    Deputy survives horrific shooting caught on camera after police stop

    A Texas deputy who was shot by a wanted Colorado man says he only remembers bits of what can be seen in video from his dashboard camera.

    Evan Spencer Ebel, who was suspected in the slaying of Colorado's prisons chief and a pizza deliveryman, shot Montague County Deputy James Boyd three times at point-blank range during a traffic stop.

    Montague County Sheriff Paul Cunningham on Wednesday released dash-cam video of the March 21 shooting.

    The video shows Boyd stopping the car for driving in the left-hand lane and not passing. As soon as Boyd approaches the car, Ebel can be seen quickly shooting Boyd three times -- twice in the chest and once in the head. He then speeds away.

    After a minute, drivers stop to help Boyd and call emergency crews.

    "I can remember stopping the car, making the approach, knowing something's not right," said Boyd, who has been recovering at a rehabilitation center in Dallas.

    "I can remember being shot, and that's about the point I blacked out for 30, 45 seconds," he said.

    "The only thing I can consciously remember is seeing the gun shoot off at me," he said.

    Boyd is scheduled to go back to work on Friday, nearly two months after the shooting.

    Even now, the video is still hard to watch, the sheriff said.

    "I mean, I don't know what else to say-- I was mad," Cunningham said. "That was somebody [who] hurt one of my deputies. You know, you want to strike back."

    "It's hard every time you watch it," he said, choking back tears. "You can almost feel the bullets when you're watching it."

    Ebel was killed later that day in a shootout in Wise County after the high-speed chase.

    Boyd said he's just grateful that his encounter with Ebel wasn't worse.

    "If it would've gone one way or another, I could be dead," he said. "It was a very close call. It just wasn't my time."

    Texas grandfather accused in shooting deaths of son and grandson

    An 82-year-old man is accused of killing his son and grandson in their home in a small Texas town.

    Police in Fairview, Collin County, found the bodies of Paul Tanner Jr., 59, and Ryan Dawson Tanner, 23, shortly before noon Friday.

    Paul Tanner's estranged wife called police after seeing a body slumped over in a chair inside the home in the 1300 block of Red Oak Trail.

    The responding officers entered the home and confirmed that the person spotted through the window was deceased. While searching the home, officers discovered another body in a bedroom.

    Police said both were shot in the head, most likely early this week.

    The Tanners lived in the home with 82-year-old Paul Alexander Tanner Sr., who was later found at an Addison motel and taken into custody.

    Police said the grandfather was unconcious when they found him and was treated at an area hospital.

    Police said they know of only one domestic call to the home, and that it did not involve the grandfather.

    Texas police are getting help from the FBI and other agencies to follow leads and try to a find 14-year-old kidnapping victim and her "obsessed" alleged kidnapper.

    Investigators believe Ruby Zavala is in serious danger after police say 23-year-old Jesus Ramirez abducted Ruby, her mother, and her sister from a Mount Pleasant, Texas, church at knife point.

    Officers believe Ramirez used the mother's truck to take the three women from Saint Michael's Catholic Church at 1403 E. First St. in Mount Pleasant around 1 p.m. Sunday.

    Ramirez later let the mother and Ruby's sister go, but continued on with Ruby Zavala.

    Early Monday morning, NBC 5 gathered exclusive video of police recovering the truck Ramirez was believed to have been driving from a wooded mining area. The truck was found wrecked and abandoned. Police are now towing the truck to search for evidence and using search dogs to track the pair.

    Mount Pleasant Police Chief Wayne Isbell says police do not believe the teen is willingly with the 23-year-old Ramirez, though they have reportedly dated in the past without her parents' knowledge.

    Isbell says Ramirez is apparently obsessed with the teen and has a criminal record involving children.

    "The suspect has already previously been charged with sexual assault of a child before," Isbell says. "We have reason to believe he may be mentally unstable and suicidal."

