Judge enters plea of not guilty for accused Colorado movie gunman, sets August trial

Holmes, who appeared in court with a dark beard and hair, has been charged with murdering 12 people during a mass shooting in a Denver movie theater during a showing of "The Dark Knight Rises." The former neuroscience student was told he could change his plea to guilty by reason of insanity at a later date. NBC's Brian Williams reports.

A judge entered a plea of not guilty Tuesday for James Holmes, the man accused of massacring 12 people at a Batman movie last summer, and scheduled a one-month trial beginning in August.

Judge William Sylvester of Colorado circuit court entered the plea after lawyers for Holmes said they were not ready to plead. The judge left the door open for lawyers to mount an insanity defense later.

Holmes walked into the courtroom in Centennial, Colo., and locked eyes with his parents, who were sitting in the second row of the courtroom. He did not show any emotion.

The judge set an Aug. 5 trial date. Prosecutors will announce by April 1 whether they will seek the death penalty.

The judge ruled Monday that Holmes must waive medical confidentiality and agree to be drugged for a psychiatric exam if he wants to claim that he is not guilty by reason of insanity. His lawyers had claimed that those provisions violated his constitutional rights.

Sylvester ruled that Holmes would have to turn over the names, addresses and medical reports of any doctor or psychologist who has treated him for a psychiatric condition.

The defense claimed in papers revealed last week that Holmes was hospitalized for several days last fall and required restraints.

Twelve people were killed and 70 injured in the July 20, 2012, shooting rampage at a midnight screening of the movie “The Dark Knight Rises” in Aurora, Colo. Holmes surrendered to police within minutes of the attack.

At his first court appearances, Holmes had reddish-orange hair and a blank stare. At subsequent hearings, his hair has been more natural-looking and his demeanor more stable. He appeared Tuesday with a bushy beard.

Colorado lawmakers on Monday advanced a package of legislation aimed at reducing gun violence in the state.

We need to give him a chance to turn his life around. A little love goes a long way, he deserves to be punished in some way i suppose, but lets not waste another life, he can still become a contributing member of society.

jason, only when he knows he's being photographed. if you look at earlier court dates when he doesn't know people are taking photos he looks normal. he's definitely trying to use the insanity defense. i think if you kill 12 people insane or sane you should still face the death penalty.

I just don't understand why it takes 5 months to prepare for a trial of someone that we ALREADY KNOW is the person responsible. I'm ignorant of the law, first to admit it. The reason this guy has not been subjected to any punishment as of yet is because like it or not even this guy has rights under the constitution. If you don't like the law of the land you can always try and change it, or just move. The judge has already ruled that Holmes can't use the insanity plea, or I should say Holmes can't use the insanity pleas unless he agrees to the judges conditions regarding the pysche exam. The fact that he doesn't speakes volumes regarding his so called insanity. If he was really so insane his lawyers would have urged him to jump at the deal. Instead it "violates his constitutional rights", yeah his right to not incriminate himself LOL.

Unlike his victims, Holmes is entitled to due process. I am sure that his lawyers were not ready to enter a plea, because, after 8 months, they were still holding out for the prosecution to offer them a deal. Until a plea was entered, the judge could not get the trial onto the docket.

I like this judge... he's already made it quite clear that, if the lawyers want to get him off with an insanity plea... by gawd, they will have to prove that he was insane and that he had no grasp on the idea of right and wrong. You go, your honor!

Sure the justice system is slow. Its a beuracratic nightmare, overburdened with cases, and lawyers don't make things any better. Been that way for a while, no one seems in too much of a hurry to fix anything.

Yeah let's give the government the authority to arbitrarily classify crimes as "acts of terror" so they have an easy way to circumvent the constitution whenever they find it convienient. The justice system may have many faults but I am not yet willing to trust the government with that sort of absolute power.

    We're one of the very few countries in the world who try and execute or imprison the truly insane in this way. Most countries do either of two things: 1) in situations such as post-partem homicide, the person is treated then released, though carefully monitored and usually forbidden to have any more children, or 2) in situations like this one, they commit the person to a psychiatric hospital where they are drugged into near imobility for life. But in either situation, the process is swift and is an attempt to "help" the mentally ill and not treat them as criminals. There are some countries, such as Iceland, that would actually try to rehabilitate this guy.

    Chris, please do not compare other countries to this country. There are vast differences with government, constitutional rights, etc, that make such comparisons useless.

    If a person is a murderer, they need to executed just like a dog that attacks a human. A murderer is an animal and should be put down. You don't rehabilitate animals that have shown the tendencies to attack and kill a human. Why not? Because once they do it, it's in their nature to do it again. No amount of drugs or therapy can change that.

