    'We weren't meant to die': Rescued hiker speaks as he leaves hospital

    One of the two hikers rescued from the Cleveland National Forest in Southern California said Sunday that he was in and out of consciousness while stuck in a rugged Orange County canyon.

    "The last thing I could tell you was going into a lucid dream," said 19-year-old Nicolas Cendoya. "I can't even tell you when I woke up. I was in lucid dreams and hallucinations for days."

    Cendoya was released from Mission Hospital in Mission Viejo in Sunday.

    "I could see the helicopters flying over me every day," Cendoya said. "When the firefighters came up to me, I couldn't even believe it."

    "We weren't meant to die," he said.

    Cendoya and Kyndall Jack, 18, were saved last week after getting lost and separated during a hike in the Trabuco Canyon area for several days.

    Jack, who was rescued a day after Cendoya, has since messaged Cendoya, thanking him for helping the pair survive.

    Cendoya was hospitalized in Mission Viejo, while Jack was at UC Irvine Medical Center in Orange. Both hikers suffered dehydration along with cuts and bruises.

    Jack remained hospitalized in good condition as of Sunday and no discharge date has been set yet, according to UC Irvine Healthcare spokesman John Murray.

    Published at 6:20 a.m. ET: An on-duty mailman was arrested Monday after allegedly choking an 11-year-old girl who was supposedly taunting him after the letter carrier inadvertently walked into the women's bathroom at a park, U.S. Postal Service and law enforcement officials said Tuesday.

    Daniel Villasenor, 55, allegedly choked the young girl after she laughed at him when he accidentally stepped into the women's restroom at Bristow Park in Commerce, southeast of downtown Los Angeles, on Monday, according to the Los Angeles County Sheriff's Department.

    Several witnesses corroborated the girl's story, sheriff's officials said. Villasensor was found nearby and arrested.

    The 31-year Postal Service employee is on unpaid leave while the investigation continues, said Richard Mahe, spokesman for USPS. The incident is also being probed by the U.S. Postal Inspection Service.

    NBC4's attempts to contact Villasenor's family for comment were declined late Tuesday. But Villasenor's neighbor in Temple City, Calif., Leo Ferraris, described the letter carrier as a "hell of a guy" who never lashed out. accus

    "He'll be barbecuing stuff and he'll say, 'I've got stuff to bring over to you so don't fix dinner tonight,'" Ferraris said.

    Villasenor was jailed on $100,000 bail and had been booked on one felony count of willful cruelty to a child.

    Authorities said they would not be releasing a booking photo of Villasenor.

    New homeowner finds hand grenades in backyard fire pit

    Police in South Los Angeles are trying to figure out why someone left a pair of old military grenades in the backyard fire pit of a house.

    The new owner of a home in the 400-block of 70th Street was doing some cleaning and happened upon the rusted explosives, said Omar Bazulto, the watch commander at the Los Angeles Police Department's Newton Division.

    The pins, which trigger grenades to blow up, were still intact.

    Officers evacuated a 300-foot area around the house shortly after noon on Sunday, when the explosives were discovered.

    It was not immediately clear how old the grenades were, of if the ammunition inside was still live.

    The department's bomb squad planned to detonate the grenades on site on Sunday.

    Flight diverted after Alaska Airlines pilot passes out

    Alaska Airlines flight 473 was traveling from L.A. to Seattle when its pilot suddenly became unconscious. The first officer took over the controls and landed safely in Portland, Ore., where the pilot was taken to the hospital. NBC's Tom Costello reports.

    A flight from Los Angeles to Seattle was diverted to Portland late Thursday after one of the pilots lost consciousness.

    Alaska Airlines said Flight 473's first officer flew the Boeing 737-700 to Portland International Airport after the captain became ill over Oregon.

    The plane landed safely at 9:05 p.m. local time (12:05 a.m. ET Friday) and paramedics took the pilot to the hospital, airline spokesman Paul McElroy said.

    The Seattle Times reported that a doctor on board was able to tend to the captain at the front of the plane.


    There were 116 passengers and five crew members on the flight, which had been due to arrive in Seattle at 9:30 p.m. local time (12.30 a.m. ET).

    The captain has been flying with Alaska Airlines for 28 years, while the first officer has been with the airline 11 years, McElroy said.

