    Boy, 10, sentenced to juvenile detention for rape, murder plot

    SEATTLE -- A 10-year-old Washington state boy was sentenced on Wednesday to up to 5 1/2 years in a juvenile detention facility for his role in a foiled plot to rape and kill a girl at his school and harm other children.

    The boy was charged with conspiracy to commit first-degree murder, juvenile firearm possession and witness tampering in connection with a plot in February at an elementary school in Colville, in the state's northeast.

    Prosecutors said he pleaded guilty last month to all charges.

    Stevens County Superior Court Judge Allen Nielson sentenced the fifth-grader to a minimum of just over three years in juvenile detention and a maximum of nearly 5 1/2 years, Stevens County prosecutor Tim Rasmussen said.

    An 11-year-old boy accused of joining in the plot is charged with conspiracy to commit first-degree murder, possession of a dangerous weapon in the form of a knife at school and tampering with a witness, Rasmussen added.

    The 11-year-old suspect faces a court hearing later this month.

    The 10-year-old boy will serve his sentence at the Echo Glen children's juvenile center in Snoqualmie, Wash., 45 miles east of Seattle. As of Thursday he had already spent nearly 100 days in a local juvenile detention facility, Rasmussen said.

    The boy told investigators he and his friend had planned to kill a former fifth-grade girlfriend because she was "rude" and "always made fun" of him and friends, according to court documents.

    They plotted to entice the girl away from their elementary school, the court papers stated.

    The 10-year-old had taken a Remington Model 1911 pistol that originally belonged to his grandfather from his older brother's room, according to court records.

    The boys had also packed ammunition and a knife, but they were stopped on Feb. 7 shortly after they boarded a school bus, Rasmussen said.

    A fourth-grade student spotted the knife and reported it to a teacher's aide, Rasmussen said. The names of six other targeted classmates were on a list the boys had, Rasmussen said.

    A former "teacher of the year" won't serve any prison time after admitting she had a sexual relationship with a 15-year-old student.

    A state Superior Court judge in Newark, New Jersey, sentenced 33-year-old Erica DePalo to lifetime parole supervision.

    She also will have to forfeit her teaching certificate and register as a sex offender.

    A tearful DePalo made a brief statement in court Monday expressing regret for her actions, and saying she was trying to rebuild her life.

    She pleaded guilty in February to child endangerment.

    Prosecutors said the Montclair resident had a brief sexual relationship with a student in her honors English class at West Orange High School.

    She initially was charged with aggravated sexual assault, sexual assault and child endangerment and could have faced up to 10 years in prison if convicted.

    Her attorney, Anthony Alfano, said DePalo suffers from bipolar disorder and was on bad medication that can cause errors in judgment.

    Cops hunt four men over repeated gang-rape of Pa. student

    Police in Philadelphia are on the hunt for four men who allegedly kidnapped and repeatedly raped a La Salle University student on Easter Sunday.

    The 20-year-old woman told police she was walking off-campus on the 4800 block of 10th Street around 10 p.m. Suddenly, she says, a black van pulled up beside her and four men jumped out. They allegedly grabbed her and forced her inside the vehicle before driving off.

    Police have not yet revealed where the men took the woman. Once they arrived, however, the woman says they repeatedly raped her before dropping her off at an unknown location and fleeing the scene.

    Despite the police investigation, the university did not notify students at the school since the alleged kidnapping happened a mile away from campus. University spokesman Jon Caroulis says, however, that officials met with the student and her family and "offered support."

    "This isn't something that anyone wants to hear about," said Karla Fernandez, a sophomore at the school. "It could've been anyone."

    Police say the suspects are four men between the ages of 20 and 25. The woman also told investigators one of the men had the tattoo "MM" on his face.

    Those with information on the case are asked to contact Philadelphia Police.

    FBI aiding in 5-state search for missing Brown University student

    Brown University student Sunil Tripathi has been missing for more than a week.

    A student from Brown University in Providence, Rhode Island has been missing for more than a week and the Federal Bureau of Investigation is helping in a five-state search, according to the Providence Journal.