    A remorseful killer shows remorse so that you'll forgive them and let them go. Not because they won't do it again.

    Most gun owners would avoid any mental health examinations like the plague. I just think of all these middle aged, fat, balding white men who are buying up all of these assault rifles. I bet half of them would be found to have anger management issues if given a proper exam. Or they would suffer from some form of delusion or paranoia.

    When I read a bizarre rant like the one I copied I always think, is this a gun owner? And most of the time the answer is of course, yes!

                If you don't think there is a valid use for an AR-15 style rifle, how about this:

                Try being a ranch owner near the Arizona/Mexico, Texas/Mexico, or NM/Mexican borders where illegal drugs are smuggled in each and every day. Places where beheading is common and cartels do not take hostages--they just kill you and leave you there. Places where it takes sometimes HOURS for a police officer to arrive after calling 9-1-1 due to manpower cuts, budget cuts, or over-worked officers or dispatchers. Try living in a place like that and then tell me how you are going to survive without protection...serious protection.

                Yes, there are valid uses for large caliber weapons to include those that have more than a 7-round magazine.

                If you are one of those that claims there is no "need" to have one, then you are free to be a victim. But, that doesn't mean I have to be one with you.

                  Ok I can accept that, it isn't always clear when people are being sarcastic when dealing with written text only. Sorry but issues like the NDAA, AUMF, the Patriot Act, and other such laws really piss me off. The single most massive curtailing of constitutional rights in the history of this nation and not only were these laws enacted nearly unanimously by congress but in a totally bi-partisan fashion with really minimal public outcry.                       He does have the right to a speedy trial, but typically, the first thing that any defense attorney will do is file to push trials and proceedings back. You can sign a form waiving your right to a speedy trial, just like you can waive your right to remain silent. The reason that the attorneys for both sides do this is to give themselves time to build their case. Sometimes in a high profile case like this one it is done to let the mood of the public (and therefore the potential jury members) cool a bit before trial.

                      The "media circus" is part of your right to have a public trial. Although I won't disagree that the media often takes advantage of that right for the sake of ratings.

                        Don't get me wrong here I am all for people's right to own firearms but, a lot of these guns rights people have some serious delusions. They have this idea that somehow as long as thier second amendment rights remain intact then all thier other rights are safe. But thier rights are being pealed away right in front of thier noses. They have this delusion that there will be some clear demarkation indicating that our government has become a tyrrany and at that point all patriotic gun owners will rise up and fight. It is sad really.

                        The reality is that itis unlikely that anyone will repeal thier right to own weapons nor does a tyrranical government really need to. Oh I am sure a tyrranical government would eventually get rid of privately owned firearms just to make thier job easier, but it would not be a priority item.                               There can be litle doubt of this guy's insanity. Nevertheless, we need to use this and other notorious killings as an incentive to learn about mental illness, and to figure out how to protect insane people from themselves, and our society from their rampages. While gun control is a debatable issue, it will not solve this problem. Neither will simple revenge.

                                  scooter - quit summarizing what you think the big bad liberals are saying. nobody says to treat holmes any nicer because we're trying to be politically correct. they're trying to respect the constitution, which entitles him to a fair trial. regardless of whether or not he is deemed legally insane, he will rot in jail for the rest of his life. nobody is going to feel bad or give him any perks because of what he did.

                                        You don't know the game; illegal mom & dad have multiple children in US; children make family eligible for AFDC, medicare, etc. That's how its done.                                             I believe he does indeed try to look "crazy" and knows that looking "crazy" works in his favor.

                                            Now the trick is to "have his cake and eat it too" at this stage,and looks like he has almost succeeded--a plea of "not guilty by insanity" but still maintaining secrecy of his psychiatric and medical histories.

                                                      I'm interested in the basis for his plea. Is he saying he didn't do it - even though there was a theater full of witnesses? Or is he saying he's not guilty of a crime because it was his constitutional right to mow down as many people as he felt like...? If it's an insanity plea, he has to stay insane for the rest of his life, never leaving the hospital.

                                                      This business of, "I was sane the day before I murdered them, but insane the day I murdered them, then sane again afterward" is a total crock.

                                                        The insane are NOT able to become "not insane". There are no cases and absolutely no data to show a "cure" for insanity. The mental health industry is even worse than meteorology in its level of erroneous results. The best that can be produced is a temporary improvement by medication. Anything that interrupts the flow of medication will promply return the insane person to the bad place.

                                                        It is inviting disaster to let these murdering psychopaths loose to run the neighborhood. They need to be gone, executed, removed from the ability to re-offend. Do the decent people have rights??
