    Teacher accused of spiking tots' sippy cups with sleeping pills pleads no contest

    A California preschool teacher charged with spiking toddlers' sippy cups with sleeping pills entered a "no contest" plea, prosecutors said on Friday, reducing her original 10 charges down to five.

    Deborah Gratz, 59, of Hollister is expected to be sentenced on July 5, and faces a jail sentence on five misdemeanor courts.

    Deputy District Attorney Summerle Davis had originally charged Gratz with five counts of attempted child endangerment and five counts of assault.


    In a statement, Davis said that this case was about parental "betrayal."

    Gratz was released from jail after she was arrested March 11 on her own recognizance following her arrest on March 11. She has declined media interviews.

    Gratz supervised 10 children at the Kiddie Academy Childcare Facility on Monterey Road in Morgan Hill, where she has since been fired. Prosecutors said that on that day in question, the cups were confiscated before any of the children drank from them. Teachers, prosecutors said, found residue in five of the cups. The sleeping aid, Sominex, is not supposed to be given to children younger than 12.

    Pharmacist accused of planting poisoned orange juice at Starbucks

    A 50-year-old pharmacist was arrested Monday night after police say she removed two bottles of orange juice from a bag - which they say were filled with rubbing alcohol - and placed them on the shelf with other refrigerated items at a Starbucks in San Jose, California.

    San Jose Police Sgt. Jason Dwyer took Ramineh Behbehanian of San Jose into custody on an attempted murder charge because the orange juice contained what police said were lethal quantities of isopropyl alcohol. She is scheduled to appear in court Thursday.

    She has no criminal record in Santa Clara County, according to court records. Late Tuesday, sources confirmed for NBC Bay Area that Behbehanian is a pharmacist working for a company owned by Johnson and Johnson.

    Authorities are still not sure why she would have allegedly mixed rubbing alcohol with some orange juice in the afternoon, left the bottles in the refrigerated section alongside some yogurt and milk, and left the Snell Avenue store about 3:30 p.m. local time (6:30 p.m. ET).

    "Why would she do such a thing?" Chris Africa said, standing outside the Starbucks on Tuesday morning. "Was she trying to poison us?"

    An alert customer standing behind her in line spotted her taking out her own bottles of juice from a green Starbucks bag, and put them in the refrigerator section. He also noticed a toxic smell. He told management. The woman might have felt under suspicion, police said, but a Starbucks employee got her license plate.

    "A lot of people out there may have seen something and probably dismissed it," Dwyer said. "But I believe that person saved lives by doing that."

    The San Jose Fire Department responded to the scene, retrieved the bottles and tested the contents with hazardous materials equipment. It turned out, the bottles were filled with orange juice and rubbing alcohol.

    On Tuesday morning, customer Brent Breyer said he was a little "apprehensive" about what happened at his usual Starbucks. He said he often brings his young daughter, who routinely grabs for items in the refrigerated section.

    Police were able to track her down at her home, though no motive has surfaced.

    A Starbucks spokesperson told NBC Bay Area that the company destroyed all the other juices in the Snell Avenue store out of an abundance of caution and had all other stores in Bay Area check their juice seals. 

    All checked out OK.

    The three 16-year-old boys charged in connection with the sexual assault of a high school classmate who later committed suicide have been released to their parents' custody.

    There are several conditions of their release, the source said, including wearing an ankle bracelet and remaining under house arrest.

    The teens were arrested April 11 in connection with sexually assaulting Audrie Pott, 15, at a Labor Day party Sept. 2. Authorities say the girl felt humiliated and cyber bullied and committed suicide eight days after the assault. All of the teens had attended Saratoga High School.

    In addition to the criminal charges, the Pott family, through attorney Bob Allard, has filed a wrongful death suit against the teens.

    In a statement last week, the boys' lawyers have called much of the reporting about the assault "inaccurate" and distanced their clients from the alleged crime and Audrie's suicide. "Most disturbing is the attempt to link Audrey's [sic] suicide to the specific actions of these three boys," some of the statement read.

