding police" constitutes murder. Aside from the monetary damages that the police department (the taxpayers) will have to pay, this officer must be made to serve jail time.

It happens in ALL states. NYC where some cops shot 27 times at a guy holding his wallet and 9 innocent citizens were also wounded on the street. LA where 2 ladies delivering papers were shot with no warning.
Cleveland, cops shoot 137 rounds and kill two UNARMED men after a chase. Oh and at least 57 cop cars in the chase.

My brother was greeted by flashing lights on the Evergreen Point Floating Bridge in Seattle. No place to pull over - none, zero. Rather than stop traffic, he continued to the end of the bridge where he stopped out of the traffic stream. He was given a ticket for "failure to stop for an emergency vehicle" - no moving violation. He was, apparently, lucky. Rather than being murdered, he took his ticket to court, and it was summarily dismissed by a magistrate as utterly nonsensical.

I can not say anything with regards to the suspect being killed since I was not a witness; I can remark on the cops actions in one area of this incident, and that is this fool needs to be fired for the lack of control of his actions and MOST certainly of his POOR marksmanship since he could not pass any firearms qualification and should not be allowed the use of any weapon. The thought that this cop was carrying enough ammo to engage in individual warfare is also a problem to consider; he apparently knew he was a terrible shoot and therefore carried an excessive number of clips to compensate for his lack of ability.
So if he dropped the suspect with one shot, all would be well in you view? Nice!

Let me set the situation straight for the pig hater. My husband is a cop, in Texas. This type of behavior is totally over the line. The cop should be fired. But put yourself in a cop's shoes. When my husband leaves at night, he pulls over people who can carry a concealed weapon. What if? I ask myself. The young man should not have died. My husband was called the "walking penal code" in the academy. His take on this was to stop the chase so NO ONE was hurt. It isn't worth it. But you forget the good things cops do. My husband caught a terrorist on 820 in Fort Worth. He has gone far beyond his call. Anyone could kill him for a traffic stop. Don't judge anyone before you have walked in their shoes. The cop who killed this young man obviously had other problems. I believe someone mentioned that he snapped. I can't speak for him, but I do know that of all the people he does catch, they have multiple warrants and deserve what they get. My bottom line includes 'innocent until proven guilty', 'sentencing according to the crime', 'equal protection under the law', and most importantly, 'the right to life'.
The man was executed, on site, for being a 'suspect' in a non-capital offense. So easy to have a cavalier attitude about 'someone else's' death. Every minute, every day, you are 'someone else' to 7 billion other people. Try an objective view at some point.