    NBC station KING5 said it was not known what caused the pilot to pass out.

    About 20 passengers were re-accommodated on other flights to Seattle, while the rest took a flight scheduled to land in Seattle at 1:15 a.m. local time Friday (4:15 a.m. ET).

    Cops: Woman kills husband, mistaking him for intruder

    NEW ORLEANS -- A 57-year-old New Orleans man was accidentally shot and fatally injured by his wife who mistook him for an intruder, police said Monday.

    The shooting occurred about 11 a.m. Monday (noon ET) in the 5800 block of North Claiborne Ave. in the Lower 9th Ward.


    Police said the man, named by the Times Picayune newspaper as Charles Williams, died at the hospital.

    No charges were immediately filed in the investigation.

    The newspaper said the man's 53-year-old wife was not arrested.

    The Times Picayune reported that the Orleans Parish district attorney's office is expected to review the case, quoting a news release from a police spokesman, officer Garry Flot.

    Small earthquake jolts Beverly Hills, L.A.

    LOS ANGELES -- A magnitude-3.2 quake hit Beverly Hills, Calif., before dawn on Monday, according to the U.S. Geological Survey. There were no immediate reports of damage.

    Beverly Hills police watch commander Sgt. Michael Publicker said his station got numerous calls from anxious citizens after the 3:26 a.m. PT (6:26 a.m. ET) quake.

    "Every alarm in the city is going off," he said. Patrol officers had seen no signs of structural damage, Publicker added.

    California’s earthquake 'swarm' unusual but not rare

    An officer at the nearby West Los Angeles police precinct said there had been no calls about the quake. 

    The U.S.G.S. reported that the epicenter was one mile from West Hollywood and eight miles from Los Angeles Civic Center, according to the Los Angeles Times.

    Damage has been reported after up to 70 earthquakes, including a 5.5-magnitude quake, shook Southern California over the weekend. NBCNews.com's Dara Brown reports.

    Dozens hurt as Metro train and bus collide near downtown Los Angeles

    A Metro bus and a blue line train collided in Los Angeles on Monday. No injuries were considered life-threatening, according to fire-rescue officials.

    A transit bus and Metro Blue line train crashed near downtown Los Angeles on Monday morning, injuring dozens of people, Los Angeles Fire Department officials say.

    Officials say at least 40 people were on board the bus. Medical personnel were attending to as many as eight people who were traveling on the train, according to NBCLosAngeles.com.

    None of the injuries was life-threatening, according to fire-rescue officials. The number of patients hospitalized was not immediately available.


    The Line 51 bus collided with the train at about 7 a.m.. The bus then crashed into at least two light poles, fire officials say.

    The intersection at Washington Boulevard and San Pedro Street remained closed. Major delays were expected, and authorities were adding more buses to the area for morning commuters.

    LA council wants to keep airwaves 'crack ho' free

    The Los Angeles City Council passes a resolution asking Clear Channel to end racist and offensive remarks. Kim Baldonado reports.

    LOS ANGELES -- Los Angeles City Council members called on TV and radio broadcasters to keep their hosts from spewing crude slurs, citing KFI radio calling Whitney Houston a "crack ho."

    The council voted 13-2 on Wednesday for a resolution urging Los Angeles stations to do "everything in their power to ensure that their on-air hosts do not use and promote racist and sexist slurs over public airwaves."

    The resolution stems from comments made by KFI talk show hosts John Kobylt and Ken Chiampou of the “John and Ken Show” who, three days after Whitney Houston died, referred to the pop music icon as a “crack ho.”

    “It is easy to become desensitized to what other groups find intolerable which ultimately fosters an environment where negative comments can go unchecked and corporate guidelines and policies are no longer being enforced,” the resolution stated.

    The resolution also states that it important for stations to hire more women and minorities.

    The measure is a symbolic stance and has no legal force. However, council members argued that it was proper for the ethnically diverse city to speak out against what they called hate speech.

    Government has no right to suppress "hateful, vile, despicable speech" but society should not tolerate it, Councilman Paul Krekorian said. "We can drown out that hatred with a loud chorus."

    The measure was sponsored by three black council members and supported by civil rights and minority media groups. It was broadened after originally naming only KFI-AM and its owner, Clear Channel, which carries Rush Limbaugh and owns hundreds of stations nationwide.