    NBC doesn't normally identify victims of sexual assault or suicide, but have used the girl’s name in this report with her parents’ permission. The Pott family has said it hopes the story will help prevent something like this from happening again.

    The teens have been charged as juveniles and their names and court proceedings are also not public.

    Three teenage boys are under arrest in connection with the alleged sexual assault of a 15-year-old California girl who later took her own life.

    Audrie Pott committed suicide on Sept. 10, 2012, eight days after she was allegedly assaulted.

    Attorney Robert Allard, who represents the girl’s family, says the teen committed suicide after photos of the alleged attack were published online.

    “Based on what we know, she was unconscious, there were multiple boys in the room with her,” Allard said. “They did unimaginable things to her while she was unconscious.”

    On Sept. 10, 2012, eight days after the alleged assault, the girl, Audrie Pott, committed suicide.

    NBC News does’t normally identify victims of sexual assault or suicide, but the girl’s name has been used in this report with her parents’ permission. They are hoping the story will help prevent something like this from happening to anyone else.

    'My life is ruined'
    The family’s attorney says the girl took her life after learning that her attackers took photos during the assault, and then published them online and showed them around Saratoga High School in Saratoga, Calif.

    According to Allard, in the days that followed the attack, the girl wrote on her Facebook page: “The whole school knows… My life is ruined.”

    The Santa Clara District Attorney’s Office would not comment on the case because the suspects are minors.

    The Santa Clara County Sheriff’s Department said all three boys are 16 years old and were arrested on charges of sexual battery.  Two of them were arrested on the Saratoga High School campus Thursday morning and the third was arrested in Gilroy, Calif.

    Allard says two of the boys are students at Saratoga High School and the third is a student at Christopher High School in Gilroy.

    All three are being held at Juvenile Hall until a detention hearing on Monday or Tuesday, but have not been charged with a crime.

    The girl’s parents, who didn’t find out about the attack until after their daughter’s death, want the boys prosecuted as adults.

    San Jose man drives car into Walmart, beats customers

    This car drove into a San Joes, California WalMart Sunday morning, according to police. The driver then got out of the car and beat four customers with a blunt object.

    A man drove a car into a San Jose Walmart, then grabbed a blunt object and began beating customers Sunday morning, police said.

    Police said they received word that a car had driven into the Walmart at 777 Story Road at 11:15 a.m. on Sunday.

    They said the driver then got out of the car, grabbed a blunt object from inside the store and began hitting people with it.


    Four people were injured, one of them seriously.

    Sources say a pregnant woman may be among the injured, all of whom were taken to the hospital.

    The man accused of driving the car and assaulting the people was booked into county jail.

    'It was scared, I was shaking': Calif. girl struck by arrow recalls ordeal

    It may sound like a whale of a tale, but an 8-year-old San Rafael girl who was struck by an arrow outside a life-size whale structure outside the Lawrence Hall of Science in Berkeley is telling the truth.

    Nadine Hairston-Millington was hit by an arrow while playing the popular structure on Tuesday during a school field trip. The arrow lodged in her leg and required hospital doctors to remove the 20-inch cross bow.

    "It hurt, it hurt a lot so I started crying a little," the third grader told NBC Bay Area on Wednesday. "I stopped when my teacher came over."

    Rushed to the hospital in an ambulance, Nadine said she sang Taylor Swift songs to stay calm: "My teacher put Taylor Swift songs on and we both sang the words together since she is my favorite singer."

    It's not quite clear how the arrow struck the girl, or who did it.

     Police Capt. Stephen  Roderick told Bay City News earlier this week that investigators are trying to reconstruct the arrow's  trajectory, a difficult task when "an arrow can travel 500 to 1,000 yards."

    Police said it did not appear that the shooting was connected to any science or math experiments at the center.