    Ramirez pleaded guilty to aggravated assault with a deadly weapon, a second-degree felony, in 2007. He was given deferred adjudication and spent five years on probation.

    The missing girl is 14-year-old Ruby Zavala. She is 5 feet tall and weighs 120 pounds. She has black hair and brown eyes. She was last seen wearing a white top, blue jeans and tan shoes.

    The suspect is 23-years-old Jesus Ramirez. He is 5 foot, 9 inches tall and weighs 165 pounds. He has black hair and brown eyes. He was last seen wearing a black baseball cap.

    Eight kids placed in foster care after being dropped off at fire station

    Child Protective Services is trying to figure out why eight children in Dallas were left alone in a home and later dropped off at a fire station.

    CPS investigators have located and are talking with the mother of the eight children, aged 3 to 12, who were reportedly left alone Sunday morning at a house in Oak Cliff.

    Police said two women who described themselves as acquaintances from church had gone over to the family's house to check on the children and did not find their mother at the house.

    Around 7 a.m., the women dropped the children off at the fire station at 745 West Illinois in Dallas.

    Dallas Fire Rescue told NBC 5 that the children were at the station for about 40 minutes before police and Child Protective Services responded. Firefighters fed and entertained the children before they were taken into custody.

    The children could not tell investigators how long they had been on their own.

    All eight siblings are now in foster care and in good health. The children will remain in foster care temporarily while the investigation continues, according to CPS spokesperson Marissa Gonzales.

    Investigators would not comment on what, if any, explanation was provided by the mother for leaving the children. CPS did not reveal if the mother would face charges.

    A former Texas official jailed on charges of making a terroristic threat is a "prime suspect" in the slaying of two Kaufman County prosecutors, one of his family members told NBCDFW.com.

    Eric Williams, 46, who is being held on $3 million bond, lost his job as Kaufman County justice of the peace last year after he was convicted of felony theft for taking computer monitors from a public building. Assistant district attorney Mark Hasse, who was the first of the local authorities slain, prosecuted that case, Reuters reported.

    Hasse, 57, was gunned down in daylight Jan. 31 in the Kaufman town square, near the county courthouse. Three months later, the county’s district attorney, Mike McLelland, 63, and his wife, Cynthia, 65, were shot to death at their home in Forney, Texas. McLelland, who had publicly vowed to find Hasse’s killer, was fired at 20 times and his wife once, according to a federal source.

    The three killings rocked the small town and caused concern among prosecutors in the region. Theories about motives behind the killings have included retaliation by white supremacist groups and Mexican drug cartels, federal prosecutors said.

    Assistant District Attorney Mark Hasse was shot and killed Jan. 31 as he left work in Kaufman, Texas.

    Attention turned to Williams after his arrest early Saturday.

    A former police officer, Williams said he was contacted by investigators just hours after McLelland and his wife were found dead.

    “I’ve cooperated with law enforcement,” Williams said. “I certainly wish them the best in bringing justice to this incredibly egregious act.”

    Williams said he met with the agents at a restaurant, where they conducted a test for gunpowder residue on his hands. He also turned over his cellphone along with his wife’s, Williams said. The investigators gave the phones back to him on Sunday.

    “I know I didn’t do anything,” Williams said. “I know where I was.”

    16 adults sickened at Texas children's store

    Fort Worth firefighters and emergency crews are trying to find out what made at least 16 adults ill at a children's store in Southwest Fort Worth.

    Around 3:30 p.m. Saturday, emergency crews responded to the buy buy BABY store at 4650 Southwest Loop 820 in Fort Worth. The patients reported feeling dizzy and/or vomiting.

    A Fort Worth Fire & Rescue public information officer told NBC DFW that no children were hurt. All of the patients are between 20-40 years of age. 


    Nine employees and four shoppers were transported to Texas Health Harris Methodist Hospital Fort Worth for medical evaluations.  Three people refused medical treatment.

    There were no complaints from neighboring stores.