    The comments led to a public outcry, a seven-day suspension for the hosts and a public apology.

    "They brought Latinos, African Americans, native Americans, women's groups -- everyone together around this particular issue," said Jasmyne Cannick, of the Black Media Alliance, who urged the council to pass the resolution.

    Station officials have promised to diversify their staff and add more minority hosts at the station where conservative hosts often rail against taxes and illegal immigration.

    Clear Channel Los Angeles and KFI responded with the following: We "support the LA City Council resolution regarding the need for diversity of personnel, inclusionary programming, and appropriate on-air language across all media."

    The resolution also cited recent remarks by Limbaugh. Limbaugh called law student Sandra Fluke a "slut" and a prostitute who wanted the government to subsidize her sex life after she urged lawmakers to consider the importance of contraception coverage in their discussion of national health care policy. He later apologized after several sponsors dropped his show.

    The station has 1.5 million listeners during any given weekday.

    Report: LA sub kept teaching after 3 abuse allegations

    LOS ANGELES -- A substitute teacher in the nation's second-largest school district was investigated three times for allegations of sexual misconduct with students before he quit in 2007 and started teaching in another district, the Los Angeles Times reported.

    The teacher, identified as 45-year-old George Hernandez, was never arrested or charged in the Los Angeles Unified School District cases.


    The Los Angeles Times reported that when the third investigation was completed, Hernandez quit teaching in Los Angeles and started working for the Inglewood Unified School District.

    He taught there for nearly three years before police found a videotape they say shows him molesting a second-grade girl at an Inglewood school.

    On Wednesday, the Huntington Park Police Department released information about the investigation involving Hernandez in September 2010. The investigation began with a report of indecent exposure involving the suspect near Gage Middle School.

    Hernandez's computer and other items were confiscated after authorities obtained a search warrant for his home. It was during that search that authorities found "a large quantity of child pornography" that included video of the suspect allegedly engaging in lewd conduct with a student, according to the sheriff's department.

    Hernandez was arrested and charged with child molestation but posted bail. He failed to appear for a preliminary hearing on Sept. 30, 2010, according to the sheriff's department.

    It is believed that Hernandez fled to Mexico, according to investigators.

    "This guy should not have been kept in the district," Kathleen Carroll, an attorney who worked for the state Commission on Teacher Credentialing, told the Times on Wednesday. "This is an outrage."

    The case is one in series of lewd conduct investigations in the Los Angele Unified School District, including the accusations against two former Miramonte Elementary School teachers. One of the former teachers, Mark Berndt, pleaded not guilty Tuesday to charges of lewd conduct involving more than 20 students.

    $1 million pot growing operation uncovered in LA county

    A traffic stop in the high desert area of Los Angeles County led police to a pot growing operation worth $1 million and the arrests of nine people, authorities said on Saturday.

    Deputies from the Lancaster sheriff’s station conducted a traffic stop at 2 a.m. Thursday at 40th Street West and Avenue D.

    Deputies discovered that the driver was on probation and had a suspended license.


    Authorities went to his home in the 7200 block of West Avenue to conduct a probation compliance check and found a marijuana growing operation, officials said.

    Deputies found several rooms had been converted into growing areas, complete with planting beds and artificial lighting.

    The deputies recovered about 800 plants, with an estimated value of $1 million.

    They also recovered several large plastic bags full of processed marijuana and a “hash oil” processing area.

    Eight others who were inside the home were arrested.

    'Wasn't the best thing I had ever done': Ex-traffic cop in porn flick fights for job

    A California traffic cop who was fired after appearing in a porn film while on duty and in uniform is trying to get his job back. KNBC-TV's Joel Grover reports.

    A former Los Angeles traffic officer said he was “totally unaware” when he was asked to appear in a porn movie while on duty and in uniform last year and now wants his job back.

    “I was caught totally unaware, by surprise,” John Dancler said during his appeal to the Los Angeles Civil Service Commission on Wednesday.

    Dancler was fired in July 2011 in the wake of an NBC4 investigation, which showed him and another traffic officer in a porn movie while on duty and in uniform, NBCLosAngeles.com reported.

    “I could not believe what was going on, it was really surreal,” Dancler said during the hearing.