    Nadine's mom, Alicia Hairston, said that the entire ordeal has been bizarre and scary, but in the end, her daughter is now home and it could have been worse.

     "I feel lucky it hit where it hit, didn't hit an artery, muscle, a vein. It could have been much worse," she said. Hairston says doctors are expecting a complete recovery.

    Nadine doesn't seem bothered by the incident at all. In fact, she thinks by catching the arrow, she may have done something kind for the statue: "I saved a whale," she said proudly.

    Very unfortunate incident... I hope she's OK. This will probably lead to the uninformed public calling for extensive background checks on people purchasing crossbows and bows and arrows... and banning quivers that hold more than 5 arrows.

    An 8-year-old  girl on a school field trip to the University of California science museum in Berkeley was hit by an arrow while she played on a whale sculpture.

    The girl, who was hit in the leg Tuesday, had to have the arrow surgically removed. She spent the night in the hospital and was released on Wednesday afternoon, according to NBCBayArea.com.

    Who fired the arrow, which came from a crossbow, remains a mystery. Police were tracing the projectile's trajectory to determine where it came from, but have not located a suspect. It remained unclear if the arrow shooting was an accident or a malicious act.

    The whale sculpture is located in a plaza outside the Lawrence Hall of Science. Other students in the area were taken inside after the girl was hit.

    UC Berkeley does have an archery group, but its members practice on the other side of the campus.

    Field trip chaperone Geoff Vassallo said the girl cried as she waited for an ambulance, but “was a pretty brave little girl.”

    Last human toll takers on Golden Gate Bridge replaced by machines

    As the end of her afternoon shift collecting tolls on the Golden Gate Bridge ended, Dawnette Reed felt the tears begin to come.

    She stepped out of her booth at lane three and made the walk back to the office for the last time. After 18 years collecting tolls at the bridge, her job was done.

    "I always say I know customers from the [baby’s] car seat to the driver's seat," Reed said of her regular customers.

    With the bridge switching to fully electronic toll collecting early Wednesday morning, the humans no longer had a place on the bridge for the first time in its more than 75 year history.

    The Bridge District offered the toll takers other jobs, but Reed wasn't interested in any of them. Driving a bus? Not for her.

    "I'm going to miss the customers," Reed said.

    The drivers knew it was the toll takers last day. Some gave Reed flowers, cards - someone she'd never met gave her a bag of cookies.

    She'd gotten to know her customers, even in the brief time it took hand over the $6 fare. They'd invited her to birthday parties and weddings.

    Sometimes she saw strange things collecting tolls.

    "We've had naked people come through with painted on bikinis," she laughed. "Sometimes we get naked people without paint on them."

    Toll collector Jacquie Dean had 18 years on the job herself. She was angry she was being replaced by electronic gizmos and cameras that would soon photograph license plates and send drivers a bill for the toll.

    Those things couldn't give directions to lost drivers, or watch out for trouble on the bridge.

    "We're not obsolete, they chose to do this to us," Dean said. "They chose to have us here. They could've kept a couple lanes open."

    The Bridge District said it would save $16 million over the next few years by replacing the toll workers.

    It was only a matter of time before humans weren't needed.

    "For the economic health of our organization I think it makes sense," said Kary Witt, manager of the Golden Gate Bridge. "Obviously the savings of doing this automatically, electronically as opposed to employing people, it's not avoidable."

    Still, as some of the workers finished their last shifts on Tuesday and walked toward the office, some were in tears as they clutched bouquets.

    Witt seemed to be choking back his own tears.

    "We do lose a bit of the human touch," Witt said. "I think that's one of the things, you know, is a bit ironic."

    Dean said the severance package offered to employees was disappointing. She wasn't sure what she would do next. But knew there would be another job somewhere.

    She said she'd miss her co-workers the most.

    "We've all gone through it together," she said, choking back sobs. "And I can say through all those tragedies in my life, this has been my normal, this is what kept me grounded."