    The home of a former Kaufman County, Texas, judge who says he was questioned by agents just hours after District Attorney Mike McLelland and his wife were shot to death was searched Friday afternoon.

    The FBI, Texas Rangers and Kaufman County investigators are gathering evidence related to the killings of McLelland and one of his top aides, Mark Hasse, according to Kaufman County public information officer Lt. Justin Lewis.


    Williams has never been named as  a suspect and no arrest warrant has been issued for Williams.

    In an interview April 3, Williams told NBC 5 he had nothing to do with the McLellands' murder and doesn't even own a gun.

    "If I was in their shoes, I would want to talk to me," Williams said in an interview at his house. "In the investigators' minds, they want to check with me to do their process of elimination."

    Williams, a former Kaufman County justice of the peace, was charged with theft and later convicted in a high-profile trial. He was kicked out of office, and his law license was suspended. He was sentenced to two years' probation and is appealing his conviction.

    But he said he is not bitter and wouldn't want to harm anyone.

    "I've cooperated with law enforcement," Williams said. "I certainly wish them the best in bringing justice to this incredibly egregious act."

    Williams' name has swirled around the courthouse because his trial was sensational news in this small community, and it included testimony of death threats.

    William said he was contacted Saturday night by investigators -- only about three hours after McLelland and his wife, Cynthia, were found dead inside their Forney home.

    He said he met the agents at a nearby restaurant, where he allowed them to swab his hands for gunpowder residue. He also gave them his and his wife's cellphones, which they returned the next day.

    "I know I didn't do anything," he said. "I know where I was."

    Williams said he was at home with his wife or up the street at his in-laws late Friday and Saturday.

    He expressed shock at the crime and sympathy for the victims' families.

    "I want to say my deepest condolences go out to the McLelland family and all the people at the courthouse," he said.

    Asked if he is angry at prosecutors, he said, "No, I'm not. Obviously that was also a part of them doing their jobs."

    Two men accused of threatening officials in unrelated cases in Kaufman County, Texas, both say they are upstanding citizens who would never hurt anyone.

    Investigators say Nick Morale, 56, of Terrell, phoned in a threat to a tip line established for the investigation into the deaths of the Kaufman County district attorney and his wife.

    Morale told NBC 5 that he called the Crime Stoppers tip line with a warning, not a threat. He said he wanted to report a conversation he had with a member of the Aryan Brotherhood of Paris, Texas, but ended up leaving a partial message because his dog knocked his phone from his hand.

    He said the gang member told him that a judge and Kaufman County District Attorney Mike McLelland were the targets of the Jan. 31 shooting that killed Assistant District Attorney Mark Hasse.

    Morale said he chalked up the conversation to boastful ranting until McLelland and his wife were found shot to death in their home.

    'The next victim'
    Morale said he then decided to call Crime Stoppers to tell someone what he had heard. He said he called the tip line and said, "The next victim is judge" before his dog knocked the phone out of his hand. The phone fell two stories and broke, he said.

    Robert Miller, 52, also of Terrell, was arrested Thursday on a charge of making a terroristic threat in connection with a Facebook posting and an email. Investigators said the posting made a threat to the safety of an assistant district attorney.

    Miller said he sent what he called an op-ed about the Kaufman County courthouse and members of the district attorney's office to news media, including NBC 5. In an interview, he denied that the post was a threat of any kind.

    The Facebook post contains harsh words for courthouse employees and warns that a specific assistant district attorney could be the next prosecutor targeted.

    Miller said he only referred to the prosecutor by name because the person was listed third on the Kaufman County District Attorney's Office's website, beneath the names of McLelland and Hasse.

    In the post, Miller suggested that the assistant district attorney seek other employment, perhaps in another state.

    He said the post was his opinion and that interactions at the courthouse prompted him to write the post. It was only intended to be an expression of his First Amendment rights, he said.

    Neither Miller nor Morale are suspects in the McLellands' deaths or are connected to them in any way, say authorities investigating the case.