    The NBC4 porn investigation went viral around the world last spring. The NBC4 team also uncovered a longstanding pattern of traffic officers who were convicted of crimes on the job, including soliciting prostitutes and shoplifting, but none had ever been disciplined, as recommended by city policy.

    Dancler said he was responding to a call for backup help in 2008 when a porn actress and her crew approached him, asking him to engage in lewd acts with the blonde woman.

    Dancler admitted under questioning he had made a mistake.

    "It wasn’t the best thing that I had ever done," Dancler said.

    When asked if he informed others about the exchange on the streets, Dancler said “No.”

    BP accuses Halliburton of destroying evidence following Gulf spill

    NEW ORLEANS -- BP has accused Halliburton of destroying damaging evidence about the quality of its cement slurry that went into drilling the oil well that blew out last year and caused the worst offshore oil spill in U.S. history.

    In a court filing, the oil company alleged that Halliburton did inadequate cement work. BP also asked a federal judge to punish the oilfield services company.

    The accusation raises the stakes ahead of a trial, expected in late February, to assign blame and damages for the April 2010 blowout of the Macondo well, which triggered the spill.


    Citing recent depositions and Halliburton's own documents, BP said Halliburton "intentionally" destroyed the results of slurry testing for the well, in part to "eliminate any risk that this evidence would be used against it at trial."

    Also in the documents filed in a New Orleans federal court, BP accused Halliburton of failing to produce incriminating computer modeling evidence. BP accused Halliburton of claiming the modeling is gone.

    BP asked U.S. District Judge Carl Barbier to penalize Halliburton and order a court-sponsored computer forensic team to recover the missing modeling results.

    'Without merit'
    Beverly Blohm Stafford, a spokeswoman for Halliburton, told Reuters the Houston-based company is reviewing BP's filing.

    "We believe that the conclusion that BP is asking the court to draw is without merit and we look forward to contesting their motion in court," she said.

    BP is coming under scathing new criticism over shortcuts and outright failures that resulted in the April 2010 disastrous oil spill in the Gulf of Mexico that killed 11 rig workers, soiled miles of coastline, and took nearly three months to get under control. NBC's Anne Thompson reports.

    The allegations in the 310-page motion ratcheted up the showdown among BP PLC and contractors, Halliburton and Transocean Ltd. The three companies have been sparring over blame for the April 2010 Deepwater Horizon blast, which killed 11 workers and led to the release of 206 million gallons of crude oil into the Gulf of Mexico.

    So far, BP, the majority owner of the Macondo well, has footed the bill for the emergency response and cleanup.

    Also involved are Anadarko Petroleum Co. and Cameron International Corp.

    The first trial over the Deepwater Horizon disaster is scheduled to start Feb. 27 in New Orleans. The first leg is expected to take about three months and determine the liability of each company involved in drilling the Macondo well. There will be other phases over cleanup costs, punitive damages and other claims.

    Federal and independent investigations of the disaster have found fault in Halliburton's cement job because it failed to properly plug the well. Halliburton used a foamy cement slurry.

    BP said Halliburton's chief cement mixer for Gulf projects testified in depositions that the cement slurry seemed "thin" to him but that he chose not to write about his findings to his bosses out of fear he would be misinterpreted.

    "I didn't want to put anything on an email that could be twisted, and turned," Rickey Morgan, the Halliburton cement expert, said in depositions. He worked at a laboratory in Duncan, Oklahoma.

    "Upon reviewing these latest testing results, Halliburton employees destroyed records of the testing as well as the physical cement samples used in the testing," BP alleged.

    People who depend of the Gulf of Mexico for their livelihood are still struggling one year after the BP spill. NBC's Jay Gray reports.

    Halliburton is the world's second-largest oilfield services provider.

    The Deepwater Horizon drilling rig's explosion on April 20, 2010, caused 11 deaths, and brought tens of billions of dollars of lawsuits. Halliburton has accused BP of fraud and defamation, among other claims.

    BP has also sued Transocean Ltd, which owned the rig, and Cameron International Corp, which made a blowout preventer.

    In October, Anadarko Petroleum Corp, which owned 25 percent of the well, agreed to pay BP $4 billion toward clean-up costs and victims compensation.

    BP has also reached settlements with Mitsui & Co, whose MOEX Offshore 2007 LLC venture was a drilling partner, and Weatherford International Ltd, which provided equipment used in the well.
