STEUBENVILLE, Ohio -- Teammates of two high school football players from Ohio accused of raping a girl at a party last summer testified on Friday they saw their classmates commit sex acts on the girl during the alcohol-fueled events that night.
A third witness, a friend of the defendants who was also granted immunity, said he saw both defendants making sexual contact with her while she appeared to be passed out, naked and face down on a basement floor.
"She wasn't moving. She wasn't talking. She wasn't participating," said Anthony Craig, 18.
The rape case against Trent Mays, 17, and Ma'lik Richmond, 16, drew national attention to the Ohio steel town of Steubenville, on the West Virginia border and about 40 miles west of Pittsburgh, after a photo and video from the party were posted online.
The computer hacking group Anonymous later publicized the picture of two males carrying the girl by her wrists and ankles and organized protests accusing the town known for its "Big Red" football team of covering up the involvement of more players.
Mark Cole, a teammate granted immunity for his testimony, said he recorded a video of Mays performing the act on the girl during a car ride between houses in Steubenville the night of the party, but deleted it the next morning.
"It was one of those moments when you realize you did something wrong or stupid," Cole said during testimony in which he also said he drank eight to 10 beers that night and his memory of the evening was foggy.
Evan Westlake, who also was granted immunity, testified he saw Richmond commit a sex act on the girl on the basement floor of a house the same night last August.
Mays and Richmond are accused of raping the girl when she was too drunk to move or speak. She told police she did not remember what happened, but reported the incident the next day after she heard details from friends. The boys have denied raping her and say any sex that happened was consensual.
Defense attorneys have questioned whether the witnesses in the case remembered details from the party or were repeating rumors that circulated afterward through their own social groups and from investigators looking into the rape allegations.
Lawyers for the boys say the victim had told friends in advance that she wanted to have sex with the players.
Prosecutors have argued the girl was too drunk to make a decision about her welfare and have introduced as evidence graphic text messages about the party and events afterward and two pictures that were recovered from mobile devices.
The juvenile charges against Mays and Redmond are being heard by visiting Judge Tom Lipps. If convicted, they could be required to stay at a juvenile detention facility until they turn 21 and then register as sex offenders.

Once these two are found guilty, then the school district should take ban this school from the football league for at least one year. These two did the actual crime, but their teammates took part in it if nothing more than watching, taking pictures and not speaking up or not stepping in while this was happening. This would also send a message to that town and those parents that think these boys did nothing wrong. I love my kids, but if they break the law, they pay.
I agree, They knew better, What they had to get a girl that was so wasted she didnt know what was happening? what does that say about the boys? And where was this girls friends at to let them know that they were getting to drunk and should have tried to slow them down. I really thought that this type of behavior with the school and town members covering for the local jocks had quit, guess I was wrong. What if these girls get some kind of infection after all this Im sure clean sex? If they go to jail, Im sure bubba will make them feel right at home! After all they do deserve such attention!

Increasing the probability that something bad will happen do you does not make it your fault.
If I go to the store on a Friday night and get killed by a drunk driver, is it my fault because I should have known I was at higher risk of being injured on a Friday night in a car?
If I ride my bike to school instead of drive and get hit by a person on a cell-phone is that my fault for cycling even though I know people text and drive and that this has resulted in deaths of cyclists in the past?
If a mom takes her child to a school function, even though it is flu season, is it her fault if she and her child get sick?
If someone joins the military, despite knowing that going to war increases the risk of death, is it their fault if they are shot or captured?
Everyone can always decide to stay at home and do nothing and go nowhere to eliminate risk in our life. Of course teenagers are more likely to be taken advantage of if they are exceptionally drunk. This doesn't mean that getting drunk means it is their fault if some @!$%# rapes them.

ryan-1853964 -- In both of your scenarios, no one is at fault. Fault implies a breach of duty. The bear owes no duty to anyone. The bridge owes no duty to anyone. The males who raped this girl, however, owed a duty to the girl, and all of us, to not commit acts of rape. They are at fault for having violated this duty. They will now face the consequences, and sadly, receive a lot less time than they deserve. The eyewitness testimony makes it clear they were at fault repeatedly by raping her repeatedly that evening.
Now, I realize that even addressing your stupid comments elevated them about fifty or sixty levels on the logic scale, an elevation they do not deserve, but I a being generous today.