    Both say that the current climate of fear and a zero-tolerance stance for anything that can be construed as a threat against the courthouse is what landed them behind bars.

    Miller and Morale are each being held on a single count of making a terroristic threat, which can carry state and federal penalties. Bond for each was set at $1 million.

    Stripping fugitives back behind bars, police say

    A capital murder suspect and a convicted drug offender who escaped from a Hopkins County jail have been captured, the county sheriff's office said Thursday.

    Brian Allen Tucker and John Marlin King escaped from the jail Tuesday morning by slipping through a hole in a fence. They were only in T-shirts and boxers after leaving their jail clothes near railroad tracks close to the jail.

    Tucker and King were apprehended in Cooper, according to Commerce police.

    No one was injured.

    The two were back inside the Hopkins County jail as of 6 p.m.

    Investigators also have possession of a sport utility vehicle that Tucker and King are believed to have stolen Wednesday.

    King was seen at the home of an acquaintance in northwest Hopkins County on Wednesday afternoon.

    Hopkins County Sheriff's Office Sgt. Brad Cummings said King had visited the woman's home on Farm-to-Market Road 3134 and left in a black SUV with an unidentified passenger.

    District attorney, wife shot to death in Texas county where assistant DA was killed, police say

    A district attorney and his wife were found shot dead in their Texas home on Saturday, a chilling crime that has become a murder mystery. NBC's Gabe Gutierrez reports.

    Kaufman County District Attorney Mike McLelland and his wife Cynthia were found shot to death inside their Forney home Saturday, nearly two months to the day after his top assistant was gunned down on his way to work earlier this year.

    Kaufman County Sheriff's Department investigators confirmed the deaths to NBC 5 Saturday evening, but officials have had little else to say about the investigation since. Sources close to the investigation told NBC 5 Saturday evening that McLelland and his wife were found at about 4 p.m. that day by a concerned relative or friend who had gone to the house after being unable to reach the couple. Other sources told NBC 5 that the McLelland's front door had been forced open and that gunshots had been fired and that an assault rifle was used in the murders.

    On Sunday afternoon, Kaufman County Sheriff David Byrnes spoke with the media, but offered little on the investigation thus far and wouldn't confirm details released by sources. Byrnes also wouldn't speculate on whether the murders are connected to the Jan. 31 slaying of Assistant District Attorney Mark Hasse saying, "there is nothing to indicate that, for sure."

    While there remains no immediate, confirmed link between Saturday's murders and Hasse's murder, the similarities between the cases prompted county officials to conduct welfare checks on all employees in the district attorney's office Saturday. All were OK, though one former Kaufman County prosecutor was "in hiding" Saturday evening and said others were as well.

    Meanwhile, as a connection between the Hasse and McLelland murders is explored, investigators continue to search for possible connections between Hasse's murder, the slaying of Colorado prison official Tom Clements and the shooting of Montague County Sheriff's Deputy James Boyd that sparked a wild car chase that ended with the fatal shooting of Evan Ebel last week in Wise County.

    Byrnes also refused to comment on whether security measures have been put in place for the staff of the district attorney's office other than to say they are taking precautions. Byrnes did say that there would be an increased and visible security presence at the Kaufman County Courthouse on Monday.

    "It's unnerving to the law enforcement community and the community at large.  That's why we're striving to assure the community that we are still providing public safety and will be able to do that," Byrnes said, about the McLelland murders.


    A tip line has been set up for the investigation and anyone with information to share with investigators is asked to call 1-877-847-7522.

    McLelland Vowed to Catch Hasse's Killer

    While police officers are frequently the target of violence while trying to apprehend criminals, attacks on prosecutors are extremely rare, though not unheard of.  McLelland said as much in January when speaking about his slain friend when he said Hasse was aware of the dangers associated with being a prosecutor.