    Girls can't wear tuxedos to prom, students told

    Students at a California high school are being told they must wear gender-specific attire to prom and for yearbook photos, prompting the ACLU to demand district officials step in to end discrimination against students by teachers and administrators at the school.

    In an 11-page letter to Hesperia Unified School District Interim Superintendent David McLaughlin, the ACLU and law firm Nixon Peabody charged that Sultana High School administrators foster a hostile and harassing climate for gay and gender non-conforming students.

    Teachers and administrators have made discriminatory comments about gay people, and have not stepped in to stop bullying by students, the ACLU said.

    Kyle Bodda, president of the Sultana Gay Straight Alliance, said the atmosphere has proven distracting to learning.

    "All students should feel safe and free to be themselves at school," Bodda said. "I'm hopeful the administration does the right thing and creates a safe environment where we can be ourselves without fear of being harassed."

    Levi Smithson-Johnston, a senior at Sultana High School, said the alleged discrimination began last year when students formed a Gay Straight Alliance club on campus.

    "It’s saddening that they would even want to discriminate or even try to hide anybody of their sexual orientation or gender," he said.

    In a statement, interim superintendent McLaughlin said he was returning to the district from spring break to "personally oversee a thorough examination of this situation.

    "These allegations are deeply concerning and they have my full and focused attention," he said. "While the ACLU letter focuses specifically on the rights of gay and lesbian students, I see it as a moral imperative to reinforce the current efforts in place regarding anti-bullying and tolerance throughout the district."

    In one incident, a teacher told a student who commented that he did not have a valentine on Valentine's Day, that that's "because you're gay and nobody wants to be with you." In another, an administrator referred to a gay student's campaign for homecoming queen as a "joke." Another teacher told a student to "take the gay headband off."

    ACLU's letter states that girls are being told they must wear dresses to the prom and boys must don tuxedos.

    "Some female members of (the Gay Straight Alliance) would like to wear tuxedos to prom. Me, myself personally would like to wear tuxedo and heels to prom," Smithson-Johnston said.

    A junior at Sultana High School, Amber Stanford said she’d like to see the school’s treatment of LGBTQ and gender non-conforming students "change drastically."

    Stanford said she plans on wearing a dress and heels to prom, but has close friends who would be affected by the dress code.

    "Any student should be able to wear whatever they want no matter if they are boy or girl because it’s what they feel comfortable in," she said.

    Students were also instructed to wear gender-specific attire for their yearbook photos, in violation of state and federal laws, according to the ACLU.

    "California law makes it crystal clear schools cannot discriminate against LGBTQ students based on sexual orientation, gender identity, gender expression," said Melissa Goodman, ACLU attorney.

    Students and lawyers alleged that administrators have censored the Gay Straight Alliance's public announcements, flyers and activities, such as movie screenings.

    The ACLU's letter noted that a gay teacher, who was advisor to the alliance, was told she was "a bad fit" after she helped a student file a complaint against a teacher and her contract was not renewed.

    The lawyers want written assurances from the district by March 25 that discrimination will end at the school.

    Innocent man cleared after 14 years behind bars for attempted rape of girl

    Johnny Williams spent 14 years in prison for an attempted rape he never committed. On Friday, a judge overturned his conviction. And on Tuesday, the 37-year-old Williams spoke publicly for the first time.

    "I'm truly happy," Williams said in a one-on-one interview at Santa Clara University. That's where a team of students and lawyers from the Northern California Innocence Project helped prove that the DNA on a 9-year-old's T-shirt did not belong to him. The DNA is what led to his 1998 attempted rape arrest.

    "Everything happens for a reason," he said.

    This is the second innocent person the Innocence Project has exonerated this year, and its 16th victory since its creation in 2001. The class at Santa Clara University also helped free Ronald Ross, 51, who was convicted in 2006 for an attempted murder and was released at the end of February, when the judge dismissed the case.