She was slipped GHB, she wasn't drunk she was drugged. Then, when they got her in the car they poured booze down her throat and assaulted her for the first time. Not her fault in any way. I once drank 20 ounce of cognac (equivalent to 10 beers at least ;-) in 3-4 hours while a a birthday party in the Ukraine (Kiev) (Anyone who goes to parties there will understand...) and I never lost my memory or self control. Actually, walked home 1 mile in a remarkably straight line with friends. Anyone using alcohol as a an excuse of misbehavior should get their ass kicked. They wanted to be dumb and alcohol just gave them a convenient excuse. Yes, I had a very bad hangover the next day, but at least I knew exactly what happened the previous day and I knew I wasn't a criminal moron.

What it is to be a man? Here are these two guys, both young men, and my question is who is teaching them to be men. One is a quarterback on the football team, I thought that the quarterback was a leadership position. I guess it's a question of do the right thing. Seeing a weaker person incapable of taking care of themselves, some might try and say "how can help this person", which would be a manly thing to do. The quarterback might say "this person is hurt let's help, follow me". But these guy are at the opposite end of the human spectrum. There are more like animals. On the movie end of watch takes place in L.A shows what happens to a female confronting a 300 pound mexican not a pretty sight. I have been following this case since I found about it. A few days after the incident I met Jane Doe's parents. Come to find out that our families have know each other for years. Looking at the pain in the parents faces was heart breaking.
The parents were the ones who found out about the posts on Twitter and Youtube and Instragram. A friend called them to tell them. Put yourself in their shoes. Can you even begin to imagine what they are going through.
I did a lot of partying in my heyday and yes there have been drunken nights that i did not recall. What these kids did this girl is unspeakable. The kids that stood by and did nothing should hang their heads in shame.

Jane Does' family has been through hell. When I spoke with the parents I advised them to get her into counselling right away. Which they have. How do you deal with something you can not remembeer?

The parents of these two should hang their heads in shame. They have done a worse than lousy job of rearing these two. They did not teach them morals or responsibility. Instead they taught them entitlement, " you are a football superstar so you are entitled." What kind of parents allow their sons at that age to stay out all night and come home drunk. The parents should be charged with child endangerment since they care so little for their sons. As for the boys they need time in prison where they will learn that all actions have consequences, something their parents failed to teach them. These Kids should admit their guilt and ask mercy from the court, The argument they are using is poor. The evidence is overwhelming. There are so many things wrong with this story. Drinking at a coaches house, Minors with alcohol, The friends of everybody standing by and letting this occur. Posting pictures to the internet. Over 350,000 texts. and on and on. Three young adults have had their live ruined. Teenage drinking kill more kids than anything else.
I certainly knew by the age of 16 that, if I encountered a person who was in a state, for any reason, that this person could not take care of himself, that I should step in and care and look out for that person until he or she was well enough to care for him- or herself. I knew not to take advantage of that person in any way, by sexually molesting him, taking money or jewelry from him, or anything else. I knew to seek help. The parents, the religious institutions, the schools, the coaches, and everyone else who has influenced these boys' lives MUST do some soul-searching and figure out why these boys did not learn this fundamental lesson to begin with, and somehow learned that it was acceptable to take advantage of a person not in full control of herself, or, indeed, unconscious. This is far too disgusting for words, and it has not been the first case by far! What are we teaching???!!!
They should definitely be tried as adults. Juvenile prison is like kiddy camp and the laws do no allow juveniles to be treated as inmates. These young men should be punished severely for their heinous acts. Serving adult time would do some justice. As a matter of fact, victims of juvenile inmates would be irate if they saw just how easily juvenile offenders have it. Not to mention it is much cheaper for us tax payers to send criminals to the adult system than the juvenile system.
When found guilty they will go to jail - juvie to adult facilities. Then the thing that will affect them, when they are released after a good number of years, is being labelled SEX OFFENDER. In my youth, I often drank with friends both male and female. Sometimes I got stupid drunk, sometimes they did but we trusted each other. This young woman thought the people around her were her friends and she trusted them. How was she to know that they were not worthy of that trust, that they would treat her lower than an animal? These young men truly believe they did nothing wrong; they have no conscience, no sense of honor, no character, no morality. They will most likely never suffer the pains human beings do when their conscience beats them up over wrong doing. Personally, I think who ever supplied the alcohol to these high school minors facilitated the sexual abuse. If no drinking was involved this probably would never have happened. I think all 3 of them should have alcohol counseling.
High school football players have quite a sense of entitlement and I doubt they have any sense of guilt for what they have done. That doesn't mean they should be registered as sex offenders. But they should be punished for their behavior, but on some lesser charge than rape.
If this was a drunk driving accident, or some other mis-judgement related event, I would agree with you. But these kids intentionally committed a heinous crime. While I don't think the sex offender registry should even exist, these kids should be charged with rape. Because that is what they did.