    Sunil Tripathi, 22, of Pennsylvania, was last seen on Friday, March 15 on the campus of the Ivy League university, according to the Journal, and the search has expanded to Connecticut, Boston, New York and Philadelphia.

    His family said Sunil’s wallet, ID cards, credit cards and cell phone were found in his room.

    “Our concerns are first and foremost with Sunil and his family,” Margaret Klawunn, vice president for student life and campus services at Brown, said in a statement posted on the university’s Web site.

    “We are hopeful that by encouraging the Brown community to help spread the word that Sunil will be located.”

    Tripathi grew up in Bryn Mawr, Pa., and has been living in Providence since 2008, according to Brown University, where he is a philosophy major and a talented saxophonist.

    Cops: High schooler assaults three during drunken rage; nurse's hip broken

    A Pennsylvania high school senior faces assault charges after he allegedly broke a school nurse’s hip while in a drunken rage.

    Since Wednesday was an exam day, seniors were allowed to arrive late at Pennsville Memorial High School, Salem County.

    Pennsville Township Police told NBC10’s Chris Cato that the 17-year-old and his friend Manpreet Singh, 18, used the opportunity to get drunk.

    The 17-year-old, who wasn’t identified because he is a minor, began to act belligerent in class.

    "They took him from the classroom and took him to the principal's office," said police Lt. A.J. Cummings.

    Sources told Cato that when the boy was confronted with a Breathalyzer test that he went nuts and shoved the principal. He then allegedly burst out the office door, knocking down school nurse Marilyn English.

    English, 68, suffered a broken hip and remained in South Jersey Healthcare Elmer Hospital Friday night.

    "I'm doing as well as can be expected for the type of injury it is," English said by phone.

    She told Cato that the boy never stopped. Police sources said he kept going right out of the building. Police said they later picked him up around 11:20 a.m. but not before he kicked an officer.

    The 17-year-old faces three assault charges, disorderly conduct and alcohol charges while Singh, who police say supplied the alcohol, faces an alcohol charge.

    The Pennsville School District had no comment on what discipline both teens could face.

    Neither teens' parents wanted to talk to NBC10. The minor’s mother slammed the door on Cato and Singh’s mother had no comment.

    As for the school nurse hurt during the teen’s alleged rage, English told Cato that she hoped the action of a couple students didn’t reflect on the majority of students saying this was an "isolated" and "abnormal" incident.

    Villanova University student Tyler Jones is facing felony charges after police say he secretly recorded three women and uploaded the videos to a pornography website.

    PHILADELPHIA -- A Villanova University student is facing felony charges after police say he secretly recorded three women and uploaded the videos to a pornography website.

    A friend of one of the victims alerted her after seeing the video online. Police say it shows the woman undressing, and her bare breasts are exposed.

    Tyler Jones admitted to police that he secretly hid his iPhone in the bathroom to record the woman and then uploaded it to a porn site from his dorm room at Villanova.

    While police were investigating, they say two other victims were discovered. One of the victims was 17 years old at the time of the recording.

    Jones is charged with dissemination and possession of child pornography, invasion of privacy, obscene materials on the Internet and criminal use of a communication facility.

    He posted bail after waiving his right to a preliminary hearing yesterday.

    Jones has taken a leave of absence this semester from Villanova.

    Former teacher indicted over claims she had sex with four of her students

    A former high school teacher in Texas has been indicted over accusations she had sex with four of her students.

    According to a September 2011 search warrant, parents of a graduate and former student of Tonya Flink, 39, reported to police that their son was living with her at her apartment.

    They told police that they believed the relationship began while their son was a senior at Haltom High School in Haltom City, which is near Fort Worth.

    In the same month, investigators learned of other relationships, according to the warrant.

    According to the report from police, the former student in question admitted that the relationship began when he would stay after school and Flink would help him with his grades. Flirting led to Flink "pushing herself onto him," according to police.

    Flink would go on to tell the student that "she loved him," that she "liked young Hispanic kids like him" and that their eventual sexual relationship involved "everything you could imagine," police said in the warrant.

