Ex-Marine arrested in alleged hate crime in attack outside California gay bar

By Miranda Leitsinger, Staff Writer, NBC News

A former Marine has been arrested in the beating of two men outside a popular gay bar in Southern California last year and will face hate-crime charges for using anti-gay slurs during the attack, the Los Angeles County District Attorney's Office said Thursday.

John Kelly O'Leary, 21, was arrested Monday by police in Evergreen Park, Ill., Deputy District Attorney Gretchen Ford of the hate crimes unit said in a statement. O'Leary was discharged from the Marines on Oct. 19, about six weeks after the attack, Marine Corps’ spokesman Master Gunnery Sgt. Mark Oliva told NBC News. He will be extradited from Illinois to California to face the charges.

O'Leary and a group of friends, including other Marines, went to the Silver Fox bar in Long Beach, Calif. in the early morning hours of Sept. 3, 2012. O'Leary was accused of shouting anti-gay slurs outside the bar at closing time, which triggered the hate crime charge, said Jane Robison, a spokeswoman for the district attorney's office.

"Following a verbal exchange with one of two alleged victims, O’Leary allegedly turned and began punching the first alleged victim as he continued to shout anti-gay slurs. The victim, who suffered a concussion and a fractured hip during the altercation, was knocked unconscious," the statement said. "As others joined in to break up the fight, O’Leary allegedly began punching and choking a second male victim before police arrived."

O'Leary has been charged with two felonies – battery with serious bodily injury and assault by means likely to produce great bodily injury – and faces up to eight years in prison, which includes time for the hate crime allegation, Robison said. The Press-Telegram of Long Beach first reported the charges.

Authorities arrested three other Marines after the attack, but they were not charged, the district attorney's office said. Robison said they were attempting to break up the assault, and Oliva said they were on active duty with their commands.

The four Marines, based at Camp Pendleton in southern California, were in their first enlistment. Oliva characterized O’Leary’s discharge as “less than honorable,” but he didn’t have the exact nature of it. He also said the Marine Corps was still conducting an inquiry into the attack.

Robison said she didn't know if the two victims were gay. Immediately after the attack, CBSLA.com reported that one of the victims had gone to the bar with his boyfriend and that he had blacked out from the assault. He was hospitalized overnight and released with non-life threatening injuries, Long Beach police said at the time.

O'Leary is being held on $105,000 bail. He has waived extradition and will be transported to Los Angeles some time next week, the district attorney's office said. Attempts to reach O'Leary, his family or an attorney representing him were unsuccessful.

Philadelphia cop seen on video using baton against man who slapped him

    NBC Philadelphia

A video uploaded to YouTube shows a Philadelphia police officer beating John Scrivano, 43, after Scrivano slapped the officer first.

    By Karen Araiza, NBCPhiladelphia.com

A video has been posted to YouTube of a Philadelphia police officer who appears to be beating a citizen with his baton, less than three weeks after a fellow officer made headlines after a video of him hitting a woman at a public event was also put online.

This time, though, the YouTube video shows the citizen, identified as 43-year-old John Scrivano, slapping the officer first.

The video was on posted on YouTube on Sunday, Oct. 14. It apparently occurred during Oktoberfest on South Street in Philadelphia on Sept. 29.

Lt. Raymond Evers defended the officer seen in the video to Philly.com, saying "The guy [Scrivano] was highly intoxicated. What do you want?" Evers billed it as "old news" to Philly.com and is not releasing the officer's name.

Internal Affairs investigated the level of force used by the officer, Evers told NBC10. But the officer was not put on desk duty or reprimanded for his actions.

Scrivano's girlfriend told NBC10 he was unconscious when paramedics arrived.

In the earlier incident this month, Lt. Jonathan Josey was caught on tape hitting a woman, and was suspended for 30 days. The department intends to fire him, according to Police Commissioner Charles Ramsey.

Philadelphia Mayor Michael Nutter publicly apologized to the victim, Aida Guzman, in the Lt. Josey case, saying he was appalled, angry and ashamed. He said Josey violated his role as a public servant.

"We're here to serve the people who hire us. We're not over them or above them," Nutter said. "We're here with them."

3 teens charged in beating death of disabled man posted on Facebook

    By Lauren Petty, NBCChicago.com

Two more teens have been charged in the beating death of a 62-year-old disabled man that Chicago police said was recorded on a cell phone and posted to Facebook.

    Follow @msnbc_us

Police said a 16-year-old gang member punched Delfino Mora, father to 12 children and a grandfather to 23, last Tuesday in an alley in the 6300 block of North Artesian. Mora's devastated family told NBC Chicago that Mora was on his regular route of collecting cans that he sells for cash when the teens confronted him.

Nicholas Ayala, 17, and Anthony Malcolm, 18, were both charged with first-degree murder and robbery.

Malik Jones, 16, the Latin Kings member accused of striking Mora, was charged with first-degree murder and ordered held without bail Sunday by Judge Adam Bourgeois.

Police said Jones handed his friends his cell phone to start filming, then demanded money from Mora and punched him in the jaw. Ayala and Malcolm are accused of taking turns filming the video, which allegedly showed Mora's head smashing into the concrete.

Mora was found unconscious and died one day later.

Police said the video was posted to Jones' Facebook page. He was arrested after police found out about the video.

"If I had them face-to-face, I would tell them I hope they regret it," said Leo Plata, Mora's grandson. "You don't do that to anybody, you don't just go around jumping people for fun."

Jones was charged as an adult and is scheduled to appear for a preliminary hearing Monday. Ayala and Malcolm are expected to appear Monday in bond court.

The attack marks the third time in the past year a Chicago attack has been filmed and the video has led to an arrest.

Not only are these teens without morals or integrity, they're also stupid. I guess, in this instance, being raised by the village failed.... again.