Truly tragic - and yet living in a college town, these 'incidents' are NOT uncommon. HOWEVER, whenever alcohol is thrown into the equation by all participants, problems are nearly a certainty! Parents should teach their kids personal responsibility for BOTH sexes (i.e., letting your daughter know of the dangers that can happen with heavy drinking - and not to allow themselves to get to that point). Teach your sons it is NEVER OK to take advantage of women NO MATTER WHAT if they wish to stay out of trouble. I am NOT blaming this young girl for what happened but, and let's be honest - would this have happened if she hadn't been drinking to the point of passing out? Why wasn't anyone else there willing to step in and defend this poor girl? Den O'synn. link please. I saw this story on 20/20 or some such and according to all reports given the girl was penetrated with the fingers of both boys. According to her states law, this is defined as rape. there were multiple accounts of the girl drinking heavily, mixing liquors and traveling to several parties the course of the night. With all the true incidents of actual rape this case seems to be a tad ridiculous imo. Not devaluing her experience which she cant even remember but it seems to be a case of wrong choices rather than malicious intent. No evidence of her being drugged.
From the fact that she recalls nothing (when you drink you usually recall something) it looks like she was drugged with the Date Rape pill. It is known that its use in rampant among high school and even jr hs athletes. The drug only stays in the system for about 12 hours so don't know if they can still detect it. The girl should not be blamed.
Full prision sentences for all of these jerks, including the rat (Cole the Second) that is supposed to have immunity. Cole, Mays and Richmond are all sexual deviants and should be locked away for a very long time.

first of all i would like to say that everyone (reporters mainly) needs to stop using the term "friend" in reference to the people who knew this girl personally. they have been saying things like "friends of the alleged victim have stated that when she left the party she appeared to be overly intoxicated and that when they tried to stop her from leaving with the two boys she stated that she was 'ok'."
seriously, i don't know what kind of friends these people were but as a female there is no way in hell i would allow my FRIEND to leave a party drunk off her ass with two dudes from the football team, are you kidding me?! what in the hell did they think was going to happen to her.
when my girlfriends and i get drunk we don't allow anyone to leave with someone when it's clear that my friend isnt in the right state of mind to make healthy choices. i would have dragged her drunk ass out of the house and gotten her safely home, not just turn around and let her leave with a grip of dudes.
and as for the massive amount of people that saw the assault happen, and the even larger amount of people that were texting back and forth while it was happening, all of their parents need to really sit down and think about how they are raising their son or daughter. the very fact that over 350,000 text messages were discovered between these kids and it took 3 days after the incident for the parents to find out what happened and nearly 10 days after the incident for the cops to start really investigating tells me that something is seriously wrong. you mean to tell me that not one of the kids at this party and the second house had morals? none of them thought "hey, shes not awake or she's super drunk, this is wrong, i should probably tell them to stop, or call the police or even threaten to call the police" tells me that there is something severely wrong with the way kids are being raised and taught in this town.
i honestly can not wrap my mind around how the Parents of the victim (how were not present for the assault) were the ones that had to go to collect what evidence they could from social media site and take it to the authorities, not one of the party goers found in necessary, during the incident or the morning after when they all woke up and read over the text messages or looked at the picture's or looked at the video, to call the police or tell one of their parents? what the hell!? some of these kids even deleted their text messages and the photo's and video without a single thought of getting justice for this girl.
I've read multiple things about this and from what i can gather they not only digitally raped her (on multiple occasions in multiple locations) but apparently they also urinated on her, and penetrated her in all three of her useable orifices (i'm trying really hard not to be graphic about it... that's the best i could do) all the kids, either by way of there physical presence as it was happening or by way of social media or text message SAW this happen to her, and not one of them said anything to their own parents or the authorities?! they deleted the evidence from their phones and moved on with their lives?! it makes no sense at all to me...
I have seen a couple of the text message's and the two boys do not seem worried or even a little bit remorseful about what they did, they were cracking jokes about it and assuring inquiring friends that the cops were not going to do anything because their coach handled it.... off of this alone i think that it is beyond an insult that they are being tried as minors and not as adults. those two boys made a very ADULT decision to RAPE a nearly or completely unconscious girl, videotape it, and brag about it.... WHY ARE THEY NOT BEING CHARGED AS ADULTS!