    Police also reported that they found evidence that Flink made at least 850 phone calls to one of the students in question over a period of a few months.

    Investigators also reported that she bought clothes for some of them and that she went to the home of one of her students and secretly knocked on his back door so she could meet with him.

    According to police, Flink resigned from her position as a computer technology teacher at Haltom High in August 2011, shortly before police began their initial investigation.

    Flink went on to teach for a time at Carter Riverside High School in the Fort Worth Independent School District, but resigned from her position long before the district ever learned of her alleged involvement with students, a district representative said.

    She was indicted by a Tarrant County grand jury.

    Flink is free after posting $10,000 bond. She is due in a Tarrant County courtroom next week, according to her attorney.

    Maryland first-grader suspended for pointing fingers at friends, saying 'pow'

    The boy, a student at Roscoe Nix Elementary School in Silver Spring, was suspended for one day. The incident happened a week after the Sandy Hook Elementary shooting in Newtown, Conn.

    The family's attorney says the 6-year-old was playing with friends, not making threats.


    "Evidently, he was pointing his finger at someone and saying, 'Pow,'" said Robin Ficker, an attorney for the family.

    The boy's parents were scheduled to meet with school officials Wednesday.

    The school system will not comment on individual disciplinary matters. But they did issue a statement detailing their typical procedure with younger students.

    "Generally, in an incident involving the behavior of our younger students, we will make sure that the student and his family are well-informed of any behavior that needs to change and understand the consequences if the behavior does not change," said Montgomery County Public Schools spokesman Dana Tofig in a statement.

    Maryland high school student committed after 'credible threat' found

    A Maryland high school student has been committed for psychiatric evaluation after his peers raised concerns about him, prompting investigators to search his locker and hospitalize him after finding a "credible threat," an official said.

    Investigators and school security found graphs, charts, diagrams, and lists in the Laurel High School student's locker on Monday that suggested he may be planning to harm other people, said Pete Piringer, spokesman for the city of Laurel.

    "There were no weapons involved, although investigators believe the student did have access to weapons," Piringer said. "Along with that potential access and the items they found in his locker, his behavior, and the fact that the classmates were uncomfortable, all led to it being a fairly credible threat."

    The student -- whose identity and age were kept private -- was taken to a local hospital for an emergency committal, where he still remains. He was never charged or arrested, Piringer said.

    "The student was not at the school at the time [of his hospitalization]. His family was cooperating," Piringer said.  "He's getting some psychiatric evaluation."

    The school never faced any direct threats, and Laurel High's school day proceeded as normal, he said. Piringer credits the student's concerned classmates -- who brought their worries to a teacher last week -- with potentially averting a threat.

    "The teacher concurred with their assessment and advised security, security then called us on Monday," Piringer said. "A large part of the credit needs to be given to the students in the first place for coming forward and notifying the authorities. Fortunately, the student is now, with the cooperation of his parents of course, at the hospital getting some medical attention."

    Laurel, Md., is about 20 miles southwest of Baltimore. Laurel High School Principal Dwayne Jones wrote on the school's website after Monday's incident, "At no time were any students threatened, harmed or placed in danger. It is my belief that the cooperation between Laurel High School and the Laurel City Police is a prime example of how schools and local law enforcement can work together to insure the well-being of students."

    Sixth-grader in Utah brings gun to school to avoid Connecticut-style attack, district spokesman says

    A Utah boy claimed he brought a gun to school for protection after the Connecticut massacre, but his classmates say he threatened them. KSL's  Andrew Wittenberg reports.

    A sixth-grade student in Utah is in police custody after he was accused of bringing a gun to school Monday, reportedly claiming he wanted to protect himself in the event of a school shooting.

    The 11-year-old is a student at West Kearns Elementary School, in Kearns, Utah, a suburb of Salt Lake City, and brought the .22-caliber handgun to school in his backpack, Granite School District spokesman Ben Horsley told NBC News. 