    Williams, born and raised in Oakland, has a different twist to his story.

    He served his entire 14 years and was released from prison in January. So, when Alameda County Superior Court Judge Larry Goodman wiped his record clean, he had already served out his whole punishment -- the last stretch at Richard J. Donovan Correctional Facility in San Diego -- one that began when he was 23 years old.

    Before this, he had no criminal record.

    But Williams on Tuesday did say that his life had been heading in the wrong direction before his arrest. He said he never graduated high school and never finished college. Being behind bars for most of his adult life made him realize he now has a second chance.

    "I want to learn from my past experiences," Williams said, not wanting to elaborate on his past life in Oakland. "I'm just happy to be back on the streets. I'm trying my best to get a job and go to school."

    As for the Oakland police who arrested him, Williams only had this to say: "We all make mistakes."

    On Sept, 28, 1998, a man who called himself "Johnny" sexually accosted a 9-year-old girl as she walked home from school. The next day, while walking in the same area, the same man attempted to rape her. Williams was a former neighbor of the girl and familiar with her family. When the girl first reported the assault she did not say she knew the attacker, which suggested a stranger.

    However, people who knew the girl suggested to police that "Johnny" may be Williams, according to Santa Clara University's Innocence Project. One week after the attack, Oakland police collected the clothes the girl was wearing during the assault. Forensic tests at the time of trial were unable to confirm biological evidence and no DNA testing was performed. On June 8, 2000, Williams was convicted of two counts of forcible lewd conduct against a child and one count of attempted rape.

    Williams wrote the Innocence Project a letter, and the students took up his case along with their sister organization, the California DNA Project. Working with the Alameda County District Attorney's Office, the T-shirt was retested and Williams' DNA was excluded.

    The Innocence Project's supervising attorney Maitreya Badami said years were taken off Williams' life, but he is eligible for a significant sum of money. All eligible, exonerated prisoners can earn up to $100 a day for every day they wrongly spent in prison. Badami said that could be about $500,000, and even though it may take a long time to get it, Williams is definitely a candidate for that money.

    Sad truth is cops are only interested in making an arrest and calling the case closed, and power hungry prosecutors are only interested in building a good conviction rate.     Rocket launcher returned at California gun buyback

    Solano County's first countywide gun buyback program today collected 344 weapons including a military rocket launcher and multiple assault rifles, according to Vallejo police Chief Joseph Kreins.

    The buyback, conducted from 10 a.m. to 3 p.m., drew in 113  handguns, 67 shotguns, 163 rifles, including multiple assault rifles and the  rocket launcher, Kreins said.

    "The goal of the operation was simple: We wanted to get as many  illegal and unwanted guns off the streets of Solano County as possible,"  Kreins said in a statement today.

    "We all know that these very firearms are often used to commit  violent crimes against our fellow citizens and in a variety of tragic  scenarios, including suicides," Kreins added.

    A similar gun buyback in Santa Clara County last weekend had a starting budget of $150,000.    In the end, the Santa Clara County sheriff's department said they received 1,116 guns, which included 47 assault weapons. They gave out about $114,0000, which means they had money left over.

    A 46-year-old Austin, Texas, man died while swimming in the Escape from Alcatraz Triathlon Sunday morning.

    Race organizers believe the man suffered a heart attack shortly after he entered the San Francisco Bay for the 1.5-mile swimming portion of the triathlon around 7:30 a.m., according a statement by Race Director Bill Burke.

    Burke said that the race's water safety team saw the man in the water and began CPR as they brought him to the shore. But rescuers were unable to revive him.


    Burke said the man is the first person to die in the race's history.

    The Escape from Alcatraz Triathlon includes a 1.5-mile swim from Alcatraz Island to the shores of the St. Francis Yacht Club, an 18-mile bike ride, and an 8-mile run through San Francisco's Golden Gate Recreational Area.