    At the time, he described Hasse as a really, really good man that was an excellent friend and a spectacular prosecutor who wouldn't be easily replaced. He also vowed to catch Hasse's killers saying, "I hope that the people that did this are watching. Because we're very confident that we're going to find you, pull you out of whatever hole you're in, bring you back and let the people of Kaufman County prosecute you to the fullest extent of the law."

    FBI agents and Texas Rangers, who were still investigating the unsolved slaying of Hasse, are now leading the investigation into Saturday's murders, according to a federal law enforcement source.

    McLelland and his wife, Cynthia Woodward McLelland, have five children including two daughters and three sons.  One of the sons is a Dallas police officer.

    Full-face transplant recipient marries woman he met in burn support group

    Dallas Wiens, of Fort Worth, was severely injured in a bizarre construction accident in 2008 when he came in contact with a high-voltage power line.

    Jamie Nash, of Garland, nearly died in a car crash in Ennis in 2010. Her car erupted in flames, and she was trapped. She was severely burned on her hands, back and legs.

    The couple became engaged last fall.


    Wiens and Nash exchanged vows Saturday morning at the Fort Worth church where Wiens was working when he was injured.

    The couple celebrated with a reception in downtown Fort Worth. They invited their doctors and nurses.

    Relationship built on hope
    The couple met in a support group at Parkland Hospital, where both were being treated.

    "I was drawn to him. I just had to meet him," Nash said in November. "I just looked at him from across the room, and there was something about him."

    Wiens said he wasn't interested -- at first.

    "I had sworn off love and relationships," he said. "I had no desire to be in one whatsoever."

    Then, on Christmas Eve, they talked all night and set up a date.

    "We went to dinner and a movie, and that's all she wrote," he said.

    The two said they have been together every day since.

    "I told him it's got to be love, because I'm not sick of you," Nash joked. "I know I've never felt more real than this."

    The couple plans to put their pasts behind them.

    "There's no reason to dwell on the past," he said.

    "It's dead and gone," she added. "It burned in the fire."

    They said they make the perfect couple and help balance each other.

    Her hands, for example, were severely injured in her accident. His are fine.

    She can see. He lost his eyesight in the accident.

    "It's a story of hope, a story of true survivors," Nash said. "I mean, if we can do it, I guarantee you, anybody out there -- we all have a story. We're all going through something. And I want to give everybody hope."

    Former cop kills pleading ex-wife, then self on same day as divorce is finalized

    Police in Texas say a man shot and killed his ex-wife and himself on the same day their divorce was finalized.

    On Wednesday, DeSoto police said 40-year-old Andre Murphy, a former police officer with the Cedar Hill Independent School District, arrived at his ex-wife Catina's home Tuesday and kicked in the front door as she pleaded with 911 officers to send help fast.

    Police said the man then ran upstairs and shot the 37-year-old woman several times before apparently turning the gun on himself.

    When officers arrived they found the bodies of the couple inside the home on the 700 block of Timber Trail.  While police are calling the incident a murder-suicide, it'll be up to the Dallas County medical examiner to officially declare Andre Murphy's death a suicide.

    As the investigation unfolded, police learned that the couple's divorce had been finalized that day and the man went to the home a short time afterward.

    Police said the couple have a 7-year-old daughter who was not at home at the time of the shootings. Jermaine Pearson, a cousin of Andre Murphy, said the couple's daughter is now staying with other family members.
     
    “She's going to be fine," Pearson said. "She has a very great support group. Not only her grandmother, her family in Lancaster, it's a huge family, and we all love the child as we love the parents."
     
    Andre Murphy was a former police officer for the Cedar Hill Independent School District. He had worked as a police officer for the district for four years before being laid off in 2012 during a reorganization of the department, the district said.

    DeSoto police initially said they had not been called to that address for any domestic violence-related calls, but said Wednesday that they were called once in September after Catina Murphy claimed her husband pushed her.  Andre Murphy was issued a ticket that was later dismissed.   The divorce decree indicated that Catina got a temporary restraining order against her husband in Oct., 2012.