im having two major issues with this case though...
the first being:
what exactly were the two boys planning to do with and about the girl after they were down? (<_<)... i just dont understand... they recorded what they did, and multiple people saw them doing it, so what were they planning to do to get away with it? were they just going to redress her and take her home and act like nothing happen? i mean with the assault being recorded and posted on the internet didnt they know they would get caught? are they that dim-witted that they thought that they were above the law and nothing would come of it? or was it the entitlement of being a star football player in a town where the only thing good that they have going for them is football?
The second issue i'm having is actually a two part issue. The first part is with the girls parents... dont shoot me, but... i find myself wondering why these parents didnt instill a better moral compass in this girl, i only say this because i was in high school 5 years ago and i know for a fact that there is no way in hell i would have put myself in a situation where i was so drunk that someone was able to climb on-top of me and rape me, getting drugged would have been the only way that i would have let that happen, because my mother taught me better. she taught me that if im drinking that come hell or high water i should never allow myself to be left alone with the male gender even if that guy is someone i know, not to mention she taught me never to get excessively drunk in public...
point being, to this day as a 26 year old i will never and have never allowed myself to be alone with a male if i'm drunk enough to not be able to walk by myself or speak without slurring all my words. not to mention the fact that my FRIENDS would not allow me to leave with a guy if i was plastered (i've actually had a friend drag me out of a house party by my hair after finding me drunk and making-out with some random dude, BECAUSE THAT'S WHAT FRIENDS DO! and i thanked her the next day because i remembered that i was drunk and once i was sober i knew i wouldn't have wanted what would have happened had my friend not shown up).
Long story short, this whole case is disgusting, these two boys are disgusting, all the kids that knew what was happening and didnt say anything about it or to stop it are disgusting, all the adults in this community that allowed this to happen and go unpunished are disgusting, and the fact that they will either be free if they win the case or free at the age of 21 and no longer is DISGUSTING.
i do hope that this case will be a lesson to high school and college girls though, i hope they pay attention and start to realize the danger that they put themselves in when they attend these parties and throw caution to the wind by getting intoxicated to the point where you can't even say yes or no. because this needs to stop happening and we need to teach our kids better moral's because at the end of the day it takes two.

It takes the victim; to knowingly and willingly consume enough alcohol, at a public or private gathering, to impair their judgement or render themselves unable to coherently think and communicate

the perpetrator; to ignore all moral rationale, humanity and respect for women for this to happen. So let this be a lesson to all the female's and parents out there.
Females, unfortunately we need to be on better guard and make better choices (not to say that all men are bad, or that all men want to hurt us, but we have to always be aware and prepared for the ones that do).

its disturbing, but i have to accept that you're probably right about that.... in one of the picture's from the courtroom Richmond was smiling and Mays looked like he didn't have a care in the world, their body language said it all to me.....
if i was on trial for rape and i was worried about it i would not be able to crack a single smile and i most definitely wouldn't be able to sit back in a relaxed position in my chair, that's for sure.

All a farce since it is in juvenile. Sad to say this may be a mildly satisfying case with no lasting effects on society. The guys may lose a few years in prison, but will walk out with relatively clean slates. If you can't laugh at how big of a joke this entire ordeal is then I will laugh for you. Bleh.
No, this will follow them throughout their lives-- if they are convicted. I'm not positive, but I believe that once a person is registered as a sex offender, they will always be a registered sex offender, and they are supposed to register in whatever town or state they move to.
I kind of wish sex offenders had to have it tattooed across their forehead so that the public is warned when people like these two are out and about. I can only hope that, convicted or not, these two have learned that it is not OK to molest a female, ever, but especially when she has been drinking. They are good-looking fellows and I can imagine that (if convicted) once they complete their sentences they might go to a bar and possibly victimize another woman.
Rapists and, most especially, Pedophiles should have their foreheads tatooed (since we can't just put them down).

Very tragic . Sad to see so many that did not have the parental guidance that would have prevented it. One other thing and this troubles on a lesser level. Will there be a second court case to charge those that provide beer to underage children? 3 young lives are forever changed and the whole town needs to ask why and how.
Funny how this is not addressed. How are we to discourage underage drinking if there are no consequences for the kids to be drinking or the adults supplying it?
Hope those boys are found guilty. How the heck can you prove any type of innocence when she's drunk and passed out like that and claim she consented to having sex. I agree that the people at that party should have stopped it, they are just as guilty and disgusting for letting it happen.

The rapists need to do time. The coach and chief of police who tried to cover this up need to do time. The citizens who have tried to protect these rapists need to do time.