    The boy, whose name has not been released because he is a juvenile, indicated that he wanted to defend himself if there was an incident similar to what happened in Newtown, Conn. Last Friday, 20 students, ages 6 and 7, and six school staff members at Sandy Hook Elementary School were killed when a gunman burst into the school and opened fire before fatally shooting himself. The gunman had killed his mother earlier that day.


    “Obviously that’s not the correct approach,” Horlsey said of the 11-year-old's action. “We teach these kids on a regular basis that they have a responsibility to keep their school safe.”

    Some witnesses have said they saw the boy brandish the gun on the playground and point it at another child's head. Other reports said the boy verbally threatened another student with the gun. Police have not yet been able to confirm these accounts, Horsley said, noting that it's sometimes difficult to sort out the facts when all the witnesses are children. 

    Horsley said two of the boy's classmates complained to a teacher at about 3 p.m. MST, about 45 minutes before the end of the school day. The teacher immediately secured the boy and took him to the principal's office. It was the principal who retrieved the boy's backpack from his classroom and contacted Granite School District police. Police were able to find the weapon and secured the situation in three to five minutes, Horsley said.

    The boy also had ammunition, although the gun was not loaded and it was not immediately clear whether the bullets were the appropriate ammunition for the gun, Horsley said. 

    The student was charged with one count of possession of a dangerous weapon on school property and three charges of aggravated assault, which is a third-degree felony, involving the alleged waving of the weapon at other students in a threatening manner.

    Horsley said the student obtained the gun at home from an extended family member who moved out of the family’s house last week.

    Previous reports indicated that the student claimed his parents told him to bring the gun to school for protection. Horsley said those claims are not accurate and said the parents have been "very cooperative.”

    Horsley said the student is likely to face severe criminal penalties, adding that he was suspended from the school and will not be let back into the traditional school setting ever. “We have a variety of alternative placements for kids who violate school safety policies,” Horsley said. 

    No one was injured in the incident, and the school was not placed on lockdown, school administrators said, because the situation was resolved immediately, and, more importantly, they feared startling students.

    Asif Kahn, 21, who lives in Chicago suburb Villa Park, bought a ticket for the Illinois Lottery's Gold Bullion game three days before Thanksgiving at a Shell station in Hillside, Ill.

    "I just took the ticket and went to my car, and I made a U-turn and went straight back home," Kahn said. "I walked into my house and I said, 'Mom, you're not gonna believe what happened."

    He said he plans on using the majority of the money to pay off thousands of dollars in student loans, and then to eventually pay for medical school.

    "I can actually imagine my life ... a better future," Kahn said. "My long-term goal is to be a cardiologist, relating to the heart. Science has always been a very broad field for me and I love it," Kahn said at a Wednesday news conference.

    He said his one splurge will be a new Mercedes. He also plans to transfer to University of Illinois at Chicago, now that he can afford the tuition.

    More than 20,000 students in a suburb of Chicago won't have class or after-school activities beginning Tuesday after teachers voted to strike.

    Teachers in Community Unit School District 300 voted Monday afternoon to strike after 11 months of negotiations failed to end with a new contract.

    The last contract expired July 1, and class sizes and salaries remain the sticking points.

    "It's pretty daunting. It's something that we kept talking about but I never really thought would happen," said fourth-grade teacher Ann Hottoby.

    "We need a better learning environment for our students. Three years ago -- over three years ago -- I had 23 students in my room. The next year I had 37," she added.

    Chicago teachers strike affects 350,000 students

    District spokesman Joe Stevens said in a voicemail to district parents and staff members that members from the Board of Education, the Local Education Assocation of District 300 -- the Carpentersville area district's teachers union -- and a federal mediator met for a final time Monday.

    Chicago teachers agree to end strike

    "After the Board agreed to LEAD's latest proposal to further reduce class sizes at all grade levels and create class-size caps for middle and high school classes, the LEAD team increased its salary proposal by returning to an earlier salary request. At this point, the Board has met LEAD's expectations regarding class sizes, but we have not reached agreement on salaries," he said in the message.
